CALL TO ORDER/ROLL CALL The Joint Special Meeting of the Rohnert Park City Council, Community Development Commission of the City of Rohnert Park, and Rohnert Park Financing Authority was called to order by Mayor Stafford at 5:00 p.m. Present: Pam Stafford, Mayor Gina Belforte, Vice Mayor Arnie Breeze, Council Member Joseph T. Callinan, Council Member Jake Mackenzie, Council Member Staff participating in all or part of this meeting: John Dunn, Interim City Manager; Benjamin Winig, Assistant City Attorney; John McArthur, Director of Public Works & Community Services; Nell Seidenspinner, Recreation Supervisor; Sandy Lipitz, Director of Administrative Services; Linda Babonis, Housing & Redevelopment Manager; Darrin Jenkins, Director of Development Services /City Engineer; and Judy Hauff, City Clerk. Community Media Center staff present for the recording and televised production of this meeting: Video Technicians Josh Jacobsen and Peter Matheny- Schuster. 2. PLEDGE OF ALLEGIANCE — Four members of Girl Scout Troup 116 led the Pledge of Allegiance: Tayler Gomes, Sophia Tiche, and Makenna Mentor Porter, students at Hahn Elementary School, and Allison Wild, student at Monte Vista Elementary School. Mayor Stafford presented each with a novelty pen. 3. PRESENTATIONS A. Mayor's Presentation of a Proclamation Proclaiming that an Award of Recognition for Outstanding Community Service be Presented to Chamber of Commerce Member Costco: Mayor Stafford shared contents and presented the Proclamation to Costco representatives, Rita Partika, Marketing Supervisor, and Dave Renz, General Manager. Mayor's Presentation of a Proclamation Recognizing and Honoring Eric Lu, Scholar / Athlete of the Year: Mayor Stafford shared contents and presented the Proclamation to Eric Lu. C. Sonoma County Tourism Bureau - 2010 /11 Funding Request and Proposed Work Plan: John Dunn, Interim City Manager, provided preliminary comments indicating this item has been scheduled to provide an update on the services of the Sonoma County Tourism Bureau to the City prior to review of the forthcoming contract for renewal of services on a future agenda. Representatives of Sonoma County Tourism Bureau, Jill VandenHeuvel, Communications and Advertising Architect, and Mark Crabb, Director of Sales, reported on this item with samples and responded to Council questions. 4. CITY MANAGER / CITY ATTORNEY / DEPARTMENT HEAD BRIEFINGS A. Preliminary Election Results: Measure E — John Dunn, Interim City Manager, reported on the successful preliminary election results for Measure E on the June 81h Election and related issues to face on the City's budget. Sandy Lipitz, Director of Administrative Services, commented on efforts regarding the City's Budget for Fiscal Year 2010 -11 and Budget Work Sessions expected to be held August 10th and 24th. Discussion ensued with .Council comments commending this effort. Interim City Manager Dunn and Assistant City Attorney Winig responded to Council questions on the upcoming process for implementation of the '/2 cent sales tax resulting from Measure E. B. Rohnert Park Farmers' Market - Nell Seidenspinner, Recreation Supervisor, with John McArthur, Director of Public Works & Community Services, reviewed a power point presentation on the Rohnert Park Farmers' Market scheduled on Friday nights from June 4th through September 24th, commented on success of the first two events, and responded to Council questions. C. City and CDC Budgets - John Dunn, Interim City Manager, commented on upcoming Consent Calendar City Council and Community Development Commission resolutions on authorizing expenditure of funds prior to the adoption of Fiscal Year 2010 -11 budgets. 5. PUBLIC COMMENTS — Mayor Stafford invited public comments at 5:40 p.m. A. Jessica Holman shared comments supporting the upcoming Rancho Cotate High School (RCHS) Homecoming Parade. She recognized numerous RCHS representatives present in the audience and introduced Alana Nelson, Entertainment Commissioner and Entertainment Coordinator, who reported on the RCHS Homecoming Parade to be held October 9, 201.0. B. Kate Caldwell shared comments in support of the Sonoma County Tourism Bureau. C. Shelly Nelson shared comments in support of the Sonoma County Tourism Bureau. CONSENT CALENDAR Council Member Breeze pulled Resolution No. 2010 -61 (Item No. 6.C.2) A. Approval of Minutes for: 1. City- CDC -RPFA Joint Regular Meeting— May 25, 2010 B. Acceptance of Reports for: 1. City Bills /Demands for Payment 2. CDC Bills /Demands for Payment C. City Council Resolutions for Adoption: 1. 2010 -60 Authorizing the Expenditure of Funds Prior to the Adoption of the Fiscal Year 2010 -11 Municipal Budget 3. 2010 -62 Approving and Adopting the Project Plans and Specifications for the Replacement of Park LED Lights and Light Poles and Authorizing to Solicit Bids for the Project D. CDC Resolution for Adoption: 1. 