The Concurrent Meetings of the City of Rolmert Park for the City Council, the .Community
Development Commission and the Rohnert Park Financing Authority met this date for a Special
Meeting/Work Session, to commence at 5:00 p.m., followed by a Regular Meeting at the Rohnert
Park City Hall, 6750 Commerce Boulevard, Rohnert Park, with Mayor Vidak- Martinez presiding.
SPECIAL MEETING/ WORK SESSION
Call to Order: Mayor Vidak - Martinez called the Special Meeting/Work Session to order at 5 :00
p.m.
Roll Call: Breeze, Mackenzie, Smith, Stafford, Vidak- Martinez
Staff present for all or part of the Special Meeting/Work Session: City Manager Donley, Assistant
City Manager Schwarz, City Attorney Kenyon, Director of Community Development Bendorff,
Director of Public Works /City Engineer Jenkins, Deputy City Engineer Barnes, Director of
Administrative Services Lipitz, Director of Public Safety Bullard, Management Analyst Babonis,
Senior Engineering Technician Pedroncelli, Community Development Assistant Azevedo,

1. COMMUNITY DEVELOPMENT / PLANNING / ENGINEERING — WORK PLANS:
Staff Report: Director of Community Development Bendorff reviewed the contents of the
Community Development Work Plan/Staff Report via a PowerPoint presentation, and he responded
to Council questions and comments.
Public comments: None.
Council direction: Council discussion concluded with direction for staff to bring back a staffing
plan based on Council's priorities.
Staff Report: Director of Public Works /City Engineer Jenkins reviewed the contents of the
Engineering Work Plan/Staff Report via a PowerPoint presentation, and he responded to Council
questions and comments.
Public comments:
Dawna Gallagher commented on the City's staffing problems.
Council direction: Council discussion concluded with direction for staff to bring back a staffing
plan based on Council's priorities.

WASTE AND RECYCLING FRANCHISE:
Staff Report: Director of Administrative Services Lipitz accompanied Management Analyst
Babonis, who reviewed the contents of the Staff Report and responded to Council questions and
continents. City Manager Donley shared additional comments regarding staff's analysis.
Public Comments:
Ralph Shapiro expressed reasons in support of competitive bidding.
Dawna Gallagher expressed support for a one -year extension of the current contract followed by
competitive bidding.
Norman L. deVall urged Council to allow for competitive bidding.
Dave Erickson addressed diesel emission issues.
Eric Koenigshofer DISTRIBUTED AND REVIEWED a document regarding the current hauler's
fleet replacement, jurisdiction rates, and the rate savings from a seven -year contract extension.
John Warran discussed how he wrote up the cost proposal for the current hauler, Rohnert Park
Disposal.
Ernie Carpenter DISTRIBUTED AND REVIEWED a document about greenhouse gas reduction,
and he expressed reasons in support of competitive bidding.
Paul Stutrud DISTRIBUTED AND REVIEWED a document about compliance with Article XIII
of the California Constitution, regarding garbage and recycling rate increases.
Pam Davis discussed North Bay Corporation's outreach programs.
Council direction: A MOTION was made by Council Member Smith to direct staff to start a
competitive bidding process. Said motion FAILED for lack of a second. Council Member Smith
DISTRIBUTED AND REVIEWED the cover of the book, The Undercover Economist, as well as
a letter to the editor of The Press Democrat from North Bay Corporation, dated May 13, 2007,
regarding the status competitive bidding in Sonoma County. Council discussion concluded with
directions for staff to move forward with the contract extension and to report back to Council at an
appropriate time.
FOR THE RECORD, a MOTION was made by Council Member Smith to direct staff to start a
competitive bidding process. Said motion FAILED for lack of a second.
FOR THE RECORD, Vice Mayor Mackenzie stated that he would have normally seconded such a
motion for purposes of discussion, but he indicated that Council discussion had already taken place
and the direction was clear.
Mayor Vidak - Martinez adjourned the Special Meeting/Work Session at 7:35 p.m.

