2006/05/09 City Council MinutesCITY OF ROHNERT PARK CONCURRENT MEETING MINUTES FOR: City Council Community Development Commission Rohnert Park Financing Authority May 9, 2006 Tuesday The Concurrent Meetings of the City of Rohnert Park for the City Council, the Community Development Commission and the Rohnert Park Financing Authority met this date in Regular Session for a meeting commencing 6:00 p.m. at the Rohnert Park City Hall, 6750 Commerce Boulevard, Rohnert Park, with Mayor Smith presiding. REGULAR SESSION: Call to Order: Mayor Smith called the Regular Session to order at 6:00 p.m. Roll Call: Breeze, Flores, Mackenzie, Vidak- Martinez, Smith Staff present for all or part of the Regular Session: City Manager Donley, City Attorney Kenyon, Assistant City Manager Schwarz, Director of Public Works /City Engineer Jenkins, Neighborhood Preservation Officer Denlis, Public Safety Lieutenant Frazer, City Clerk Hauff and Videographer Beltz_ CLOSED SESSION: Council adjourned to Closed Session to consider Litigation Matters and Personnel Matters. REGULAR SESSION: Council reconvened Regular Session at 6:45 p.m. 1. PLEDGE OF ALLEGIANCE: Tyler -Avery Lewis, Student, Thomas Page Elementary School, led the Pledge of Allegiance. Mayor Smith and Tyler had their picture taken together. 2. MAYOR'S REPORT ON CLOSED SESSION: Mayor Smith indicated that there was no reportable action from the Closed Session. 3. SCHEDULED APPEARANCES /PRESENTATIONS: Rebuilding Together Rohnert Park - Cotati, Report on 4/29/06 volunteer efforts: Neighborhood Preservation Officer Denlis provided a Power Point presentation and encouraged the public to call 588 -2219 for more information on future Rebuilding Together events. Council acknowledged the efforts that went into the event. Vice Mayor Vidak- Martinez suggested that staff explore ways to make it easy for the public to contribute to the Rebuilding Together effort. Mayor Smith thanked The Community Voice for covering Rebuilding Together on its front page. City of Rohnert Park CONCURRENT MEETINGS Minutes (2) May 9 2006 for City CounciUCommunity Development Commission/Rohnert Park Financing Authority 2. Jim Leddy, Chair of the Sonoma County Housing Coalition Consensus Council and District Director, Office of State Senator Wesley Chesbro for acceptance of City's Resolution Proclaiming May 14 to 21, 2006 as "Affordable Housing Week ": Mr. Leddy, accompanied by his two sons, thanked Council for its work on affordable housing, and he noted that there will be a kick -off event next Monday, May 15 "' at the Flamingo Hotel. 3. American Lung Association Representative Jenny Bard regarding "Breathe Easy Ride" Saturday, May 27, 2006 at Sonoma Mountain Village: Ms. Bard DISTRIBUTED AND REVIEWED information about The Two Rock Breathe Easy Ride, as well as an article from The Press Democrat regarding the incidence of asthma in Sonoma County. She encouraged Council to attend said event. Mayor Smith suggested that Ms. Bard make.a presentation to the School District. 4. SSU STUDENT REPORT: Sonoma State University Associated Students, Inc., by James J. Reilly, III, Legislative Representative: Mr. Reilly DISTRIBUTED copies of The Star and introduced Whitney Diver, the new ASI representative. Ms. Diver reported on Student Senate elections and responded to Council questions about her studies. 5. UNSCHEDULED PUBLIC APPEARANCES /COMMENTS: Jon Warren, Men Evolving Nonviolently (M.E.N.), Santa Rosa, was recognized and DISTRIBUTED AND REVIEWED written comments regarding MEN. He reviewed MEN's 25 years of service in Sonoma County helping men with domestic violence and communication issues. He requested that the City provide MEN with a free or Iow -rent room large enough to accommodate 6 to 15 men every Wednesday evening from 7 -10 p.m. At the suggestion of Councilmember Flores, Council AREED TO DIRECT STAFF to look into the possibility of providing a place for MEN to meet as requested. 