The City Council of the City of Rohnert Park met this date for a Special Meeting/Work Session, to
commence at 5:00 p.m., followed by the Regular Concurrent Meetings of the Rohnert Park City Council,
Community Development Commission of the City of Rohnert Park, and Rohnert Park Financing
Authority, to commence at 6:00 p.m. at the Rohnert Park City Hall, 6750 Commerce Boulevard, Rohnert
Park, with Mayor Mackenzie presiding.
SPECIAL MEETING/WORK SESSION
CALL TO ORDER
Mayor Mackenzie called the Special Meeting/Work Session to order at 5:05 p.m.

REFUSE RATES
Director of Administrative Services Lipitz introduced William Schoen of R3 Consulting, who
reviewed a rate model calculator via Excel spreadsheets and responded to Council questions.
Accounting Manager Orme reviewed the "Refuse Franchise,— 2008/2009 Rate Model Overview"
PowerPoint presentation and responded to Council questions. Council Member Smith reported on
the recommendation of the Waste and Recycling Subcommittee. Mayor Mackenzie read aloud
Council Member Breeze's written comments.

Council CONCURRED to direct staff to further evaluate commercial /non - residential rate
increases between 11.8% and 20% and residential rates increases by either flat percentages or with
smaller increases for the 20 -and 32- gallon cans and larger increases for 68- and 95- gallon cans.

CALL TO ORDER
The Regular Meeting of the City Council of the City of Rohnert Park was called to order by Mayor
Mackenzie at 5:55 p.m.

CLOSED SESSION
Mayor Mackenzie adjourned the City Council to Closed Session at 5:55 p.m. to discuss the following
litigation matter:
CONFERENCE WITH LEGAL COUNSEL — ANTICIPATED LITIGATION
Initiation of litigation pursuant to subdivision (c) of Section 54956.9: one potential case.
RECONVENE REGULAR SESSION
Mayor Mackenzie reconvened the Regular Session at 6:30 p.m. All members were present, with the
exception of Council Member Breeze.
PLEDGE OF ALLEGIANCE
Mayor Mackenzie led the Pledge of Allegiance.
1. MAYOR'S REPORT ON CLOSED SESSION (Government Code § 54957.1)
Mayor Mackenzie announced that the Council had met in closed session regarding the litigation
matter as described on the agenda and that no reportable action had been taken.
At this time, Mayor Mackenzie made the following announcements:
a. Those who attend City Council meetings are expected to observe decorum during Council
meetings.

Mayor Mackenzie recognized Deputy City Engineer Barnes, who provided an update regarding the
status of the Various Streets 2008 project and announced that a map of the affected streets will be
available on the City's website at www.rptraffic.com.
2. PRESENTATIONS
a. Presentation by Peter Verb iscar- Brown, Executive Director of Global Partners for
Development, Rohnert Park: Mr. Verbiscar -Brown provided information regarding Global
Partner's humanitarian projects in East Africa via PowerPoint presentation.
b. Presentation by Dan Hubley, Chairman, Boys & Girls Club of Rohnert Park: Dan Hubley
provided update regarding the status of the Rohnert Park Boys and Girls Club programs and
sites.
PUBLIC COMMENT
a. Jessica Holman, Leadership Advisor, and Megan Cornejo, Entertainment Coordinator, Rancho
Cotate High School, requested a waiver of fees associated with the Rancho Cotate High School
Homecoming parade on October 1 lth.
Council CONCURRED to waive said fees.

5. PARK CLEANING SERVICES
Consideration of Awarding a Contract for Park Cleaning Services
1. City Manager Donley and Assistant City Attorney Winig reviewed the contents of the staff
report and responded to Council questions. Council Member Smith distributed a flyer from Old
Adobe Developmental Services.

MOVED by Council Member Smith seconded by Council Member Vidak - Martinez, to adopt
Resolution No. 2008 -131, Rejecting All Bids for Park Cleaning Services. With Council
Member Smith and Council Member Vidak - Martinez voting in favor, Vice -Mayor Stafford and
Mayor Mackenzie voting against, and Council Member Breeze absent, the motion was
DEFEATED due to a tie vote.

absent, a motion to continue the matter to a future Council meeting for hearing by the full

6. SEWER SERVICE CHARGES INITIATIVE
Consideration of Adopting Resolution Approving Ballot Argument against the Initiative to Reduce
City of Rohnert Park's Current Sewer Service Charges to Charges in Effect on January 1, 2006, and
Adopting Resolution Opposing the Initiative to Reduce City of Rohnert Park's Current Sewer
Services Charges
1. City Manager Donley and Assistant City Attorney Winig reviewed the contents of the staff
report.
2. Public Comments:
a. Susan Adams, Chair of the committee opposing Measure L, spoke in opposition to the
measure.
3. Resolutions for Adoption:

