CALL TO ORDER: of the City of Rohnert Park for Community Development Commission Session for a Regular Meeting to the Rohnert Park City Hall, Rohnert Park, with Mayor Mackenzie Mayor Mackenzie CALLED the Council Meeting to order at 6:03 p.m. and led the pledge of allegiance. ROLL CALL: Present: (5) Councilmembers Flores, Smith and Spradlin; Vice Mayor Vidak- Martinez; and Mayor Mackenzie Absent: (0) None Staff present for all or part of the Regular Session: City Attorney Kenyon, Assistant City. Manager Donley, Senior Planner Bendorff and Animal Shelter Supervisor Zeldes. ANNOUNCEMENTS: Mayor Mackenzie announced that Assistant City Manager Donley will be covering the meeting as City Manager Leivo is with his wife, who had successful surgery in San Francisco today. Mayor Mackenzie commented on events surrounding a protest/ demonstration along Snyder Lane at Rancho Cotate High School this weekend. The Mayor noted that representatives of both the City and the School District made sure that ordinances were obeyed and that there was no infringement of First Amendment rights. *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINUTES April 12, 2005 Page(2 ) 1. Thomas Paolini, Troop No. 68: Not present. Erik Steffenson, Troop No. 68: Present. Brian Wall, Troop No. 23: Present. Mayor Mackenzie presented Mr. Steffenson and Mr. Wall with their certificates. 2. Jeff Nicks, Public Safety Officer, regarding Every 15 Minutes Program at Rancho Cotate High School: Mr. Nicks was not present. He arrived later as indicated in the minutes. 3. Catherine Bramkamp regarding Sonoma State University Open House Event: Mr. Bramkamp was not present. She arrived later as indicated in the minutes. 4. Seamus Seanachaoi regarding beneficial use of bio- diesel fuel to help farmers, economy and environment: Mr. Seanachaoi explained the advantages of bio- diesel fuel, and he encouraged the City to convert its fleet to bio- diesel. He told the Council to go to biodiesel.org for more information. He also shared comments on the importance of living wills. 3. Catherine Bramkamp regarding Sonoma State University Open House Event: [Out of order] Ms. Bramkamp DISTRIBUTED AND REVIEWED an outline regarding plans for an October 8, 2005 Open House at Sonoma State University. Mayor Mackenzie DIRECTED STAFF to contact Ms. Bramkamp as this event develops. Vice Mayor Vidak- Martinez SUGGESTED that the City participate in this event to distribute information about City services /events /programs. Council CONCURRED TO AGENDIZE SSU's Open House for a future Council meeting. 2. Jeff Nicks, Public Safety Officer, regarding Every 15 Minutes Program at Rancho Cotate High School: [Out of order] Officer Nicks DISTRIBUTED formal invitations to the Councilmembers requesting their attendance at Every 15 Minutes. He described the planning and effectiveness of the two -day event, which educates teens about the devastating effects of alcohol - related car accidents. *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINUTES April 12, 2005 Page(3 ) 5. Barbara Greene requesting City Council to consider setting up an official City Creek Committee: Mayor Mackenzie stated that Ms. Greene will not be present this evening. The Mayor noted his ongoing interest in a Master Creek Program. 2. STUDENT REPORTS: SSU - Sonoma State University Associated Students, Incorporated, by James J. Reilly III, Legislative Representative: Mr. Reilly DISTRIBUTED copies of The Star and reported on the following matters /events, including (1) Spring break over, (2) April 20 student rally at the capitol over fee hikes, (3) Mr. Reilly re- elected to ASI, (4) Appointment of Greg Sarris, (5) Job Fair on Thursday, (5) Author Luis Rodriguez to speak this Friday at the Cooperage, and (6) Response to tone of Press Democrat article about SSU students and the Party Ordinance. 3. UNSCHEDULED PUBLIC APPEARANCES /COMMENTS: 1. Tom Thunderhorse, 207 Southwest Boulevard, was recognized and expressed concern that the owner of Southwest Shopping Center may have to take down a barrier he erected between the shopping center and Rotten Robbies Gas Station to discourage the speeding, which has become a problem particularly at night. Mayor Mackenzie DIRECTED STAFF to review traffic enforcement in that area on the evening shifts. 