2. Dawna Gallagher was recognized and expressed concerns about the effects of the University District on groundwater levels. Approval of City Council Portion of Concurrent Meeting Minutes for: Regular Concurrent City Meetings - April 11, 2006 Vice Mayor Vidak - Martinez and Councilmember Breezed indicated that they would be abstaining due to their absence from the meeting. Upon MOTION by Councilmember Mackenzie, seconded by Councilmember Flores, the Regular Concurrent City Meeting Minutes for April 11, 2006 were APPROVED 3 -0 -2 with Vice Mayor Vidak- Martinez and Councilmember Breeze abstaining, City of Rohnert Park CONCURRENT MEETINGS Minutes (4) May 9 2006 for City CounciUCommunity Development Commission/Rohnert Park Financing Authority 2006 -119 Rejecting All Proposals for Exercise Equipment for the Sports Center Council AGREED with Councilmember Flores' suggestion that if the bids for the second proposal come in too high again, staff consider a reduced effort. Upon MOTION by Councilmember Flores, seconded by Vice Mayor Vidak- Martinez, and UNANIMOUSLY APPROVED, reading was waived and Resolution 2006 -119 was ADOPTED. 2006 -122 Authorizing and Approving Funding Agreement with Sonoma County Water Agency for Funding of Coleman Creek Storm Drain Extension, Project No. 2005 -07 Mayor Smith stated that City staff is working diligently with other agencies on flooding matters_ A MOTION was made by Mayor Smith, seconded by Councilmember Mackenzie, to approve Resolution 2006 -122. Under discussion, Councilmember Mackenzie noted that there will be further discussion on the topic of flooding when he reports on the water meetings. After the motion, which was UNANIMOUSLY APPROVED, reading wasAvaived and Resolution 2006 -122 was ADOPTED- 2006-124 Accepting Project and Directing the City Engineer to File Notice of Completion for Sewer Interceptor /Outfall Project No. 2003 -11 Mayor Smith expressed his pleasure with the completion of this project. Upon MOTION by Mayor Sinith, seconded by Vice Mayor Vidak- Martinez, and UNANIMOUSLY APPROVED, reading was waived and Resolution 2006 -124 was ADOPTED. 2006 -126 Authorizing the Filing of an Application for Federal Surface Transportation Funds through the Metropolitan Transportation Commission's Transportation for Livable Communities Program for the City Center Drive /Plaza Improvements Project, City of Rohnert Park and Committing the Necessary Local Match for the Project and Stating the Assurance of the City of Rohnert Park to Complete the Project Mayor Smith called the public's attention to this project and he urged public participation at the time of the meetings related thereto. A MOTION was made by Mayor Smith, seconded by Councilmember Flores, to approved Resolution 2006 -26. Under discussion, Councilmember Flores commended staff for its efforts on this project. After the motion, which was UNANIMOUSLY APPROVED, reading was waived and Resolution 2006 -26 was ADOPTED. 7. DEPARTMENT OF PUBLIC SAFETY MATTER: Emergency Operations Center (EOC) Exercises on May 2, 2006 — Report: City Manager Donley reminded Councilmembers to schedule appointments with Nancy Thompson to receive their official ID's. Mayor Smith DISTRIBUTED a newspaper article relating to this topic. Public Safety Lieutenant Frazer reviewed the contents of the Staff Report, and he responded to Council questions and comments. Councilmembers expressed support for having an annual meeting for the EOC Exercises as a line item in the budget, with said meeting including maps on the wall and information provided via computers. Furthermore, Council suggested staff work with City of Rohnert Park CONCURRENT MEETINGS Minutes (5) Mav 9 2006 for City CounciUCommunity Development Commission/Rohnert Park Financing Authority Sonoma State University on the next EOC Exercises event, as well as clarify the roles of those involved in the Exercises. 