The Concurrent Meetings of the City of Rohnert Park for the City Council, the Community
Development Commission and the Rohnert Park Financing Authority met this date in Regular
Session for a meeting commencing 6:36 p.m. at the Rohnert Park City Hall, 6750 Commerce
Boulevard, Rohnert Park, with Mayor Smith presiding.
REGULAR SESSION:
Call to Order: Mayor Smith called the Regular Session to order at 6:36 p.m.
Roll Call: Breeze, Flores, Mackenzie, Vidak- Martinez, Smith
Staff present for all or part of the Regular Session: City Manager Donley, Assistant City Attorney
Whelan, Assistant City Manager Schwarz, Director of Administrative Services Lipitz, Housing and
Redevelopment Project Manager Ellena, Senior Planner Rich, Management Analyst Tacata and
Videographr Beltz.
CLOSED SESSION:
Council adjourned to Closed Session to consider Litigation Matters
REGULAR SESSION:
Council reconvened Regular Session at 7:18 p.m. and Mayor Smith led the Pledge of Allegiance.
Mayor Smith encouraged students to call City Hall if they are interested in leading the Pledge of
Allegiance.
1. MAYOR'S REPORT ON CLOSED SESSION:
Mayor Smith indicated that there was no reportable action from the Closed Session.
2. SCHEDULED APPEARANCE /PRESENTATION:
Brad Baker regarding Sonoma Mountain Village goals and preliminary development plan (former
Agilent Campus on Valley House Drive, Rohnert Park): Mayor Smith reminded Council about the
upcoming Mayors' & Councilmembers' event at Sonoma Mountain village on July 13''. Mr. Baker
shared .a Power Point presentation about plans for Sonoma Mountain Village, and Richard Pope
provided further details. Councilmembers expressed appreciation for the presentation.

3. UNSCHEDULED PUBLIC APPEARANCES /COMMENTS:
1. Peter Tscherneff, Sonoma County, was recognized and discussed the importance of water. He
noted his concerns about industries that harm animals. He also raised questions about the
legality of a restraining order to stay away from a trial. He SUBMITTED documents
regarding said restraining order to Council.
2. Dawna Gallagher, 5025 Country Club Drive, was recognized and discussed the judge's ruling
against the City in the case brought by the OWL Foundation related to the City's Water Supply
Assessment (WSA). She explained reasons why the University District Specific Plan (USDP)
cannot be built, noting that an aquifer cannot be replaced with wetlands, and she inquired why
the public had not been informed of the judge's ruling in said case. Mayor Smith confirmed
through Assistant City Attorney Whelan that the City is still waiting for certification from the
judge in this matter.
4. CONSENT CALENDAR:
Mayor Smith asked if there were any questions about matters on the Consent Calendar. The
following items were removed: The Regular Concurrent City Meetings Minutes per
Councilmember Breeze, Resolutions 2006 -168 and 2006 -169 per Councilmember Flores'
recommendation; Resolution 2006 -175 per City Manager Donley's recommendation; and
Resolutions 2006 -171, 2006 -172, 2006 -176, 2006 -179 and 2006 -180 per Mayor Smith's
recommendation.

