2008/03/25 City Council MinutesCITY OF ROHNERT PARK CONCURRENT MEETING MINUTES FOR: City Council Community Development Commission Rohnert Park Financing Authority March 25, 2008 Tuesday The Concurrent Meetings of the City of Rohnert Park for the City Council and the Community Development Commission met this date for a Regular Meeting to commence at 6:00 p.m. at the Rohnert Park City Hall, 6750 Commerce Boulevard, Rohnert Park, with Mayor Mackenzie presiding. REGULAR MEETING Call to Order: Mayor Mackenzie called the Regular Meeting to order at 6:00 p.m. Roll Call: Breeze, Smith, Vidak - Martinez, Mackenzie Absent: Stafford (Excused absence) Staff present for all or part of the Regular Session: Assistant City Manager Schwarz, City Attorney Kenyon, Director of Public Safety Bullard, Director of Community Development Bendorff, Management Analyst Tacata, Deputy City Clerk Griffin, and Videographer Beltz. PLEDGE OF ALLEGIANCE: Brandon Boccaleoni, Student, La Fiesta Elementary School, led the Pledge of Allegiance. Mayor Mackenzie PRESENTED Brandon with a card and a pen. MOMENT OF SILENCE: City Council and the audience observed a Moment of Silence in memory of two Rohnert Park citizens who tragically lost their lives during the past week. 1. SONOMA STATE UNIVERSITY (SSU) STUDENT REPORT: Mayor Mackenzie stated that Sonoma State University Associated Students, Inc.'s representative, Heather Hanson, University Affairs Coordinator, was not present due to Spring Break. UNSCHEDULED PUBLIC APPEARANCES /COMMENTS: Mike Riley, Wal -Mart Store Manager, and Wendell Day, Wal -Mart Store Co- Manager, DISTRIBUTED packets of Post -It Recycled Notes and PRESENTED Council with a Wal- Mart and Post -It Brand Environmental Challenge award check in the amount of $1,000. They INVITED Council to attend the Earth Day event at Wal -Mart, beginning at 10 a.m. on April 191. Mayor Mackenzie DIRECTED STAFF to report back to Council with recommendations for the expenditure of said funds. 2. John Hudson shared comments regarding the sewer rate initiative. Upon MOTION by Council Member Smith, seconded by Council Member Breeze, and APPROVED 4 -0 -1 with Vice Mayor Stafford absent, Agenda Item No. 9 was moved forward in the meeting. 9. CITY MANAGER'S /CITY ATTORNEY'S REPORTS: [Taken out of agenda order by Council motion] 1. Sewer Rate Initiative: Assistant City Manager Schwarz responded to matters raised by Mr. Hudson, and he DISTRIBUTED AND REVIEWED a comparison chart entitled, "Subregional User Agency Sewer Rates." 2. UNSCHEDULED PUBLIC APPEARANCES /COMMENTS: [Continued] 1. Crystal Alexander requested procedural information as to the planting of a tree on Camino Colegio in memory of her daughter's boyfriend, Kevin Carr- Grillo. Staff directed Ms. Alexander to contact Recreation Services Manager Miller regarding her request. 3. CONSENT CALENDAR: Council Member Vidak - Martinez signified removal of the City Council Portion of Special Concurrent Meetings — March 11, 2008, and the City Council Portion of Regular Concurrent Meetings — March 11, 2008. Assistant City Manager Schwarz explained a revision in Resolution 2008 -46. 2. Approval of City Bills /Demands for Payment in the amount of $3,197, 293.64 3. Resolutions for Adoption: 2008 -40 Rejecting the Claim of Joseph J. Van Genderen [Alleged Automobile Damage from Construction Site] 2008 -41 . Rejecting the Insufficient Claim of Craig McClain and Karen McClain (Alleged Police Actions) 2008 -42 Opposing Closure of State Parks 2008 -43 Opposing Proposition 98 on the June 2008 Ballot 2008 -44 Supporting Proposition 99 on the June 2008 Ballot 2008 -45 Approving a One -Year Extension of Temporary Debris Box Franchise Agreements with Rohnert Park Disposal, Inc. and Industrial Carting City of Rohnert Park CONCURRENT MEETINGS Minutes (3 of 7) March 25, 2008 for City Counci!/Community Development CommissionlRohnert Park Financing Authority 2008 -46 Authorizing the Purchase of Playground Design Services, Equipment, and Installation 2008 -47 Authorizing a Request to the Metropolitan Transportation Commission for the Allocation of Fiscal Year 2008 -2009 Transportation Development Act Article 3 Pedestrian/Bicycle Project Funding 2008 -48 Authorizing the Submittal of Applications for All California Integrated Waste Management Board (CIWMB) Grants for which the City Is Eligible Upon MOTION by Council Member Smith, seconded by Council Member Breeze, and APPROVED 4 -0 -1 with Vice Mayor Stafford absent, reading was waived, and the Consent Calendar, with the exception of the City Council Portion of Special Concurrent Meetings — March 11, 2008, and the City Council Portion of Regular Concurrent Meetings — .March 11, 2008, was ADOPTED. Item for consideration: 1. Approval of Minutes for: City Council Portion of Special Concurrent Meetings — March 11, 2008 City Council Portion of Regular Concurrent Meetings — March 11, 2008 Council Member Vidak - Martinez called attention to page 4, Agenda Item 8, "Council Committee and /or Other Reports," subitem 5, "Other Informational Reports," and she requested the addition of the following items: Attendance at a 3/5, meeting for the Development Agreement Subcommittee meeting regarding the Stadium Lands; a 3/6 meeting of the Climate Protection Conference Steering Committee; and a 3/7 fundraiser for the Rancho Cotate High School Music Boosters Club. Upon MOTION by Council Member Vidak- Martinez, seconded by Council Member Smith, the City Council Portion of Special Concurrent Meetings - March 11, 2008, and the City Council Portion of Regular Concurrent Meetings — March 11, 2008, were APPROVED 4 -0 -1, AS AMENDED, with Vice Mayor Stafford absent. 