The Concurrent Meetings of the City of Rohnert Park for the City Council, the Connnunity
Development Commission and the Rohnert Park Financing Authority met this date for a Special
Meeting/Work Session, to commence at 5:00 p.m., followed by a Regular Meeting at the Rohnert
Park City Hall, 6750 Commerce Boulevard, Rohnert Park, with Mayor Vidak - Martinez presiding.
SPECIAL MEETING/WORK SESSION
Call to Order: Mayor Vidak- Martinez called the Special Meeting /Work Session to order at 5:05
p.m.

Absent: Stafford (Excused)
Staff present for all or part of the Special Meeting/Work Session and/or Regular Session: City
Manager Donley, Assistant City Attorney Whelan, Assistant City Manager Schwarz, Director of
Administrative Services Lipitz, Director of Community Development Bendorff, Director of Public
Works /City Engineer Jenkins, Housing and Redevelopment Manager Ellena, Management Analyst

I. SIX -MONTH FINANCIAL REVIEW:
Director of Administrative Services Lipitz reviewed the contents of the Mid -Year Budget PowerPoint
presentation, and she responded to Council questions and comments.
II. THREE -YEAR FINANCIAL REVIEW:
Director of Administrative Services Lipitz reviewed the contents of the Mid -Year Budget PowerPoint
presentation, and she responded to Council questions and comments. City Manager Donley reviewed
his March 27, 2007 memo to the Council Members.
Council discussion/direction: All Council Members thanked staff for the Mid -Year Budget
Review. Council Member Smith noted the realistic projections, and he suggested that pot holes need
to be repaired, that Performing Arts Center (PAC) and Parks and Recreation subsidies be reduced to
one - third, and that the Special Enforcement Unit (SEU) merge into the regular unit. Council
Member Breeze asked that staff come back with dollar values or percentages in terms of cutting back
operational expenses. Vice Mayor Mackenzie noted his record of voting against staff salary
increases. He expressed concern about the City's reserves, and he stated that the health and safety of
citizens is the starting point for determining the essential services of the city. Mayor Vidak- Martinez
indicated that the city has balanced its budget by selling its assets, and yet still it faces a very large

medical benefits deficit. She noted that the purpose of reserves is to keep the city running through an
emergency /crisis situation. She asked that staff review how to maintain a quality of life in Rohnert
Park, and she suggested that staff come back with suggestions on how to do things differently, how to
use the City's assets to its advantage, and how to be early adopters of various programs. In response
to City Manager Donley's inquiry regarding a letter from staff to the Federated Indians of Graton
Rancheria (FIGR), Council AGREED that any funding received from the Tribe per the City's
request must be used only for the SEU or to fund a School Resources Offices, or said funds must be
returned.

CITY COUNCIL REGULAR MEETING
Call to Order: Mayor Vidak- Martinez called the Regular Meeting to order at 6:15 p.m.

CLOSED SESSION: Mayor Vidak- Martinez adjourned to a Dinner Break and Closed Session at
6:15 p.m. Council discussed Labor Negotiations in Closed Session.
REGULAR SESSION: Mayor Vidak- Martinez reconvened Regular Session at 6:50 p.m.
PLEDGE OF ALLEGIANCE:
Ashley Wilson and Joe Lozano, students from La Fiesta Elementary School, led the Pledge
of Allegiance. Mayor Vidak- Martinez PRESENTED Ashley and Joe each with a card and a'pen.
1. MAYOR'S REPORT ON CLOSED SESSION:
Mayor Vidak- Martinez stated that no reportable action was taken in Closed Session.
2. SCHEDULED APPEARANCES /PRESENTATIONS:
Dawna Gallagher re: Water & Open Space /Presentation of Proposed Resolution: Ms. Gallagher
showed Council a map from the State of the recharge areas in and around Rohnert Park. She
DISTRIBUTED a copy of the caption in the case of Sonoma County Water Coalition, et al. v.
Sonoma County Water Agency, and she urged the Council to take action to save the City's
wells and protect its water supply. She suggested that Council stop litigating its Water Supply
Assessment and work with the University District to sell certain surplus school land to the Open
Space District. Mayor Vidak- Martinez inquired where Ms. Gallagher got her information.

