CITY COUNCIL, CDC & RPFA JOINT REGULAR MEETING - Call to Order /Roll Call Mayor Stafford called this meeting to order at 6:00 p.m. Present: Pam Stafford, Mayor Gina Belforte, Vice Mayor Arnie Breeze, Council Member Joseph T. Callinan, Council Member Absent: Jake Mackenzie, Council Member (out of town on business in Washington, D.C.) Staff and /or consultant participants: Daniel Schwarz, Interim City Manager; James J. Atencio, Assistant City Attorney; Sandy Lipitz, Director of Administrative Services; Darrin Jenkins, Director of Development Services; John McArthur, Director of Public Works & Community Services; Brian Masterson, Director of Public Safety; and Judy Hauff, City Clerk. Community Media Center staff present for the recording and televised production of this meeting: Josh Jacobsen, Video Technician and Josh Cimino, Video Technician. 2. PLEDGE OF ALLEGIANCE - Led by Zoe Keller, Student, Waldo Rohnert Elementary School, led the pledge of allegiance. Mayor Stafford presented Zoe with a card and a pen. 3. SSU STUDENT REPORT - Jesse Schwartz, SSU ASI Legislative Representative, Sonoma State University Associated Students, Inc. introduced Sean Richards, ASI Senator for Social Sciences, who provided the SSU Student Report on current activities at SSU. 4. PRESENTATIONS 1. Proclamation Recognizing Lindsay Catton for SSU All American Women's Soccer Award Mayor Stafford shared contents of this proclamation and presented it to Lindsay Catton. Proclamation Declaring April 2010 as Big Read, Sonoma County Month in Rohnert Park Mayor Stafford recognized representatives present at this Council meeting, who are promoting this item for the local public broadcaster KRCB, Rick Robison and Cheryl Scholar, Windsor Council Member. Mayor Stafford shared contents of the proclamation and called attention to the Big Read book markers and pamphlets on the table at the entrance of the Council Chamber available for people to take, which include the message on choosing The Adventures of Tom Sawyer as the featured Big Read Sonoma County book. 3. Recognition of Lauren D. Anderson, D.D.S. for being the longest standing member of the Chamber of Commerce — Mayor Stafford shared contents of the proclamation for this item and presented it to Dr. Lauren Anderson. Dr. Anderson expressed appreciation for this recognition, shared examples of past experiences, commended current efforts of City Council, and acknowledged following Lindsay Catton's success at SSU with soccer. 4. Acknowledging the Rohnert Park Warriors Cheerleading Squad for winning First Place at the National Competition in Southern California at Disneyland — Mayor Stafford advised there was a scheduling conflict on this item and indicated this recognition .would be deferred until the April 13, 2010 City Council meeting. 5. CITY MANAGER / CITY ATTORNEY / DEPARTMENT HEAD BRIEFINGS 1. Ballot Measure E — Revenue Enhancement — Interim City Manager Schwarz acknowledged that the City Council voted recently to put this measure on the ballot. He advised that word has been received from the Sonoma County Registrar of Voters that this has been assigned Measure E f6r the June 8, 2010 Election. 6. PUBLIC COMMENTS — Mayor Stafford invited public comments at 6:20 p.m. 1. David Grundman, resident, reviewed his letter and attachments provided at the dais regarding concerns about Public Safety costs in Rohnert Park. 2. Tim Danesi, resident, shared comments regarding his efforts on a new project Arcadia Publishing has asked him to do for a history book to compile photos from Rohnert Park and the surrounding rural areas to be completed next year. He indicated the need to collect photographs and stories related to the photos and that he would be doing many things to inform the public about this project. He shared contents of the flyer prepared for this project which was provided to City Council at the dais and available for others on the table at the Chamber entrance. Mr. Danesi noted the flyer contained contact information to reach him and information on this project is also available on their website at www.rphist.org. 3. David Patton, resident, shared examples commending the efforts of Rohnert Park's Public Safety Department including reasons for not being able to put an amount of money on how their job is being done and urging Council to retain the City's Public Safety Officers. 4. Shirley Patton, resident, commented on her recent visit with the Federated Indians of Graton Rancheria (FIGR) and her attendance at a town hall meeting last night with three City Council Members present. She shared portions of an informational brochure Minutes of the City of Rohnert Park JOINT REGULAR MEETING Q of 10) March 23, 2010 _for City Council /Community Development Commission /Rohnert Park Financing Authority reviewing FIGR contributions to the City outlined in the Memorandum of Understanding (MOU) with the City and an overview of the final Environment Impact Study (EIS) Report. She expressed appreciation of the FIGR contributions to the City, urged being a good neighbor with them, and signified the importance of the City keeping its public safety officers until the casino comes knowing there will be a need to hire officers again in the future. 