2009/10/13 City Council MinutesMINUTES OF THE ROHNERT PARK CITY COUNCIL Community Development Commission Rohnert Park Financing Authority CONCURRENT MEETINGS Tuesday, October 13, 2009 The City Council of the City of Rohnert Park met this date for Regular Concurrent Meetings of the Rohnert Park City Council, Community Development Commission of the City of Rohnert Park, and Rohnert Park Financing Authority, scheduled to commence at 6:00 p.m. at the Rohnert Park City Hall, 130 Avram Avenue, Rohnert Park, with Mayor Breeze presiding. CALL TO ORDER - The Regular Meeting of the City Council of the City of Rohnert Park was called to order by Mayor Breeze at 6:18 p.m. ROLL CALL Present: Arnie Breeze, Mayor Gina Belforte, Vice Mayor Joseph T. Callinan, Council Member Jake Mackenzie, Council Member Pam Stafford, Council Member Absent: None Staff and /or consultants participating in all or part of this session: Daniel Schwarz, Interim City Manager; Michelle Marchetta Kenyon, City Attorney; Darrin Jenkins, Director of Development Services /City Engineer; John McArthur, Director of Public Works and Community Services; Guy Miller, Recreation Services Manager; Sandy Lipitz, Director of Administrative Services, and Judy Hauff, City Clerk. PLEDGE OF ALLEGIANCE — Jordan Girman, Student, Evergreen Elementary School, led the Pledge of Allegiance. Mayor Breeze presented Jordan with a card and pen. 1. MAYOR'S PRESENTATIONS: 1. Proclamation in Observance of United Nations Day, October 24, 2009. Mayor Breeze shared contents of this Proclamation and presented it to Bob Abramson, Board Member of the United Nations Association of Sonoma County. Mr. Abramson expressed appreciation for the proclamation and made brief comments. He provided the UN Flag for the City to fly during the week of October 19 -24 for observance of United Nations Day and distributed a flyer for the upcoming event: "An Evening with Jake Mackenzie" Co- Sponsored by UNA -USA Sonoma County Chapter, Sonoma Minutes of the City of Rohnert Park CONCURRENT MEETINGS (2 of 10) October 13, 2009 for City Council /Community Development Commission /Rohnert Park Financing Authority Academy, and Climate Protection Campaign on Wednesday, October 14, 2009 from 7:00 p.m. to 9:00 p.m. at the Sonoma Academy Fitzsimmons Black Box Theater in Santa Rosa. 2. Resolution Supporting October 2009 as "Domestic Violence Awareness Month ". Mayor Breeze shared contents of this Resolution and presented it to Tina Dalvalos, YWCA Representative. Ms. Dalvalos made brief comments expressing appreciation for the resolution and for the City Council's continued support. 2. SSU STUDENT REPORT - Sonoma State University Associated Students, Inc., Student Report by Jesse Schwartz, SSU ASI Legislative Representative. Mayor Breeze advised SSU ASI Representative Jesse Schwartz was not present for this report 3. CITY MANAGER / CITY ATTORNEY / DEPARTMENT HEAD BRIEFINGS 1. Development Services Department: a. Introduction of Marilyn Ponton, Planning and Building Manager Director of Development Services, City Engineer Darrin Jenkins made this introduction and reviewed Ms. Ponton's qualifications for this position. Ms. Ponton expressed appreciation for being selected and looked forward to working with the City Council on upcoming projects. 2. Public Works and Community Services Department: a. Introduction of Jessica Schieberl, Part Time Technical Advisor at the Senior Center Director of Public Works and Community Services John McArthur made this introduction and reviewed Ms. Schieberl's qualifications for this position. Ms. Schieberl expressed appreciation for the opportunity to join Rohnert Park and looked forward to working at the Senior Center. 3. Agenda Streaming — Interim City Manager Schwarz announced that a practice run is commencing with this Council meeting for agenda streaming with Granicus software package for making digital televised Council meetings available to the public. 4. PUBLIC COMMENTS — Mayor Breeze invited members of the public to speak at 6:37 p.m. 1. Debbie Bailey commented on upcoming event celebrating the Rohnert Park Community Band's 30t" Anniversary at A Park this Saturday, October 17, 2009 from 11:00 a.m. to 3:00 p.m. She invited Council to come to this event and expressed appreciation for past support of the City Council. 