2. Charles Kitchen, 4457 Hollingsworth Circle, was recognized and expressed concern with the City's proposed terms for the Second Amendment to the ground lease with CourseCo. He emphasized that fees should be tied to the Consumer Price Index, and he shared comments about the maintenance of the courses. He also stated that residents will not be saving that. much money with the new terms. 3. Don Codding, 6400 Redwood Drive, was recognized and discussed the proposed manufacturing plant for bio- diesel at the Agilent site. He announced the Agilent Development Public Forum sponsored by Codding Enterprises on April 21, 2005. Mayor Mackenzie and Council wished a Happy Birthday to Videographer Linda Beltz. *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINUTES April 12, 2005 Page(4 ) Councilmember Smith left the chambers at 6:45 p.m. due to conflict -of- interest issues regarding Golf Course Matters. 4. GOLF COURSE MATTERS: Consideration of terms of Second Amendment to the CourseCo Ground Lease: 1. Staff Report: Assistant.City Manager Donley reviewed the contents of the Staff Report, and Councilmember Flores of the Golf Course Subcommittee shared brief comments. 2. Public Comments: 1. Charles Kitchen, 4457 Hollingsworth Circle, was recognized and discussed how there are essentially no discounts in the 2005 Foxtail fees. He inquired how much money the City is losing in the guaranteed rent, and he reiterated that the resident fees and annual card fees should be tied to the Consumer Price Index. He also stated that there should be no less than 18 groundspeople. 3. Resolution for Adoption: 2005 -98 APPROVING THE SECOND AMENDMENT TO THE GROUND LEASE WITH ROHNERT PARK GOLF, L.P. (COURSECO) Council Motion /Discussion /Vote: A MOTION was made by Vice Mayor Vidak- Martinez, seconded by Councilmember Flores, to approve Resolution 2005 -98. Under discussion, Councilmember Flores referred to areas in Schedule 2 that needed to be revised. City Attorney Kenyon advised Council to amend the motion to allow her to review and revise the resolution as recommended. The maker of the motion and the second agreed. After said motion, APPROVED 4 -0 -1 with Councilmember Smith abstaining, reading was waived and Resolution 2005 -98 was ADOPTED with DIRECTIONS FOR STAFF to review and revise said resolution as recommended. Councilmember Smith returned to the chambers at 6:55 p.m. 5. PARKS MASTER PLAN AND COMMUNITY FIELDS CITIZENS ADVISORY COMMITTEE WORK PLAN: [DEFERRED] Review redrafted Committee Work Plan and results of first meeting held 04/06/05: *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINUTES April 12, 2005 Page(5 ) 1. Staff Report: Assistant City Manager Donley stated that Recreation Services Manager Miller was not present to give the Staff Report. On the advice of City Attorney Kenyon, Council CONCURRED TO DEFER said item to a future Council meeting when Recreation Services Manager Miller can provide the Staff Report. 2. Public Comments: Item DEFERRED. 3. Council Discussion /Direction /Action: Item DEFERRED. 6. PARKING EXEMPTIONS ORDINANCE: Consideration of proposed ordinance amending Section 17.16.040 of the Rohn.ert Park Municipal Code regarding parking exemptions to accommodate required disabled parking: 1. Staff Report: Senior Planner Bendorff shared the contents of the Staff Report. 2. Public Comments: None. 3. Waive Second Reading and Adopt Ordinance by reading title: No. 735 AMENDING ROHNERT PARK MUNICIPAL CODE SECTION 17.16.040 PERTAINING TO PARKING EXEMPTIONS Council Motion /Discussion /Roll Call Vote: Upon MOTION by Councilmember Flores, seconded by Councilmember Spradlin, and UNANIMOUSLY APPROVED, reading was waived and Ordinance 735 was ADOPTED BY ROLL CALL VOTE. Councilmember Smith thanked staff for providing informational Planning Department documentation. 