The Concurrent Meetings of the City of Rohnert Park for the City Council, the Community
Development Commission and the Rohnert Park Financing Authority met this date in Regular
Session for a meeting to commence at 6:00 p.m. at the Rohnert Park City Hall, 6750 Commerce
Boulevard, Rohnert Park, with Mayor Vidak- Martinez presiding.
Call to Order: Mayor Vidak - Martinez called the meeting to order at 6:00 p.m.
Roll Call: Breeze, Mackenzie, Smith, Stafford, Vidak- Martinez
Staff present for all or part of the Regular Session: City Manager Donley, City Attorney Kenyon,
Assistant City Manager Schwarz, Housing and Redevelopment Manager Ellena, Director of Public
Safety Bullard, Director of Administrative Services Lipitz, Deputy City Clerk Griffin, and
Videographer Beltz.
CLOSED SESSION: Council adjourned to Closed Session to discuss Real Estate Negotiations and
Litigation Matters.
REGULAR SESSION: Mayor Vidak- Martinez reconvened Regular Session at 6:48 p.m.

1. MAYOR'S REPORT ON CLOSED SESSION:
Mayor Vidak- Martinez stated that no reportable action was taken in Closed Session.
2. SCHEDULED APPEARANCES /PRESENTATIONS:
1. Michael Spielman, Drug Abuse Alternative Center (DAAC) Presentation: Mr. Spielman
DISTRIBUTED AND REVIEWED brochures and documents regarding Alcohol and
Drug Abuse Facts, Sonoma County's Methamphetamine Profile, and DAAC's "Turning
Lives Around Tour." Mr. Spielman responded to Council questions and comments.
Council Member Smith suggested that staff report back on the City's efforts at
environmental protections in terms of programs and codes and how they can better work
together with DAAC's goals. Mr. Spielman noted that the Sonoma County Prevention
and Planning Division could offer helpful information per Council Member Smith's
recommendation.

2. Maggie Hart, Laguna Ecosystem Restoration and Management Plan: Joe Honton, on
behalf of the Laguna de Santa Rosa Foundation, DISTRIBUTED AND REVIEWED
the contents of a Power Point presentation regarding development of the Laguna
Restoration and Management program. He also passed around the final report for the
program and the framework of the Laguna de Santa Rosa Foundation. Mayor Vidak-
Martinez suggested that staff purchase a copy of said report book for the City.
Dan Blanquie, Chair - Parks, Recreation and Open Space Committee Community Forum,
February 1, 2007 at 7:00 p.m., Burton Avenue Recreation Center: Mr. Blanquie
INVITED Council and members of the public to said forum which will help identify
needs for future Parks and Recreation facilities for the next 20 years in concert with the
City's General Plan.
3. SSU STUDENT REPORT:
Sonoma State University Associated Students, Inc. by Whitney Diver, Legislative
Representative: Ms. Diver reported on the following matters: Start of Spring Semester
next week; ongoing progress with the University Center and the Green Music Center;
next Associated Students meeting, February 7`h.
4. UNSCHEDULED PUBLIC APPEARANCES /COMMENTS:
Peter Tscherneff, Sonoma County, was recognized and shared a variety of comments on the
state of Sonoma County, the war in Iraq, and the next presidential election.
2. Steven Young, 310 Corte Rayado, was recognized and, first, commended the work that DAAC
has done in Sonoma County and for him personally. He urged Council to consider that all of
the facts concerning the Rancho Verde Mobile Home Park conversion are not out yet.
Debbie Clarkson, Corte Naranja, was recognized and asked for the City's assistance in
gathering and providing accurate information to the residents of Rancho Verde Mobile Home
Park regarding the possible conversion. She noted that many residents are on the fence as far
as buying. She also suggested that the City consider the use of wind and solar power, as an
example to the community, due to Rancho Verde's proximity to the Laguna de Santa Rosa.
4. Tom Hansen, P_O. Box 2037, was recognized and DISTRIBUTED AND REVIEWED the
contents of a letter (1) regarding false accusations which have caused him to withdraw his
application for the Parks and Recreation Commission, and (2) recommending procedures be
put in place for dealing with allegations of unethical acts by City volunteers or City staff,
including the formation of a standing Ethics Committee. Furthermore, he noted that having
no recourse to address the false accusations against him, he will no longer continue as a
volunteer on the Parks, Recreation, Open Space (PROS) Committee.
5. Gerard Giudice, 7396 Circle Drive, was recognized and welcomed Council Member Stafford.
He thanked Council and City staff for the upgrade to C Section park. He expressed support
for firework sales, and he encouraged Council to put the casino to a vote of the people.

