2009/04/14 City Council Resolution 2009-34RESOLUTION NO. 2009 -34 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK APPROVING A ONE -YEAR EXTENSION OF TEMPORARY DEBRIS BOX FRANCHISE AGREEMENTS WITH ROHNERT PARK DISPOSAL, INC. AND INDUSTRIAL CARTING WHEREAS, on November 13, 2001, the City Council adopted Resolution No. 2001 -234 selecting Empire Waste Management, Industrial Carting and Rohnert Park Disposal, Inc. as the companies to be licensed by agreements to provide Temporary Debris Box Services in the City of Rohnert Park; and WHEREAS, the term of the franchise agreements commenced upon the City's award of the contracts and continued in full force until June 30, 2008, with the possibility of three one - year extensions to June 30, 2011; and WHEREAS, Empire Waste Management ceased doing business in Sonoma County in January 2008; and WHEREAS, there are only two Temporary Debris Box Service providers licensed by agreement with the City of Rohnert Park; and WHEREAS, Resolution No. 2008 -45 was adopted on March 25, 2008, for a one year extension of the temporary debris box franchise agreements with Rohnert Park Disposal, Inc. and Industrial Carting; and WHEREAS, staff desires to extend the franchise agreements with Industrial Carting and Rohnert Park Disposal, Inc., respectively, for one year; and WHEREAS, the extension of the franchise agreements will provide staff with adequate time to select a qualified temporary debris box hauler(s); and WHEREAS, a consultant will assist staff in developing an RFP, managing the bid process, and generating an agreement that incorporates key terms and conditions to attain City diversion goals, maintain reasonable rates and provide for adequate performance, enforcement and reporting; and WHEREAS, staff recommends the City Council approve a one -year extension of the Temporary Debris Box franchise agreements with Industrial Carting and Rohnert Park Disposal, Inc.; and WHEREAS, staff further recommends that City Council authorize and direct the Interim City Manager to execute and deliver on behalf of the City of Rohnert Park a Notice of Intent to Extend the Temporary Debris Box franchise agreements with Industrial Carting and Rohnert Park Disposal, Inc., respectively. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rohnert Park that it does hereby authorize and approve a one -year extension of the Temporary Debris Box franchise agreements with Industrial Carting and Rohnert Park Disposal, Inc. BE IT FURTHER RESOLVED that the Interim City Manager is hereby authorized and directed to execute certain Letter of Intent concerning the proposed one -year extension of Temporary Debris Box agreements with franchisees. City Cleric Michelle Marchetta Kenyon In accordance with the Agreement, Item 3, Term of Franchise, and City Attorney Item 20, Amendment, the City of Rohnert Park does hereby extend the Term of Franchise with Industrial Carting for one year. The amended James J. Atencio term shall extend from July 1, 2009 to June 30, 2010. All remaining Benjamin D.
