The Concurrent Meetings of the City of Rohnert Park for the City Council, the Community
Development Commission and the Rohnert Park Financing Authority met this date for a Joint
Meeting, to commence at 6:00 p.m., between the City Council and the Community Development
Commission, followed by a Regular Meeting at the Rohnert Park City Hall, 6750 Commerce
Boulevard, Rohnert Park, with Mayor Vidak- Martinez presiding.

Call to Order: Mayor Vidak - Martinez called the Joint Meeting to order at 6:03 p.m.

CLOSED SESSION
Mayor Vidak- Martinez adjourned City Council to CIosed Session at 6:03 p.m. to discuss Labor
Negotiations and Real Estate Negotiations. Mayor Vidak- Martinez adjourned the Joint Meeting of
the City Council and the CDC to convene the City Council Regular Meeting.

Mayor Vidak- Martinez convened the City Council Regular Meeting at 7:08 p.m.

PLEDGE OF ALLEGIANCE:
Madeline Camilleri, Student, Monte Vista Elementary School, was not present to lead the Pledge of
Allegiance. Mayor Vidak- Martinez led the Pledge of Allegiance.
MOMENT OF SILENCE:
City Council and the audience observed a Moment of Silence in memory of Sergeant Mario K.
Deleon of the United States Army I" Infantry Division. Mayor Vidak - Martinez noted that
Sergeant Deleon was a resident of Rohnert Park.
1. MAYOR'S REPORT ON JOINT CITY COUNCIL /CDC CLOSED SESSION:
Mayor Vidak- Martinez stated that no reportable action was taken in the Joint City Council /CDC
Closed Session.
2. SCHEDULED APPEARANCES /PRESENTATIONS:
George Perez, St. Joseph Health System, Update on Health Care Services: Mr. Perez
DISTRIBUTED AND REVIEWED via a PowerPoint presentation the contents of a letter and
brochure regarding current program activities and services offered by St. Joseph Health System,
and he responded to Council questions and comments. Vice Mayor Mackenzie suggested that said
information regarding programs and services be placed on the City's Web site.
Brad Baker, Codding Enterprises, Update on Sonoma Mountain Village (SMV) Green Building
and Association of Bay Area Governments (ABAG) Grant Funds: Mr. Baker shared a PowerPoint
presentation reviewing progress at SMV; the new company, Codding Genesis; and sustainability
issues. Representatives Geoff Syphers and Richard Pope also shared brief comments. Mr. Baker
asked for the City's assistance with the capital grant program put on by ABAG. At the request of
Vice Mayor Mackenzie, Council CONCURRED TO AGENDIZE consideration of the City's
application for Priority Development Area Designation under ABAG's Focus Program.
Mayor's Presentation of Resolution No. 2007 -58 Proclaiming April 27, 2007 as Children's
Memorial Day in Memory of Children Who Have Died by Violence to Representative of
Minimizing Occurrences of Violence in Everyday Society (MOVES): Mayor Vidak- Martinez read
and presented a framed resolution to Jim Wilkinson of MOVES. Mr. Wilkinson shared brief
comments, and he noted details of the new 1- 866- SPEAK -UP program for youth.
Gary Young, Director, Rohnert Park Community Band, 4th of July Concert: Mr. Young
DISTRIBUTED AND REVIEWED the contents of a letter to the City suggesting further ways
the City can help the Rohnert Park Community Band and the Moonlighters "Swing Era" Band
promote their 9th Annual Fourth of July "Concert in the Park" event. Vice Mayor Mackenzie
passed on the business card of Dan Condron, Vice President of University Affairs at Sonoma State
University, so that the band could work with SSU. City Manager Donley suggested that the
Recreation Department could make posters. Council Member Breeze recommended Mr. Young
speak to Carla Howell of the Chamber of Commerce. Mr. Young also asked to the Council to
consider budget allocations for acoustical improvements at Burton Recreation Center.