2. Dawna Gallagher expressed her continued interest in the AB 939 appointment listed later on tonight's agenda. CONSENT CALENDAR Mayor Breeze advised that all items on the consent calendar were to be considered together by one action of the Council with ROLL CALL VOTE due to an Ordinance listed for adoption unless any Council Member or . anyone else interested in a consent calendar item had a question about the item. Council Member Stafford pulled Resolution No. 2009 -105. Council Member Callinan pulled Item No. 2 on City Bills. Vice Mayor Belforte pulled Item No. Lc on the minutes for the September 22nd City Council regular concurrent meetings. Mayor Breeze pulled Resolution No. 2009 -107. 1. Approval of Minutes for: a. City Council Portion of Regular Concurrent Meetings — September 8, 2009. b. City Council Special meeting September 22, 2009. 3. Acceptance of Cash/Investments Report for Month Ending August 2009. 4. Resolutions for Adoption: a. 2009 -103 Honoring Maya van den Heuvel, Recreation Supervisor, on the Occasion of Her Retirement. b. 2009 -104 Honoring Thonie Hevron, Public Safety Dispatcher, on the Occasion of Her Retirement. d. 2009 -106 Approving the 2009 -10 Supplemental Law Enforcement Services Fund Expenditure Plan. f. 2009 -108 Authorizing the Purchase of a Commercial Power Mower for the Public Works Department. 5. Ordinance for Adoption: a. No. 818 Adding Chapter 10.50, Residential Parking Permit Program, to Title 10, Vehicles and Traffic, of the Rohnert Park Municipal Code to Establish a Residential Parking Permit Program. 6. Acceptance of Quarterly Report on City Council Travel Expenditures. 7. Senior Citizens Advisory Commissioner Resignation (Vice Mayor Belforte nomination) a. Accepting letter of resignation from Susan Snyder as of September 16, 2009 (two -year term to expire December 31, 2010). MOTION by Council Member Mackenzie to approve the Consent Calendar with the exception of the September 22, 2009 City Council Regular Concurrent Meetings, the City bills /demands for payment, and Resolution Nos. 2009 -105 and 2009 -107, seconded by Council Member Stafford, CARRIED UNANIMOUSLY via roll call vote, reading was waived and the Consent Calendar with stated exceptions was APPROVED. Minutes of the City of Rohnert Park CONCURRENT MEETINGS (4 of 10) October 13, 2009 for City Council /Community Development Commission / Rohnert Park Financing Authority Items for consideration: 1. Approval of Minutes for: c. City Council Portion of Regular Concurrent Meetings — September 22, 2009. Vice Mayor Belforte referred to the bottom of page 4 of these minutes and recommended removal of the comments prior to the motion adopting Resolution No. 2009 -101 to be in accordance with Council Protocols directing action minutes. Discussion concluded in COUNCIL CONCURRENCE to DEFER approval of these minutes and direct staff to review the video tape on this portion of the September 22nd meeting to see if "for the record" was indicated for inclusion of the comments in question. [CITY CLERK NOTE: The City Clerk reviewed the video tape of the above - referenced portion of the September 22 "d Council meeting and found that "for the record" was not indicated during the comments in question. Accordingly, the correction showing removal of the comments has been reflected in the September 22, 2009 Regular Council Meeting Minutes with said minutes distributed for Council's consideration of approval, as listed on the October 27, 2009 Regular Council Meeting Agenda. ] 2. Acceptance and Approval of City Bills /Demands for Payment. Council Member Callinan commented on this item. MOTION by Council Member Stafford to approve the City Bills /Demands for payment, seconded by Council Member Mackenzie, and CARRIED UNANIMOUSLY, the October 13, 2009 City Bills /Demands for Payment were APPROVED as presented. c. 2009 -105 Recognizing Pat Anderson for Her Volunteer Work Organizing the .2 nd Annual Community Health Faire. Council Member Stafford commented on this resolution. MOTION by Council Member Stafford to adopt Resolution No. 2009 -105, seconded by Council Member Callinan, and CARRIED UNANIMOUSLY, reading was waived and the adoption of Resolution No. 2009 -105 was APPROVED. e. 2009 -107 Approving Job Description and Salary Range for Administrative Assistant — Confidential, and Authorizing Recruitment of the Position Mayor Breeze commented on this item and Interim City Manager Schwarz responded to Council questions. MOTION by Council Member Stafford to adopt Resolution No. 2009 -107, seconded by Council Member Mackenzie, and CARRIED UNANIMOUSLY, reading was waived and the adoption of Resolution No. 2009 -107 was APPROVED. STATUS REPORT on PUBLIC FACILITIES FINANCE PLAN UPDATE 1. Staff Report - Director of Development Services /City Engineer Jenkins provided this status report via power point presentation and responded to Council questions. 2. Public Comments - Mayor Breeze invited public comments on this item at 7:15 p.m. No one responded. 