Mayor's Presentation of Proclamations:
Proclaiming April as Parkinson's Awareness Month in Rohnert Park: Mayor Vidak-
Martinez read said resolution.
2. Proclaiming April as Child Abuse Prevention Month to Sonoma County Child Abuse
Prevention Coordinating Council: Robin Bowen explained how the Child Abuse
Prevention Coordinating Council serves Sonoma County. She DISTRIBUTED
wristbands, pins, posters, and bookmarks for the Child Abuse Council, as well as a flier
for the "Blue Ribbon Campaign to Prevent Child Abuse" fundraiser on Monday, April 9",
at Mary's Pizza Shack. Mayor Vidak- Martinez discussed the importance of being a
mandated reporter.

Sonoma State University Associated Students, Inc. by Whitney Diver, Legislative Representative:
Ms. Diver DISTRIBUTED copies of The Star to Council, and she reported that the California
Faculty Association voted to support the strike with an agreement reached not to do so until April
6 "'- Council Member Smith and Vice Mayor Mackenzie noted their attendance at Sea Wolf Day.
Mayor Vidak- Martinez indicated that she made a presentation to the Student Senate.
4. UNSCHEDULED PUBLIC APPEARANCES /COMMENTS:
Mary Anne Doan, Executive Director, Community Child Care Council of Sonoma County, was
recognized and discussed various programs and services of the Council, from child care
referrals to parenting classes. She DISTRIBUTED her card and an informational brochure, as
well as an invitation to the "Tuxedos `n' Tennis Shoes" fundraiser on April 21 S`
2. Chip Worthington, 4695 Snyder Lane, was recognized and expressed concern that due diligence
has not been done in terms of sewer and water for the casino. He requested that Council join
Sebastopol, Petaluma, and Santa Rosa in requesting an extended comment period for the Draft
Environmental Impact Study (EIS).
Dawna Gallagher, 5025 Country Club Drive, was recognized and questioned how Council
reconciles urban sprawl with its goal of sustainability, including reduction of greenhouse gases.
She suggested that City staff and Council support the developers rather than the City's stated
goals of sustainability. Council Members responded to Ms. Gallagher's comments.

Council Member Smith signified removal of Resolution 2007 -41. Vice Mayor Mackenzie signified

Upon MOTION by Vice Mayor Mackenzie, seconded by Council Member Smith, and
APPROVED 4 -0 -1 with Council Member Stafford absent, reading was waived and the Consent
Calendar, with the exception of Resolution Nos. 2007 -41, 2007 -43, and 2007 -45, was ADOPTED.
Items for Consideration:
2007 -41 Re- designating the Sonoma County Transportation Authority as the
Sonoma County Program Manager of the AB 434 Motor Vehicle
Registration Fee Fund, Named the Transportation Fund for Clean Air
(TFCA) Program
Council Member Smith expressed support for said resolution as long as it is only a one -year
resolution. He expressed a desire for the City to keep its future options open. Upon MOTION by
Council Member Smith, seconded by Vice Mayor Mackenzie, and APPROVED 4 -0 -1 with
Council Member Stafford absent, reading was waived and Resolution 2007 -41 was ADOPTED AS
AMENDED to have a one -year duration, with staff flagging the resolution in approximately nine
months' time for the SCTA representative to address said matter.