8. PLANNING AND ZONING /COMMUNITY DEVELOPMENT MATTERS: 1. University District Specific Plan - Consideration of applications for an approximately 297 acre site that is generally located on each side of Hinebaugh Creek, east of the current City limits, south of Keiser Avenue, west of Petaluma Hill Road, and north of Copeland Creek (APN 045- 253 -007, 045- 253 -009 through —012, 045- 253 -018, 045- 262 -001 through -004, 047 - 131 -019, and 047 - 131 -024 through -027) as follows: 1)Certification of a Final Environmental Impact Report; 2)Amendments to the Land Use Map and Text of the Rohnert Park General Plan concerning the subject properties; 3)Prezoning to Specific Plan (S -P) and Pub] ic %Institutional (P -I) Districts *; 4)Specific Plan/Design Guidelines for the Project: 5)Development Agreement; 6)Tentative Subdivision Maps to subdivide the property; 7)Development Area Plans for the initial phases of development; and 8)Annexation of property to the City of Rohnert Park.* * The prezoning to P -I and the annexation would also include the 39 -acre Creekside Middle School site. a. Staff Report: City Manager Donley explained staff's recommendation to defer this matter to the next Council meeting. A MOTION was made by Vice Mayor Vidak- Martinez, seconded by Councilmember Flores, to DEFER consideration of the University District Specific Plan to the next Council meeting on May 23rd. Redevelopment Plan Amendments Proposed for the Rohnert Park Redevelopment Project - Consideration of proposed amendments eliminating the existing time limit on incurring debt and amending certain time limitations with respect to the Redevelopment Plan for the Rohnert Park Redevelopment Project: a. Staff Report: City Manager Donley explained the contents of the Staff Report. b. Public Comments: None_ c. Waive Further Reading and Adopt Ordinance by reading title: No. 758 Eliminating the Existing Time Limit on Incurring Debt and Amending Certain Time Limitations with Respect to the Redevelopment Plan for the Rohnert Park Redevelopment Project City of Rohnert Park CONCURRENT MEETINGS Minutes (6) May 9 2006 for City CounciUCommuhity Development Commission / Rohnert Park Financing Authority Council motion/discussion /roll call vote: A MOTION was made by Councilmember Mackenzie, seconded by Councilmember Breeze, to , adopt Ordinance No. 758.. Under discussion, in response to Councilmember Flores' inquiry, City Attorney Kenyon indicated that taxes cannot be collected after 2038. After the motion, which was UNANIMOUSLY APPROVED BY ROLL CALL VOTE, reading was waived and Ordinance No. 758 was ADOPTED. 9. CITY CENTER PLAZA DESIGN: Consideration of establishing a City Council Ad Hoc Subcommittee or appointing an existing City Council Subcommittee to participate in the City Center Plaza Design meetings: Council discussion/direction /action: Staff comments and Council discussion concluded when a MOTION was made by Councilmember Mackenzie, seconded by Vice Mayor Vidak- Martinez, to establish a City Center Ad Hoc Subcommittee to be made up of Councilmember Breeze and Vice -Mayor Vidak- Martinez, with first alternate being Councilmember Flores, second alternate being Councilmember Mackenzie, and third alternate being Mayor Smith. Said motion was UNANIMOUSLY APPROVED. 10. SANTA ROSA PLAIN CONSERVATION STRATEGY IMPLEMENTATION COMMITTEE: Consideration of Amendment to the Planning Agreement concerning Santa Rosa Plain Conservation Strategy Committee to modify the composition of the Committee: I _ Staff /Council Liaison Report: Assistant City Manager Schwarz reviewed the contents of the Staff Report. 2. Public Comments: None 3. Resolution for Adoption: 2006 -128 Approving Amendment No. 1 to Santa Rosa Plain Conservation Strategy Planning Agreement Council motion/discussion/vote: A MOTION was made by Councilmember Mackenzie, seconded by Vice Mayor Vidak- Martinez, to adopt Resolution 2006 -128. Under discussion, Councilmember Flores discussed the basis /purpose of the team in terms of defining the habitat of the California Tiger Salamander. Councilmember Mackenzie reviewed matters related to the composition of the committee. After the motion, which was UNANIMOUSLY APPROVED, reading was waived and Resolution 2006 -128 was ADOPTED. 