The City Council of the City of Rohnert Park met this date for Regular Concurrent Meetings of
the Rohnert Park City Council, Community Development Commission of the City of Rohnert
Park, and Rohnert Park Financing Authority, scheduled to commence at 6:00 p.m. at the Rohnert
Park City Hall, 130 Avram Avenue, Rohnert Park, with Mayor Breeze presiding.
1. CITY COUNCIL REGULAR MEETING - Call to Order /Roll Call
CALL TO ORDER — The Regular Meeting of the City Council of the City of Rohnert
Park was called to order by Mayor Breeze at 6:04 p.m.

2. PLEDGE OF ALLEGIANCE
Camryn Ellis, 5th Grade Student, Evergreen Elementary School, led the Pledge of Allegiance.
Mayor Breeze presented Camryn with a card and pen.
3. SSU STUDENT REPORT - Sonoma State University Associated Students, Inc., Student
Report by Jesse Schwartz, SSU ASI Legislative Representative.
Mayor Breeze advised the SSU Student Representative was not able to attend tonight's
Council meeting. In his absence, Mayor Breeze shared contents of his written report

distributed at the Council meeting which included recently appointing an Ad -hoc
Committee at SSU to address issues related to the City's Parking Permit Program and
current efforts involved in its mission to mitigate the impact of SSU commuter parking on
local residents.
4. CITY MANAGER / CITY ATTORNEY / DEPARTMENT HEAD BRIEFINGS
1. Sonoma County Waste Management Agency (SCWMA) Report - Interim City
Manager Schwarz reported on the SCWMA meeting he attended last week as the City's
Representative on this Board which included, by a three to two vote they did not support
divestiture; proceeded with how to hire a new director; and advised he was appointed to
a sub - committee for this recruitment process.
2. Sales Tax Trends - Interim City Manager Schwarz reviewed the two reports prepared
by the City's Sales Tax Consultant, Jerry Peeler of MuniServices, for Sales Tax Trends
for Rohnert Park regarding (1) Historical Amounts by Quarter and (2) Historical
Amounts by Benchmark Year. Mr. Schwarz and Director of Administrative Services
Lipitz responded to Council questions on these reports.
3. Housing Element — Planning Manager Ponton reported on the recent approval of
Rohnert Park's Draft Housing Element by HCD (Housing Community Development of
the State of California). She commended this feat in today's market place noting that
Rohnert Park is one of 5 cities of 110 that has reached approval by HCD. She reviewed
the next steps of the process toward getting the final certification letter and confirmed
this is for a 7 year program.
4. SWAT FIRE EMS Director of Public Safety Masterson reviewed two publications
distributed at the Council meeting entitled SWAT FIRE EMS/Urban Shield Goes
International: (1) Year Book 2009 & (2) Final Exercise.
5. Cambridge Who's Who recognition of Judy Hauff — Interim City Manager Schwarz
shared contents of recent press release distributed at the Councif meeting from
Cambridge Who's Who recognizing Judy Hauff, Clerk for the City of Rohnert Park, for
excellence in municipal services and celebrating 21 years of professional success.
5. PUBLIC COMMENTS
Mayor Breeze invited public comments at 6:32 p.m. No one responded.
6. CONSENT CALENDAR
Mayor Breeze advised that all items on the consent calendar were to be considered together
by one action of the Council unless any Council Member or anyone else interested in a
consent calendar item had a question about the item.
Mayor Breeze pulled Resolution No. 2009 -114.
1. Approval of Minutes for:
a. City Council Portion of Regular Concurrent meetings — September 22, 2009.

b. City Council Special Meeting — October 13, 2009.

2. Acceptance and Approval of City Bills /Demands for Payment.
3. Acceptance of Cash/Investments Report for Month Ending September 2009.
4. Resolutions for Adoption:
a. 2009 -113 Approving the Form of and Authorizing the Execution and Delivery
of a Purchase and Sale Agreement and Related Documents with
Respect to the Sale of the Seller's Proposition 1A Receivable from the
State; and Directing and Authorizing Certain other Actions in
Connection Therewith.
c. 2009 -115 Approving Job Description and Salary Range for Meter Technician
and Authorizing Recruitment of the Position.
d. 2009 -116 Authorizing and Approving a Settlement Agreement Relating to
Stutrud V. City of Rohnert Park (Sonoma County Superior Court No.
SCV- 237482.
e. 2009 -117 Approving a One -Year Extension of Temporary Debris Box Franchise
Agreements with Rohnert Park Disposal, Inc. and Industrial Carting.
MOTION by Council Member Stafford to adopt the Consent Calendar with the
exception of Resolution No. 2009 -114, seconded by Council Member Mackenzie, and
CARRIED UNANIMOUSLY, reading was waived and the Consent Calendar with
stated exception was APPROVED.