6. SEWER AND WATER SYSTEMS:
Consideration of ordinance re- adopting sewer and water rate increases:
1. Staff & Bartle Wells Consultant Reports: Director of Administrative Services Lipitz
reviewed the contents of a Power Point presentation and responded to Council
questions and comments.
2. PUBLIC HEARING: Mayor Vidak- Martinez opened the Public Hearing at 7:50

a. John Hudson, 399 Bonnie Avenue, was recognized and noted that he represents
Paul Stutrud in a suit against the City regarding sewer rates. He expanded on his
written objections to the increase in the sewer rate, noting indications that the
new sewer pipe was built to serve developers and noting violations of Proposition
218. He expressed concerns about inaccurate information being provided to the
public, and he reiterated his opposition to paying infrastructure costs for new
development. He urged Council to review in surrounding the tripling of
sewer rates in the City of Dixon when Brookfield Homes came to build there.
b. Tony Ardone, Valero Car Wash owner, was recognized and expressed concern
about the inequity in the formula applied to car washes. He reviewed how car
washes are unfairly penalized by the sewer rate increase, and he noted that his
only solution is to install his own meter.

A MOTION was made by Council Member Smith, seconded by Council Member
Breeze, to introduce Ordinance No. 774. Under discussion, Council Member
Smith commented on the appropriateness of water and sewer operations not
running at a loss and maintaining reserves without General Fund subsidies, and he
noted that the new sewer interceptor pipe spared the City a public health disaster
during the heavy rains of late 2005. Council Member Breeze noted her support of
the City's efforts per the sewer interceptor pipe, and, at her request, Director of
Administrative Services Lipitz explained why it is advisable for the City to
maintain a surplus in the sewer and water funds. Vice Mayor Mackenzie
expressed support for the Staff Report, and he briefly reviewed the history of water
meters in Rohnert Park and the City's water supply policy per the General Plan.
He indicated that Russian River water will be an ongoing topic, as well as
discharge of treated affluent, and he stated that the City should have some
representation on the Board of Public Utilities. Mayor Vidak- Martinez discussed
how state and federal regulations drive the costs of water and sewer rates. After
the motion, which was UNANIMOUSLY APPROVED, reading was waived and
Ordinance No. 774 was INTRODUCED BY ROLL CALL VOTE.

7. WATER, SEWER, AND GARBAGE BILLING EXEMPTIONS AND REFUNDS:
Consideration of Amending Chapter 8.12, Chapter 13.12 and Chapter 13.44 of the Rohnert Park
Municipal Code to provide for water, sewer and garbage billing exemptions and refunds:
1. Staff Report: Director of Administrative Services Lipitz reviewed the contents of the
Staff Report and responded to Council questions and comments. At the suggestion of
Council Member Smith, City Attorney Kenyon agreed to include indemnification
language into the agreement, but that it was not necessary to include such language in
the ordinance.
2. Public Comments: None.

8. SEWER CAPACITY CHARGES:
Consideration of Sonoma County Request to Postpone Implementation of Sewer Capacity Charges:
1. Staff Report: City Manager Donley reviewed the contents of the Staff Report, and he
responded to Council questions and comments.
2. Public Comments:
a. Ken Jameson, Canon Manor, was recognized and urged Council to find a way for the
residents of Canon. Manor to pay off the sewer capacity charges in a reasonable
fashion.

