2008/09/08 City Council MinutesMINUTES OF THE SPECIAL CONCURRENT MEETINGS OF THE CITY OF ROHNERT PARK City Council Community Development Commission Rohnert Park Financing Authority Monday September 8, 2008 The City Council of the City of Rohnert Park met this date for Special Concurrent Meetings of the Rohnert Park City Council, Community Development Commission of the City of Rohnert Park, and Rohnert Park Financing Authority, to commence at 6:00 p.m. at the Rohnert Park City Hall, 6750 Commerce Boulevard, Rohnert Park, with Mayor Mackenzie presiding. CALL TO ORDER The Special Meeting of the City Council of the City of Rohnert Park was called to order by Mayor Mackenzie at 6:00 p.m. ROLL CALL Present: Jake Mackenzie, Mayor Pam Stafford, Vice -Mayor Amie Breeze, Council Member Tim Smith, Council Member Absent: Vicki Vidak- Martinez, Council Member (due to illness) Staff present for all or part of the Regular Meeting: Stephen Donley, City Manager; Daniel Schwarz, Assistant City Manager; Ben Winig, Assistant City Attorney; Ron Bendorff, Director of .Community Development; Sandy Lipitz, Director of Administrative Services; John McArthur, Director of Utilities /General Services; Patrick Barnes, Deputy City Engineer; Cathy Orme, Accounting Manager; Terri Griffin, Deputy City Clerk; and Linda Beltz, Videographer. PLEDGE OF ALLEGIANCE Mayor Mackenzie led the Pledge of Allegiance. Mayor Mackenzie announced his intention to represent the City of Rohnert Park as Chair of the Mayors' and Councilmembers' Association of Sonoma County at tomorrow's Memorial Services in honor of Fairfield City Council Member Matt Garcia. 1. MAYOR'S REPORT ON CLOSED SESSION (Government Code § 54957.1) Mayor Mackenzie announced that the Council had met in closed session regarding the matters listed on the agenda. Regarding the litigation matter Hauff v. Sonoma County Board of Supervisors, Mayor Mackenzie made the following report: "The City Attorney's Office filed a peremptory writ of mandate pursuant to Elections Code section 9295 to strike false and misleading statements contained in the ballot argument in favor of Measure and in the rebuttal to the ballot argument against Measure L. Judge Boyd of the Sonoma County Superior Court set a hearing for last Thursday to address this matter. Prior to the hearing, the signatories to the ballot argument and rebuttal agreed to amend or strike the false statements. Judge Boyd therefore signed an order directing the Registrar of Voters to print the ballot arguments without the false and misleading statements to ensure that the public will have accurate information prior to casting a vote on Measure L." 2. PRESENTATIONS 1. Mayor's Presentation of a Proclamation Recognizing Lauren Xie, California Junior Miss: The Mayor read aloud and presented Ms. Xie with the proclamation and a gift (travel bag). Ms. Xie thanked the City Council and made brief remarks. 3. PUBLIC COMMENTS 1. Patrick Barnes, Deputy City Engineer, provided a status report regarding the 2008 Various Streets project and its effects on Golf Course Drive, Country Club Drive, and M Section. 2. Paul Libeu, Rohnert Park, spoke in favor of subsidized water sub - meters in Mountain Shadows Square and distributed graphs entitled, "Annual Water Consumption Averages and Winter Averages — Rohnert Park Single - Family Residences and Mountain Shadows Square Housing Units." 3. Jane Ginn, Rohnert Park, spoke in opposition to Measure L. 4. Dawna Gallagher, Rohnert Park, spoke in favor of Measure L. 4. CONSENT CALENDAR Vice Mayor Stafford signified removal of the City Council Portion of the Regular Concurrent Meetings Minutes of August 26, 2008, and Resolution No. 2008 -143. 2. Approval of City Bills/Demands for Payment in the amount of $377,646.70. Accepting Cash/Investments Report for Month Ending February, 2008. 4. Resolutions for Adoption: 2008 -141 Approving and Adopting the Plans & Specifications for the City Center Plaza and Drive Improvements Project, City Project No. 2006 -02 and Awarding the Contract to Ghilotti Construction Company 2008 -142 Approving the 2008 -09 Supplemental Law Enforcement Services Fund Expenditure Plan 2008 -144 Approving Job Description and Salary Range for Information Systems Operations Manager and Authorizing Recruitment for the Position 2008 -145 Approving Job Description and Salary Range for Arborist and Authorizing Recruitment for the Position 2008 -146 Rejecting the Claim of Horst Schulz [Traffic Accident Involving Pedestrian] MOVED by Council Member Smith, seconded by Council Member Breeze, and CARRIED 4 -0 -1 with Council Member Vidak- Martinez absent, reading was waived and the Consent Calendar was APPROVED with the exception of the City Council Portion of the Regular Concurrent Meetings Minutes of August 26, 2008, and Resolution No. 2008 -143. Items for Consideration 1. Approval of Minutes for: City Council Portion of Regular Concurrent Meetings — August 26, 2008. Item 6, Park Cleaning Services (p. 3): Vice Mayor Stafford amended the minutes to reflect that Paul Stutrud did not speak under public comments. MOVED by Vice Mayor Stafford, seconded by Council Member Breeze, and CARRIED 4 -0- 1 with Council Member Vidak- Martinez absent, reading was waived and the City Council Portion of the Regular Concurrent Meeting Minutes for August 26, 2008, was APPROVED AS AMENDED. 