2006/09/12 City Council MinutesCITY OF ROHNERT PARK SPECIAL MEETING/WORK SESSION MINUTES FOR: Rohnert Park City Council September 12, 2006 Tuesday The City Council for the City of Rohnert Park met this date in a Special Meeting/Work Session to commence at 5:00 p.m. at the Rohnert Park City Hall, 6750 Commerce Boulevard, Rohnert Park, with Mayor Smith presiding. SPECIAL MEETING/ WORK SESSION: Call to Order: Mayor Smith called the Special Meeting/Work Session to order at 5:03 p.m. Roll Call: Breeze, Flores, Mackenzie, Vidak- Martinez, Smith Staff present for all or part of the Special Session: City Manager Donley, Assistant City Manager Schwarz, Building Official Bruck, Director of Public Works /City Engineer Jenkins, and Videographer Beltz. UNSCHEDULED PUBLIC APPEARANCES: No members of the public were interested in speaking. COMMUNITY CHOICE POWER — The Solution to California's Energy and Climate Crisis: 1. Reviews by the following representatives: a. Ann Hancock, Climate Protection: Ms. Hancock briefly reviewed Community Choice Aggregation, and she commended the City of Rohnert Park for embracing such a new concept. She also noted that a Community Climate Action Plan meeting had taken place today. b. Jerry Lahr, Association of Bay Area Governments (ABAG): Mr. Lahr discussed ABAG's natural gas aggregation program, and he elaborated on the aspect of opting out of such a program. He responded to Council questions and comments regarding the status of ABAG's natural gas aggregation program, the terms of participation, the use of compressed natural gas vehicles, and the stability of gas prices. c. David Rubin, Pacific Gas & Electric Company: Prior to Mr. Rubin's presentation, PG &E's Governmental Relations Representative for the North Bay and North Coast, Marie Gainer Murphy, shared opening comments about PG &E's position on Community Choice Aggregation (CCA) and how PG &E is helping cities and counties make that decision. Mr. Rubin explained his background with CCA and he provided a detailed explanation of CCA as a viable option for cities and counties. He responded to Council questions and comments regarding PG &E's assistance if a city chooses CCA, the opt -out phases, and use of PG &E's transmission system if a city or county generates or procures power from other sources. Rohnert Park City Council SPECIAL MEETING/ WORK SESSION Minutes (2) September 12 2006 d. Paul Fenn, Non - profit consultant: Mr. Fenn clarified a clerical error in the agenda, noting that he owns a power facility and is a nonprofit consultant and a community advocate of CCA. He also noted his background with CCA law. Mr. Fenn responded to Council questions and comments regarding the effectiveness of regional Joint Powers Authorities (JPA), the use of hydro - electric turbines, the use of residential solar panels in San Francisco and the San Francisco model, and the controversy surrounding nuclear plants. 2. Public Comments: Mayor Smith called forward members of the public interested in commenting on this matter: a. Dave Erickson, Climate Protection Campaign, was recognized and discussed how large -scale wind projects are better and less expensive than nuclear plants. He also noted that the real promise of CCA is that it allows cities or counties to act as bargaining units to negotiate with power generators for a competitive rate. b. John Rosenblum, Climate Protection Campaign, Consultant, was recognized and discussed various ways to reduce cost by reducing the amount of water and energy used in a community. 3. Council discussion /direction /action: Councilmember Breeze commended the speakers for informative reports. She encouraged staff to pursue discussions with the County of Sonoma and /or other local cities regarding the CCA idea. Councilmember Flores called attention to the pressing climate and resource issues facing the world today, and he noted that CCA provides cities an alternative way of protecting the environment and providing energy. Councilmember Mackenzie noted the City's efforts several years ago to work with a JPA. He suggested that staff be directed to start discussions on a County Administration level and with Sonoma County Water Agency (SCWA) regarding the idea of CCA, and that staff raise the CCA idea up at the upcoming Mayors' & Councilmembers' Association meeting. Vice Mayor Vidak- Martinez expressed a desire to hear staff's input on what the