2007/05/08 City Council MinutesCITY OF ROHNERT PARK CONCURRENT MEETING MINUTES FOR: City Council Community Development Commission Rohnert Park Financing Authority May 8, 2007 Tuesday The Concurrent Meetings of the City of Rohnert Park for the City Council, the Community Development Commission and the Rohnert Park Financing Authority met this date .for a Special Meeting, to commence at 5:00 p.m., followed by a Regular Meeting at the Rohnert Park City Hall, 6750 Commerce Boulevard, Rohnert Park, with Mayor Vidak - Martinez presiding. SPECIAL MEETING Call to Order: Mayor Vidak- Martinez called the Special Meeting to order at 5:00 p.m. Roll Call: Breeze, Mackenzie, Smith, Stafford, Vidak- Martinez Staff present for all or part of the Special Meeting: City Manager Donley, City Attorney Kenyon, Assistant City Manager Schwarz, Director of Administrative Services Lipitz, and Management Analyst Huntley. Unscheduled Public Appearances: None. CLOSED SESSION Mayor Vidak- Martinez adjourned Council to Closed Session to discuss Litigation and Personnel Matters. SSU STUDENT REPORT: Sonoma State University Associated Students, Inc. by Whitney Diver, Legislative Representative: Ms. Diver DISTRIBUTED copies of The Star to Council, and she reported on the following matters: Introduction of new SSU Legislative Representative at the next Council meeting; SSU baseball team second in the nation; commencement on May 26`h; Ms. Diver's election as Student Body President. Council CONCURRED with Vice Mayor Mackenzie suggestion to direct staff to prepare a letter over the Mayor's signature acknowledging Ms. Diver's attendance and service for Sonoma State University_ 1. SCHEDULED APPEARANCES /PRESENTATIONS: [Out of agenda order] California State Assembly Member Jared Huffman, Legislative Update: Mayor Vidak- Martinez stated that Assembly Member Huffman had arrived. Assembly Member Huffman, accompanied by his assistant Lisa Badenfort, DISTRIBUTED AND REVIEWED a document entitled, "Legislation 2007," and he responded to Council questions and comments. Vice Mayor Mackenzie gave Assembly Member Huffman a brochure regarding a Climate Protection event in Windsor on June 4th. 3. UNSCHEDULED PUBLIC APPEARANCES /COMMENTS: John Hudson, 399 Bonnie Avenue, was recognized and expressed concern that the residents of Rohnert Park are in effect subsidizing the sewer trunk line for Brookfield Homes, 4. Resolution for Adoption: 2007 -79 Ordering the City Manager to Abate Nuisances Existing within the City Upon MOTION by Vice Mayor Mackenzie, seconded by Council Member Stafford, and UNANIMOUSLY APPROVED, reading was waived and Resolution 2007 -79 was ADOPTED. 3. Alcoholic Beverage Sales — Consideration of Addition of Chapter 8.34 to the Rohnert Park Municipal Code Establishing Use Permit Requirements for Alcoholic Beverage Establishments and Options on Establishing an Annual Permit Fee: 1. Staff Report: City Manager Donley reviewed the contents of the Staff Report and responded to Council questions and comments. Council CONSENSUS., with the exception of Council Member Breeze, was to support Option One as outlined in the Staff Report. 2. Public Comments: 1. Gerard Giudice, 7396 Circle Drive, was recognized and expressed reasons for his concerns that businesses will be paying twice for the incompetencies of government. 2. Mark Young, Calistoga, partner in Latitude in Rohnert Park, was recognized and expressed his concern about the confusion that could be created by the overlap and lack of clarity in the ordinance. 3. Ordinance for Adoption: Waive Further Reading and Adopt Ordinance by reading title: No. 780 Adding Chapter 8.34 regarding "Use Permits for Alcoholic Beverage Establishments," to the Rohnert Park Municipal Code to Adopt a Use Permit Requirement for Alcoholic Beverage Establishments A MOTION was made by Vice Mayor Mackenzie, seconded by Council Member Smith, to adopt Ordinance No. 780. Under discussion, Council Member Smith and Vice Mayor Mackenzie discussed Alcohol Beverage Control's (ABC) inability to enforce its policies, and they noted their support for language in the ordinance indicating that grant monies from ABC will be used to mitigate the annual pen-nit fee_ Council Member Breeze explained how local businesses will be unfairly hurt by this ordinance and its