CALL TO ORDER/ROLL CALL Mayor Stafford called the City Council /CDC /RPFA joint regular meeting to order at 5:00 p.m. Present: Pam Stafford, Mayor Gina Belforte, Vice Mayor Arnie Breeze, Council Member Joseph T. Callinan, Council Member Jake Mackenzie, Council Member Staff Present: Gabriel Gonzalez, City Manager; Benjamin Winig, Assistant City Attorney; and Terri Griffin, Deputy City Clerk. 2. CDC Resolution for Adoption: 1. 2010 -22 Approving an Amended and Restated Lease with the City of Rohnert Park for the Property Located at 100 Enterprise Drive and Commonly Known as 6800 Hunter Drive ACTION: Moved /seconded (Belforte /Mackenzie) and carried unanimously to approve the Consent Calendar items with the exception of Item Nos. 7.C.1 (Resolution No. 2010 -127), 7.C.2 (Resolution No. 2010 -128), and 7.E. Items removed from the Consent Calendar for discussion: 1. 2010 -127 Endorsing and Prioritizing Applications for the 2011/2012 Community Development Block Grant Funding ACTION: Moved /seconded (Belforte /Mackenzie) and carried unanimously to adopt Resolution No. 2010 -127. 2. 2010 -128 Adopting Revised Manual of Standard, Details and Specifications for Water, Streets and Roadway Systems DIRECTION Council concurred to table the item to provide staff an opportunity to analyze the letter from Brookfield Homes and directed staff to determine whether a future City Council workshop should be scheduled to discuss the issues raised in the letter or whether the matter should be brought back to Council as a regular agenda item. Staff was further directed to address concerns raised in the letter regarding increased costs. E. Approval of Letters to the County of Sonoma regarding County Road Maintenance ACTION: Moved /seconded (JM /GB) and carried unanimously to approve letters with a correction to the Third District for Supervisor Zane and additional copies to Sonoma County Public Works Director Phil Demery, Second District Supervisor -elect David Rabbitt, Fourth District Supervisor -elect Mike McGuire, Sonoma State University, University District representative, Southeast Specific Plan representative, and the City of Cotati. SONOMA COUNTY /CITY SOLID WASTE ADVISORY GROUP (SWAG) - UPDATE City Council consideration of concurrence with SWAG's priorities and objectives for developing a regional long-term sold waste option. A. Staff Report provided by City Manager Gonzalez. B. Presentation by Sonoma County Director of Public Works, Phil Demery. DIRECTION Council concurred with SWAG's priorities and objectives as presented. 9. APPEAL HEARING - SITE PLAN AND ARCHITECTURAL REVIEW FOR NORTH BAY CENTRE RENOVATION City Council consideration of an appeal of the Planning Commission decision to approve a site plan and architectural review for the North Bay Centre renovation including a 24 Hour Fitness and new 2,500 square foot commercial building located at 6335 Commerce Boulevard consisting of one parcel totaling 8.40 acres (APN 143 -051 -073) (File No. PL2010- 039SR) A. Staff Report provided by Planning and Building Manager Ponton and Dalene Whitlock, W- Trans. Mike Karasik, representing the property owner, and Colin Russell, project architect, responded to Council questions. B. Mayor Stafford opened the public hearing at 6:27 pm. 1. Aaron Locks, Rohnert Park, spoke on behalf of the appellant in support of the appeal. Mayor Stafford closed the public hearing at 6:36 p.m. C. Resolution for Adoption: 1. 2010 -131 Upholding the Planning Commission Action to Approve Site Plan and Architectural Review for the North Bay Centre Renovation Including a 24 Hour Fitness and New 2,500 Square Foot Commercial Building Located at 6335 Commerce Boulevard, Rohnert Park, California (APN 143 - 051 -073) (File No. PL2010- 039SR) ACTION: Moved /seconded (Mackenzie /Callinan) and carried unanimously to adopt Resolution No. 2010 -131 and direct staff to address onsite water reuse, preservation of existing trees, and use of native plants in landscaping as the application goes through permitting process and report back to Council on these issues. 10. 2010 FIRE CODE ORDINANCE Consideration of Adoption of Ordinance Adopting by Reference the 2010 Edition of the California Fire Code, as Amended A. Staff Report provided by Fire Marshal Adam. B. Mayor Stafford opened the public hearing at 6:52 p.m. Hearing no public testimony, Mayor Stafford closed the public hearing at 6:52 p.m. C. Staff Report provided by Director of Development Services Jenkins B. Mayor Stafford opened the public hearing at 6:55 p.m. 1. Ben Boyce, Sonoma, spoke in support of Tier 1 standards and region -wide uniformity. 