2007/02/27 City Council MinutesCITY OF ROHNERT PARK CONCURRENT MEETING MINUTES FOR: City Council Community Development Commission Rohnert Park Financing Authority February 27, 2007 Tuesday The Concurrent Meetings of the City of Rohnert Park for the City Council, the Community Development Commission and the Rohnert Park Financing Authority met this date for a Special Meeting /Work Session, to commence at 6:00 p.m., followed by a Regular Meeting at the Rohnert Park City Nall, 6750 Commerce Boulevard, Rohnert Park, with Mayor Vidak- Martinez presiding. TREE PRESERVATION AND PROTECTION ORDINANCE: Consideration of Proposed Rohnert Park Municipal Code Amendments and Additions to Chapter 12.24 (Public Tree Care) and Chapters 17.04 (Definitions) and 17.15 (Tree Preservation and Protection) of Title 17 - Zoning (File Number PL2006 -031 MC): Senior Planner Rich shared the contents of a PowerPoint presentation per the Staff Report. City Arborist Edson and City Manager Donley responded to Council questions and comments regarding Single - family fully developed R -L zoned lots, Green Building considerations, a public education program, large shade trees in large parking lots, drought- resistant trees, the problems with redwood trees, plans for new developments, heritage trees for Rohnert Park, and inventorying the City's trees. 2. Council discussion /direction: Council discussion concluded with CONCURRENCE on the following matters: (1) Council support for exemption for all developed single - family lots; (2) Council support of the need for a public educational program; (3) Council support for requiring of developers large shade trees in all new developments /remodels and regional shopping centers; (4) Council support for categorical funding for tree preservation; and (5) Council support to' maintain the job description for the City Arborist job. Council supported an inventory of all of the City's trees but acknowledged that this would be impractical at this time. Additionally, City Arborist Edson suggested that the City purchase a 60 -foot bucket so that the services of a contractor will not be needed to prune the City's tallest trees. Council Member Smith suggested that staff consider planning an Arbor Day celebration and /or look into the organization known as Tree City USA. REGULAR SESSION: Mayor Vidak- Martinez reconvened Regular Session at 7:27 p.m. PLEDGE OF ALLEGIANCE: Cooper Nicks, 0' grade student from Monte Vista Elementary School, led the Pledge of Allegiance. SCHEDULED APPEARANCE/PRESENTATION: 1. Bill Appledorf re Santa Alicia Footbridge: Mayor Vidak - Martinez indicated that said item has been pulled from the agenda. Council Member Smith referred to a message from Mr. Appledorf indicating that his concerns about gang activities have been fully addressed at this time by Council Member Smith and City Manager Donley. SSU STUDENT REPORT: Sonoma State University Associated Students, Inc. by Whitney Diver, Legislative Representative: Ms. Diver DISTRIBUTED copies of The Star to Council, and she reported on the following matters: (1) Possible rolling walk -out strikes by the faculty per pay raise negotiations; (2) Visits by the California State University Board of Trustees; (3) Accreditation for the Student Health Center: (4) Student Body elections. 4. UNSCHEDULED PUBLIC APPEARANCES /COMMENTS: 1. Christina Chadwick, 7065 Adele Avenue, was recognized and expressed support for construction of a sound wall to Southwest Boulevard. She cited safety concerns and urged the Council to protect the people of Rohnert Park. 2.. Erin Armstrong, 840 Lancewood, was recognized and INVITED Council Members to attend the March 14`h tour of the Rancho Cotate High School campus at 9 a-m. Council Member Smith asked Ms. Armstrong to E -mail Council Members with reminders of said monthly tour. 5. CONSENT CALENDAR: A. Ordinance for Introduction: Waive Further Reading and Introduce Ordinance by reading title: No. 780 Adding Chapter 8.34 regarding "Use Permits for Alcoholic Beverage Establishments," to the Rohnert Park Municipal Code to Adopt a Use Permit Requirement for Alcoholic Beverage Establishments Mayor Vidak- Martinez stated that said item would be deferred, per staff recommendation, to the second City Council meeting in March. At