b. Janis Garitas, Canon Manor, was recognized and conveyed to Council how the
charges have been confusing from a homeowner's perspective. She stated that there
is not even enough time to get a loan in order to pay the connection fee in a timely
manner, and she suggested that Council waive said fee for six months.
3. Resolution for Adoption:
2007 -14 Changing the Effective Date of Resolution No. 2006 -278 regarding Sewer
Capacity Charges
A MOTION was made by Vice Mayor Mackenzie, seconded by Council Member
Stafford, to adopt Resolution 2007 -14. Under discussion, Council Member Smith noted
that the opportunity to pay $6000 for the connection had been available to all Canon
Manor residents. He expressed disappointment at the behavior of certain Canon Manor
residents at a Council meeting back in November, 2006, and he briefly commented on
the threat of litigation. Council Member Breeze stated that Mayor Vidak- Martinez and
Vice Mayor Mackenzie had worked on Canon Manor issues for many years, and she
expressed concern about extending the deadline for payment. Vice Mayor Mackenzie
reviewed the history of the Canon Manor Subcommittee, and he reiterated that the City
acted openly and fairly on the matter of sewer hook -up fees. He noted his support for a
three -month extension of the payments. Mayor Vidak - Martinez reviewed her
participation on the Canon Manor Subcommittee, and she stated that Mike Kerns has
been a champion per this issue_ She also discussed the increase in home values in Canon
Manor due to the new sewer, and she noted that home equity loans are available to help
residents pay for the fee. After the discussion, said motion FAILED 2 -3, with Mayor
Vidak- Martinez .and Council Members Breeze and Smith dissenting.
9. SONOMA COUNTY WATER AGENCY STRATEGIC PRIORITIES:
Consideration of Letter to the Water Advisory Committee Chair regarding the Sonoma County
Water Agency Strategic Priorities:
Council discussion/action: Vice Mayor Mackenzie explained the letter to Council, and
Council CONCURRED to direct staff to send the letter over the Mayor's signature.
10. AGREEMENT WITH SONOMA COUNTY TRANSPORTATION AUTHORITY (SCTA):
Consideration of an Agreement with Sonoma County Transportation Authority regarding
Disposition of Regional Traffic Mitigation Funds from the University District Specific Plan:
Staff Report: City Manager Donley reviewed the contents of the Staff Report, and he
responded to Council questions and comments. Council CONCURRED with Vice
Mayor Mackenzie's recommendation that staff convey to LAFCO at the upcoming
meeting that neighboring cities be required to meet the same standards.
2. Public Comments:
a. Kevin Pohlson, 500 La Gonda Way, Suite 100, Danville, representing the University
District and Vast Oaks, expressed support for the City's approval of the SCTA
agreement regarding regional traffic fees. He noted that he will provide a letter
expressing his position on this matter.

3. Resolution for Adoption:
2007 -15 Authorizing and Approving an Agreement with Sonoma County
Transportation Authority regarding Disposition of Regional Traffic
Mitigation Funds from the University District Specific Plan
A MOTION was made by Vice Mayor Mackenzie, seconded by Council Member
Stafford, to adopt Resolution 2007 -15. Under discussion, *Council Member Breeze noted that the
University District is the first project to set aside regional traffic mitigation funds per the Development Agreement it has
with the City of Rohnert Park.* Council Member Smith indicated that he supports the concept,
but not the agreement as drafted. He expressed concern about the way that County
counsel negotiates matters. Vice Mayor Mackenzie called attention to Recital No. 4
regarding the duties of LAFCO, and City Attorney Kenyon discussed how recitals go
towards intent. After the motion, which was APPROVED 4 -1 with Council Member
Smith dissenting, reading was waived and Resolution 2007-15 was ADOPTED.

11. PARKS AND RECREATION COMMISSION:
Consideration of Amending Section 2.32.020 of the Rohnert Park Municipal Code to Change the
Parks and Recreation Commission from Seven to Five Members:
Staff Report: Assistant City Manager Schwarz reviewed the contents of the Staff
Report.

3. Ordinance for Introduction:
a. Waive Further Reading and Introduce Ordinance by reading title:
No. 778 Amending Rohnert Park Municipal Code Section 2.32.020,
"Established — Membership" Changing from Seven to Five Members
Upon MOTION by Council Member Smith, seconded by Council Member
Stafford, and UNANIMOUSLY APPROVED, reading was waived and
Ordinance No. 778 was INTRODUCED BY ROLL CALL VOTE.
12. PARKS, RECREATION, AND OPEN SPACE COMMITTEE:
Consideration of the composition of the Parks, Recreation and Open Space Committee:
1. Staff Report: Assistant City Manager Schwarz reviewed the contents of the Staff Report,
noting that the resolution will be amended to reflect this evening's withdrawal of Tom
Hansen's application for the Parks and Recreation Commission and his resignation from
the PROS Committee.