11. COUNCIL COMMITTEE AND /OR OTHER REPORTS: 1. Mayors' & Councilmembers' Assn., City Selection Committee, 5/11/06 meeting to select representatives to fill upcoming vacancies for the following: a. Local Agency Formation Commission (LAFCO), 4 -year term (Deborah Fudge's term expires 5/1/06) City of Rohnert Park CONCURRENT MEETINGS Minutes (7) May 9 2006 for City'CounciUCommunity Development Commission/Rohnert Park Financing Authority Council discussion/direction/action: A MOTION . was made by Councilmember Flores, seconded by Vice Mayor Vidak- Martinez, to support Steve Allen to fill the vacancy at LAFCO. Under discussion, Councilmember Breeze expressed support for Mr. Allen. Councilmember Flores called attention to the fact that the City will be annexing large sections of land in the future as defined in the General Plan. Councilmember Mackenzie noted that Debora Fudge has served well with her background in planning. Vice Mayor Vidak Martinez explained that Steve Allen would provide the best support for Rohnert Park in terms of its future annexation projections. Mayor Smith concurred with Councilmember Mackenzie's comments. Said motion was APPROVED 3 -2 BY ROLL CALL VOTE with Councilmember Mackenzie and Mayor Smith dissenting. b. Airport Land Use Commission, 4 -year term (David Glass' term expires 5/1/06) Council discussion /direction/action: Council CONCURRED with Councilmember Flores' suggestion to direct the Mayor to use his discretion in supporting a candidate. 2. Water Issues Sub- Committee, 4/26/06 mtg.: Councilmembers Flores and Mackenzie DISTRIBUTED AND REVIEWED the Water Issues Subcommittee Report, as well as information on the Rohnert Park Green City Project. 3. Creeks Master Plan Sub - Committee, 4/26/06: Councilmember Mackenzie reported on the new City Manager for C.otati and the plan for Copeland Creek. 4. Sonoma County Water Conservation Summit, 4/26/06: Mayor Smith noted that said meeting had been cancelled due to the excessive amount of rain over the past months. 5. North Bay Business Journal - Construction Outlook Conference, 4/27/06: Councilmember Mackenzie reported on (1) the desire of many cities for smaller, walkable communities and (2). the rising cost of construction. Mayor Smith DISTRIBUTED pens from the conference. 6. National Association of Postal Supervisors, Mayor's Welcome Address, 4/27/06: Mayor Smith indicated that he gave the welcoming address for this event. 7. He noted that he will be making a brief presentation at the Mayors' and Councilmembers' Committee meeting this Thursday, and he commented on matters related to Regional Housing Needs Assessment (RHNA) numbers. 14. CITY MANAGER'S /CITY ATTORNEY'S REPORTS: 1. McDonough Holland & Allen (MHA) Oakland Office Earns "Green" Certification: City Attorney Kenyon. explained the certification, and Council commended MHA. 2. State Legislation: Assistant City Manager Schwarz reviewed the Staff Report. Council discussion /direction/action: Assistant City Manager Schwarz responded to Council concerns about AB 2987, the Cable and Video Service bill. 3. Future Agenda Scheduling: City Manager Donley explained the scheduling matters. Council discussion/direction /action: Council AGREED to hold a Budget Study Session on May 301" in the afternoon due to consideration of the University District at the May 23`d Council meeting. 4. Mobile Home Parks Sewer Rates: City Manager Donley shared the contents of the Staff Report. 5. New City Hall Update: At the suggestion of City Manager Donley, Council CONCURRED to schedule a Study Session in the future for review of the City Hall design. 6. Westside Public Safety Station Update: City Manager Donley explained this item and responded to Council questions and comments. 7. Boys & Girls Club: City Manager Donley reported on a meeting with Lynn Conde regarding and update on the activities of the Boys & Girls Club. Sonoma County Transportation Authority (SCTA): Councilmember Mackenzie noted that Director Public Works /City Engineer Jenkins attended said meeting yesterday. City Engineer Jenkins reported on (1) the Draft EIR for the central project commencing with a public meeting on June 21" at Cotati City Hall, and (2) funding matters related to the bond measure that passed the California State Senate and Legislature. City Attorneys Meeting in Palm Springs: City Attorney Kenyon reported on her attendance at last week's meeting, noting that Rohnert Park was mentioned notably in regard to the Hillsboro decision and to its vicious dog ordinance.