Lands Modular Buildings Removal Project, City Project No. 2009 -07
and Awarding the Contract to Delta Oilfield Services Inc.
Mayor Breeze commented on this item. Interim City Manager Schwarz and City
Attorney Kenyon responded to related questions on the progress of the option
agreements for the purchase of the Stadium Lands, which Mayor Breeze indicated to
have on the record, that the option date is December 31, 2009; the City is moving
forward with them; and it is anticipated the City will do everything that is required of
the City on the agreement by then.
MOTION by Council Member Callinan to adopt Resolution No. 2009 -114, seconded
by Vice Mayor Belforte, and CARRIED UNANIMOUSLY, reading was waived and
Resolution No. 2009 -114 was APPROVED.

7. EXECUTIVE RECRUITMENT SERVICES — Presentations by previously selected
finalists for executive recruitment services to assist in recruiting a City Manager and
potential selection of firm.
1. Staff Report/Interviews - City Attorney Kenyon reviewed the staff report provided for
this item regarding the process leading up to the previous Council selection of the top
three proposals concluding in the presentations scheduled at this Council meeting.
a. Alliance Resource Consulting, Inc. — Sherrill Uyeda, Senior Partner, Alliance
Resource Consulting, Inc., distributed an informational booklet to Council and
made this presentation. She responded to Council questions
b. Ralph Anderson & Associates —Jeff Foltz, Project Director, Ralph Anderson &
Associates, distributed a revised report and revised project cost and made this
presentation. He responded to Council questions.
c. Peckham & McKenney —Bobbi Peckham, Partner, Peckham & McKenney,
provided an overview of background experience and qualifications for this
presentation. She responded to Council questions.
2. Public Comments — Mayor Breeze invited public comments at 7:45 p.m. on this item.
No one responded.
3. Council discussion /direction /action
a. Council motion by Council Member Mackenzie for recruitment of the City Manager
to hire the firm of Peckham & McKenney in an amount not to exceed
$22,500 including expenses with all due haste, I seconded by Council Member
Stafford.
b. Council discussion ensued.
c. Council vote on the motion on the floor CARRIED 3 — 2 with Council Member
Callinan and Mayor Breeze dissenting, to hire the firm of Peckham & McKenney
for recruitment of the City Manager in an amount not to exceed $22,500 including
expenses was APPROVED.
Council Member Mackenzie left the Chamber at 8:01 p.m.
8. MOBILE HOME PARKS RENT APPEALS BOARD APPOINTMENT — Consideration
of Council appointment to fill one current vacancy on the Mobile Home Parks Rent Appeals
Board for completion of a two (2) year term expiring December 31, 2009 as follows:
1. Due to Lorna Blanc recent resignation (Formerly VVM nomination/will be GB or JC)
a. Council discussion /direction /action
Vice Mayor Belforte nominated Patrick Reymond to fill this vacancy. COUNCIL
CONCURRED with the exception of the absence of Council Member Mackenzie.
Administrative correction inserted 1/11/10 by City Clerk Hauff to include the seconder of the motion inadvertently
omitted from hard copies of these minutes initially distributed, as confirmed by the Clerk's review of the video of

9. STANDING COMMITTEE / AD HOC COMMITTEE / LIAISON REPORTS
1. Standing Committees
Council Member Mackenzie returned to the meeting during the next report at 8:05 p.m.
a, Water Issues, 10/15/09 mtg. (JM /PS)
Council Members Stafford and Mackenzie confirmed their attendance at this
meeting and reported on items listed on the agenda provided for this meeting which
included: successful work along the Laguna by youth crews; suggestion to increase
water fees to fund capital projects and request for input from contractors on this;
and next Monday the Water Advisory Committee will meet with the Technical
Advisory Committee and other members of the Water Budget Subcommittee to
review current. funding concerns for projects and specific tasks and timelines
needed.
b. Economic Development, 10/21/09 mtg. (AB /GB)
Mayor Breeze and Vice Mayor Belforte confirmed their attendance at this meeting
and reported on items listed on the agenda provided for this meeting which
included: (1) Economic Development Monthly Update by Roy Gugliotta, President
and CEO, of the Chamber of Commerce and (2) CDC Budget Update.
2. Liaison Reports
a. Rohnert Park - Cotati Regional Library Advisory Board, 10/20/09 mtg. (GB)
Vice Mayor Belforte advised she was unable to attend this meeting due to an illness
in her family.
b. Association of Bay Area Governments (ABAG) Fall General Assembly,
10/22/09 (PS /JM) — Council Members Stafford and Mackenzie reported on their
attendance at the ABAG Fall General Assembly which included panel discussions
and keynote speakers pertaining to this year's theme, "Planning and Development
During Economic Downturns: Building New Partnerships ".
10. COMMUNICATIONS
Council Member Mackenzie called attention to Press Democrat article distributed at
tonight's Council meeting on the recent passing of J. Karla Lemon. He shared comments
on Ms. Lemon's background as Conductor of the Sonoma State University Orchestra, and
when SSU decided not to keep the Orchestra, Karla Lemon directed the Performing Arts
Center Orchestra for several years when the Spreckles Performing Arts Center opened in
early 1991.
Vice Mayor Belforte called attention to the publication on Sonoma County Summer Youth
Ecology Corps and commented on the success of this program. Discussion included
Council commending the efforts of this program in Rohnert Park and concluded in
COUNCIL CONCURRENCE for staff to make arrangements for a presentation by this
group on a future Council agenda.