3. Council discussion /direction — Discussion concluded in COUNCIL CONCURRENCE to proceed as described in the report provided by staff for this item. 7. GREEN BUILDING STANDARDS AND RATING SYSTEMS - Consideration of Green Building Standards and Rating Systems for Construction of Buildings of Certain Covered Project Types. 1. Staff Report — Director of Development Services /City Engineer Jenkins reviewed the staff report provided for this item and responded to Council questions. 2. Public Comments - Mayor Breeze invited public comments on this item at 7:42 p.m. No one responded. 3. Resolution for Adoption: 2009 -109 Approving and Adopting Green Building Standards and Rating Systems for Construction of Buildings of Certain Covered Project Types. a. Council motion by Council Member Mackenzie to adopt Resolution No. 2009 -109, seconded by Vice Mayor Belforte b. Council discussion ensued. c. Council vote on the motion on the floor CARRIED 4 — 1 with Council Member Callinan dissenting, reading was waived and the adoption of Resolution No. 2009 -109 was APPROVED. 8. CITY POOLS - Review of public outreach process and results regarding future uses of Alicia and Ladybug Pool sites. 1. Staff Report — Interim City Manager Schwarz reviewed the staff report provided for this item and responded to Council questions. Recreation Services Manager Miller also responded to Council questions on this item. 2. Public Comments - Mayor Breeze invited public comments on this item at 8:10 p.m. No one responded. 3. Council discussion /direction - Discussion concluded in AGREEMENT indicated by the Council majority, with Council Member Callinan not in favor, to decommission the pools at Alicia and Ladybug Parks and direct staff to proceed with preparation of a Minutes of the City of Rohnert Park CONCURRENT MEETINGS (6 of 10) October 13, 2009 for City Council /Community Development Commission / Rohnert Park Financing Authority report for future Council consideration on the decommissioning procedure and other recommendations for the A and L Pool sites. 9. EXECUTIVE RECRUITMENT SERVICES — Consideration of proposals submitted for executive recruitment services for position of City Manager and Council action to either: 1) Select finalists for interviews by Council; or 2) Reject all proposals and direct in -house process. 1. Staff Report — City Attorney Kenyon reviewed the staff report provided for this item and responded to Council question. 2. Public Comments - Mayor Breeze invited public comments on this item at 8:34 p.m. No one responded. 3. Council discussion /direction a. Council motion by Council Member Stafford to proceed with option 2 in the staff report to select the top proposals and invite those finalists to be interviewed by the Council; seconded by Council Member Mackenzie b. Council discussion ensued. c. Council vote on the motion on the floor CARRIED 3 — 2 with Council Member Callinan and Mayor Breeze dissenting, to proceed with option 2 in the staff report was APPROVED. Council Member Mackenzie left the Chamber at 8:47 p.m. and returned to the meeting during the following discussion at 8:50 p.m. Further discussion of this item concluded in AGREEMENT by the Council majority, with Council Member Callinan and Mayor Breeze not participating, to select the following three firms to be interviewed by Council: Ralph Andersen & Associates; Alliance Resource Consulting, Inc.; and Peckham & McKenney. 10. STANDING COMMITTEE / AD HOC COMMITTEE / LIAISON REPORTS 1. Standing Committees: a. Economic Development, 9/23/09 mtg. (AB /GB) Mayor Breeze and Vice Mayor Belforte confirmed their attendance at this meeting and reported on the items listed on the agenda provided for this meeting which included Banner Program Update and CDC Budget Update and Finance Review. b. Waste and Recycling, 9 /30/09 mtg. (GB /PS) Vice Mayor Belforte and Council Member Stafford confirmed their attendance at this meeting and reported on the items listed on the agenda provided for this meeting which included: the Committee's recommendation to extend the contracts for one year with the Temporary Debris Box Contractors, Rohnert Park Disposal and Industrial Carting; and an update on the Food Waste Pilot Program by Steve McCaffrey of Rohnert Park Disposal. Public comments — Mayor Breeze invited public comments at 9:02 p.m. Minutes inutes of the City of Rohnert Park CONCURRENT MEETINGS (7 of 10) October 13, 2009 for City Council /Community Development Commission /Rohnert Park Financing Authority Steve McCaffrey of Rohnert Park Disposal advised that November 1St is the startup date for the Food Waste Recycle Program. 