the suggestion of Council Member Smith, Council CONCURRED TO DEFER consideration by the full Council of said ordinance to the first meeting in April 8. MEDICAL MARIJUANA DISPENSARIES: Consideration of Amendments to Sections 17.04.030, 17.06.060, and 17.06.130 of the Rohnert Park Municipal Code (Land Use Regulations) regarding Medical Marijuana Dispensaries (File PL2005- 025MC): 1. Staff Report: Director of Community Development Bendorff shared the contents of the Staff Report via a PowerPoint presentation. Public Safety Commander Giesige provided a report regarding the Department of Public Safety's concerns. San Francisco' Drug Enforcement Agency (DEA) Field Division Representative Anna Mathis provided a report regarding federal law and medical marijuana dispensaries. 2. PUBLIC HEARING: Mayor Vidak - Martinez opened the Public Hearing at 9:14 p.m. 1. Dona Frank, Operator of a medical marijuana dispensary on Santa Rosa Avenue, P.O. Box 14146, Santa Rosa, was recognized and expressed support for dispensaries. She referred back to the Alcoholic Beverage Sales staff report citing 71 establishments that sell alcohol in Rohnert Park, and 5029 alcohol- related police calls Iast year. She stated that the dispensary she operates had zero calls in 2006. She discussed the elaborate security system on the premises, and she noted her recommendation that the marijuana be grown in industrial areas, not residential homes. She urged Council to look beyond the fear tactics in the staff report and to be progressive in recognizing the need for medical marijuana dispensaries. 2. Tim Ritter, 7 Issel Lane, was recognized and discussed aspects of Proposition 215. He said it is up to cities to force the state's hand in providing direction on a community's role in regulating the dispensing of medical marijuana. John Laughlin, Counselor, Educational Psychologist, School District, 5860 Labath, was recognized and discussed the huge problem of marijuana in schools. He noted easy accessibility to marijuana for students, and he expressed support for Public Safety's position on the matter of medical marijuana dispensaries. 4. Susan Adams, Rohnert Park Planning Commissioner, 5758 Davis Circle, was recognized and urged the Council to adopt the ordinance which would clarify that a medical marijuana dispensary is not a pharmacy and thereby not a land use that would be pennitted within the City. 5. Ellen Beardsley, via letter, 7276 Barb] Lane: Supports legalized and controlled use of medical marijuana, but opposed to a medical marijuana dispensary within the City of Rohnert Park. Mayor Vidak - Martinez closed the Public Hearing at 9:27 p.m. 3. Ordinance for Introduction: Waive Further Reading and Introduce Ordinance by reading title: No. 781 Amending Sections 17.04.030, 17.06.060, and 17.06.130 of the Rohnert Park Municipal Code (Land Use Regulations) regarding Medical Marijuana Dispensaries A MOTION was made by Council Member Stafford, seconded by Vice Mayor Mackenzie, to introduce Ordinance No. 781 _ Under discussion, Council Member Smith stated that he has met people who have benefited from medical marijuana. He noted that there has been no ground swell of support for dispensaries in Rohnert Park, and that delivery service is a safe option to dispense the medical marijuana. He indicated that when the State gives clear guidelines, Council can possibly reconsider the matter at that time. Council Member Stafford stated that when, dispensaries were voted oil, it was not envisioned that there would be one in every City. She commended the Planning Commission's work in this matter. Vice Mayor Mackenzie expressed support for delivery services, and he noted that when the State takes action, the matter can come before Council again. Mayor Vidak- Martinez stated that she has personally dealt with catastrophic illness, and she noted that her concern is for the ill in terms of pureness and dosage and other regulatory matters. She expressed a desire to wait for the State to establish clear guidelines. After the motion, which was APPROVED 4 -0 -1 with Council Member Breeze absent, reading was waived and Ordinance No. 781 was INTRODUCED BY ROLL CALL VOTE. NUISANCE ABATEMENT - GRAFFITI UPDATE: Review of issues relating to graffiti in Rolinert Park and staff efforts to reduce /abate graffiti problems: 1. Staff Report: Assistant City Manager Schwarz shared the contents of the Staff Report. 