3. SSU STUDENT REPORT:
Sonoma State University Associated Students, Inc. by Whitney Diver, Legislative Representative:
Ms. Diver DISTRIBUTED copies of The Star to Council, and she reported on the following
matters: SSU Business School accredited; California Institute of Human Services (CIHS) to be
phased out; CSU and California Faculty Association agreement on pay increase for faculty;
replacement of the women's track team by a women's golf team.
4. UNSCHEDULED PUBLIC APPEARANCES /COMMENTS:
1. John Hudson, 399 Bonnie Avenue, was recognized and expressed concern regarding the full -
page ad in The Community Voice urging citizens to conserve water in light of the fact that the
City is in the Court of Appeal trying to prove that it has plenty of water for various projects.
He stated that the City and the Council are controlled by developers.
2. Michael J. McCaffrey, .18 Fredrick Drive, was recognized and urged the City to help the
Homeowner Associations of Planned United Developments (PUDs) to participate in water
conservation activities. He questioned why the City would charge $15 to read each water
meter were individual meters to be installed in PUDs. Mayor Vidak- Martinez directed staff to
look into this matter. Vice Mayor Mackenzie noted that the Water Issues Subcommittee will
do the same.
3. Dawna Gallagher, 5025 Country Club Drive, was recognized and requested assistance in
obtaining a copy of the documents regarding the State - designated recharge areas as referenced
by Mayor Vidak- Martinez at the March 27, 2007 City Council meeting. She questioned why
the City would be supporting projects when it needs water and is encouraging water
conservation. Mayor Vidak- Martinez indicated that it was a report, not a map, referenced on
March 27`x', and City Manager Donley stated that said report was provided to Ms. Gallagher.
5. CONSENT CALENDAR:
Mayor Vidak- Martinez asked Council Members if there were any questions about matters on the
Consent Calendar. Council Member Smith and Vice Mayor Mackenzie signified removal of the
City Council Portion of the Concurrent Meetings Minutes for April 10, 2007 for further discussion.

Upon MOTION by Council Member Smith, seconded by Council Member Breeze, and
UNANIMOUSLY APPROVED, reading was waived and the Consent Calendar, with the
exception of Item A, the City Council Portion of the Concurrent Meetings Minutes for April 10,
2007, was ADOPTED.

City Council Portion of Concurrent Meetings — April 10, 2007
Council Member Smith recommended clarifying language in Agenda Item 4, Reporting
Requirements for Animal -to- Animal Bite Incidents, to more accurately reflect animal bites, thereby
replacing the word "dog" with "animal" and the word "dog- bite" with "animal- bite." For Agenda
Item 7.5, Sonoma State University Subcommittee meeting, Vice Mayor Mackenzie recommended
amending the final sentence of Council direction to read as follows: "Mayor Pro Tern Mackenzie
asked Council to concur that Rohnert Park would not support supplying urban services to the
proposed faculty and staff housing 88 -acre project. Council CONCURRED with said statement."

Upon MOTION by Council Member Smith, seconded by Council Member Breeze, the City
Council Portion of the Concurrent Meetings Minutes for April 10, 2007 were APPROVED
AS AMENDED.
6. ALCOHOLIC BEVERAGE SALES ORDINANCE:
Consideration of Addition of Chapter 8.34 to the Rol-inert Park Municipal Code Establishing Use
Permit Requirements for Alcoholic Beverage Establishments:
Staff Report: Public Safety Sergeant Sweeney, Director Public Safety Bullard, and Ms.
Sharon O'Hara reviewed the contents of the Staff Report and responded to Council questions
and comrments.
2. Public Comments:
1. Carla Howell, Chamber of Commerce, 6050 Commerce Boulevard, No. 211, was
recognized and expressed concern that the recommended distance for off -sale
establishments as outlined in Section D may be an disincentive to establishments like
jazz clubs or wine bars.
2. Mark Kostielney, Director of Health Services for Sonoma County, 4423 Hollingsworth
Circle, was recognized and expressed support for the ordinance, calling attention to the
numerous problems of drugs and alcohol in the county.
3. Leonardo Tacata, 7723 Beverly Drive, was recognized and discussed how decreasing the
access to alcohol. lowers the public cost. He noted that the ordinance sets up
partnerships to teach about improper distribution of alcohol.
4. Jessica Lenth, Sonoma State student, 1949 East Cotati Avenue, was recognized and
expressed support for the ordinance. She called attention to the problems in downtown
Cotati due to the closeness of several bars, and she had a group of friends in the
audience hold up signs of support for the alcohol ordinance.
5. Dennis McCormack, 1431 Jasmine Circle, was recognized and expressed his support for
the ordinance. He read a description of a drunkard from Proverbs, Chapter 23, verses
29 -35 in the Bible.
6. Chief Nate Johnson, Sonoma State University, 1801 East Cotati Avenue, was recognized
and expressed his support for the ordinance. He noted the effects on communities that
do not have such an ordinance, and he discussed how said ordinance ties in with the
City's goals of safety, sustainability, and partnerships.
7. Johnnise Downs, California Restaurant Association, 1011 10'x' Street, Sacramento, was
recognized and expressed the Association's opposition to the ordinance, urging the City
to make the ordinance more fair to restaurants and compliant operators. She noted that
the fee is also a concern.