7. ANIMAL CONTROL REGULATIONS ORDINANCE: Consideration of proposed ordinance amending Title 6 of the Rohnert Park Municipal Code concerning animal control regulations: *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINUTES April 12, 2005 Page(6 ) 1. Staff Report: Animal Shelter Supervisor Zeldes reviewed the contents of the Staff Report and responded to Council questions /comments. At the recommendation of Councilmember Smith, staff agreed to AMEND Section 6.02.070, Definitions, Item f, Commercial Kennel, to remove the.word "and" from "and /or" for clarification and consistency purposes. At the request of Mayor Mackenzie, a representative of Forgotten Felines came forward to discuss feral cats and the organization's services. 1. Jennifer Kirshner, Executive Director, Forgotten Felines of Sonoma County, was recognized and defined a feral cat, as well as elaborated on the spay /neuter and educational services offered by Forgotten Felines. She noted that the organization works closely with the Animal Shelter, and she indicated that their goal is to get people to register their feral colonies. Mayor Mackenzie stated that he and his wife are members of Forgotten Felines, that they have four licensed cats and feed and care for a number of feral cats, and that they support the efforts of the Animal Shelter. 2. Public Comments: None. 3. Waive First Reading and Introduce Ordinance by reading title. No. 738 AMENDING TITLE 6 OF THE ROHNERT PARK MUNICIPAL CODE CONCERNING ANIMAL CONTROL REGULATIONS Council Motion /Discussion /Roll Call Vote: A MOTION was made by Councilmember Flores, seconded by Vice Mayor Vidak- Martinez, to introduce Ordinance 738. Under discussion, Councilmember Spradlin requested that staff clarify how the public will know whether to apply for a commercial kennel or a hobby kennel. Animal Shelter Supervisor Zeldes commented on the intent of the kennel as the differential. After said motion, which was UNANIMOUSLY APPROVED, reading was waived and Ordinance 738 was INTRODUCED, AS AMENDED, BY ROLL CALL VOTE. 8. ZONING ORDINANCE: Consideration of proposed ordinance amending certain designated sections of Chapter 17, Zoning, of the Rohnert Park Municipal Code regarding kennels and small animals: *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINUTES April 12, 2005 Page(7 ) 1. Staff Report: Senior Planner Bendorff shared the contents of the Staff Report. 2. Public Comments: None. 3. Waive First Reading and Introduce Ordinance by reading title. No. 739 AMENDING SECTIONS 17.040.030, 17.06.030, 17.06.060, 17.06.100, 17.06.190, 17.07.020(0) and 17.07.020(AA) OF THE ROHNERT PARK MUNICIPAL CODE REGARDING KENNELS AND SMALL ANIMALS Council Motion /Discussion /Roll Call Vote: A MOTION was made by Vice Mayor Vidak- Martinez, seconded by Councilmember Spradlin, to introduce Ordinance 739. Under discussion, Councilmember Smith inquired if a citizen can have a hobby kennel without going to the Planning Department. Senior Planner Bendorff indicated that in that case a citizen would only need to go to the Animal Shelter because there is not commercial intent. After said motion, which was UNANIMOUSLY APPROVED, reading was waived and Ordinance 739 was INTRODUCED BY ROLL CALL VOTE. 9. SONOMA COUNTY WASTE MANAGEMENT AGENCY MATTER: Consideration of Regional Beverage Container Recycling Program: 1. Council Subcommittee Report, March 29, 2005 meeting: Councilmember Smith shared the contents of the Staff Report. 2. Resolution for Adoption: 2005 -99 AUTHORIZING THE SONOMA COUNTY WASTE MANAGEMENT AGENCY TO SUBMIT THE FUNDING REQUEST FORM TO THE DEPARTMENT OF CONSERVATION'S DIVISION OF RECYCLING, AND TO IMPLEMENT A BEVERAGE CONTAINER RECYCLING PROGRAM ON ITS BEHALF, AND, ONCE RECEIVED, TO FORWARD DEPARTMENT OF CONSERVATION FUNDS FOR BEVERAGE CONTAINER RECYCLING TO THE SONOMA COUNTY WASTE MANAGEMENT AGENCY *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINUTES April 12, 2005 Page(8 ) Council Motion /Discussion /Vote: A MOTION was made by Councilmember Smith, seconded by Councilmember Spradlin, to adopt Resolution 2005 -99. Under discussion, Councilmember Flores commented on the increased redemption revenues. After said motion, which was UNANIMOUSLY APPROVED, reading was waived and Resolution 2005 -99 was ADOPTED. 