4. PROPOSITION 1B FUNDING PROJECT LIST: Consideration of Approving a List of Projects for Proposition 1B Funding, Amending the Fiscal Year 2007 -08 Capital Improvements Project Budget to Update the 2008 Streets Maintenance Project, and Authorizing the City Engineer to Request Proposition 113 Funds Disbursement: Staff Report: Management Analyst Tacata reviewed the contents of the Staff Report. On the advice of City Attorney Kenyon, Council Member Vidak- Martinez stated her intention to abstain based on the proximity of Lancaster Drive to her residence, and she left the Council Chamber at 6:23 p.m. Management Analyst Tacata responded to Council questions and comments. 2. Council Member Vidak - Martinez returned to the Council Chamber at 6:26 p.m. CONCURRENCE: At the suggestion of Mayor Mackenzie, Council CONCURRED to re -open the "Unscheduled Public Appearances /Comments." 2. UNSCHEDULED PUBLIC APPEARANCES /COMMENTS: [Continued] 1. Joseph Mesenbrind expressed concern about the recent death of Heather Billings and requested the dismissal of the officer involved. City Attorney Kenyon explained the citizen complaint process available through the Department of Public Safety. 5. GENERAL PLAN ANNUAL STATUS REPORT FOR CALENDAR YEAR 2007: Consideration of the Annual Status Report on the General Plan for Calendar Year 2007 (Planning File: PL2008- 007GP): 1. Staff Report: Director of Community Development Bendorff reviewed the contents of the Staff Report and responded to Council questions and comments. 2. Public Comments: None. 3. Council discussion/receive and file report: Council discussion concluded with CONCURRENCE to receive and file said report. 6. COUNCIL COMMITTEE AND /OR OTHER REPORTS: 1. Sonoma County Waste Management Agency meeting, 3/19: Council Member Smith provided a brief report. 2. Parks, Recreation and Open Space Committee meeting, 3/19: Assistant City Manager Schwarz provided a brief report on behalf of Vice Mayor Stafford. 3. Santa Rosa Plain Conservation Strategy Implementation (California Tiger Salamander) Committee meeting, 3/19: Mayor Mackenzie provided a brief report. Economic Development Subcommittee meeting, 3/19: Council Members Breeze and Vidak- Martinez provided a report, including announcement of the upcoming Chamber Business Expo and Sustainability Conference at Sonoma Mountain Village., They also noted that the Economic Development Subcommittee will be meeting the third Wednesday of every month at *2-1 p.m. *AMENDMENT ABOVE made by Council Member Breeze at the April 8, 2008 City Council meeting. Other informational reports, if any: Councilmember Smith DISTRIBUTED a flyer from the Sonoma County Waste Management Agency regarding Junk Mail, and he noted his attendance at the following events: Sonoma County Board of Supervisors meeting regarding the Jefferson Awards, 3/18; Tour of the New City Hall with Director of Public Works /City Engineer Jenkins, 3/24. Council Member Breeze: No other informational reports. Council Member Vidak- Martinez noted her attendance at the following meetings: Meeting with Climate Protection liaisons and County of Sonoma representatives to discuss the concept of a Sonoma County Climate Congress, 3/21; Sonoma Mountain Business Cluster meeting, 3/25. She also called attention to recognition of the Gold Certificate of Achievement in Leadership Award *for- Rehnei4 Deft- from the National League of Cities as noted in the recent edition of Nation's Cities Weekly. *AMENDMENT ABOVE made by Council Member Vidak- Martinez at the April 8, 2008 City Council meeting. Mayor Mackenzie also noted attendance at the following events: Sonoma -Marin Area Rail Transit (SMART) Board of Directors meeting, 3/19; Local Government Commission's 17th Annual Yosemite Conference for Local Elected Officials. 7. COMMUNICATIONS: Council Member Smith acknowledged a March 24, 2008 editorial in The Press Democrat, entitled "Green Scene," and read the following portion of said editorial into the record. "Currently, a citizens' group is attempting to qualify a measure for the ballot that would roll back sewer rates. The group is opposed to a series of rate hikes that ended the city's practice of subsidizing wastewater costs through the general fund and that helped pay for Rohnert Park's share of the Geyser's .Project. "We have sympathy with ratepayers who've seen their monthly bills increase dramatically overtime. In tough economic times, rate increases can be a real hardship. But there are costs involved in meeting the legal environmental standards imposed by state and federal governments and in upholding the green standards expected in Sonoma County." 8.