redundancy City of Rohnert Park CONCURRENT MEETINGS Minutes (5 of 12) May 8 2007 for City Council /Community Development Commission /Rohnert Park Financing Authority of fees, and she noted her support for stiffer fines for people buying alcohol for minors. Council Member Stafford explained how cities are in the position of having to do ABC's jobs, and she noted her support for putting ABC funds into the City's program. Mayor Vidak- Martinez explained how this ordinance is an outgrowth of the City's resolution to support the Department of Public Safety. After the motion, which was APPROVED 4 -1 with Council Member Breeze dissenting, reading was waived and Ordinance No. 780 was ADOPTED BY ROLL CALL VOTE. 4. Annual Permit Fee Options: Council discussion /direction: Council CONCURRED to direct staff to bring a fee resolution back with language indicating that staff will make efforts to seek grants and use any awarded grant monies to mitigate the annual permit fee. 6. RANCHO VERDE MOBILE HOME PART TENTATIVE PARCEL MAP: Consideration of an Appeal of the Planning Commission's Denial of an Application for Tentative Parcel Map for the Rancho Verde Mobile Home Park: Staff Report: Mayor Vidak- Martinez asked that Council Members disclose for the record any contact that they may have had with the applicant or with the residents related to this particular item. Council Member Smith stated that he attended a town hall meeting at Rancho Verde Mobilehome Park, but did not discuss this appeal. Council Member Breeze stated that she attended a meeting with park residents at Rancho Verde Mobilehome' Park and an informal meeting at Starbucks on January 12, 2007_ Senior Planner Rich reviewed the contents of the Staff Report and responded to Council questions and comments. 2. PUBLIC HEARING: Mayor Vidak- Martinez opened the Public Hearing at 8:29 p.m. Presentation by Applicant, Sue Loftin, The Loftin Firm, 5760 Fleet Street, Suite 110, Carlsbad, California. Ms. Loftin was recognized and made a ten - minute PowerPoint presentation outlining reasons supporting the conversion of Rancho Verde to a resident owned mobilehome. park by means of a Tentative Parcel Map for a single -lot subdivision with a condominium overlay. Ms. Loftin DISTRIBUTED AND REVIEWED a packet of documents in response to the City's Staff Report, and she discussed how the proper scope of review was not used either by the Subdivision Committee nor the Planning Commission in rendering their decision. Mayor Vidak- Martinez allowed Sue Loftin, Esq., on behalf of the Applicant, to make some final rebuttal remarks. Resolution for Adoption: 2007 -80 Upholding the Planning Commission's Denial of a Tentative Parcel Map for the Rancho Verde Mobile Home Park, Over a 41.40 Acre Site, Located at 760 Rohnert Park Expressway, APN 143- 040 -049, Rancho Verde Mobile Home Park "Rancho Verde MHP" (Indian Springs Ltd. and Sunset Strip Corporation) A MOTION was made by Vice Mayor Mackenzie, seconded by Council Member Smith, to adopt Resolution 2007 -80_ Under discussion, Council Member Smith called attention to staff's diligence throughout this process, as well as his prior preparation for this item. He indicated that he would not be able to adequately address the Applicant's packet of documents submitted this evening, and he reviewed his analysis of the Government Code Section Findings regarding the Applicant's appeal of said findings pursuant to Government Code sections 66427.5 and others, as outlined in the January 18, 2007 letter from The Loftin Firm. Council Member Breeze indicated that she will be making her decision in this matter based on staff's due diligence in adhering to the codes that govern this proposed mobilehome park conversion. Council Member Stafford expressed support for Council Members Smith and Breeze's comments. Vice Mayor Mackenzie noted staff's due diligence in calling attention to the Applicant's lack of compliance with the requirements of the pertinent Government Code and Municipal Code sections. Mayor Vidak- Martinez discussed the City's long history in dealing with mobilehome park issues, and she noted staff's determination regarding the application's compliance issues. After the motion, which was UNANIMOUSLY APPROVED, reading was waived and Resolution 2007 -80 was ADOPTED. At this time, Mayor Vidak - Martinez allowed a public speaker to come forward and make brief comments about ingress and egress issues at Rancho Verde Mobilehome Park. RECESS: Mayor Vidak- Martinez declared 'a recess at 9:17 p.m. RECONVENE: Mayor. Vidak- Martinez reconvened Council at 9:26 p.m_ with all Council Members present. 