2007/08/28 City Council MinutesCITY OF ROHNERT PARK CONCURRENT MEETING MINUTES FOR: City Council Community Development Commission Rohnert Park Financing Authority August 28, 2007 Tuesday The Concurrent Meetings of the. City of Rohnert Park for the City Council, the Community Development Commission and the Rohnert Park Financing Authority met this date for a Special Meeting, to commence at 5:00 p.m., followed by a Regular Meeting at the Rohnert Park City Hall, 6750 Commerce Boulevard, Rohnert Park, with Mayor Vidak - Martinez presiding. SPECIAL MEETING/ WORK SESSION Call to Order: Mayor Vidak- Martinez called the Special Meeting/Work Session to order at 5:02 p.m. Roll Call: Breeze, Mackenzie, Stafford, Vidak- Martinez Absent: Smith (Out of town on City business) Staff present for all or part of the Special Meeting/Work Session: City Manager Donley, Assistant City Manager Schwarz, Director of Administrative Services Lipitz, Performing Arts Center (PAC) Managing Director McDougall, Management Analyst Babonis, Deputy City Clerk Griffin, and Videographer Beltz. Unscheduled Public Appearances: None. 1. CITY BUDGET WORK SESSION: Performing Arts Center — Fiscal Year 2007 -2008 Budget: PAC Managing Director MacDougall reviewed the contents of the Staff Report, including PAC brochures. Director MacDougall, City Manager Donley, and Director of Administrative Services Lipitz responded to Council questions and comments. Council discussion/direction/action: Council Members commended PAC staff for their work, and they encouraged ongoing efforts in terms of updating the Web site, creating additional public banners, and pursuing more grants. Council CONCURRED to direct staff to continue compiling rental fee data and to reexamine rental fees every other year. At this time, Jud Snyder from the audience provided a brief comment about the PAC's exposure in The Community Voice as the budget for that item has been eliminated. . CLOSED SESSION Mayor Vidak- Martinez adjourned Council to Closed Session to discuss Litigation and Personnel Matters. REGULAR SESSION Mayor Vidak- Martinez reconvened Council in Regular Session at 7 :02 p.m. PLEDGE OF ALLEGIANCE: Katriana Sweeney, age 6, led the Pledge of Allegiance. Mayor Vidak - Martinez PRESENTED Katriana with a card and a pen. 1. MAYOR'S REPORT ON CLOSED SESSION: Mayor Vidak- Martinez indicated that there was no reportable action from Closed Session, 2. SSU STUDENT REPORT: Sonoma State University Associated Students, Inc. (ASI), by Nicole Schlossberg, Legislative Representative: Ms. Schlossberg reviewed her background and reported on the status of the incoming freshmen class and the ASL 3. UNSCHEDULED PUBLIC APPEARANCES /COMMENTS: I . Betty Fredericks, 6950 Commerce Boulevard, Suite 1, was recognized and called for Council to be accountable by dissolving the Tribal Council Ad Hoc Subcommittee and no longer meeting privately with the Federated Indians of Graton Rancheria (FIGR) and Station Casinos. For the record, Vice Mayor Mackenzie stated that the Tribal Liaison Subcommittee has not met this year at all, nor has he had a telephone conversation with either FIGR or Station Casinos. 2. Sean O'Donnell, Rohnert Park Public Works Department, Service Employees International Union (SEIU) member, was recognized and reminded Council that there are people behind the budget cuts at the bargaining table. 3. Carl Allyn, Rohnert Park Public Works Department, SEIU member, was recognized and expressed reasons for asking the City to work more closely with SEIU in the future to achieve terms that are good for all parties. 4. Dawna Gallagher, 276 City Center Drive, was recognized and made a formal request to schedule a brief presentation at the next Council Meeting about impeachment of President Bush and Vice President Cheney. Mayor Vidak- Martinez clarified the City's agenda protocol regarding scheduled and unscheduled public comments policies. CONSENT CALENDAR: Mayor Vidak- Martinez asked if there were any questions about matters on the Consent Calendar. City Manager Donley called attention to Resolution 2007 -140. He clarified a matter regarding the parking lot and recommended Council take action on said resolution. Mayor Vidak- Martinez, on behalf of Council Member Smith, signified removal of the City Council Portion of the Regular Concurrent Meetings Minutes of August 14, 2007. 