7. CONSENT CALENDAR Mayor Stafford advised all items on the consent calendar were considered together by one action of the City Council, the Community Development Commission, and /or the Rohnert Park Financing Authority, whichever is applicable, with ROLL CALL VOTE due to an Ordinance listed for adoption, unless any Council Member or anyone else interested in a consent calendar item had a question about the item. Council Member Breeze pulled Resolution No. 2010 -25. Vice Mayor Belforte pulled item 1.a on the joint regular meeting minutes. 1. Approval of Minutes for: b. City Special Meeting — March 12, 2010 2. Minutes of the City of Rohnert Park JOINT REGULAR MEETING (4 of 10) March 23, 2010 for City Council /Community Development Commission / Rohnert Park Financing Authority Items for consideration 1. Approval of Minutes for: a. City- CDC -RPFA Joint Regular Meeting — March 9, 2010 Vice Mayor Belforte referred to page 3, item 3.a of these minutes regarding the adoption of Resolution No. 2010 -20 on Council "approving a budgeted amount for the Director of Public Safety's salary for the next three years including a six month severance that equals about $80,000 ". She stated that in light of this information provided in the minutes along with the recent article in the Community Voice and the communication received recently from a resident on this matter, asked if the Interim City Manager could go over the actual terms of the contract to be reflected in tonight's meeting minutes. With consent to proceed indicated by Mayor Stafford, Interim City Manager Schwarz referred to the correspondence received from a resident and his response on this matter, as listed on Council Communications and provided to Council in the agenda packet for this evening's meeting. Mr. Schwarz shared that there seems to be an interpretation from residents that Chief Masterson is receiving an increase in pay and that is absolutely not the case. He reviewed the key points noted in the staff report provided for this item and discussed at the last Council meeting which included: 1) the contract actually formalizes the Chief's current salary; 2) the contract also provides that the Chief is going to pay the employee cost to fund his pension, so in effect, the Chief is taking a 9% cut in pay, which didn't seem to come out based on the letter the city received; and 3) regarding the confusion about the severance clause, the severance clause is a contractual arrangement, where if the city wants to release an employee without cause, then it can do that if it so chooses, so the severance does calculate to roughly $80,000 but it has no value provided the Chief continues to fulfill his contract in the good standing that is anticipated. Vice Mayor Belforte requested for the record that the above review of this contract by the Interim City Manager be reflected in the minutes of tonight's Council meeting. Consent of this request was indicated by Mayor Stafford. MOTION by Vice Mayor Belforte to approve the City- CDC -RPFA Joint Regular Meeting Minutes of March 9, 2010 as submitted, seconded by Council Member Callinan', CARRIED 4 — 0 — 1 with Council Member Mackenzie absent, reading was waived and said motion was APPROVED. 3. City Council Resolutions for Adoption: c. 2010 -25 Approving the Summary of Terms and Conditions of the Tentative Agreement with the Rohnert Park Public Safety Managers' Association (RPPSMA) Council Member Breeze expressed the preference to hold off on the approval of this agreement until the final agreement is available for review. Discussion included responses to Council questions on this item by Interim City Manager Schwarz and concluded in Council agreement to DEFER this item until the final agreement is available. I AMENDMENT made administratively by City Clerk, following review of the video of the March 23, 2010 City Council meeting, to include the seconder of the motion inadvertently omitted from these minutes. CITY BUDGET FY 2010/11 - Consideration of options for additional budget cuts 1. Staff Report — Interim City Manager Schwarz and Director of Administrative Services Lipitz reviewed the staff report provided for this item via power point presentation and responded to Council questions throughout the presentation. Discussion following the staff report included comments for the record indicated by Council Member Callinan as follows: "We have this on our agenda tonight and it recommends seven sworn officer positions and I don't think that we have made sufficient cuts in our budget. We have done good but still have some more cuts. I made suggestions a month ago at our meetings and Council decided not to go with those. Some of those are attorney fees where I feel we are spending way too much money. We spent $1.2 million last year on attorney fees. I suggested we cut that way down. The Council majority decided to make $65,000 cut on that. I still think we have room to make cuts for that. I'm going to just give you a quick small example. We are in the process of a city manager recruitment and we've had our attorney at two meetings, attend both meetings, five to six hour meetings, sitting in the corner which I don't feel we need. We're paying her $300 an hour for her to babysit us and I don't think, and don't get me wrong, I think our attorney does a great job, but we shouldn't be giving her direction to do that. That's just one example and there's many things our attorney does that we could