Vice Mayor Mackenzie explained the resolution and staff's use of consultants' reports. A
MOTION was made by Vice Mayor Mackenzie, seconded by Council Member Breeze, to adopt
Resolution 2007 -43. Under discussion, Council Member Smith stated that Ms. Gallagher's
comments earlier this evening regarding the City Attorney and the City Engineer were slanderous
and unhelpful. After the motion, which was APPROVED 4 -0 -1 with Council Member Stafford
absent, reading was waived and Resolution 2007 -43 was ADOPTED.
2007 -45 Calling for Sealed Bids or Proposals for the Rohnert Park City Hall,
130 Avram Ave., Project No. 2004 -33
Vice Mayor Mackenzie and Council Member Smith discussed how this resolution represents the
City's' efforts at sustainability. Upon MOTION by Vice Mayor Mackenzie, seconded by Council.
Member Smith, and APPROVED 4 -0 -1 with .Council Member Stafford absent, reading was
waived and Resolution 2007 -45 was ADOPTED.
6. ENERGY EFFICIENCY STANDARDS ORDINANCE:
Consideration of Adding Title 14, Chapter 14.02 to the Rohnert Park Municipal Code and
Adopting Local Energy Efficiency Standards for Buildings Covered by the 2005 California
Building Energy Efficiency Standards:
1. Staff Report: Building Official Bruck reviewed the contents of the Staff Report.
2. Public Comments: None.
3. Ordinance for Adoption:
Waive Further Reading and Adopt Ordinance by reading title:
No. 779 Adding Title 14, Chapter 14.02 to the Rohnert Park Municipal Code
and Adopting Local Energy Efficiency Standards for Buildings Covered
by the 2005 California Building Energy Efficiency Standards
A MOTION was made by Council Member Smith, seconded by Vice Mayor Mackenzie
to adopt Ordinance No. 779. Under discussion, Council Member Smith discussed how
this is an important step for sustainability and greenhouse gas reduction. He noted that
cost would be small and payoff would be fast. Council Member Breeze stated that while
this is an important ordinance for sustainability, said costs are passed down to the
consumer, and that may cause some families not to be able to afford a home in Rohnert
Park. Vice Mayor Mackenzie noted that increased energy costs will be reduced for the
new homeowners, and he called attention to the Environmental Technology Center at
SSU. After the motion, which was APPROVED 4 -0 -1 with Council Member Stafford
absent, reading was waived and Ordinance No. 779 was ADOPTED BY ROLL CALL
VOTE.
7. GREEN BUILDING ORDINANCE:
Consideration of Addition of Chapter 14.50, "Green Building" to the Rohnert Park Municipal
Code:

A MOTION was made by Vice Mayor Mackenzie, seconded by Council Member Smith,
to adopt Ordinance No..782. Under discussion, Council Member Smith reemphasized
his comments under Ordinance No. 779. After the motion, which was APPROVED 4 -0-
1 with Council Member Stafford absent, reading was waived and Ordinance No. 782 was
ADOPTED BY ROLL CALL VOTE.
8. CALIFORNIA PUBLIC EMPLOYEES' RETIREMENT SYSTEM (CaIPERS) CONTRACT
AMENDMENT:
Consideration of an Amendment to the Contract between the City Council of the City of Rohnert
Park and the Board of Administration of the California Public Employees' Retirement System
(CaIPERS):
1. Staff Report: City Manager Donley reviewed the contents of the Staff Report and
responded to Council questions and comments.
2. Public Comments: None.
3. Resolution for Adoption:
2007 -50 Intention to Approve an Amendment to Contract between the Board of
Administration, California Public Employees' Retirement System and
the City Council, City of Rohnert Park
A MOTION was made by Vice Mayor Mackenzie, seconded by Council Member
Breeze, to adopt Resolution 2007 -50. Under discussion, Council Member Smith called
for a plan from staff on how to pay for these increases. Vice Mayor Mackenzie stated
that the City does have a contract with the bargaining units, and that this resolution
shows that it is acting in good faith under State labor law. After the motion, which was
APPROVED 3 -1 -1 with Council Member Smith dissenting and Council Member
Stafford. absent, reading was waived and Resolution 2007 -50 was ADOPTED.

After the motion, which was APPROVED 3 -1 -1 with Council Member Smith dissenting
and Council Member Stafford absent, reading was waived and Ordinance No. 784 was
INTRODUCED BY ROLL CALL VOTE.
9. ANNUAL STATUS REPORT ON THE GENERAL PLAN FOR CALENDAR YEAR 2006:
Consideration of the Annual Status Report on the General Plan for Calendar Year 2006 (Planning
File: PL2007- 006GP):
1. Staff Report: Director of Community Development Bendorff reviewed the contents of
the Staff Report via a PowerPoint presentation.
2. Public Comments:
Linda Burke, Sebastopol, was recognized and asked Council how the City can reconcile
its goals of sustainability with the water and sewer problems, traffic congestion, and
pollution that come with large new developments. She noted that the City of Sebastopol
is not approaching sustainability in this manner, and she urged the Council to consider
the path that it is taking.
3. Council discussion/direction: Council Members shared comments about their review
of the Annual Status Report, and they CONCURRED to accept said report.
10. REQUEST FOR PROPOSALS FOR THE GENERAL PLAN UPDATE AND
ENVIRONMENTAL IMPACT REPORT:
Consideration of Authorizing Staff to Distribute a Request for Proposals for the General Plan
Update and Environmental Impact Report (Planning File: PL2007- 007GP):
1. Staff Report: Director of Community Development Bendorff reviewed the contents of
the Staff Report, and he responded to Council questions and comments.
2. Public Comments: None.