Vice Mayor Belforte called attention to the successful event of the President's Marching
Band with the Marines in Sonoma County last week end. The Rancho Cotate High School
marching band went back east earlier this year and this event provided a great opportunity
for them to see and talk to the Marines marching in the band.
Mayor Breeze called attention to the recent successful Chile Cook Off and Car Show by
Rohnert Park's independent business leaders held at Applebee's parking lot in Rohnert
Park with about 1,100 attendees. Proceeds went to a mentoring program for youth called
"Friends at the Top ".
11. MATTERS FROM/FOR COUNCIL
1. Laguna Conference and Science Symposium, 10/15 &16/09 (JM)
Council Member Mackenzie reported on his attendance at this three day event at
Sonoma Mountain Village by Laguna de Santa Rosa Foundation which included:
review of impacts on species that live in the Laguna and other areas like the Russian
River Watershed due to changes in climate and rainfall patterns; formation of a working
group that will present their concerns; U.S. Geological Survey Study plans to meet with
the Water Agency on these impacts that can be expected with rising temperatures and
changing rainfall; and he represented the City at a mixer at the end of the symposium
with Supervisor Shirlee Zane and other elected officials present.
2. Calendar of Events — Mayor Breeze brought attention to this item provided for
informational purposes. Council Member Mackenzie called attention to the Ad Hoc
Committee meeting listed on November 2nd for Canon Manor Wastewater Collection
Services and advised he notified staff that he had a scheduling conflict so this meeting
needed to be rescheduled.
3. City Council Agenda Forecast — Mayor Breeze brought attention to this item provided
for informational purposes.
4. AB 939 Local Task Force Representative — Consideration of Nomination for
Appointment
a. Council discussion /direction /action
Mayor Breeze acknowledged that three applications were received indicating
interest in this appointment. Discussion included MOTION by Mayor Breeze to
nominate Carl Leivo for the appointment to the AB 939 Local Task Force,
seconded by Council Member Callinan, FAILED 2 — 3 with Vice Mayor Belforte
and Council Members Mackenzie and Stafford dissenting, the nomination of Carl
Leivo for this appointment was NOT APPROVED.
Discussion concluded in MOTION by Council Member Stafford to nominate Chris
Rogers for the appointment to the AB 939 Local Task Force, seconded by Council
Member Mackenzie, CARRIED 3 - 2 with Council Member Callinan and Mayor
Breeze dissenting, the nomination of Chris Rogers for this appointment was
APPROVED.

6. Other informational items:
a. Redwood Empire Municipal Insurance Fund (REMIF) Board Meeting —
Council Member Callinan advised he attended the recent REMIF Board Meeting
and reported the City will receive $52,300 from excess of funds on liability
insurance. There is an excess of $2.1 million eligible to members and there will be
a breakdown provided on this by mid - December.
b. Meeting Industry Ladies Invitational (MILI) — Mayor Breeze advised that she
and Council Member Callinan attended a welcome for MILI on Sunday at the
Foxtail Golf Club. She shared that MILI is a group of ladies that are charged with
finding areas where business meetings can be held and to find places in hotels to
stay. They will be touring around Sonoma County and their schedule included a
tournament today at Fox Tail and dinner tonight at the DoubleTree.
Interim City Manager Schwarz responded to Mayor Breeze's request for a report on
when the banners will be up, that the order has been placed and the banners will go
up as soon as possible when received.