10. COUNCIL COMMITTEE AND /OR OTHER REPORTS: 1. Sonoma County Agricultural'Preservation & Open Space District, Ad Hoc, Santa Rosa, March 23, 2005 meeting and Regular Advisory Committee, March 24, 2005 meeting: Per the Ad Hoc meeting, Mayor Mackenzie reported on discussions about re- authorization of the quarter -cent sales tax. Per the Regular Advisory Committee meeting, Mayor Mackenzie had nothing to report for the Rohnert Park community. 2. California Tiger Salamander Ad Hoc Committee, March 23, 2005 and April 6, 2005 meetings: Vice Mayor Vidak - Martinez and Mayor Mackenzie shared comments on the fetter being sent to Congresswoman Woolsey regarding having a Federal presence at these meetings., 3. League of California Cities - Economic Development, March 24, 2005 meeting: Councilmember Smith referred Council to information from this meeting provided to them in their agenda packets a couple weeks ago. Mayor Mackenzie indicated that it is his intention that the City continue to be represented in the League's Town & Gown discussions. 4. Russian River Watershed, March 24, 2005 meeting: Mayor Mackenzie remarked on the progress of the Integrated Regional Water Management Plan. 5. Climate Protection /Santa Rosa's, March 24, 2005 meeting: Mayor Mackenzie commented on the progress of the City's Energy Conservation Plan and the idea of a one -year update. 6. Association of Bay Area Governments (ABAG) /Cal -Fed Task Force /Water Forum, March 28, 2005 meeting: Mayor Mackenzie commented on the Bay Area Integrated Regional Water Management Plan. *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINUTES April 12, 2005 Page(9 ) 7. Rotary Garden Dedication, March 30, 2005: Councilmember Smith commented on the cooperative efforts of Rotary and the Department of Public Works for this event. Mayor Mackenzie noted that citizens can get more information about xeriscaping in the library. 8. Water Advisory Committee (WAC), April 4, 2005 meeting: Mayor Mackenzie gave a brief update on matters relating to Marin Municipal Water District. 9. Redwood Empire Municipal Insurance Fund (REMIF) Board Meeting, April 7, 2005: Councilmember Smith commented on the Blue Cross rate increase, and he discussed the City's Workers' Comp and liability figures and percentages. 10. Sonoma County Transportation Authority (SCTA), April 11, 2005 meeting: Mayor Mackenzie gave an update on the Strategy Plan and the Bodway Park Bike Lanes Project. 11. Agilent Development Public Forum sponsored by Codding Enterprises, April 21, 2005: Mayor Mackenzie referred Council to Don Codding's comments earlier this evening, and he encouraged members of the public to attend said Public Forum. 12. League of California Cities, North Bay Meeting, April 21, 2005: Councilmember Smith indicated that he should be able to attend this meeting, as well as the Agilent Development Public Forum on the same date. 13. League of California Legislative Action Days, May 11 -12, 2005: Mayor Mackenzie indicated that he will attempt to attend part of this event. 14. Other informational reports, if any: a. L Section Meeting: Vice Mayor Vidak- Martinez DISTRIBUTED AND REVIEWED fliers for a May 14, 2005 meeting regarding development of Ladybug Park and Creek restoration. b. Chamber of Commerce /Business Resource: At the suggestion of Councilmember Smith, Mayor Mackenzie DIRECTED STAFF to invite representatives of Ben Stone's office to speak to the Council about ways to encourage businesses to recycle. *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINUTES April 12, 2005 Page(10) c. Sonoma County Waste Management Agency meeting: Councilmember Smith gave a brief update on the anticipated tipping fee increases. d. Keegan Leadership Series: Councilmember Smith reported his attendance at this event. e. Sonoma State University Gala Ball: Councilmember Smith and Mayor Mackenzie reported on their attendance at this event. Mayor Mackenzie DIRECTED STAFF to report back on an upcoming meeting with SSU President Arminana. Vice Mayor Vidak- Martinez noted that SSU representatives are interested in working with the City on emergency preparedness issues. f. Contract negotiations: Councilmember Flores reported that he and Mayor Mackenzie continue to work with the Interim City Manager and the City Attorney on contracts. 