CITY COUNCIL AND COMMUNITY DEVELOPMENT COMMISSION (CDC)
REGULAR CONCURRENT MEETINGS:
Mayor Vidak- Martinez called the City Council and CDC Regular Concurrent Meetings to order at
7:38 p.m. with all Council Members present.
Staff present for all or part of the Special Meeting/Work Session: City Manager Donley, Assistant
City Manager Schwarz, City Attorney Kenyon, Director of Public Works /City Engineer Jenkins,
Deputy City Engineer Baines, Management Analyst Babonis, PAC Managing Director McDougall,
Building Official Bruck, Deputy City Clerk Griffin, and Videographer Beltz.
PLEDGE OF ALLEGIANCE:
Haley Rogina, Student, Evergreen Elementary School, led the Pledge of Allegiance and was
PRESENTED with a card and a pen from Mayor Vidak- Martinez.
Mayor Vidak- Martinez adjourned Council to consecutive and separate CDC and City Council Closed
Sessions at 7:40 p.m.

The CDC considered Real Property Matters in Closed Session.
2. CITY COUNCIL CLOSED SESSION:
The City Council considered Personnel Matters in Closed Session.
3. RECONVENE CITY COUNCIL AND CDC REGULAR CONCURRENT MEETINGS TO
OPEN SESSION:
Mayor Vidak- Martinez reconvened City Council and the CDC Regular Concurrent Meetings to
Open Session at 8:29 p.m.
4. CHAIR'S REPORT ON CDC CLOSED SESSION AND MAYOR'S REPORT ON CITY
COUNCIL CLOSED SESSION:
Mayor Vidak- Martinez stated that there was no reportable action from either Closed Session.
Whereby, the CDC Regular Concurrent Meeting was recessed and the City Council Regular
Concurrent Meeting was continued.
5. SSU STUDENT REPORT:
Mayor Vidak- Martinez reported that Sonoma State University Associated Students, Inc. (ASI)
Legislative Representative Nicole Schlossberg left this evening's proceedings due to illness.
6. SISTER CITIES RELATIONS COMMITTEE REPORT
Report on Visit to Hashimoto City, Japan, by Erika Weil, Rohnert Park's Student Ambassador:
Mayor Vidak- Martinez reported that said item will be DEFERRED to another Council meeting.

Upon MOTION by Vice Mayor Mackenzie, seconded by Council Member Breeze, and
UNANIMOUSLY APPROVED, reading was waived and the Consent Calendar, with the
exception of the City Council Portion of the Regular Concurrent Meetings Minutes of September
11, 2007, was ADOPTED.

City Council Portion of Regular Concurrent Meetings — September 11, 2007
Mayor Vidak- Martinez indicated that she would be abstaining from the vote due to her absence
from the last Council meeting. Upon MOTION by Council Member Smith, seconded by Vice
Mayor Mackenzie, the City Council Portion of the Regular Concurrent Meetings Minutes of
September 11, 2007 was APPROVED 4-0 -1 with Mayor Vidak- Martinez abstaining.

2007 -160 Authorizing and Approving an Agreement between the County of Sonoma
and the City of Rohnert Park for Interim Public Wastewater Service to
the Canon Manor West Area Pending County's Acceptance of the
Improvements
City Attorney Kenyon reviewed an amendment to paragraph 9, line 6 of the Agreement, adding
the language, "or the 2001 Agreement." A MOTION was made by Vice Mayor Mackenzie for
purposes of discussion, seconded by Council Member Stafford, to approve Resolution 2007 -160 as
modified by the City Attorney.
FOR THE RECORD, Vice Mayor Mackenzie noted that he and Mayor Vidak- Martinez, as
members of the Canon Manor Subcommittee, put a great amount of effort into the 2001
agreement. He stated that the County has done a poor job of holding up their end of the
agreement, and he urged City Attorney Kenyon make sure various problems are resolved to the
satisfaction of the City Engineer before final signature of the City Attorney and the Mayor. City
Attorney Kenyon commented on whether Council needed the agreement at outlined in Resolution
2007 -160 to move forward. Deputy City Engineer Barnes stated that the Engineering Department
is close to resolving issues on the gravity matters, but not so close to resolution on the pump
station issues. Vice Mayor Mackenzie reiterated that he and Council Member Smith had voiced
their dissatisfaction with the County's performance. City Manager Donley indicated that the
agreement in Resolution 2007 -160 establishes standards for the County to meet, and Deputy City
Engineer Barnes explained how punch Iist items would still be in place.
Council discussion concluded, and for said motion, which was APPROVED 3 -2 with Vice Mayor
Mackenzie and Council Member Smith dissenting, reading was waived and Resolution 2007 -160
was ADOPTED AS AMENDED by the City Attorney.
Consideration of Proposed Rate Increase for Solid Waste Disposal and Rubbish or Refuse
Collection:
1. Staff Report: Management Analyst Babonis reviewed the contents of the Staff Report via a
PowerPoint presentation, and she responded to Council questions and comments.
2. PUBLIC HEARING: Mayor Vidak- Martinez opened the Public Hearing at 9:06 p.m.
Dawna Gallagher questioned which residents received notices as she did not.
Mayor Vidak - Martinez closed the Public Hearing at 9:07 p.m.
3. Resolution for Adoption:
2007 -161 Establishing Solid Waste Disposal and Rubbish or Refuse Collection Rates
A MOTION was made by Vice Mayor Mackenzie, seconded by Council Member Breeze, to
adopt Resolution 2007 -161.
FOR THE RECORD, Vice Mayor Mackenzie stated that he and his wife received the rate
notice at their residence on Gladstone Way.