2006 -181 Rejecting the Claim of David B. McWhirter (re. alleged damage caused
from rocks in water pipes)
Upon MOTION by Councilmember Flores, seconded by Councilmember Mackenzie, and
UNANIMOUSLY APPROVED, reading was waived and the Consent Calendar, with the
exception of the Regular Concurrent City Meetings Minutes for June 13, 2006 and Resolution Nos.
2006 -168, 2006 -169, 2006 -171, 2006 -172, 2006 -175. 2006 -176, 2006 -179 and 2006 -180, was
ADOPTED.
Items for consideration:
A. Approval of City Council Portion of Concurrent Meeting Minutes for:
Special Meeting/Work Session and Regular Concurrent City Meetings- June 13, 2006
Councilmember Breeze made two amendments to the minutes: Page 7, first motion, for the dissenting
votes, amend "Councilmember Breeze" to read "Councilmember Mackenzie "; Page 7, third motion, for
the dissenting vote, amend "Councilmember Breeze" to read "Councilmember Flores." Mayor Smith
made two amendments to the minutes: Page 5, last motion, amend the phrase "the City cannot pursue
anything legally" with the phrase "the City may not be able to pursue anything legally "; Page 12, Item
15 -2, amend the word "staff' to read "City Council." A MOTION was made by Mayor Smith, seconded
by Vice Mayor Vidak- Martinez, to approve the City Council portion of the Concurrent Meeting Minutes
for the Special Meeting/Work Session and Regular Concurrent City Meetings for June 13, 2006. Said
minutes were UNANIMOUSLY APPROVED AS AMENDED.
2006 -168 Honoring and Thanking Laura Campbell for Her Part in the
Xeriscape Landscaping at "Campbell Island"
and
2006 -169 Honoring and Thanking the Rohnert Park/Cotati Rotary Club for
the Xeriscape Landscaping at Rohnert Park Expressway and
Country Club Drive
Councilmember Flores expressed pleasure that Council has acknowledged the efforts of Ms. Campbell
and the Rohnert Park/Cotati Rotary Club in their water conservation project. Upon MOTION by
Councilmember Flores, seconded by Vice Mayor Vidak- Martinez, and UNANIMOUSLY APPROVED,
reading was waived and Resolutions 2006 -168 and 2006 -169 were CONSECUTIVELY AND
SEPARATELY ADOPTED.
2006 -171 Authorizing and Approving an Agreement for Services with Hector
Correa to Serve as Artistic Director at the Performing Arts Center
Mayor Smith acknowledged the work of Mr. Correa. Upon MOTION by Mayor Smith, seconded by
Councilmember Mackenzie, and UNANIMOUSLY APPROVED, reading was waived and Resolution
2006 -171 was ADOPTED.
2006 -172 Approving Agreement with Cotati - Rohnert Park Unified School
District for Joint Use of Certain Public Facilities Owned by City of.

At the request of Mayor Smith, City Manage Donley provided clarification of the City's usage of
Creekside Middle School. Upon MOTION by Mayor Smith, seconded by Vice Mayor Vidak- Martinez,
and UNANIMOUSLY APPROVED, reading was waived and Resolution 2006 -172 was ADOPTED.
2006 -175 Authorizing Amendment Number Two to the Memorandum of
Agreement with the City of Rohnert Park and the Service
Employees International Union (S.E.I.U.) Local 707
City Manager Donley corrected a typographical error, noting that the Senior Lead Worker stipend will be
effective July 1, 2006. Upon MOTION by Councilmember Flores, seconded by Mayor Smith, and
UNANIMOUSLY APPROVED, reading was waived and Resolution 2006 -175 was ADOPTED AS
AMENDED.
2006 -176 Approving a Loan Agreement with the Community Development
Commission Providing for the Use of CDC Funds to pay for
Wetlands Mitigation Costs Associated with the Proposed Reuse and
Redevelopment of the Rohnert Park Stadium
Mayor Smith noted that the City will be responsible to pay for the cost of the wetlands, and he indicated
that he will be voting against said resolution. Upon MOTION by Councilmember Mackenzie, seconded
by Councilmember Flores, and APPROVED 4 -1 with Mayor Smith dissenting, Resolution 2006 -176 was
ADOPTED.
2006 -179 Approving the Memorandum of Understanding Regarding Water
Transmission System Capacity Allocation During Temporary
Impairment by and Between the Sonoma County Water Agency
and Various Other Parties
Based on the suggestion of Mayor Smith that Resolution 2006 -179 may not be timely, Council
CONCURRED TO DEFER consideration of said resolution.
2006 -180 Calling for Sealed Bids for the 2006 Street Maintenance Project,
. Asphalt Overlay, Project No. 2005 -04
Mayor Smith commended staff efforts on this project. Upon MOTION by Mayor Smith, seconded by
Councilmember Breeze, and UNANIMOUSLY APPROVED, reading was waived and Resolution 2006-
180 was ADOPTED.
5. COLEMAND CREEK STORM DRAIN IMPROVEMENTS PROJECT, PROJECT NO. 2005-
07:
Consideration of Mitigated Negative Declaration and a Mitigation Monitoring Program, Approval of
the Project, and Authorization to Bid for this Project:
1. Staff Report: Management Analyst Tacata reviewed the contents of the Staff Report and
responded to Council questions and comments.