7. GRATON RANCHERIA CASINO AND HOTEL DRAFT ENVIRONMENTAL IMPACT STATEMENT: Consideration of the City of Rohnert Park's Comments to the National Indian Gaming Commission regarding the Draft Environmental Impact Statement for the Graton Rancheria Casino and Hotel: Staff Report: Assistant City Manager Schwarz reviewed the contents of the Staff Report and responded to Council questions and comments. 2. Public Comments: 1. Susan H. Adams, 5758 Davis Circle, was recognized_ She noted her support for Council's work on the City's comment letter, and she suggested that said letter be sent to the Department of the Interior. 2. Fred Soares, Bellevue Township, was recognized. He commended staff's thoroughness with the letter, but he questioned who would enforce the mitigation. He expressed opposition to the casino and stated that the letter should be sent to the Department of the Interior. 4. Dawna Gallagher, 5025 Country Club Drive, was recognized. She expressed support for staff's efforts with the comment letter, and she questioned the City's ability to mitigate traffic, water and sewer issues caused by a casino. 5. Larry Esparza, 41 Verde Circle, was recognized. He expressed his opposition to a casino, noting that the issues created by a casino cannot be adequately mitigated. 6. Diane Nelson, 6044 Dawn Drive, was recognized. She commended staff's efforts with the comment letter, and she encouraged the City not to accept anymore gifts from the Tribe. 7. Debbie Clarkson, 510 Corte Naranja, was recognized. She expressed concerns about flooding mitigation at the proposed casino site. 3_ Council discuss ion/direction/action: Council discussion concluded with staff direction as follows: (1) Correct any inaccurate statements; (2) Add an opening paragraph that the letter was reviewed by the City Council at its May 8, 2007 meeting; (3) Strengthen the language about the casino's financial impact on the City, taking note of the City's unfunded retiree medical benefits; (4) Request inclusion of analysis of Alternative H and recirculation of the DEIS in said letter; (5) Highlight any major themes in the letter. 8. SUBREGIONAL WASTEWATER SYSTEM POLICY ADVISORY COMMITTEE (PAC): Consideration of appointment to the Policy Advisory Committee (PAC) for the Subregional Wastewater System: 1. Staff Report: City Manager Donley reviewed the contents of the Staff Report. 2_ Public Comments: None. 3. Council discussion /direction/action: Council AGREED with the appointment of Vice Mayor Mackenzie to the PAC for the Subregional Wastewater System, with Council Member Breeze serving as the alternate. 9. COUNCIL COMMITTEE AND /OR OTHER REPORTS: 1. Water Issues Subcommittee meeting, 4/25: Vice Mayor Mackenzie and Council Member Breeze reported on water conservation matters. 2_ Sonoma County Water Agency breakfast meeting' 4/25: Vice Mayor Mackenzie reported on SCWA's sustainability program. He explained and SUBMITTED to City Manager Donley the Water Advisory Committee's May 2" d memo and other related documents. 3. Creek Master Plan Ad Hoc Subcommittee meeting, 4/25: Vice Mayor Mackenzie provided a brief report on various topics from the meeting. 4. Sonoma County Central Disposal Site Community Meeting, 4/25: Council Member Smith noted that said meeting was geared specifically for people who live in the vicinity of the landfill site. North Bay Corporation Construction and Demolition Site walk- through, 4/30: Mayor Vidak- Martinez and Council Member Smith noted their attendance at said event. 8. Waste & Recycling Subcommittee meeting, 5/1: Mayor Vidak - Martinez and Council Member Smith reported on various topics from said meeting. 9. Sonoma County Water Agency (SCWA) Public Meeting on Water Project Environmental Impact Report, 5/1: Council discussion/direction: At the request of Vice Mayor Mackenzie, Council CONCURRED to direct the City Attorney to confer with Deputy County Counsel Jill Golis regarding a water supply resolution requested by'SCWA. 10.
