A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK
APPROVING ARTWORK AND AUTHORIZING A CREDIT TOWARD FUTURE
ARTWORK FOR SONOMA MOUNTAIN VILLAGE — FILE NO. PL2006 -053.
WHEREAS, Sonoma Mountain Village, LLC filed a building permit application on
behalf of Comcast for tenant improvements and new construction that totaled $1,300,000
( "Project ");
WHEREAS, pursuant to the City's Public Art Ordinance set forth in Rohnert Park
Municipal Code Chapter 17.18, since the construction costs for the Project totaled more than
$500,000, the applicant was required to install public art at a cost of at least one percent of the
total Project valuation or pay an in -lieu fee in an amount that is equal to one percent of the total
Project valuation;
WHEREAS, one percent of the Project's total valuation equals $13,000;
WHEREAS, the applicant has installed one wall mural and three metal statues
( "Artwork ") at Sonoma Mountain Village, located at 1400 Valley House Drive (APN 046 -051-
045);
WHEREAS, the Artwork's total value is $36,841;
WHEREAS, the applicant has requested: (1) approval of the Artwork in accordance with
Chapter 17.18, and (2) authorization of a $23,841 credit toward future public art requirements;
WHEREAS, on December 8, 2008, the Cultural Arts Commission reviewed and
recommended approval of the applicant's request; and
WHEREAS, on January 22, 2009, the Planning Commission reviewed and
recommended approval of the applicant's request.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rohnert
Park that it does hereby approve applicant's request as follows:
A. The Artwork satisfies the criteria outlined in Chapter 17.18 of the City's Municipal Code.
Specifically, the applicant has installed one wall mural (measuring 20 feet x 24 feet) that
is constructed from recycled plywood. The mural is located on the southwest corner of
building 4. In addition, the applicant has installed three aluminum statues (measuring
approximately 4 feet x 3 feet) of internationally renowned European poster images
(Marmo Rhaus, Vermouth Blanc, and Pates Baroni). The statues are located in the
northeast planter area adjacent to the cafe.
B. The value of the Artwork exceeds the one percent requirement and therefore a credit in
the amount of $23,841 toward future public art requirements is approved. Specifically,
the total value of the Artwork is $36,841, which exceeds the required $13,000 (one
percent of Project valuation) by $23,841.
BE IT FURTHER RESOLVED that the City Council finds that inclusion of public art
is categorically exempt from the California Environmental Quality Act, pursuant to California
Code of Regulations, Title 14, Chapter 3, Section 15301 (Class 1 — Existing Facilities).