be saving money at. Consultants, in this report we got tonight it says that we cut our consultants. Our Council majority hired two consultants that I can think of for about $200,000, the Lew Edwards Group for our tax measure and the city manager recruitment. Both of those could have been handled by the Council. I think that we're still spending too much money on things like that. I suggested, or I don't know if Councilwoman Breeze suggested it, suggested our Assistant City Manager that's been vacant for two years. That's $160,000. That's almost two police officers right there. If it comes down to it, I would say stay status quo. Leave our Interim City Manager where he sits. We don't need to hire an assistant city manager right now. Get that $160,000 back into our budget. There's two police officers. You know it's not mandatory that we go out and hire somebody right now. I'd rather have a police officer than an assistant city manager. I feel strongly about that. We signed a three year contract just recently for our Police Chief and, again, Mr. Masterson is doing a great job and I am behind him 100% but we don't have the right to give him a three year contract when we're asking all of our other employees to take pay cuts. I don't think we can guarantee him three years that we can pay him that salary. The way the economy is and everything, I don't understand that and I did not vote for that and I think that is money we should be looking at. Our outside contracts, I don't think that we have looked at all of our outside contracts enough. We have services that people rent from us that maybe we need to up our fees that we charge these people. We haven't done that in a long time. ,We need to look at some of that stuff. One of my suggestions was a $300,000 reduction in Public Safety Department without any layoffs. I repeat without any layoffs. We gave them a task, I think it was a year ago, almost a year and a half ago, $3.5 million. They rose to the occasion and made the cuts where they needed to. I think if we asked them they could find a little bit more. I asked for $300,000 and the Council majority said no. I lowered it to $150,000. Council majority said no. At the next meeting, Police Chief comes back and says, "I can give you $150,000." It's out there. I know that they stretch it. There may be some things that they have to put off, maybe some of the stuff they do like the special training. I think that they are doing an excellent job at what they do, so I think that. if we ask them and give them a number, I think they can come up with something. Engineering Department, I don't know if we took a look at that. I know that Darrin does a great job in the Engineering Department but three years ago we had five employees in the Engineering Department and now we have eight. We just got rid of one but we still have seven. We have not done any new building or business in that Engineering Department in the last two years that I know of so I'm thinking I would rather have a sworn officer on the streets than someone sitting up in City Hall in Engineering. That's just my perspective. Finance Department. We have eleven people in the Finance Department. You know what, we've got to go bare bones. We've got to collect money and pay our bills. That's all we've got to do. You know we can't do internal audits and I'm a firm believer in that and I suggested that when I first was elected to this Council, but it's bare bones time. We need to cut down to exactly what we need to do and get the job done to collect our money and pay our bills and call it a night. I'd rather have that done than cut officers. Going back to the Police Department, I asked for $100,000 cut in the unanticipated facility maintenance. I was told that's for a roof on our building. That roof is still sitting there and we haven't spent a dime on it but that money's still there. So I know there's money in that Public Safety Department that they can find and I know if they dig hard that they will find it. I have asked upper management to take a 15% pay cut like our neighboring City of Cotati has done. It hasn't been done and I think that needs to be done. We need to follow by example. Recently we had a murder in town and we haven't had one in a while. I praise our Public Safety Department. Within three days we had that murder resolved and we had an arrest. That is good work. Kudos to them. Two days ago we had a hostage situation over at Motel 6. We got a phone call from our Interim City Manager telling us about that and thank Dan for that. Within hours a deadly situation was resolved. No one was hurt. Two gentlemen walked out of that hotel with their hands up. Great job again. There's so many things that I think that we need to look at. We get everybody saying we need to reduce our work force, we need to reduce police, until that one time when you dial 9 -1 -1, and then all of a sudden they can't get there quick enough. I will not be voting for any reduction in Police Department Public Safety layoffs. I think there are so many other cuts that we still need to do and we can do and I praise this Council for what we have done but there is still more stuff that we can dig up without laying off our police officers. Thank you." Further discussion following the staff report included MOTION by Council Member Callinan to put hiring of a new city manager on hold and to freeze the assistant city manager position, seconded by Council Member Breeze. Discussion ensued. The motion on the floor FAILED 1 — 3 — 1 with Vice Member Belforte, Council Member Breeze and Mayor Stafford dissenting, and Council Member Mackenzie absent, said motion was NOT APPROVED. 