11. PUBLIC ART ORDINANCE:
Consideration of Proposed Addition of Chapter 17.18 (Public Art) to the Rohnert Park Municipal
Code (Planning File: PL2006- 029MC):
1. Staff Report: Director of Community Development Bendorff reviewed the contents of
the Staff Report.
2. Public Comments: None.
3. Ordinance for Introduction:
Waive Further Reading and Introduce Ordinance by reading title:
No. 785 Adding Chapter 17.18, "Public Art," to the Rohnert Park Municipal
Code
A MOTION was made by Council Member Smith, seconded by Council Member
Breeze, to introduce Ordinance No. 785. Under discussion, all Council Members
thanked members of the Cultural Arts Commission and the Planning Commission for
their efforts with this ordinance. Council Member Smith stated that public art will help
retail businesses. Council Member Breeze stated that while she is grateful for public art,
there is a cost that is passed on to the developer and then to the homeowner. Mayor
Vidak- Martinez expressed support for the policy of having the art reviewed by the
Cultural Arts Commission, then the Planning Commission, and finally the City Council.
After the motion, which was APPROVED 4 -0 -1 with Council Member Stafford absent,
reading was waived and Ordinance No. 785 was INTRODUCED BY ROLL CALL
VOTE.
4. Resolution for Adoption:
2007 -51 Approving and Adopting Public Art Ordinance Guidelines
Upon MOTION by Vice Mayor Mackenzie,. seconded by Council Member Breeze, and
APPROVED 4 -0 -1 with Council Member Stafford absent, reading was waived and
Resolution 2007 -51 was ADOPTED.
12. COUNCIL COMMITTEE AND /OR OTHER REPORTS:
1. National League of Cities 2007 Congressional City Conference, 3/10 -3/14: Mayor Vidak-
Martinez noted her attendance at several sustainability workshops. She DISTRIBUTED
AND REVIEWED a pamphlet entitled, "Preparing for Pandemic Influenza," as well as an
article about Energy Committee activities and opportunities for the City. Vice Mayor
Mackenzie suggested a meeting with Tom Roth from Lynn Woolsey's office.
2. Association of Bay Area Governments: Sonoma County -wide Meeting — Local
Governments Setting Bay Area Growth, Conservation and Funding Priorities, 3/12/07:
Vice Mayor Mackenzie and Council Member Smith reported on discussions regarding
Primary Development matters. Vice Mayor Mackenzie noted that Sonoma Mountain
Village was the front -page story in the Real Estate section of San Francisco's Sunday
Chronicle.