4. Resolutions for Adoption: 2008 -143 Authorizing the Purchase of Playground Design Services, Equipment, and Installation Vice Mayor Stafford commended the Rotary Club for partnering with the City to fund new playground equipment. MOVED by Council Member Breeze, seconded by Vice Mayor Stafford, and CARRIED 4 -0- 1 with Council Member Vidak - Martinez absent, reading was waived and Resolution No. 2008- 143 was ADOPTED. 5. WORK SESSION REGARDING REFUSE RATES Director of Administrative Services Lipitz introduced Accounting Manager Orme, who reviewed a "Follow up Work Session - Refuse Rates" PowerPoint presentation and responded to Council questions. 2. Paul Stutrud spoke in favor of incentives for recycling and expressed concerns regarding frequency of garbage pick -up. Michael Mac McCaffry, Rohnert Park, expressed concerns regarding the inability of an individual homeowner within a homeowners association to switch to a smaller garbage can. 3. Council CONCURRED to direct staff to pursue the modified percentage method and review administrative fees and to refer the issues raised by the public speakers to the Refuse & Recycling Subcommittee. 6. NORTHWEST SPECIFIC PLAN AREA (SOUTH) Consideration of a Proposed Preliminary Specific Plan for an Approximately 31.4 Acre Site Encompassing the Southeast Portion of the Northwest Specific Plan Area Community Development Director Bendorff reviewed the contents of the staff report via PowerPoint presentation and responded to Council questions. The project applicant, Lloyd Goto, Cypress Equities reviewed current projects by Cypress Equities via PowerPoint presentation. Mr. Goto introduced David Janes, SGBA Architecture and Planning, who reviewed site information and exhibits demonstrating plans and proposed uses for the project via PowerPoint presentation. Mr. Goto and Mr. Janes responded to Council questions. 2. PUBLIC HEARING: Mayor Mackenzie opened the Public Hearing at 8:19 p.m. a. Elisabeth Moss expressed concerns regarding water supply for the project. b. Paul Stutrud, Rohnert Park, expressed concerns regarding water supply, sewer services, and public safety services for the project. c. Dawna Gallager expressed concerns regarding the project's proximity to the casino site, water supply and General Plan consistency. Mayor Mackenzie closed the Public Hearing at 8:20 p.m. 3. Council discussion included the following topics: environmental review of water, sewer, and traffic requirements; transition of the site to the Cotati - Rohnert Park Unified School District; bike and pedestrian circulation; attracting youth to the project; the lack of office /industrial uses; the addition of more park/green area; LEED certification; 'development agreement requirements; and coordination of the project with the adjoining Wilfred/Dowdell Village project. RECESS Mayor Mackenzie called a recess at 8:39 p.m. Mayor Mackenzie reconvened the Special Meeting at 8:48 p.m. All members were present except Council Member Vidak- Martinez. 7. COMMUNICATIONS Council Member Smith called attention to an article in Western Cities regarding green building programs and the accompanying photographs of Peter Bruck, Building Official, and Sonia Espino, Community Development Assistant. He also called attention to the City Manager Donley's invitation to a City Council Candidate Briefing on September 22"d. Vice Mayor Stafford called attention to a response letter she received from Jared Huffman regarding the state budget. Mayor Mackenzie called attention to a newspaper advertisement regarding the Sonoma Mountain Village Art and Wine Festival on September 20th. 9. MATTERS FROMIFOR COUNCIL 1. Calendar of Events 2. Mayor Mackenzie requested that Assistant City Attorney Winig formally extend the Council's congratulations. Council CONCURRED to formally honor the Coast Guard employee who lives in Rohnert Park for her receipt of the Coast Guard Civilian Employee of the Year award. 11. PUBLIC COMMENTS None.