8. Joe Gaffney, 7498 Burton Avenue, was recognized and expressed his support for the
ordinance. He discussed how the proposed fee schedule is not unreasonable.
9. Felicia Keith, 952 Ethel Court, was recognized and reviewed her work as a decoy minor
for the Alcohol Beverage Control (ABC) in Rohnert Park, noting she had been sold
alcohol five times.
10. Stephanie Bodi, 7498 Burton Avenue, was recognized and expressed her support for the
ordinance, noting that it would bring Rohnert Park in line with many communities and it
would hold businesses more accountable.
3. Ordinance for hitroduction:

No. 780 Adding Chapter 8.34 regarding "Use Permits for Alcoholic Beverage
Establishments," to the Rohnert Park Municipal Code to Adopt a Use
Permit Requirement for Alcoholic Beverage Establishments
A MOTION was made by Vice Mayor Mackenzie to introduce Ordinance No. 780,
seconded for purposes of discussion by Council Member Smith. Assistant City Attorney
Whelan noted a clerical change adding a definition for "City Manager" to include his or her
designee. Under discussion, Council Member Smith indicated that he does not support the
ordinance in its present form, particularly noting that he does not support a fee structure
based on past behavior. He expressed support for high -end establishments which serve food,
for education programs, and for establishment of a fee structure that would ensure
compliance. Council Member Breeze expressed agreement with some parts of the ordinance,
but expressed her opposition to burdening the Department of Public Safety in terms of
enforcement and to the fee structure, which could adversely affect and/or unfairly penalize
an establishment. She stated that the downtown could be hurt by such an ordinance, and she
noted that the ordinance does not put programs in place to counsel binge drinkers or to deal
with the social problems of alcohol in general. She suggested that staff consider looking to
the Federated Indians of Graton Rancheria (FIGR) to provide funds for these sorts of
programs. Council Member Stafford expressed support for many of the concerns stated by
Council Members Smith and Breeze. She discussed the importance of education and
Responsible Beverage Training, and she expressed problems with the fee structure, noting
that it could unfairly penalize businesses. Vice Mayor Mackenzie expressed support for
using the collected fees to pay for Responsible Beverage Training. He stated that Council
could make changes to the 1000 -feet limit by crafting language regarding land -use
discretionary authority in terms of a fully developed downtown. He also suggested that
Council make yearly adjustments to the annual permit fees and that said fees be phased in
over the course of a year. Staff clarified that there is no fee structure before Council tonight,
because there is no resolution regarding a fee structure at this time. As maker of the motion,
Vice Mayor Mackenzie then recommended a FRIENDLY AMENDMENT that language be
crafted to exempt the City Center and the University District from falling under the
ordinance's jurisdiction. Mayor Vidak- Martinez indicated that she would second such an
amendment. City Manager Donley shared brief comments on the nature of the amendment.
Vice Mayor Mackenzie clarified that the Council would have the authority to establish
certain conditions for Specific Areas in the General Plan, specifically the City Center and the
University District. Council Member Smith expressed his concerns about redundancy with.