3. Local Government Commission Conference - Building Livable Communities: Moving the
Smart Growth/Water Sustainability Agenda Forward, 3/16 -3/18: Vice Mayor Mackenzie
and Council Member Smith reported on the importance of the City positioning itself well
to receive bond monies for various projects.
4. City Council Special Meeting /Work Session — Goal Setting: Council Members shared
their perspectives on the helpfulness of the meeting and the positive interchange between
City staff and City Council.
5. Santa Rosa Plain Conservation Strategy Implementation Committee (California Tiger
Salamander) meeting, 3/20: Assistant City Manager Schwartz reported on CTS cost
issues.
6. Sonoma County Waste Management Agency meeting, 3/21: Council Member Smith noted
his attendance at said meeting and reported that there was no budget as of this time.
7. Parks, Recreation and Open Space Committee (PROS), 3/21: Assistant City Manager
Schwarz reported on School District matters.
8. Association of California Water Agencies Legislative Symposium, 3/21: Vice Mayor
Mackenzie reported on his meeting with Senator Pat Wiggins, as well as the State Water
Board Contract meeting the next morning.
9. Association of Bay Area Governments Hazardous Waste Management Facility Allocation
Committee meeting, 3/23: Council Member Smith reported on hazardous waste matters,
particularly pharmaceutical waste in the water system.
10. Other informational reports, if any:
Coast Guard Training Center Opening, 3/14: Council Member Smith reported on
said opening at Two Rock.
Cotati - Rohnert Park Kiwanis Club Charter Ceremony for the Rancho Cotate High
School Key Club, 3/20: Council Member Smith noted his attendance at said
ceremony.
Opening Night at Performing Arts Center, 3/23: Council Member Smith noted his
attendance at said performance.
North East Specific Plan Area: Council Member Smith noted that in said meeting
today he encouraged the North East SP representatives to move forward and to
review the University District's plan.
Rancho Cotate Booster Event: Vice Mayor Mackenzie reported on the phased
development plan.
Water Advisory Committee /Technical Advisory meeting: Vice Mayor Mackenzie
reported on the resolution to be presented to the Board of Supervisors, and Council
CONCURRED to give him authority to represent the City on water supply issues at
upcoming meetings.

Rancho Verde Mobile Home Park Town Hall Meeting re Condo Conversion, on April 5 "': Council
Member Smith called attention to said announcement.
Letter from Judith Paulson, El Cajon resident, to Department of Public Safety, commending
Detective Steve Horton, and attached response letter to Ms. Paulson from Director of Public Safety
Bullard: Council Member Smith called attention to said letter commending the Department of
Public Safety and Detective Horton.
14. MATTERS FROM /FOR COUNCIL:
1. Schedule of Events and Meetings: Document provided to Council in agenda packets.
2. City Council Agenda Forecast: Document provided to Council in agenda packets.
Mayor Vidak- Martinez noted that she will miss the next Council meeting while she
recovers from surgery.

15. CITY MANAGER'S /CITY ATTORNEY'S REPORTS:
1. Legislative Report: Assistant City Manager Schwarz reviewed the contents of the Staff
Report.
Council discussion /direction: Council discussion concluded with Council
CONCURRENCE to continue the practice of allowing the Mayor to sign letters in
support of positions adopted by the League of California Cities.
2. Sami Tawasha's Donation: Council discussion concluded with Council
CONCURRENCE to direct staff to disburse Mr. Tawasha's $1000 donation with half
going to recreational scholarships /programs and half going to the Animal Shelter.
3. Community Gardens: City Manager Donley stated that next Tuesday he and Mayor
Vidak- Martinez will be meeting with representatives from Occidental to discuss where to
establish community gardens.
4. 2007 Helen Putnam Awards: City Manager Donley provided an update on the
applications.
5. Other informational items, if any:
Environmental Impact Study (EIS) meeting, 4/4 -5: City Manager Donley noted said
meeting and provided an update on the status of requests for an extension.

16. PUBLIC COMMENTS:
1. Fred Soares, Interim Mayor of Bellevue Township, 4319 Primrose Avenue, was recognized and
expressed concern about the water supply for the casino, as well as the health of the Laguna de
Santa Rosa in the area. He stated that the residents of the Southwest County are the City's
downstream neighbors, and as such he asked the City to adhere to its sustainable policies, as
well as to attend to the overgrown weeds blocking the City's sign on the road to Stony Point.
2. Pam Miller, Southwest Neighborhood Alliance 4306 Primrose Avenue, was recognized and
reviewed the impacts of the City's development on the Southwest neighborhood, citing
problems including traffic, trash, flooding, and drinking water. She called attention to
Council's Five Goals and urged the City to be a neighbor to the Southwest residents.
ADJOURNMENT: Mayor Vidak- Martinez adjourned the City Council meeting at 9:29 p.m. to
consecutively and separately convene the meetings of the Community
Development Commission and the Rohnert Park Financing Authority.

Consent Calendar, as outlined in the agenda, was APPROVED 4 -0 -1 with
Commissioner Stafford absent.