3. Resolution for Adoption:
2007 -16 Rescinding Resolution No. 2005 -02 and Approving and Authorizing the
Formation of the Parks, Recreation and Open Space Committee
A MOTION was made by Council Member Smith, seconded by Council Member
Breeze, to adopt Resolution 2007 -16. Under discussion, Council Member Smith
reiterated that the resolution shall (1) be amended to reflect Mr. Hansen's withdrawal,
and (2) be amended to include language that the PROS Committee shall include each
member of the Parks and Recreation Commission. He also thanked Council Member
Stafford for serving as the Council liaison with the PROS Committee. After the motion,
which was UNANIMOUSLY APPROVED, reading was waived and Resolution 2007-
16 was ADOPTED.
13. COMMISSION /COMMITTEEBOARD APPOINTMENTS:
1. Council action regarding nominations and appointments for two -year terms
expired on December 31, 2006:
Bicycle Advisory Committee: Council CONCURRED with the reappointment of
Charles Rowell for a two -year term to expire December 31, 2008.
Parks and Recreation Commission: Council CONCURRED with the new
appointment of Richard Armerding for a two -year term to expire December 31,
2008.
Sister Cities Relations Committee: Council CONCURRED with the
appointments of Ronald Rasmussen per Council Member Stafford and Olga Senyk
per Council Member Smith for two -year terms to expire December 31, 2008.
14. COUNCIL COMMITTEES AND /OR OTHER REPORTS:
1. Library Advisory Board meeting 1/16/07: Council Member Smith provided a brief
report.
2. Special Meeting/Work Session — Goal Setting, 1/17/07: Council Member Smith
expressed anticipation of another goal- setting session in March, 2007.
3. Parks, Recreation and Open Space Committee meeting, 1/17/07: Council Member
Stafford reminded Council of the forum to be held on February 7"'.
4. Sonoma County Waste Management Agency meeting, 1/17/07: Council Member Smith
DISTRIBUTED AND REVIEWED a SCWMA memo, and he noted that he missed
said meeting due to the Council's Goal- Setting meeting.
5. Senior Citizens Advisory Commission, 1/18/07: Council Member Stafford reported on
senior excursions.
6. Sonoma County Mayors' and Councilmembers' Association meeting, 1/18/07: Mayor
Vidak- Martinez called for Council Member ideas per programming. Said ideas included
Community Power, Pandemics/Public Health Disasters, and inviting Legislative
Representatives to come speak. She also shared with Council the various City Selection
Committee appointments and the Association appointments.

7. Other informational reports:
League of California Cities Mayors & Council Members Academy - Leadership Institute,
1/10 - 1/12/07: Council Members Stafford and Smith reported briefly on League training
in a variety of workshops.
League of California Cities — Policy Committee Meeting, 1/12/07: Vice Mayor
Mackenzie reported that he is the Vice Chair of Climate Protection and related issues,
and he called attention to an upcoming meeting.
Sonoma County Accountable Development Coalition Forum - Creating Great
Communities Near Transit, 1/18/07: Council Member Smith noted his attendance at said
forum.
Meeting with Rancho Verde residents: Council Member Breeze reported on an informal
meeting she had on January 12, 2007 with 4 -5 Rancho Verde residents. She stated that
she listened to the concerns of the residents and that she recommended (1) that the
residents ask the City Council to step forward as. a fact - finding body, and (2) that the
residents contact the Council's Mobile Home Parks Subcommittee members.
15. COMMUNICATIONS:
Communications per the attached outline were brought to the Council's attention. The following
communications were pulled for discussion:
a. Article in The Press Democrat about Kyle Jackson: Council Member Smith called attention to
said article about Kyle Jackson, a Rancho Cotate High School student, and he pointed out the
mention about Kyle's trip to Hashimoto, Japan, Rohnert Park's Sister City.
b. Jim Cronin's resignation from the Golf Course Oversight Committee: At the suggestion of
Vice Mayor Mackenzie, Council CONCURRED to direct staff to prepare a letter thanking Mr.
Cronin for his years of service.
16. MATTERS FROMIFOR COUNCIL:
1. Calendar of Events: Document provided in Council agenda packets.

3. Other informational items, if any:
a. Refurbishment of the Rogina family van for their handicapped daughter: At the
suggestion of Mayor Vidak- Martinez, Council CONCURRED to issue
proclamations honoring a mailman and a local automotive company, as well as the
group of individuals they assembled to assist in the refurbishment of the van.
b. Local Government Commission — Spring Conference, March 16 -18, re water and
land use matters: Vice Mayor Mackenzie noted said upcoming conference.

17. CITY MANAGER'S /CITY ATTORNEY'S REPORTS:
1. Review of Public Records Act Requests: City Manager Donley reviewed the contents of
the Staff Report.
2. Other informational items, if any:
a. Rancho Verde Subdivision Subcommittee meeting: City Manager Donley stated that
the Subcommittee recently met and reviewed and rejected the application for a
subdivision.
18. PUBLIC COMMENTS:
Debbie Clarkson, 510 Corte Naranja, was recognized and, as a resident of Rancho Verde
Mobile Home Park, she inquired of City Council whom the residents could come to for reliable
and unbiased information regarding the possible conversion of the park. City Attorney Kenyon
advised Council Members not to attend Rancho Verde Mobile Home Park meetings, and City
Manager Donley directed Housing and Redevelopment Manager Ellena to provide Ms.
Clarkson with her contact information.
ADJOURNMENT: Mayor Vidak- Martinez adjourned the City Council meeting at 9:55 p.m. to
consecutively and separately convene the meetings of the Community
Development Commission and the Rohnert Park Financing Authority.

recommendation to proceed with the Tax - Exempt Financing (Option 1).