2010 -09 Authorizing the Expenditure of Funds Prior to the Adoption of the Fiscal Year 2010 -11 CDC Budget ACTION: Moved (Callinan), seconded (Belforte), and carried unanimously to approve the Consent Calendar with the exception of Item No. 6.C.2 for Resolution No. 2010 -61. Item Removed from Consent Calendar: C. City Council Resolution for Adoption: 2. 2010 -61 Approving Waiver of Encroachment Permit Fees for Rancho Cotate High School Homecoming 2010 Parade to Be Held October 9, 2010 Council Member Breeze shared comments expressing support of this item and encouraging fundraising ideas due to the City's current budget constraints. Discussion ensued. ACTION: Moved (Breeze), seconded (Belforte), and carried unanimously to adopt Resolution No. 2010 -61 as amended to include language for an additional "whereas ", to be properly drafted by the Assistant City Attorney, indicating that the Rancho Cotate High School leadership program has committed to conduct fundraising activities to help with the cost of this waiver. COMMUNITY DEVELOPMENT COMMISSION: FINANCING PLAN Approval of the Community Development Commission Financing Plan John Dunn, Interim Executive Director, provided preliminary comments on this item including reference to extensive review on defeasance and restructuring of bonds at the April 27th meeting and effects of the recent state raid on redevelopment funds. A. Staff Report — Sandy Lipitz, Director of Administrative Services, and Linda Babonis, Housing & Redevelopment Manager, reviewed this report via power point presentation and responded to Commission questions. Vice Mayor Belforte indicated that she needed to abstain from this subject due to her position and role with Sonoma County Adult and Youth Development (SCAYD). B. Public Comments — Mayor Stafford opened public comments for this item at 6:20 p.m. No one responded. C. ACTION: Moved (Mackenzie), seconded (Breeze), and carried 4 -0 -1 abstained (Belforte), as recommended by staff, to approve the Community Development Commission to use the recommended portions of the interest on the 2007R bonds ($1.2M) and H bonds ($100,000) toward debt service payments and to make a one -time transfer of $500,000 from the Project Fund to the Housing Fund for housing obligations. 8. COMMUNITY DEVELOPMENT COMMISSION: FISCAL YEAR 2010 -11 FUNDING REQUESTS - Consideration by the Community Development Commission of Fiscal Year 2010 -11 Funding Requests by Committee on the Shelterless (COTS), Sonoma County Adult and Youth Development (SCAYD), and Rebuilding Together Rohnert Park - Cotati A. Staff Report - Linda Babonis, Housing & Redevelopment Manager, with Sandy Lipitz, Director of Administrative Services, reviewed this report and responded to Commission questions. Vice Mayor Belforte indicated she needed to abstain from all three of the resolutions being considered for this item due to her role on SCAYD. Vice Mayor Belforte left the dais at 6:30 p.m. to be recused from this item. B. Public Comments — Mayor Stafford invited public comments on this item at 6:33 p.m. 1. Diane Broadhead of Rebuilding Together expressed appreciation for past support and encouraged continued support. 2. Brian Goodman of Rebuilding Together shared reasons for needing continued support. 3. Gina Belforte, as a member of the public, shared reasons urging Council to fund 100% of the funding requests for this item due to the needs of these non - profits. CDC Resolution for Adoption: 1. 2010 -10 Authorizing and Approving Amendment No. 11 to the Agreement with Committee on the Shelterless (COTS) to Provide Management Services of CDC -owned Shared Living Housing and a COTS- leased Transitional Home on Alma Street and Authorizing CDC Financial Assistance ACTION: Moved (Mackenzie), seconded (Breeze),. and carried 4 -0 -1 absent /recused (Belforte), to adopt CDC Resolution No. 2010 -10 as submitted Authorizing and Approving Amendment No. 11 to the Agreement with Committee on the Shelterless (COTS). 2. 2010 -11 Authorizing and Approving Amendment No. 8 to the Agreement with Sonoma County Adult and Youth Development (SCAYD) to Provide Homeless Prevention Services for Households at Risk of Becoming Homeless Due to Temporary Financial Hardship ACTION: Moved (Mackenzie), seconded (Callinan), and carried 3 - 1 dissenting (Stafford) -1 absent /recused (Belforte), to adopt CDC Resolution No. 2010 -11 as submitted Authorizing and Approving Amendment No. 8 to the Agreement with Sonoma County Adult and Youth Development (SCAYD). 