City could do, in light of its current resources, that would have the biggest impact in terms of energy production and transmission. City Manager Donley shared comments about SCWA's potential interest in CCA. Mayor Smith stated that energy alternatives and ideas like CCA need the support of the community, and he expressed a desire to learn more about public interest in CCA. He indicated that the City should consider working with the City of Cotati and Sonoma State University regarding Community Choice Power. Council CONCURRED (1) to direct staff to bring the CCA issue up at the Mayors' & Councilmembers' meeting and report on feedback; (2) to direct staff to report back on their input and comments regarding CCA; (3) to direct City Manager Donley to report on and get feedback from the upcoming City Managers' meeting. SPECIAL MEETING/WORK SESSION: Following an earlier Special Meeting /Work Session, Council had a Dinner Break from 6:20 p.m. until approximately 6:45 p.m. REGULAR SESSION: Call to Order: Mayor Smith called the Regular Session to order at 6:46 p.m. Roll Call: Breeze, Flores, Mackenzie, Vidak- Martinez, Smith Staff present for all or part of the Regular Session: City Manager Donley, Assistant City Attorney Whelan, Assistant City Manager Schwarz, Director of Community Development Bendorff, Housing and Redevelopment Project Manager Ellena, Director of Public Works /City Engineer Jenkins, Public Safety Lieutenant Frazer and Videographer Beltz. PLEDGE OF ALLEGIANCE: Ella Donley and Hannah Knox, First Grade Students at Evergreen Elementary School, led the Pledge of Allegiance. Mayor Smith PRESENTED Ella and Hannah each with a card and a pen. SCHEDULED APPEARANCES /PRESENTATIONS: 1. Mayor's Presentation of Resolution of Recognition Honoring the Rohnert Park/Cotati Friends of the Library: Mayor Smith READ AND PRESENTED a framed resolution and a pin honoring the Friends of the Library. One of the members shared brief comments. Councilmember Flores passed on information to the Friends of the Library regarding donation of a storage unit for their books. 2. Doreene Hanks regarding City Municipal Funds Management pertaining to Public Safety Department Decisions, Demands and Defaults; and Condition of Bike Paths, Bus Stops and Streets: Ms. Hanks DISPLAYED a piece of metal found in a local bike path, and she SHARED a photo album of the current condition of Copeland Creek bike path. She expressed concern about garbage and dead animals on the bike path, and she discussed problems she has had in dealing with the Department of Public Safety regarding issuance of a ticket she received. City of Rohnert Park CONCURRENT MEETINGS Minutes (2) September 12 2006 for City CounciUCommunity Development Commission/Rohnert Park Financing Authority Erin Armstrong regarding introduction of Cougar Ambassadors, a new public relations group at Rancho Cotate High School (RCHS), with efforts to improve image at RCHS and desire to have signs at entry points into Rohnert Park saying "Home of the Rancho Cotate Cougars ": Ms. Armstrong DISTRIBUTED folders to Council and discussed the Cougar Ambassadors' desire to display a sign in honor of the Rancho Cotate Cougars on the Spreckels Performing Arts digital billboard or any other prominent location in town. Council discussion concluded with CONCURRENCE to direct staff to report back with ideas on a gateway sign for the Rancho Cotate Cougars. Councilmember Flores suggested that Ms. Armstrong have the Rancho Cotate Art Department design the sign, and Councilmember Breeze suggested that the Rancho Cotate students design a banner and contact the Cultural Arts Commission. 2. SSU STUDENT REPORT: Sonoma State University Associated Students, Inc. By Whitney Diver, Legislative Representative: Ms. Diver DISTRIBUTED copies of The Star to Council, and she reported on matters including the outsourcing of SSU's bookstore to Barnes & Noble, efforts to increase attendance at SSU sporting events, the new book by SSU's Project Censored, and voter registration efforts. Councilmember Flores encouraged Councilmembers to go visit the new Darwin Hall, and Councilmember Mackenzie stated that he will attend the Senate Meeting tomorrow at the Student Union. 3. UNSCHEDULED PUBLIC APPEARANCES /COMMENTS: Bonnie Black, 1065 Hawthorne, was recognized and stated that she would wait for Agenda Item No. 6. 