2. Council discussion /direction: Council discussion concluded with Council CONCURRENCE with the staffs recommendations. 10. SOUND WALLS ON HIGHWAY 101: Consideration of Sound Walls on Highway 101: 1. Staff Report: Director of Public Works /City Engineer Jenkins reviewed the contents of the Staff Report. Mayor Vidak - Martinez called forward members of the public who submitted speaker cards for this matter. 1. Constance Cordwell, Rohnert Park, was recognized and urged Council, if they approve the sound wall, to do it right and extend it a sufficient distance to deal with the noise and pollution problems in the area. 2. Christina Chadwick, Rohnert Park, was recognized. She reviewed noise and safety issues in the area of the proposed sound wall, and she urged Council to build a sound wall to protect citizens and cyclists_ 2. GREEN BUILDING ORDINANCE: Consideration of Addition of Chapter 1 4.50, "Green Building" to the Rohnert Park Municipal Code and Consideration of Resolutions Adopting Green Building Standards and Compliance Threshold Levels: 1. Staff Report: Building Official Bruck reviewed the contents of the Staff Report and responded to Council questions and comments. 2. Public Comments: 1. Richard Pope, Sonoma Mountain Village Project Manager, CEO St. James Properties, was recognized and congratulated the City for taking the initiative with its Green Building Ordinance. He noted that Codding Enterprises supports and embraces sustainable building. Under discussion, Council Member Smith noted that the Climate Protection Campaign will be receiving national honors for its work. Council Member Stafford thanked Building Official Bruck for his efforts. Vice Mayor Mackenzie called attention to the City's Sustainability Ordinance and thanked staff for their efforts. Resolution for Adoption: 2007 -29 Approving and Adopting Green Building Standards and Rating Systems for Construction of Buildings of Certain Covered Project Types Upon MOTION by Vice Mayor Mackenzie, seconded by Council Member Smith, and APPROVED 4 -0 -1 with Council Member Breeze absent, reading was waived and Resolution 2007 -29 was ADOPTED. 5. Resolution for Adoption: 2007 -31 Amending the Engineering Fee Schedule, Adopted by Resolution No. 2006 -39, to Add a Fee for State Franchised Cable Operators or Video Service Providers Who Appeal the Denial of an Encroachment Permit to the City Council Upon MOTION by Vice Mayor Mackenzie, seconded by Council Member Stafford, and APPROVED 4 -0 -1 with Council Member Breeze absent, reading was waived and Resolution 2007 -31 was ADOPTED. 13. SONOMA COUNTY MAYORS' & COUNCILMEMBERS' ASSOCIATION: Consideration of vacancies to be filled at the March 8, 2007, Meeting of the Sonoma County Mayors' and Councilmembers' Association: Council discussion/direction/action: As noted below. City Selection Committee Appointments: Airport Land Use Commission: Council AGREED to support the appointments of John Sawyer and Sam Salmon. Local Agency Formation Commission Alternate: Vice -Mayor Mackenzie and Councilmember Stafford concurred with Mayor Vidak- Martinez' suggestion to defer this item to see if others apply in addition to Teresa Barrett and to support Mayor Vidak- Martinez' selection. Councilmember Smith noted his support for the appointment of Teresa Barrett. 2. Association Appointments: Association of Bay Area Governments Executive Board: Council AGREED to support Pam Torliatt's appointment with Susan Gorin as an alternate. Council Member Smith and Vice Mayor Mackenzie expressed interest in serving as alternates North Coast Rail Authority Board of Directors: Council AGREED to support the appointment of Council Member Smith. 3. Legislative Committee a. Consideration of whether to recommend that the Legislative Convnittee be continued: Council CONCURRED. b. Consideration. of whether to recommend that the Legislative Committee conform to Bylaws for established terms (two years for committees, with incumbents eligible for reappointment for an additional two years) or continue to let each City establish its own member's term of office for this committee? : Council CONCURRED to continue to let each city establish its own member's term of office for this committee. 