3.2010 -12 Approving Funding for Rebuilding Together Rohnert Park - Cotati (Rebuilding Together) Home Rehabilitation Services for Low and Very Low Income Homeowners of Rohnert Park ACTION: Moved (Mackenzie), seconded (Callinan), and carried 3 - 1 dissenting (Stafford) -1 absent /recused (Belforte), to adopt CDC Resolution No. 2010 -12 as submitted Approving Funding for Rebuilding Together Rohnert Park - Cotati (Rebuilding Together) Home Rehabilitation Services for Low and Very Low Income Homeowners of Rohnert Park Vice Mayor Belforte returned to the dais at 6:45 p.m. 9. SONOMA COUNTY WATER AGENCY (SCWA) WATER SUPPLY STRATEGY ACTION PLAN Review of the Sonoma County Water Agency (SCWA) Water Supply Strategy Action Plan (Plan) and consideration of providing comments to SCWA regarding the Plan John Dunn, Interim City Manager, provided preliminary comments on the letter drafted by staff for this item. A. Staff Report - Darrin Jenkins, Director of Development Services /City Engineer, reviewed this report and responded to Council questions. B. Public Comments — Mayor Stafford invited public comments on this item at 7:00 p.m. 1. Michael Newell, Santa Rosa resident and works at Valley House Drive, commented on water levels and restrictions pertaining to this item. Director of Development Services Jenkins responded to further questions on this item pertaining to dealing with costs in the future related to the Endangered Species Act. ACTION: Moved (Mackenzie), seconded (Belforte), and carried unanimously to send the above - reviewed letter as drafted over the Mayor's signature to the Sonoma County Water Agency regarding the Water Supply Strategy Action Plan. 10. STANDING COMMITTEE / AD HOC COMMITTEE / LIAISON REPORTS A. Standing Committee Reports 1. Economic Development, 6/2/10 mtg. (PS /GB) Vice Mayor Belforte and Mayor Stafford reported on this meeting. B. Ad Hoc Committee Reports — none C. Liaison Reports 1. Mayors' and Councilmembers' Association, 6/10/10 mtg. (PS /GB /JC /JM) Mayor Stafford reported on this meeting attended by all Council Members and staff. Each Council Member separately shared comments commending this meeting and the Green Music Facility. Council agreed with suggestion by Council Member Callinan to send a letter over the Mayor's signature expressing appreciation to Sonoma State University for their efforts preparing for this meeting, commending the Green Music Facility and success of this event. , 2. Chamber of Commerce Board of Directors, 6/15/10 mtg. (PS) Mayor Stafford advised she was not able to attend this meeting. 3. Solid Waste Advisory Group Mayor Stafford reported that this Group met a week and a half ago. D. Other Reports 1. Economic Briefing Breakfast, 6/11/10 mtg. (PS) Mayor Stafford and Vice Mayor Belforte reported on this meeting. Interim City Manager Dunn commented on staff efforts on the budget for this session. 2. Sonoma County Transportation Authority /Regional Climate Protection Authority (SCTA/RCPA), 6/14/10 mtg. (JM) - Additional Liaison Report: Council Member Mackenzie reported on this meeting. He indicated the need to schedule an item on the June 22"d City Council agenda on the proposed ordinance for the vehicle registration fee (VRF) ballot measure to receive Council direction on how to vote on this item at the July 12th SCTA/RCPA meeting. 3. Rancho Cotate High School 43rd Graduation Vice Mayor Belforte commented on the success of this recent event. 4. Rancho Cotate High School Girls' Softball Team Mayor Stafford shared that this team came in second recently in the North Coast Playoffs and commended their efforts. Rancho Cotate High School - Project Graduation Mayor Stafford commended the success of this recent event, appreciated all the volunteers that helped, and commended fundraising and decorating efforts. 6. Best Friends Canine Event Mayor Stafford commended this recent event. 11. COMMUNICATIONS Council Member Breeze called attention to recent letter from resident regarding the sound wall in M Section and was pleased to hear staff is working on a response. Interim City Manager Dunn confirmed the letter responding to this matter will be prepared for the Mayor's signature. 12. MATTERS FROM/FOR COUNCIL A. Calendar of Events Mayor .Stafford called attention to the Choir Performance at the Senior Center on Saturday, June 26th B. Wal -Mart Appeal Hearing — Consideration of appropriate date for the Wal -Mart Appeal Hearing (PS) - Interim City Manager Dunn explained the memo provided for this item. ACTION: Council agreed July 29, 2010 would be the best date for this hearing, indicated starting the meeting at either 5:30 or 6:00 p.m., and requested the City Manager to check further on location options for this meeting. C. Other informational items 1. Code Enforcement item — Council Member Callinan asked if this item could be placed on a future agenda for consideration. Discussion concluded in Council agreement that this item be considered during upcoming budget reviews. 2. Public Facilities Finance Plan — Council Member Callinan indicated attending a meeting on this item last week with Director of Community Services /City Engineer Jenkins and requested an update at the next Council meeting. Interim City Manager Dunn responded staff was prepared to report on this tonight or it could be agendized for the next meeting. Council Member Callinan expressed the preference for this item to be agendized. 3. City Manager's Contract — Council Member Callinan requested an update on this item. Mayor Stafford responded that Council Members received an email message on this matter earlier today. Assistant City Attorney Winig responded to further questions from Council Member Callinan on this matter.