2. John Hudson, 399 Bonnie Avenue, was recognized and, referring to an article in the August 24 edition of The Press Democrat, he expressed concerns about the cost overruns for the new City Hall. He noted that the City has already taken the residents' money in the form of higher water and sewer fees to build a sewer line for the benefit of developers, and he urged Council and staff to pay attention to Proposition 218 which may affect the City's water, garbage, and sewer rates. Mayor Smith asked staff to provide Mr. Hudson with the report regarding City Hall cost overruns. 3. John O'Neill, 4374 Gloria Court, was recognized and expressed ongoing concerns about the use of a tennis court at Golis Park as a makeshift dog park. He cited sanitation and noise among his concerns, and he urged the City to revisit the idea of re- opening the tennis court to dogs, as well as posting signs about limited use. Assistant City Manager Schwarz shared brief comments. Council CONCURRED TO AGENDIZE said matter for the next Council meeting. 4. Len Carlson, 349 Circulo San Blas, was recognized and urged Council to try to find a way to help get water meters installed and implemented in Rancho Grande. He expressed concern that the park owner is dividing the water bill among the 309 residents, thereby making residents pay for the common area water. 5. Gordon Anderson, 301 Enterprise Drive, was recognized and SUBMITTED photos of construction work taking place at Hampton Trace Apartments, and he DISTRIBUTED AND REVIEWED the contents of multi- document packets regarding the conversion of Hampton Trace Apartments into condominiums. He noted his ongoing concerns with the conversion, and he indicated that the City already has a shortage of affordable housing. City of Rohnert Park CONCURRENT MEETINGS Minutes (3) September 12 2006 for City CounciUCommunity Development Commission/Rohnert Park Financing Authority 6. Michael Caalim, 295 Burton Avenue, was recognized and SUBMITTED a CD of photos, as well as color pictures, showing the deterioration of Burton Avenue Mini -Park. He expressed a desire to see the park restored. City Manager Donley commented on the process for naming the City's parks. At Mr. Caalim's request, Council provided him with a brief oral update on the status of a skateboard park. Barb Greene, P.O. Box 7055, Cotati, was recognized and encouraged Council to allow the 20/20 Recyling facility to come back to its location behind the now vacated Albertson's due to the accumulation of bottles and cans. She also encouraged members of the public to assist in watering the hundreds of public trees that were recently planted by local groups in the creek area. She indicated there are too many for the Sonoma County Water Agency to water, and she noted that it only takes a gallon of water to help. Ms. Greene also PRESENTED a Singing Frog to Mayor Smith and staff for the new bench on Copeland Creek. Marcella Setter, 1515 Griffin Way, was recognized and PRESENTED a petition to Council, signed by approximately 150 people who use the Dog Park on Roberts Road, asking that the City take care of the over - watering which is causing large mud puddles, which present a threat to the dogs and create messes in the owners' cars. She also expressed support for the members of a dog group that meet and use a Golis Park tennis court for their dogs, and she urged Council to consider the greater needs of the community when reviewing this matter. Councilmember Mackenzie stated that at one time there were three tennis courts in Golis Park, but due to the rising popularity of rollerblading in the mid 90's, one tennis court was converted for use by rollerbladers. 4. CONSENT CALENDAR Mayor Smith asked if there were any questions about matters on the Consent Calendar. Councilmember Flores signified removal of Resolution 2006 -229. Items for Consideration: 2006 -229 Awarding the Contract to TerraCon Pipelines, Inca for the Coleman. Creek Storm Drain Project, Project No. 2005 -07 Councilmember Flores thanked. Director Public Works /City Engineer Jenkins for his efforts with the storm drain, which will ultimately help alleviate the City's flooding problems. Upon MOTION by Councilmember Flores, seconded by Vice Mayor Vidak- Martinez, and UNANIMOUSLY APPROVED, reading was waived and Resolution 2006 -229 was ADOPTED. 