Administrative Services Director Lipitz introduced Scott Miller of Odenberg, Ullakko, Muranishi
(OUM) and Company, LLP, CPA, who reviewed the 2006 -07 Comprehensive Annual Financial
Reports. Administrative Services Director Lipitz responded to Council questions.
MOVED by Vice -Mayor Stafford, seconded by Council Member Vidak- Martinez, and CARRIED
4 -0 -1, with Council Member Breeze absent, the motion to concurrently accept the 2006 -07
Comprehensive Annual Financial Reports was APPROVED.
8. ENGINEERING FEES
Consideration of Updating the Engineering Fee Schedule to Include Full Cost Recovery when
Using Outside Consultant Services for Some Fees, Include the New Plumbing Permit Fee, and
Make a Clerical Correction to the Public Improvement Plan Check Fee and the Street
Vacation /Abandonment Request Fee
1. City Engineer Jenkins reviewed the contents of the staff report and responded to Council
questions.
2. PUBLIC HEARING: Mayor Mackenzie opened the Public Hearing at 7:52 p.m. There being
no members of the public interested in commenting on said matter, Mayor Mackenzie closed
the Public Hearing at 7:52 p.m.
3. Resolution for Adoption:
2008 -134 Approving the Updated Engineering Fee Schedule
MOVED by Council Member Vidak- Martinez, seconded by Vice -Mayor Stafford and
CARRIED 4 -0 -1 with Council Member Breeze absent, reading was waived and Resolution
No. 2008 -134 was ADOPTED.
9. WATER SERVICE RATES
Consideration of Amending Chapter 13.04 of the Rohnert Park Municipal Code to Increase Water
Service Rates
1. Administrative Services Director Lipitz reviewed the contents of the staff report via "Proposed
Water Rate Increase" PowerPoint presentation.
2. PUBLIC HEARING: Mayor Mackenzie opened the Public Hearing at 8:04 p.m.
a. Robert Grundman spoke in opposition to the proposed increase in water rates.
b. Larry Resnick spoke in opposition to the proposed increase in water rates.

System) To Increase Water Service Rates
MOVED by Vice -Mayor Stafford, seconded by Council Member Vidak- Martinez to waive
further reading and introduce Ordinance No. 801.
A FRIENDLY AMENDMENT was proposed by Vice -Mayor Stafford to replace the word
"wishes" in the second recital of the ordinance with "has determined it is fiscally responsible."
The motion CARRIED 4 -0 -1 with Council Member Breeze absent, reading was waived and
Ordinance No. 801 as amended was INTRODUCED BY ROLL CALL VOTE.
10. SPEED LIMIT ORDINANCE
Consideration of Amending Section 10.20.10 of the Rohnert Park Municipal Code Declaring Prima
Facie Speed Limits on Certain Streets
City Engineer Jenkins reviewed the contents of the staff report. City Engineer Jenkins and
Director of Public Safety Bullard responded to Council questions.

3. Ordinance for Introduction:
Waive Further Reading and Introduce Ordinance by Reading Title:
No. 802 Amending Section 10.20.10 of the Rohnert Park Municipal Code Declaring
Prima Facie Speed Limits on Certain Streets
MOVED by Vice -Mayor Stafford and seconded by Council Member Vidak- Martinez to waive
further reading and introduce Ordinance No. 802. With Vice -Mayor Stafford and Council
Member Vidak - Martinez voting in favor, Council Member Smith and Mayor Mackenzie voting
against, and Council Member Breeze absent, said motion was DEFEATED due to a tie vote.
MOVED by Mayor Mackenzie and seconded by Vice -Mayor Stafford to waive further reading
and introduce Ordinance No. 802 as amended to strike the following streets from Section 1 of
the ordinance: "Country Club Dr from Rohnert Park Exwy. To Southwest Blvd.," "Country
Club Dr from Golf course Dr to Rohnert Park Exway.," and "Rohnert Park Exwy. From Snyder
to Petaluma Hill Road."
An AMENDMENT was proposed by Council Member Smith to also strike from Section 1 of
the ordinance: "Rohnert Park Expressway from Country Club Dr to Snyder." Said amendment,
being accepted by the maker of the motion and rejected by the second of the motion, was
DEFEATED.
The main motion CARRIED 3 -1 -1 with Council Member Smith voting against and Council
Member Breeze absent, reading was waived, and Ordinance No. 802 as amended was
INTRODUCED BY ROLL CALL VOTE.

No. 2008 -135 was ADOPTED.

Mayor Mackenzie called a recess at 9:07 p.m. At the request of Council Member Smith, Mayor

1. Fireworks Ordinance Update: City Manager Donley reviewed the contents of his
memorandum and recommended Council endorse development of a countywide standard
fireworks ordinance.

City Manager Donley's recommendation.