3. Resolutions for Adoption:
2006 -182 Adopting a Mitigated Negative Declaration and a Mitigation Monitoring
Program for the Coleman Creek Storm Drain Improvements Project,
Project No. 2005 -07, and Approving the Project
A MOTION was made by Councilmember Flores, seconded by Councilmember
Mackenzie, to adopt .Resolution 2006 -182. Under discussion, Councilmember Breeze
stated that this resolution will bring relief to those residents whose homes were recently
flooded. Councilmember Flores noted that this is a large.project that will help the City
avoid flooding problems during winter. Councilmember Mackenzie stated that this project
is a good example of what the Flood Control District does for the City. After the motion,
which was UNANIMOUSLY APPROVED, reading was waived and Resolution 2006 -182
was ADOPTED.
2006 -183 Calling for Sealed Bids for the Coleman Creek Storm Drain Improvements

Upon MOTION by Vice Mayor Vidak- Martinez, seconded by Councilmember
Mackenzie, and UNANIMOUSLY APPROVED, reading was waived and Resolution
2006 -183 was ADOPTED.
6. FISCAL YEAR 2006 -07 CITY BUDGET AND THE FIVE -YEAR CAPITAL
IMPROVEMENT PROGRAM (CIP) BUDGET:
1. Staff Reports: Director of Administrative Services Lipitz reviewed the contents of the
Staff Report via a Power Point presentation, and she responded to Council questions and
comments.
2. PUBLIC HEARING concurrently for 2006 -07 proposed budgets for City and Five -
Year Capital Improvement Program (CIP): Mayor Smith opened the Public Hearing
at 8:15 p.m. There being no members of the public interested in speaking, Mayor Smith
closed the Public Hearing at 8:15 p.m.
3. Resolution for Adoption:
2006 -184 Approving and Adopting a Budget for Fiscal Year 2006 -07
A MOTION was made by Councilmember Mackenzie, seconded by Councilmember,
Breeze, to adopt Resolution 2006 -184. Under discussion, Councilmember Breeze
recommended that with the addition of a sergeant for fire prevention, a layer of
supervision in the field should be considered. Councilmember Flores discussed the
quality of life in Rohnert Park, and he noted that major programs in the City generally
require subsidies. Councilmember Mackenzie noted that there is seldom ever public
comment on the City's most important document, the budget. He stressed the importance
of implementing the City's Economic Development Strategy guided by the City's Top
Five Goals, and he reviewed the challenges the City faces in next year's budget. Vice
Mayor Vidak - Martinez noted that the City has had to sell its assets to meet its operating
expenses. She did note some increases in the City's revenues, and she discussed how the

City has been supporting its most vulnerable citizens. Mayor Smith thanked City staff,
and he referred to a recent article in The Press Democrat, noting that he had been
accurately quoted in said article. The Mayor DISTRIBUTED an article from "Atlantic"
magazine regarding WalMart, and he discussed his concerns about retiree medical
benefits. After the motion, which was UNANIMOUSLY APPROVED, reading was
waived and Resolution 2006 -184 was ADOPTED.
4. Resolution for Adoption:
2006 -185 Adopting the Five Year Capital Improvements Program for Fiscal Year
2006 -07 through Fiscal Year 201041 and Approving Projects for fiscal
Year 2006 -07
A MOTION was made by Councilmember Flores, seconded by Councilmember Breeze,
to adopt Resolution 2006 -185. Under discussion, Councilmember Mackenzie noted that
one of his technical questions had been addressed. Councilmember Flores stated that it is
important for staff to project capital projects on the basis of priorities. Mayor Smith
noted that the Capital Improvement Program relies on development, which is affected by
certain lawsuits and the development of the casino, and he expressed his concerns related
thereto. After the motion, which was UNANIMOUSLY APPROVED, reading was
waived and Resolution 2006 -185 was ADOPTED.

APPROVED 4 -1 with Chairperson Smith. dissenting, reading was waived and CDC Resolution
2006 -11 was ADOPTED.