2006 -231 Approving the Memorandum of Understanding Regarding Water Transmission System Capacity Allocation During Temporary Impairment By and Between the Sonoma County Water Agency and Various Other Parties Mayor Smith referred Council to page 4 regarding the Peak Demand Allotments. He stated that he would like to see more fair allocations among the contractors in the future, or he will no longer be willing to support the MOU. Upon MOTION by Mayor Smith, seconded by Councilmember Flores, and UNANIMOUSLY APPROVED, reading was waived and Resolution 2006 -231 was ADOPTED. At the suggestion of Mayor Smith, Council CONCURRED to consider Agenda Item 11. 1, "Preventing Condominium Conversion of Mobile Home Parks," during consideration of Agenda Item 5.1, "Condominium Conversions Moratorium." 5. PLANNING AND ZONING /COMMUNITY DEVELOPMENT MATTERS: 1. Condominium Conversions Moratorium - Consideration of Adoption of Urgency Ordinance (by a four - fifths vote of the City Council) Imposing a Moratorium Upon Condominium Conversions, ( Rohnert Park Municipal Code Section 17.07.020(HH) regulates condominium conversions in the City): a. Staff Report: Housing and Redevelopment Project Manager Ellena reviewed the contents of the Staff Report and responded to Council questions and comments. b. Waive Further Reading and Adopt Urgency Ordinance by Reading Title: No. 766 Urgency Ordinance Imposing a Moratorium Upon Condominium Conversions A MOTION was made by Councilmember Flores, seconded by Vice Mayor Vidak- Martinez, to adopt Urgency Ordinance No. 766. Under discussion, Councilmember Breeze commended staff's efforts in conducting an in -house vacancy survey, and she expressed support for staff's recommendations. Per Agenda Item 11. 1, Councilmember Breeze referred Council to a letter she had written requesting that Council direct staff to prepare a Mobile Home Park Conversion Prevention Ordinance, citing the large loss of low -cost housing units, particularly for seniors. Assistant City Attorney Whelan explained how the City is limited by State law when it comes to mobile home park conversions. She noted that the issue of the required Survey of Support by mobile home park owners will be litigated in the future, and she stated that she will follow up on that matter with a memo to Council. Councilmember Flores stressed the importance of maintaining apartments with affordable rates. Councilmember Mackenzie discussed how there will be a reduction in affordable housing if the City were not to take action this evening on condominium conversions. Vice Mayor Vidak- Martinez also discussed the City's efforts to maintain affordable housing, and she noted how the City is pre - empted from taking action on mobile home park conversions. Mayor Smith emphasized that tonight's action is regarding the matter of condominium conversions. After the motion, which was UNANIMOUSLY APPROVED, reading was waived and Urgency Ordinance No. 766 was ADOPTED BY ROLL CALL VOTE. 2. Residential Parking Exemptions - Consideration of Introduction of Proposed Amendment to Subsection 17.16.040.C.8 of the Rohnert Park Municipal Code regarding Residential Parking Exemptions: a. Staff Report: Director of Community Development Bendorff reviewed the contents of the Staff Report and responded to Council questions and comments. b. PUBLIC HEARING: Mayor Smith opened the Public Hearing at 8:14 p.m. There being no members of the public interested in speaking on this matter, Mayor Smith closed the Public Hearing at 8:14 p.m. c. Waive Further Reading and Introduce Ordinance by Reading Title: No. 767 Amending Title 17, Zoning, of the Rohnert Park Municipal Code, Subsection 17.16.040.C.8 Regarding Residential Parking Exemptions A MOTION was made by Councilmember Mackenzie, seconded by Councilmember Breeze, to introduce Ordinance No. 767. Under discussion, Councilmember Breeze noted that this provision will allow residents to convert their garages without affecting the fronts of their homes. Councilmember Flores discussed how this ordinance ensures consistency in the appearances of neighborhoods. Mayor Smith noted how garage conversions impact parking. After the motion, which was UNANIMOUSLY ADOPTED, reading was waived and Ordinance No. 767 was ADOPTED BY ROLL CALL VOTE. City of Rohnert Park CONCURRENT MEETINGS Minutes (6) September 12 2006 for City Council/Community Development Commission / Rohnert Park Financing Authority 3. Joint Meeting of City Council & Planning Commission - Consideration of topics for this Joint Meeting to be held at City Hall from 3:00 -5:00 p.m., September 26, 2006: Senior Planner Bendorff stated that Ethics Training will be from 3 -5 p.m., and the Joint Meeting will be from 5:30 -7:00 p.m. He asked Councilmembers to prioritize a list of potential topics for the Joint Meeting. Council discussion /direction /action: Council discussion concluded with Director of Community Development Bendorff summarizing Council's preferences, notably the Housing Element Update for 2009, Neighborhood Preservation, and the Corridor Concept Plans. Councilmembers also expressed an interest in discussing the General Plan Update. 