2010/11/23 City Council Resolution 2010-131RESOLUTION NO. 2010 -131 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK, CALIFORNIA, DENYING THE APPEAL OF PLANNING COMMISSION DECISION TO CONDITIONALLY APPROVE THE SITE PLAN AND ARCHITECTURAL REVIEW FOR THE NORTH BAY CENTRE RENOVATION INCLUDING A 24 HOUR FITNESS AND NEW 2,500 SQUARE FOOT COMMERCIAL BUILDING LOCATED AT 6335 COMMERCE BOULEVARD, ROHNERT PARK, CA (APN 143 - 051 -073) (FILE NO. PL2010- 051SR) WHEREAS, applicant (representing Argonaut Investments, LLD,) filed Planning Application No. PL2010 -051 Site Plan and Architectural Review to permit the renovation of the North Bay Centre shopping center to include a 24 Hour Fitness Center and a new 2,500 square foot commercial building located at 6335 Commerce Boulevard (APN 143 - 051 -073) ( "Project "), in accordance with the City of Rohnert Park Municipal Code sections 17.25.030 and following; WHEREAS, the Project is located within the Regional Commercial (C -R) zoning designation; WHEREAS, on October 14, 2010, the Rohnert Park Planning Commission held a duly noticed public hearing, received oral and written testimony concerning the Project, deliberated, and approved the application through the adoption of Planning Commission Resolution No. 2010 -28; WHEREAS, on October 25, 2010, Kristen Selvage filed a timely appeal of the Planning Commission's decision in accordance with Rohnert Park Municipal Code sections 17.25.120 and following; WHEREAS, on November 23, 2010, the City Council of the City of Rohnert Park held a duly noticed public hearing to consider the appeal of the Planning Commission decision; WHEREAS, the City Council independently reviewed written and oral information received from City staff and an outside traffic consultant concerning the Project, which includes all of the information that was before the Planning Commission; and WHEREAS, the City Council received oral and written testimony from the appellant and members of the public and independently reviewed and considered such testimony. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Rohnert Park, California, denies the appeal based on the findings set forth in the November 23, 2010 Council Agenda Item Staff Report and the additional findings set forth below: 1. The proposed renovation of the shopping center will enhance its appearance and give it a new contemporary look compared to the existing dated architecture of the center. The revisions to the shopping center will stand out as a major improvement to this key commercial area. 2. The renovation of the existing buildings on the site will include new entry elements for the existing grocery store and for 24 Hour Fitness both located in the main commercial building on the site. The two raised roof elements will provide a more interesting roof line for the building and emphasize the entry to these two businesses. 3. A marked pedestrian passage way will lead from the bus stop on the Commerce Boulevard frontage of the property to the new commercial building and continue to the walkway in front of the primary commercial building with 24 Hour fitness and the Grocery outlet to encourage the use of public transportation. Bicycle parking will be provided on -site including a secure bicycle storage room for use by the health club patrons and employees. 4. This proposal is exempt from CEQA under Article 19, Section 15301 Class 1 (Existing Facilities), which entails the operation, repair, maintenance, permitting, leasing, licensing or minor alteration of existing public or private structures... involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination. The proposed project includes leasing an existing building, and the only building expansion would be a de minimis expansion at a rear of the building to accommodate bicycle parking for patrons and for employees. Interior work would include minor tenant improvements of the existing structure and exterior work would include minor alterations and upgrades of the existing building. The use would continue to be that of an existing shopping center consistent with the City's current zoning regulations. The proposal is also exempt from CEQA under Article 19, Section 15303, Class 3 (New Construction or Conversion of Small Structures), which consists of construction and location of limited numbers of new, small facilities or structures such as a store, motel, office, restaurant or similar structure not involving the use of significant amounts of, hazardous substances, and not exceeding 2,500 square feet in floor area. The proposed new commercial building would be 2,500 square feet in area and the uses that would occupy the building would be typical retail commercial uses not involving the use of hazardous substances. BE IT FURTHER RESOLVED, that the conditions of approval set forth in Planning Commission Resolution No. 2010 -28 are hereby adopted. DULY AND REGULARLY ADOPTED on this the 23rd day of November, 2010.