2. Doug Hilberman, Construction Coalition and American Institute of Architects, spoke in support of Tier 1 standards and region -wide uniformity. Mayor Stafford closed the public hearing at 7:01 p.m. C. Ordinance for Adoption: Waive Full Reading and Adopt Ordinance by Reading Title: 1. No. 829 Adopting the 2010 California Building Standards Code by Reference, Amending Chapter 15.04 (General Provisions and Penalties), Chapter 15.08 (Building Code), Chapter 15.16 (Electrical Code), Chapter 15.20 (Plumbing Code), and Chapter 15.24 (Mechanical Code) of Title 15, and Adding Chapter 15.10 (Residential Code), Chapter 15.22 (Energy Code), and Chapter 15.26 (Green Building Standards Code) to Title 15, "Buildings and Construction," of the Rohnert Park Municipal Code ACTION: Moved /seconded (Callinan /Breeze) and carried unanimously by roll call vote to waive full reading and adopt Ordinance No. 829 D. Ordinance for Adoption: Waive Full Reading and Adopt Ordinance by Reading Title: 1. No. 830 Repealing Title 14 (Sustainability) of the Rohnert Park Municipal Code ACTION: Moved /seconded (Cal linan /Belforte) and carried unanimously by roll call vote to waive full reading adopt Ordinance No. 830 ACTION: Moved /seconded (Mackenzie /Belforte) to direct staff to bring back for Council consideration at a future meeting the CalGreen Tier l standards adopted by the other Sonoma County cities. Vice Mayor Belforte proposed a friendly amendment that staff be directed to include an economic feasibility study if possible. The amendment was accepted by the maker of the motion, and the motion as amended carried unanimously. 12. STANDING COMMITTEE / AD HOC COMMITTEE / LIAISON REPORTS A. Standing Committee Reports 1. Vice Mayor Belforte reported on the November 16`h Economic Development meeting. B. Liaison Reports 1. Mayor Stafford reported on the November 16 "' Chamber of Commerce board meeting and announced the Holiday Lights Ceremony will be held December 4`h at the City Center Plaza. Council Member Mackenzie reported on the November l0`" North Coast Integrated Regional Water Management Panel; the Governor's Climate Change Conference at UC Davis; the SMART Board of Directors meeting; Supervisor Paul Kelley's November 6t" retirement event; and his intention to seek reappointment by the Sonoma County Board of Supervisors to the Metropolitan Transportation Commission. 13. COMMUNICATIONS Vice Mayor Belforte called attention to a thank you note from the Rancho Cotate High School Student Body Association. Council Member Callinan announced Rancho Cotate High School's 51 -0 win in its first playoff game. Council Member Mackenzie called attention to a communication from a resident of Redwood Park Estates and his observation of the onsite work at the University District at the invitation of Brookfield Homes. 14. MATTERS FROM/FOR COUNCIL A. Mayor Stafford announced the City Council will hold a special meeting on December 7, 2010, at 6:00 p.m. B. Mayor Stafford reported on Veteran's Day Ceremony. C. Council Member Callinan requested that the following items be placed on a future Council meeting agenda: (1) discussion of the SMART train; (2) discussion of City street maintenance; and (3) a presentation by a representative of the Sonoma County Agricultural Preservation and Open Space District regarding its activities in the Rohnert Park vicinity. D. Council Member Breeze highlighted a communication from Reverend Tharpe regarding his annual Thanksgiving Day meal and requested payment of the City's $500 contribution by November 1. 15. PUBLIC COMMENTS 1. Dan Adam, Rohnert announced the upcoming Santa float in December and the Sports Federation fundraiser in January. 16. RECESS TO CLOSED SESSION Council Member Callinan recused himself from discussion of the closed session item due to his ownership of real property within 500' of the subject property and left the meeting at 7:30 p.m. Mayor Stafford recessed the joint regular meeting to closed session in Conference Room 2A at 7:30 p.m. to consider: CONFERENCE WITH REAL PROPERTY NEGOTIATORS (Government Code §54956.8) Property: 1455 Golf Course Drive (Assessor's Parcel number 160- 400 -055) City Negotiator: Gabriel Gonzalez, City Manager Negotiating parties: City of Rohnert Park and J. RECONVENE OPEN SESSION Mayor Stafford reconvened the joint regular meeting open session in the Council Chamber at 8:24 p.m. All Council members were present except Council Member Callinan. 18. MAYOR'S REPORT ON CLOSED SESSION (Government Code § 54957.1) Mayor Stafford advised there was nothing to report from the closed session. 19.