6. ' PARKS AND RECREATION COMMISSION MATTERS: 1. Animal Bite Incidents Reporting - Municipal Code Amendment Proposal: Parks and Recreation Commission requests assignment of staff resources to draft an amendment to the Rohnert Park Municipal Code to increase reporting requirements for incidents when animals bite humans or other animals: a. Staff Report: Assistant City Manager Schwarz reviewed the contents of the Staff Report, and he responded to Council questions and comments. . b. Public Comments: 1. Bonnie Black, 1065 Hawthorne, was recognized and stated that the Parks and Recreation Commission's intent in its recommendation to Council was to include bite incidents that occur all over town and to include incidents that were not necessarily bites. c. Council discussion /direction /action: At the suggestion of Councilmember Flores, Council CONCURRED to direct staff to draft an amendment as outlined in the Staff Report. Councilmember Mackenzie and Vice Mayor Vidak Martinez emphasized that staff should not use language that is too broad in the amendment. Councilmember Mackenzie also expressed an interest in hearing back from staff regarding resources and enforcement of this amendment. 2. Dog Parks Restriction to Altered.Dogs - Municipal Code Amendment Proposal: Parks and Recreation Commission requests assignment of staff resources to draft an amendment to the Rohnert Park Municipal Code to limit dog park access to altered dogs: a. Staff Report: Assistant City Manager Schwarz reviewed the contents of the Staff Report. b. Public Comments: 1. Bonnie Black, 1065 Hawthorne, was recognized and stated that, as a member of the Parks and Recreation Open Space Committee (PROS), it was her feeling that many patrons of the City's Dog Park would like to feel safer there. She indicated that Dog Park Rules need to be more than mere suggestions. She reviewed the idea of a monitoring program, as well as use of different dog tags to identify altered and unaltered dogs. City of Rohnert Park CONCURRENT MEETINGS Minutes (7) September 12 2006 for City CoundtlCommunity Development Commission /Rohnert Park Financing Authority c. Council discussion /direction /action: Councilmember Breeze expressed concerns regarding the legal issues that may arise, as well as the burden on Public Safety in terms of enforcement. Councilmember Flores expressed support for a six -month ban on allowing unaltered dogs access to the dog park, while Councilmember Mackenzie expressed support for a 12 -month ban. Councilmember Mackenzie also recommended that staff follow up on a dog- monitoring program. Vice Mayor Vidak- Martinez expressed support for a dog- monitoring program with clear training on when to call Public Safety. Mayor Smith expressed support for different tags for altered and unaltered dogs, and he summarized Council's direction by directing the Parks and Recreation Commission to come back with recommendations and further information on the proposal. Assistant City Manager Schwarz noted that the Parks and Recreation Commission's next meeting will be the third Monday in October. 7. DEPARTMENT OF PUBLIC SAFETY MATTERS: 1. National Incident Management System (NIMS) - Consideration of adoption of the National Incident Management System (NIMS): a. Staff Report: Public Safety Lieutenant Frazer reviewed the contents of. the Staff Report, and he responded to Council questions and comments. b. Public Comments: None. c. Resolution for Adoption: 2006 -232 Approving the Adoption of the National Incident Management System (NIMS) Upon MOTION by Vice Mayor Vidak- Martinez, seconded by Councilmember Breeze, and UNANIMOUSLY APPROVED, reading was waived and Resolution 2006 -232 was ADOPTED. 