the General Plan, and he withdrew his support from the proposed motion. For purposes of
discussion, Vice Mayor Mackenzie introduced an AMENDING MOTION to include (1) the
clerical amendment per staff's reconunendation to define "City Manager" and (2) language
crafted by staff to exempt the City Center and the University District from said ordinance,
including findings as to why such an exemption should exist. Assistant City Attorney
Whelan advised Vice Mayor Mackenzie to get a second to the amended motion. Council
Member Stafford seconded the amended motion. Under discussion, Mayor Vidak - Martinez
discussed how the ordinance would reinforce existing laws about selling alcohol to minors
and to intoxicated people. She stated the ordinance will free up public safety officers, noting
the reduction in calls once the Party Ordinance was in place. She explained how prevention
is cheaper than critical intervention, and she called for an annual report on the ordinance for
Council's consideration. Staff clarified where the amended language would appear in the
ordinance, and she elaborated on Council's ability to establish a fee schedule. Mayor- Vidak-
Martinez called for a roll call vote on the amended motion. Said amended motion FAILED
2 -2 -1 BY ROLL CALL VOTE, with Council Members Breeze and Stafford dissenting, and
Council Member Smith abstaining. Council Member Smith made a MOTION to introduce
Ordinance No. 780, seconded by Vice Mayor Mackenzie, and amended to include only the
clerical amendment per staff's recommendation to define "City Manager." After the motion,
which was APPROVED AS AMENDED 3 -2, with Council Members Breeze and Stafford
dissenting, reading was waived and Ordinance No. 780 was INTRODUCED BY ROLL
CALL VOTE.
RECESS: Mayor Vidak- Martinez declared a recess at 10:08 p.m.
RECONVENE: Mayor Vidak- Martinez reconvened Council at 10:15 p.m. with all Council Members
present.
7. CALIFORNIA PUBLIC EMPLOYEES' RETIREMENT SYSTEM (CalPERS) CONTRACT
AMENDMENT:
Consideration of an Amendment to the Contract between the City Council of the City of Rohnert
Park and the Board of Administration of the California Public Employees' Retirement System
(Ca1PERS):
Staff Report: City Manager Donley reviewed the contents of the Staff Report.

adopt Ordinance No. 784. Under discussion, Council Member Smith expressed concern
about how the cost of said ordinance is to be allocated. After the motion, which was
APPROVED 4 -1 with Council Member Smith dissenting, reading was waived and
Ordinance No. 784 was ADOPTED BY ROLL CALL VOTE.

A MOTION was made by Council Member Smith, seconded by Council Member Stafford, to
adopt Ordinance No.. 768. Under discussion, Council Member Smith noted his agreement with
the clarifying amendment for the second reading. After the motion, which was
UNANIMOUSLY APPROVED, reading was waived and Ordinance No. 768 was ADOPTED
BY ROLL CALL VOTE.
10. NEIGHBORHOOD GARDENS:
Consideration of a Budget for the Establishment of Neighborhood Gardens in City Parks:
Staff Report: Management Analyst Tacata reviewed the contents of the Staff Report, and she
responded to Council questions and comments.
Public Comments: None.
3. Council discussion /direction: Council Members shared their perspectives on the proposed
Neighborhood Gardens. Council discussion concluded, and for purposes of moving forward,
Council Member Breeze stated that she supports staff, s recommendations with the clarification (1)
that the City is not asking for the funds from the Federated Indians of Graton Rancheria (FIGR),
but rather being gifted the funds by FIGR, and (2) that through signage and/or notification to the
public it be made very clear that if there are no funds in the future, the City will not be funding the

11. WATER CONSERVATION MEASURES:
Consideration of Measures to Conserve Water in the City of Rohnert Park:
1. Staff Report: City Engineer/Director Public Works Jenkins provided an oral report
reviewing the newspaper ad placed by the Sonoma County Water Agency (SCWA), noting
that the public can call 707/547 -1910 or 707/547 -1906 for more information regarding water

3. Request for Funding from the Federated Indians of the Graton Rancheria for Public Safety
Programs: City Manager Donley gave a brief oral report, and he and Director of Public Safety

discussion concluded with CONCURRENCE to request that FIGR provide funding for
the Special Enforcement Unit, a School Resource Officer, and a civilian Records