4. Approval of Meeting Dates for 2007 The Board discussed the request from Jake Mackenzie to consider five general membership meetings and five alternate =month Board of Directors meetings per year in lieu of the new - quarterly schedule that combines both meetings on the same night.. The consensus of the Board was to have five general membership meetings per year with the next meeting in March, combined with the Board of Directors meetings, but would like each Mayor to take . this item back to their respective Councils with a final vote to be taken at the next Board meeting: Council CONCURRED with the Board's consensus. 14. COUNCIL COMMITTEE AND /OR OTHER REPORTS: 1. Redwood Empire Municipal Insurance Fund - Public Agency Risk Managers Association Conference, 2/13 -2/16: Council Member Smith noted his attendance at said conference. 2. Santa Rosa Plain Conservation Strategy Implementation Committee (California Tiger Salamander) (CTS) meeting, 2/20: Vice Mayor Mackenzie noted his attendance at said meeting. Assistant City Manager Schwarz shared comments regarding implementation matters. At the suggestion of Vice Mayor Mackenzie, Council CONCURRED TO AGENDIZE. for a future agenda consideration of the costs for a possible CTS plan. 3. Sonoma -Mann Area Rail Transit District Board meeting, 2/21: Vice Mayor Mackenzie noted his attendance at said meeting and related relevant matters concerning the location of the Rohnert Park SMART Station to Council. 4. Sonoma County Waste Management Agency meeting, 2/21: Council Member Smith noted his attendance at said meeting and related relevant matters to Council. 5. Other informational reports: City of Rohnert Park CONCURRENT MEETINGS Minutes (11 of 14) February 27 2007 for City CounciUCommunity Development Commission/Rohnert Park Financing Authority California Transportation Commission meeting, 2/20: Vice Mayor Mackenzie stated that he could not attend said meeting due to his attendance at a State Water Control Resources Board meeting. Business Environmental Alliance 6`h Annual Business Breakfast, 2/22: Council Members Smith and Stafford and Vice Mayor Mackenzie noted their attendance at said breakfast meeting. Arbors Grand Opening, 2/23: Mayor Vidak - Martinez noted that all Council Members present attended the grand opening. Talking Points re Santa Rosa Memorial Hospital /Sutter Hospital merger discussions: Council Member Smith noted that he and City Manager Donley attended said discussions. He stated that Memorial will be contacting the City to schedule. an agenda item per urgent care center matters. Community Target- Setting Workshop: Vice Mayor Mackenzie SUBMITTED applications to Mayor Vidak- Martinez for Climate Protection Campaign representatives from the community. 15. COMMUNICATIONS: Communications per the attached outline were brought to the Council's attention. The following communications were pulled for discussion: a. Noreen Evans' bill to protect mobile home park residents from conversion of mobile home parks to condominiums: Council Member .Smith noted his participation in the press conference regarding this announcement. b. Letter from Katie Crump, resident, re traffic problems near Rancho Cotate High School: Vice Mayor Mackenzie stated that he is meeting with Ms. Crump on the morning of March 13'h per her concerns. Mayor Vidak - Martinez stated that she referred Ms. Crump to City Manager Donley. Council Member Smith stated that he corresponded with Ms. Crump as well. 16. MATTERS FROM/FOR COUNCIL: 1. Sonoma State University (SSU) sewer contract matters: City Manager Donley noted that he met with Dan Condron from SSU. He recommended that the SSU Subcommittee meet with himself prior to setting up a meeting with SSU. Council Member Smith requested that City Attorney Kenyon be present at said Subcommittee meeting. b. University District Master Property Tax Agreement: Assistant City Manager Schwarz reported that the County Board of Supervisors upheld with a 5 =0 vote staff's recommendation per the University District regarding the property tax agreement. 18. PUBLIC COMMENTS: Members of the public desiring to speak were called forward. No members of the public responded.