Ordinance), Section 17.04 (Definitions), 17.07 (Land Use Footnotes /Special Provisions
and 17.27 (Signage Standards):
Staff Report: Senior Planner Rich reviewed the contents of the Staff Report, and
staff responded to Council questions and comments. Councilmembers expressed
an interest in having staff clarify signage standards that pertain to properties with
various owners. Council CONCURRED to include athletic sign -ups under civic
events, and to rename civic events "community events" per Section 17.27.040

A MOTION was made by Vice Mayor Vidak- Martinez, seconded by
Councilmember Mackenzie, to adopt Resolution 2006 -186. Under discussion,
Mayor Smith reiterated that athletic sign -ups are to be considered community
events. Senior Planner Rich responded to Councilmember Mackenzie's inquiry
about a sign on church property. Mayor Smith also inquired about enforcement
issues and hand -held signs. Council CONCURRED to direct staff to report back
with suggested text regarding hand -held signs for the ordinance. After the
motion, which was UNANIMOUSLY APPROVED, reading was waived and
Resolution 2006 -186 was ADOPTED.
4. Waive Further Reading and Introduce Ordinance by Reading Title:
No. 765 Amending Title 17 (Zoning Ordinance) of the Rohnert Park
Municipal Code, Sections 17.04 (Definitions), 17.07 (Land Use
Footnotes /Special Provisions), and 17.27 (Signage Standards), File

Upon MOTION by Councilmember Mackenzie, seconded by Councilmember
Flores, and UNANIMOUSLY APPROVED, reading was waived and Ordinance
No. 765 was ADOPTED BY ROLL CALL VOTE AND AS AMENDED to

Traffic," to aid with code enforcement for parking violations:

A MOTION was made by Councilmember Mackenzie, seconded by Councilmember
Breeze, to adopt Ordinance No. 763. Under discussion, Councilmember Flores
REQUESTED that staff look into parking problems in E Section at Evelyn and Elsa.
After the motion, which was UNANIMOUSLY APPROVED, reading was waived and
Ordinance No. 763 was ADOPTED BY ROLL CALL VOTE.
10. NOVEMBER 2006 ELECTION MATTERS:
Consideration of two election- related resolutions: (1) Calling and giving notice of holding a General
Municipal Election to be held on Tuesday, November 7, 2006, for the election of two officers, both
with four year terms to expire in December of 2006, and requesting that the County of Sonoma
conduct the Election; and (2) Adopting regulations for candidates of elective office pertaining to
Candidates' Statements:
As the two City Council officers with terms to expire in December of 2006, Councilmembers Breeze
and Flores recused themselves from these proceedings and stepped out of the Council chambers at
9:20 p.m.

attendance at said event.
3. Senior Citizens Advisory Commission, 6/15/06 mtg.: Councilmember Flores reviewed
events planned at the Senior Center. In particular, he noted the July 29`x' "Old and New"
Summer Market, and he stated that members of the public interested in donating can
contact Vicki Wilkerson at the Senior Center.
4. Santa. Rosa Plain Conservation Strategy Implementation Committee /California Tiger
Salamander (CTS), 6/21/06 mtg.: Councilmember Mackenzie provided a brief report,
including comments on the agricultural committees.
5. Water Issues Sub- Committee, 6/21/06 mtg.: Councilmember Flores reported on two
matters: (1) the dredging of the creeks; (2) the need for the public to check their
residences for water leaks.
Creek Master Plan Sub - Committee, 6/21/06 mtg.: Councilmember Mackenzie provided a
brief update on Committee activities, and. he noted that the Laguna de Santa Rosa
Foundation is now a part of the committee.

a. Bay Area SMART Growth: Councilmember Mackenzie noted that their Report
Card of the Bay Area Top- Scoring Cities will be released tomorrow.
b. Relay for Life: Vice Mayor Vidak - Martinez noted that she, as well as

c. Senior Senior Banquet: Vice Mayor - Vidak Martinez noted her attendance and
called attention to this event, which was yesterday at the Senior Center to honor
seniors over 90 years of age.
d. League of California Cities: Mayor Smith noted his attendance at today's
League meeting in Sacramento, and he provided a brief update on the
Telecommunications bill.

14. CITY MANAGER'S REPORT:
1. Legislative Update: City Manager Donley noted that this matter was covered earlier in
the meeting.
2. Other informational items, if any:
a. Station Casino meetings: City Manager Donley reviewed matters from two meetings
which he and City Attorney Kenyon had with Station Casino representatives /
Northwest Specific Plan representatives. Council CONCURRED with
Councilmember Mackenzie's request for a report regarding the meetings, and with
Mayor Smith's suggestion that the information be posted on the City's web site.
b. Sewer Bills: City Manager Donley noted that staff has received many inquiries about
the new water and sewer bills. He stated that current sewer bills for residents are
based on winter averaging.