Council discussion concluded, and for said motion, which was UNANIMOUSLY
APPROVED, reading was waived and Resolution 2007 -161. was ADOPTED.
10. RECREATION FACILITY USE FEES:
Consideration of Proposed Increases to Recreation Department Facility Use Fees, including Rental
Fees for the Community Center, Burton Avenue Recreation Center, and Senior Center,
Damage /Cleaning Deposits for Various Facilities, and Fees for Swim Lessons and Private
Swimming Pool Rentals:

Consideration of Proposed Increases to Spreckels Performing Arts Center Facility Use Fees and
Cleaning Deposits:
1. Staff Reports: City Manager Donley reviewed the contents of the respective Staff Reports.
2. PUBLIC HEARING: Mayor Vidak- Martinez opened the Public Hearing at 9:08 p.m. There
being no .members of the public interested in commenting, Mayor Vidak- Martinez closed the
Public Hearing at 9:08 p.m.
3. Resolution for Adoption:
2007 -162 Approving. Adjustments in Facility Rental and Program Fees for Various
Recreation Facilities
and
2007 -163 Approving Adjustments in Facility Use Fees for Spreckels Performing Arts
Center
Council Member Smith stepped out of the Council chambers at 9:08 p.m. A MOTION was
made by Vice Mayor Mackenzie, seconded by Council Member Breeze, to separately and
consecutively adopt Resolution Nos. 2007 -162 and 2007 -163. Council discussion concluded,
and for said motion, which was APPROVED 4 -0 -1 with Council Member Smith absent due to
his stepping out of Council chambers momentarily,. reading was waived and Resolution Nos.
2007 -162 and 2007 -163 were ADOPTED.
12. CLIMATE ACTION PLAN FOR CITY OPERATIONS:
Consideration of Approving the "City of Rohnert Park Greenhouse Gas Emissions Reduction
Action Plan Analysis Prepared by the Climate Protection Campaign and Adopting "Plan C" of the
Plan to Reduce Greenhouse Gases Generated by City Operations:
1. Staff Report: -Building Official Bruck reviewed the contents of the Staff Report. Sam Pierce,
Mayor of Sebastopol, shared additional comments and responded to Council questions.

Adopting "Plan C" of the Plan to Reduce Greenhouse Gases Generated by
City Operations
A MOTION was made by Vice Mayor Mackenzie, seconded by Council Member Smith, to
adopt Resolution 2007 -164. Council discussion concluded, and for said motion, which was
UNANIMOUSLY APPROVED, reading was waived and Resolution 2007 -164 was
ADOPTED. Council Member Smith requested to agendize Council consideration of directing
staff to prepare a letter to the Governor calling for the Public Utilities Commission (PUC) to
consider rule changes in the area of alternative energy sources.

1. Parks, Recreation & Open Space Committee meeting: Council Member Stafford indicated she
was unable to attend said meeting.

Rancho Cotate High School Homecoming Parade: City Manager Donley reviewed plans for
said event currently scheduled for October 13, 2007.