2. Liaison Reports: a. Water Advisory Committee & Technical Advisory Committee, 10/4/09 mtg. (JM) Council Member Mackenzie confirmed his attendance at this combined meeting and reported on the items listed on the agenda provided for this meeting which included: SCWA Water Project Redirection and New Water Supply Strategies; and Summer 2009 Water Contractor Statistics including review of Water Conservation Programs. He noted that the Water Issues Subcommittee meets this Thursday at noon. Mayor Breeze left the Chamber during the above report at 9:04 p.m. with Mayor Pro Tempore Belforte presiding over the meeting during the Mayor's absence. b. Mayors' & Councilmembers' Association, 10/8/09 mtg. (GB /JM) Vice Mayor Belforte confirmed that she and Council Member Mackenzie attended the Board of Directors Meeting and the General Membership Meeting of the Mayors' and Councilmembers' Association. She reported on the items listed on the agendas provided for these meetings which included discussion at the Board of Directors Meeting on whether or not to support the Sonoma County Agricultural Preservation and Open Space District's Matching Grant Program. This item was tabled and there will be presentations to all the City Councils to review this Matching Grant Program. She advised Gus Walter from Cloverdale was appointed to the North Coast Rail Authority. The General Membership Meeting included a presentation by Walter Kieser on "Responding to Economic and Fiscal Stress — a New Paradigm for Cities ". A copy of this report was provided for distribution to the full Council. There was also a Golden Gate Bridge District Update on transit buses. Mayor Breeze returned to the meeting during the above report at 9:14 p.m. and resumed presiding over the meeting. 11. COMMUNICATIONS Council Member Stafford called attention to an invitation from Rancho Cotate High School to attend the RCHS Homecoming Parade this Saturday at 10:00 a.m. to take place on Snyder Lane between the High School and the Creek Side Middle School. 12. MATTERS FROM /FOR COUNCIL 1. Calendar of Events — Mayor Breeze brought attention to this item, provided for informational purposes. 2. City Council Agenda Forecast - Mayor Breeze brought attention to this item provided for informational purposes. 3. AB 939 Local Task Force Representative - Consideration of Nomination for Appointment a. Council discussion /direction /action — Discussion included acknowledgment of one application received to date from Dawna Gallager; previous Council agreement Minutes of the City of Rohnert Park CONCURRENT MEETINGS (8 of 10) October 13, 2009 _ for City Council /Community Development Commission / Rohnert Park Financing Authority to hold this vacancy open longer to provide the opportunity for more applications; and concluded in COUNCIL CONCURRENCE that this application process will be closed October 26, 2009 and Council would make a decision on its nomination for this appointment at one of the next two regular City Council meetings. 4. Other informational items: a. Local Agency Formation Commission ( LAFCO) — Council Member Stafford called attention to the LAFCO meeting held last week and advised that the Wilfred /Dowdell area was annexed to Rohnert Park. City Attorney Kenyon left the Chamber at 9:14 p.m. b. Rohnert Park Chamber of Commerce — Council Member Stafford called attention to the Chamber of Commerce Membership Meeting held last week which included recognitions as follows: Dr. Robert Eyler at Sonoma State University as Outstanding Community Business Leader of the Year; Costco as Business of the Year; and Sonoma Mountain Village as Economic Development Leader of the Year. c. Sonoma Mountain Village Wine Festival — Council Member Stafford called attention to this event that took place on Sunday at the Double Tree Plaza. d. Education Foundation Sock Hop — Council Member Mackenzie called attention to this event he and his wife attended Saturday night at the Double Tree and noted that Assembly Member Jerod Huffman attended with his daughter. e. Biggest Loser/National TV Show — Mayor Breeze called attention to the send off she attended recently for two contestants, Sam and Koli Poueu, Rohnert Park residents, who are going to be on the 2010 National TV Show, Biggest Loser, to be aired January 2010. City Attorney Kenyon returned to the meeting at 9:17 p.m. f. Mayor officiated at wedding — Council Member Callinan commended Mayor Breeze on officiating at a wedding recently. g. Walk and Roll to School Day at Monte Vista Elementary School — Council Member Mackenzie commended individuals involved in the success of this event last week and noted they are hoping all schools will participate next year. 13.
