2008/05/27 City Council MinutesCITY OF ROHNERT PARK CONCURRENT MEETING MINUTES FOR: City Council Community Development Commission Rohnert Park Financing Authority May 27, 2008 Tuesday The Concurrent Meetings of the City of Rohnert Park for the City Council, the Community Development Commission and the Rohnert Park Financing Authority met this date for a Regular Meeting to commence at 6:00 p.m. at the Rohnert Park City Hall, 6750 Commerce Boulevard, Rohnert Park, with Mayor Mackenzie presiding. DEMONSTRATION OF NEW SPLIT -BODY COLLECTION VEHICLE BY ROHNERT PARK DISPOSAL: Steve McCaffrey, Rohnert Park Disposal, demonstrated to Council Members, staff, and members of the public the new split -body collection vehicle. Mayor Mackenzie ANNOUNCED second and first place winners as follows: Second Place, Anna Blanchard, Jared Jensen, and Nick Laurent, Novato High School/Marin School of the Arts, "Frederick the Water Drop ": Unable to attend to accept award due to the closure of Highway 101. First Place, Joe Montoya, Novato High School/Marin School of the Arts: "Don't Waste Water ": Unable to attend to accept award due to the closure of Highway 101. Mayor's Presentation of Proclamations Recognizing and Honoring Members of the Parks, Recreation, and Open Space (PROS) Committee: Mayor Mackenzie PRESENTED proclamations to the following PROS Committee members in attendance: Richard Amerding, Daniel Blanquie, Cindy Peterson, and Vice Mayor Pam Stafford. CHAMBER OF COMMERCE QUARTERLY REPORT: Rohnert Park Chamber of Commerce Quarterly Report: Amy Ahanotu and Pat Savage provided a brief oral update regarding Chamber of Commerce activities /matters, including the following items: Hiring of a new executive director, installation of the new Board of Directors, development of a new business directory, the Chamber budget, a move towards transparency in Chamber activities, the North Bay Business Expo, and the upcoming Art & Wine Festival, Holiday Lights, and golf tournament events. 3. SANTA ROSA SUBREGIONAL WASTEWATER TREATMENT SYSTEM: Presentation regarding the Santa Rosa Geysers Recharge Project by Dan Carlson, Deputy Director of Utilities — Subregional, City of Santa Rosa: Dan Carlson, City of Santa Rosa Utilities Department, provided an update regarding the Subregional Wastewater Treatment System and the Geysers Expansion Project via PowerPoint presentation. He DISTRIBUTED a flyer regarding Medicine Drop -Off Locations, and he responded to Council questions and comments. 4. UNSCHEDULED PUBLIC APPEARANCES /COMMENTS: Lebo Newman, Coast Landscape Management, Inc., requested Council pull the Award of Landscape Services — North for further discussion. Duane Faloni, Trugreen Landcare, Inc., spoke in favor of the City's landscape Request -for- Proposal process. Approving Job Description and Salary Range for Supervising Maintenance Worker and Authorizing Recruitment for the Position City Manager Donley DEFERRED consideration of Resolution No. 2008 -75 to a future Council meeting due to ongoing meet - and - confer with the Service Employees International Union (SEIU). CALIFORNIA PUBLIC EMPLOYEES' RETIREMENT SYSTEM (Ca1PERS) CONTRACT AMENDMENT: Consideration of Approving an Amendment to the Contract between the City Council of the City of Rohnert Park and the Board of Administration of the California Public Employees' Retirement System (Ca1PERS) regarding the Annual Cost -of- Living Allowance Increase: 1. Staff Report: City Manager Donley reviewed the contents of the Staff Report. 2. Public Comments: None. 3. Ordinance for Adoption: Waive Further Reading and Adopt Ordinance by Reading Title: No. 797 Authorizing an Amendment to the Contract between the City Council of the City of Rohnert Park and the Board of Administration of the California Public Employees' Retirement System Upon MOTION by Council Member Smith, seconded by Vice Mayor Stafford, and APPROVED 4 -0 -1 with Council Member Breeze dissenting, reading was waived and Ordinance No. 797 was ADOPTED BY ROLL CALL VOTE. 7. GRADING ORDINANCE AMENDMENTS: Consideration of Proposed Amendments to Chapter 15.50, Excavations, Grading and Fills, of Title 15, Buildings and Construction, of the Rohnert Park Municipal Code: 1. Council discussion: Council CONCURRED to receive and file said report. 9. SEWER LATERAL REPLACEMENT GRANT PROGRAM: Consideration of Establishing a Sewer Lateral Replacement Grant Program: 1. Staff Report: Management Analyst Tacata reviewed the contents of the Staff Report and responded to Council questions and comments. 2. Public Comments: None. 3. Resolution for Adoption: 2008 -79 Establishing a Sewer Lateral Replacement Grant Program in the City of Rohnert Park Council CONCURRED to direct staff to report back on said matter in twelve (12) months. Upon MOTION by Council Member Vidak- Martinez, seconded by Council Member Smith, and UNANIMOUSLY APPROVED, reading was waived and Resolution No. 2008 -79 was ADOPTED. 10. REFUSE, RECYCLABLE MATERIALS, COMPOSTABLE MATERIALS AND STREET SWEEPING SERVICES: Consideration of Approving an Amended and Restated Agreement with Rohnert Park Disposal, Inc.. 1. Staff report: Management Analyst Babonis reviewed the contents of the Staff Report and responded to Council questions and comments. Stadium Lands: Council Member Smith informed Council of a meeting he had with Dennis Hunter and Ernie Carpenter regarding the Stadium Lands. b. Federated Indians of Graton Rancheria (FIGR): Council Member Breeze informed Council of her communications with Greg Sarris of FIGR. 15. CITY MANAGER'S /CITY ATTORNEY'S REPORTS: 1. Budget Structure Outline: City Manager Donley discussed the current status of the budget cuts and staff's intention to freeze vacant positions. 2. Legislative Update: a. May Revision to 2008 -2009 State Budget: Assistant City Manager Schwarz reviewed Governor Schwarzenegger's May revisions to the State Budget, and he discussed the status of bills on the hot list, indicating that he will work with Mayor Mackenzie on a request for a veto of Assembly bill 983 regarding public contracts. b. Water Conservation - Letters regarding AB 2153 (Krekorian) and AB 2175 (Laird): Council discussion/direction: Upon recommendation by Assistant City Manager Schwarz, Council CONCURRED to direct staff to send letters of opposition under the Mayor's signature regarding water conservation bills AB 2153 and AB 2175. Neighborhood Garden Update: City Manager Donley reviewed the contents of the Staff Report. Dan Hubley, Boys & Girls Club, spoke in favor of a Neighborhood Garden at the Boys & Girls Club provided said garden is funded and safe. Council direction: A MOTION was made by Council Member Vidak- Martinez to support the staff's recommendation as outlined in the Staff Report. Said motion FAILED FOR LACK OF A SECOND. A MOTION was made by Council Member Smith, seconded by Vice Mayor Stafford, (1) to direct staff to work with the Boys & Girls Club, the Occidental Arts and Ecology Center, and the Federated Indians of Graton Rancheria (FIGR) to determine if the site in B Park near the Boys & Girls Club is suitable for a neighborhood or community garden; and (2) to direct staff to return to Council with a proposal for a site lease at a nominal fee, during a trial period, at no cost to the City, and with funding for the garden to be provided by FIGR directly to the Boys & Girls Club.