1. Head for Her Thirty Years as an Employee of the City of -Rohnert Park 2007 -137 Commending Patrick Lynd, Public Safety Sergeant, on the Occasion of His Retirement 2007 -138 Supporting Save -A -Life Foundation and Declaring September as National Save -A -Life Month 2007 -139 Authorizing and Approving Amendment No. 5 to Task Order 2004 -14 with Winzler & Kelly Consulting Engineers. for Supplemental Engineering Services for the Eastside Trunk Sewer Project — Phase I (City Project No. 2004 -05) 2007 -140 Authorizing and Approving a Subordination Agreement among the City of Rohnert Park, Community Development Commission, Burbank Housing Development Corporation, State of California Department of Housing and Community Development and. Arbors Rohnert Park Apartments, L.P. 2007 -141 Calling for Sealed Proposals for Janitorial Maintenance for Various City Facilities 2007 -142 Authorizing and Approving an Agreement for Veterinarian Services with Roger Klein, DVM Upon _MOTION by Vice Mayor Mackenzie, seconded by Council Member Breeze, and APPROVED 4 -0 -1 with Council Member Smith absent, reading was waived and the Consent Calendar, with the exception of the City Council Portion of the Regular Concurrent Meetings Minutes of August 14, 2007, was ADOPTED. Under "Council discussion /direction/action," she noted Council Member Smith's amendment of the following statement, "He indicated that segmentation of the project is proper," to read, "He indicated that segmentation of the project appears to be proper." Upon MOTION by Mayor Vidak- Martinez, seconded by Vice Mayor Mackenzie, the Regular Concurrent Meetings Minutes of August 14, 2007 were APPROVED, AS AMENDED, 4 -0 -1 with Council Member Smith absent. S. PARK RULES ORDINANCE: Consideration of Renaming 9.62 and Amending Section 9.62.010, "Unlawful Acts in Public Parks and Recreational Facilities," of the Rohnert Park Municipal Code: 1. Staff Report: Assistant City Manager Schwarz reviewed the contents of the Staff Report. 2. Public Comments: None. 3. Ordinance for Adoption: Waive Further Reading and Adopt Ordinance by Reading Title: No. 792 Renaming 9.62 and Amending Section 9.62.010, "Unlawful Acts in Public Parks and Recreational Facilities," of the Rohnert Park Municipal Code Upon MOTION by Vice Mayor Mackenzie, seconded by Council Member Breeze, and APPROVED 4 -0 -1 with Council Member Smith absent, reading was waived and Ordinance No. 792 was ADOPTED BY ROLL CALL VOTE. 6. 2005 URBAN WATER MANAGEMENT PLAN: Consideration of Adopting the City of Rohnert Park 2005 Urban Water Management Plan (UWMP) and Authorizing Filing with the Department of Water Resources: 1. Staff Report: Public Works Director /City Engineer Jenkins introduced Mary Grace Pawson of Winzler & Kelly, and Ms. Pawson reviewed the contents of the Staff Report via PowerPoint presentation. Ms. Pawson responded to Council questions and comments. 2. PUBLIC HEARING: Mayor Vidak- Martinez opened the Public Hearing at 7:36 p.m. A. H.R. Downs, 1390 North McDowell Boulevard, was recognized and expressed his concerns with the timing, budget, and safety of the water supply as outlined in the UWMP. He SUBMITTED an OWL Foundation letter about the Urban Water Management Plan, as well as a packet of articles about pollutants emerging from treated sewage. B. Dawna Gallagher, 276 City Center Drive, was recognized and expressed concern about the City's assessment of its water supply and demand, as well as concern about pollutants in the water supply. Ms. Pawson explained the delay in the City's process in getting the UWMP done. She also commented on the process of making supply projections and the safety of recycled water. City Attorney Kenyon confirmed that the UWMP has been available for j ublic review since August 14, 2007, and she shared additional comments on timing of the UWMP. 3. Resolution for Adoption: 2007 -143 Adopting the City of Rohnert Park 2005 Urban Water Management Plan and Authorizing Filing with the Department of Water Resources A MOTION was made by Council Member Breeze, seconded by Vice Mayor Mackenzie, to adopt Resolution 2007 -143. At the conclusion of Council discussion after the motion, which was APPROVED 4 -0 -1 with Council Member Smith absent, reading was waived, and Resolution 2007 -143 was ADOPTED. 7. COUNCIL COMMITTEE AND /OR OTHER REPORTS: 1. Santa Rosa Plain Conservation Strategy Implementation Committee (California Tiger Salamander) meeting, 8/15: Vice Mayor Mackenzie provided a brief report. Council discussion/direction /action: No direction needed or given at this time. 2. Waste & Recycling Subcommittee meeting, 8/21: Mayor Vidak- Martinez provided a brief report. She indicated the Subcommittee's recommendation for a Work Session regarding waste and recycling matters for the full Council at the second Council meeting in September. New City Hall Groundbreaking Ceremony, 8/21: Mayor Vidak- Martinez provided a brief report. B. Introduction of new School District Superintendent /Open House: Council Member Stafford provided a brief report. C. Senior Center Pancake Breakfast: Council Member Stafford provided a brief report. D. Northern Fire Station Explorers Pancake Breakfast: Council Member Stafford provided a brief report. E. Series of water meetings: Vice Mayor Mackenzie updated Council on various water meetings he's been attending statewide. F. Convocation of Sonoma State University: Vice Mayor Mackenzie briefly reported that he and Council Member Smith attended said function. 8.