2. Public Comments Mayor Stafford invited public comments on this item at 7:50 p.m. No one responded. Council discussion /direction /action — Discussion included: MOTION by Council Member Breeze for the top 15% of the wage earners to come together and come back with a percentage that they would like to give back in their salaries, seconded by Council Member Callinan. Discussion included friendly amendment by Mayor Stafford to change the motion to indicate the top 20% of the wage earners, accepted by the maker and seconder of the motion, CARRIED 4 — 0 — 1 with Council Member Mackenzie absent, said motion was APPROVED. MOTION by Council Member Callinan to ask the Public Safety Department to make $200,000 more cuts in its budget without layoffs, seconded by Council Member Breeze. Discussion ensued including responses to Council questions on this item by Interim City Manager Schwarz, Director of Public Safety Masterson and Director of Administrative Services Lipitz. The motion on the floor FAILED 2 — 2 — 1 with Vice Mayor Belforte and Mayor Stafford dissenting and Council Member Mackenzie absent, said motion was NOT APPROVED. MOTION by Vice Mayor Belforte to take some of the suggestions made this evening and bring them back to the next Council meeting to consider options and alternatives, DIED for lack of a second. Discussion ensued. 9. REVENUE ENHANCEMENT AD HOC COMMITTEE REPORT (AB /JM) 1. Discussion of Flyer for Ballot Measure E Council Member Breeze indicated this ad hoc committee met recently here at City Hall regarding preparation of the flyer for Ballot Measure E. She explained the flyer displayed at the dais and indicated it would be mailed out sometime this week. Mayor Stafford shared that Interim City Manager Schwarz provided a report recently to the seniors on Measure E with good reception from the seniors. RECESS: Mayor Stafford recessed this meeting at 8:20 p.m. RECONVENE: Mayor Stafford reconvened this meeting at 8:28 p.m. with all Council Members present with the exception of Council Member Mackenzie. 10. STANDING COMMITTEE / AD HOC COMMITTEE / LIAISON REPORTS 1. Standing Committee Reports a. Economic Development, 3/18/10 mtg. (GB /PS) Vice Mayor Belforte provided this report which included: Sonoma Mountain Business Cluster items on recently receiving the iHub rating and transitioning graduate businesses out of the incubator into Rohnert Park; potential marketing plan; and looking at an alternative plan for the Performing Arts Center. Minutes of the City of Rohnert Park JOINT REGULAR MEETING (8 of 10) March 23, 2010 _ for City Council /Community Development Commission /Rohnert Park Financing Authority Mayor Stafford reported on efforts reinstating the 5016 status for the City of Rohnert Park. She also called attention to a recent article in the Press Democrat on creative idea of Andy Durkee donating a quarter a day to help with the City's budget called "Quarters for Quality" and expressed appreciation for the first check received on this in the amount of $45 for the first three months of the year. 2. Liaison Reports a. Sonoma County Waste Management Agency, 3/17/10 mtg. (DS) Interim City Manager Schwarz provided this report which included noting that decisions require unanimous votes for this agency of ten members. Budget discussions are starting so they might have many meetings before adopting a budget. He commended efforts to lower costs to all the partners. b. Senior Citizens Advisory Commission, 3/18/10 mtg. (JC /PS) This report was provided below following "Other Reports" c. Water Advisory Committee & Technical Advisory Committee, 3/22/10 mtgs. (GB /JM) Vice Mayor Belforte provided this report which included advising there was a 4 to 4 vote on whether to raise rates or not and because Rohnert Park, Petaluma and Santa Rosa are weighted heavier, resulted in a no vote, which represents an advisory vote only. Noting another $120,000 cut in the budget, she indicated their recommendation will be made to the Board of Supervisors at its meeting of April 20th 3. Other Reports. a. Sonoma County /City Solid Waste Advisory Group, 3/15/10 (PS /GB) Mayor Stafford reported this group is a Task Force made up of all the cities that contribute to the County landfill. They are meeting regularly to try and find out what can or cannot be done with our landfill. A committee has been formed made up of environmentalists and business people working together to help facilitate this group on efforts trying to come up with something that will work for everybody. b. Chamber of Commerce Board of Directors, 3/16/10 mtg. (PS) Mayor Stafford advised there was a meeting last week and some ribbon cuttings. One was for Dr. Anthony Lieu who is taking over the dental practice of Dr. Lauren Anderson, recognized earlier this evening, with Dr. Anderson still working for him. Another was for the successful and well attended opening of Goodwill on Commerce Boulevard which is the largest in the County at 17,000 square feet, beautifully organized, and is a