2. Emergency Operations Plan Revision - Consideration of adoption of changes to the existing City of Rohnert Park Emergency Operations Plan to include the National Incident Management System (NIMS): a. Staff Report: Public Safety Lieutenant Frazer reviewed the contents of the Staff Report. b. Public Comments: None. c. Resolution for Adoption: 2006 -233 Approving the Revision of Emergency Operations Plan Management System (NIMS) the Existing City of Rohnert Park (to integrate the National Incident Upon MOTION by Vice Mayor Vidak- Martinez, seconded by Councilmember Breeze, and UNANIMOUSLY APPROVED, reading was waived and Resolution 2006 -233 was ADOPTED. Humboldt Fire Update - Final Report for Strike Team sent to Humboldt County by David B. Frazer, Lieutenant - Fire Services: Public Safety Lieutenant Frazer noted that he has a copy of the related memorandum to submit to City Manager Donley. He reviewed the Final Report for the Strike Team, and City Manager Donley discussed why the City participates in providing assistance in cases like the Humboldt Fire. Councilmember Flores stepped out of the Council Chambers from 9:05 p.m. until 9:07 p.m. 8. INFRASTRUCTURE PROPOSITIONS ON NOVEMBER 2006 BALLOT: Consideration of joining with the League of California Cities in Support of Propositions IA, 1B, 1C, 1D, lE and Proposition 84 for building and maintaining infrastructure essential to building and preserving the economic and social well being of residents and local businesses (TS): 1. Review of Propositions: Mayor Smith provided a brief oral report on these propositions. 2. Public Comments: None. 3. Resolution for Adoption: 2006 -234 Supporting Propositions 1A, 1B, 1C, 1D, 1E and Proposition 84 on the November 2006 Ballot Upon MOTION by Councilmember Mackenzie, seconded by Councilmember Breeze, and UNANIMOUSLY APPROVED, reading was waived and Resolution 2006 -234 was ADOPTED. 9. Cities Annual Conference, 9/6/06: Councilmember Flores noted that he attended a health benefits workshop and an affordable housing workshop, of which he DISTRIBUTED the Power Point presentation. Councilmember Mackenzie noted his attendance at a video franchise workshop and Prop 218 discussions. Mayor Smith shared comments on how adjustments to the number of units and increased square footage would allow Rohnert Park to be treated more fairly in terms of ABAG's affordable housing considerations. Councilmember Mackenzie indicated that he would raise that issue at the next ABAG meeting. Health Care Summit hosted by Santa Rosa Chamber of Commerce, 9/11/06: Mayor Smith indicated that he attended this meeting with Director of Administrative Services Lipitz. 10. Public Safety Command Staff meeting, 9/12/06: Mayor Smith and Vice Mayor Vidak Martinez reported on discussions regarding matters including Safety fairs, CSO duties, Neighborhood Watch, SEU /Canine Unit, and recruitment and retention- 11. 11. COMMUNICATIONS: Communications per the attached outline were brought to the attention of the Councilmembers. The following communications were raised. 1. Letter from Virginia Garnot re Water /Sewer.bill at Valley Village: Vice Mayor Vidak- Martinez REQUESTED a staff report regarding the large increase in the water and sewer bills for the residents at Valley Village. City Manager Donley provided an update on said matter. 2 Letter from Geraldine Duncann: Mayor Smith REQUESTED that staff respond to Ms. Duncan's concerns regarding Rancho Verde Mobile Home Park owners' attempts to convert the park to condominiums. 3. Letter from Shiori Higashikawa,Goodwill Ambassador in Hashimoto, Japan: Mayor Smith called attention to said letter and City Manager Donley's response 11. MATTERS FROM/FOR COUNCIL: 1. Preventing the Condominium Conversion of Mobile Home Parks: Previously covered in the meeting during Agenda Item No. 5.1. 2. Increasing Penalties for Graffiti and Increasing Enforcement of Graffiti Laws: Councilmember Breeze referred to a letter she prepared regarding this matter, and she SHARED recent photos of graffiti all around town. *Councilmember Breeze requested Council consensus to consider formation of a Graffiti Task Force involving Public Safety, Public Works, and the School District.* Councilmember Flores suggested that high school students get community service hours for painting over the graffiti in a program to be monitored by the Department of Public Works. Vice Mayor Vidak- Martinez suggested that Public Safety report back to Council with suggestions.