sales tax generating place for the City. Mayor Stafford advised with the Chamber going in a different direction that Executive Director, Roy Gugliotta, is no longer working for the Chamber of Commerce. Interim City Manager Schwarz responded to Council question that the City has not been spending the funds previously allotted for this contract as they were frozen a while ago, so this has returned about $27,000 to the City's Redevelopment Agency. Liaison Reports b. Senior Citizens Advisory Commission, 3/18/10 mtg. (JC /PS) Mayor Stafford provided this report which included. commending Interim City Manager Schwarz on the presentation he made on Measure E with the help of Director of Public Safety Masterson which had positive reception from the seniors. They also discussed initiating a senior club membership for voluntary memberships for the senior citizens at the Senior Center which would be another way to help make the Senior Center self - sustaining with the result of not needing the extra General Fund money from the City. Council Member Callinan indicated agreement with Mayor Stafford's report on this meeting with the seniors noting that it was very positive coming out of the meeting and expressing support of Measure E. 11. COMMUNICATIONS - Copies of communications were provided to Council for review prior to this meeting. Council Members desiring to read or discuss any communication may do so at this time. No action may be taken except to place a particular item on a future agenda for Council consideration. Council Member Breeze called attention to someone from the audience commenting during this evening's recess about the Mayor mentioning earlier that Measure E only costs 50 cents per $100 spent per person. The individual's comment was that this statement really had an effect on them and recommended getting a written statement out to the public on this. Interim City Manager commented on the new button called "City's Financial Condition" on the City's Website to provide information on Measure E. He advised that we are informers and do not advocate and that there is a nice flyer for the new button with questions and answers on Measure E. He believed this statement was already on the website but would check to make sure it is. Discussion ensued. Council Member Breeze called attention to an email Council received recently pertaining to a phone call the City received regarding a walker for Conservation Action. She shared the concerns expressed in a phone call she received on this as well which resulted in her phone call to the walker expressing concern about his approaching minor children to sign cards, which included leaving their names and addresses, especially when a parent had already said no on the matter and that only adults, not minors, should be approached. She shared that the walker was very apologetic and responded to her question asking if walkers were trained, that they were trained but there was no specific training not to approach children and that walkers are not fingerprinted. Assistant City Attorney Atencio and Interim City Manager Schwarz responded to Council question confirming it is correct that permits are not necessary for walkers and are only required if someone is selling something. 12. MATTERS FROM /FOR COUNCIL 1. Town Hall Meeting with Supervisor Shirlee Zane, 3/22/10 (PS) Mayor Stafford reported on the success of this Town Hall Meeting held last night at the Library. She advised it was very well attended with a lot of questions about Wal -Mart and casinos, and noted there were no questions about Measure E as she had hoped. She shared that this was the second Town Hall Meeting Supervisor Shirlee Zane has had here and people appreciate her coming and listening to our issues. Calendar of Events — Mayor Stafford indicated this item was provided for informational purposes. Interim City Manager Schwarz advised that the Rohnert Park Public Safety Officers Association (RPPSOA) has been working with Recreation staff on plans for an Easter Egg Hunt at the City Center Plaza and Library Plaza on Saturday, April 3rd. He expressed appreciation to both departments for these efforts and noted that an informational flyer on this would be forthcoming. 3. City Council Agenda Forecast— Mayor Stafford indicated this item was provided for informational purposes. Interim City Manager Schwarz responded to questions from Council Member Callinan which included: he would get back to him regarding the construction contracts listed on the Agenda Forecast; and per recent request from Council Member Callinan, the report on stadium lands is in final review and will be distributed to Council soon. 4. Other informational items a. Mayor Stafford advised that the Education Foundation of Cotati - Rohnert Park had a successful and well attended Annual Sharing of the Green event on Saturday night. She commended the efforts for this event and the money it provides for our schools. 13. PUBLIC COMMENTS Mayor Stafford invited public comments at 8:47 p.m. No one responded. 14. RECESS TO CITY COUNCIL CLOSED SESSION IN CONFERENCE ROOM 2A Mayor Stafford recessed this meeting at 8:47 p.m. to discuss: 1. CONFERENCE WITH LEGAL COUNSEL —Anticipated Litigation (Government Code §54956.9) Initiation of litigation pursuant to subdivision (c) of Section 54956.9: (one potential case) 15.