11. COMMUNICATIONS: Communications per the attached outline were brought to the attention of the Council. The following communications were discussed: Rancho Cotate High School scholarship awards: At the suggestion of Vice -Mayor Vidak- Martinez, Council CONCURRED TO AGENDIZE consideration of supporting an RCHS scholarship(s). Community Beautification Ordinance: Councilmember Flores referred to a letter of appreciation from a resident regarding the community beautification ordinance. UC -CSU Host Cities /Berkely meeting: Mayor Mackenzie DIRECTED STAFF to contact the City of Berkeley about the convening of an informal meeting sometime in May, 2005 regarding the UC -CSU Host Cities. Brookfield Homes /School District's transfer of properties: At the request of Mayor Mackenzie, Council CONCURRED TO AGENDIZE Council consideration of a letter of support over the Mayor's signature regarding this matter. *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINUTES April 12, 2005 Page(11) 12. MATTERS FROM /FOR COUNCIL: 1. State Water Resources Control Board, April 21, 2005 Hearing on Russian River Water in Sacramento: Mayor Mackenzie shared brief comments on this event. Council consideration of Mayor to attend /participate: Council Discussion /Direction /Action: At the request of Mayor Mackenzie, Council CONCURRED to direct the Mayor to attend /participate in the State Water Resources Control Board Hearing on April 21, 2005. 2. Policies regarding electronic equipment and Internet access for Councilmembers: Councilmember Smith commented on his interest in this matter. Council CONCURRED TO DIRECT STAFF to report back with recommendations regarding home offices at a future Council meeting. 3. Santa Rosa Pot Clubs Ordinance: Councilmember Smith DISTRIBUTED AND REVIEWED.an article from The Economist, and he suggested that Council may want to review this matter. Council and staff discussion concluded with Council CONCURRENCE TO DIRECT STAFF to report back at the next Council meeting on the status of medical marijuana_ and how to proceed with this matter. 4. Climate Protection Campaign - City Representatives to May 22, 2005 meeting: Mayor Mackenzie briefly discussed this meeting. Council Discussion /Direction /Action: Vice Mayor Vidak- Martinez indicated that she can attend part of this meeting, and she reiterated the need for representatives. Councilmember Smith suggested Brad Baker of Codding Enterprises as a business representative. At the suggestion of the Mayor and Vice Mayor, Council AGREED to DIRECT them to report back with their ideas for a team of four representatives for the community target- setting workshop. 5. LCC Indian Gaming Subcommittee, San Jose, April 6, 2005 meeting: Mayor Mackenzie requested to RE- AGENDIZE this matter for the next Council meeting after Council has had time to review the documents. *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINUTES April 12, 2005 Page(12) 6. Schedule of Events and Meetings: Mayor Mackenzie referred Council to the Upcoming Events document in the agenda packets. 7. City Council Agenda Forecast: Provided to Council in the agenda packets. Councilmember Flores brought up a Mayors' & Councilmembers' Association matter. Mayor Mackenzie noted that there will be a one- or two -hour 2005 -06 Budget Work Session on the next agenda. 8. Other informational items, if any: a. Speed Limits: Councilmember Smith requested an update on this matter. Mayor Mackenzie reported that there is interest in bringing the issue up in the next Mayors' & Councilmembers' meeting. Council AGREED TO DIRECT STAFF to bring the matter up at the next City Managers' meeting as well. 13. CITY MANAGER'S REPORT: 1. Rancho Adobe Fire District, Letter of March 24, 2005: Assistant City Manager Donley reported on the Fire District's committee, which will survey local jurisdictions regarding the possibility of shared services, consolidations and contracts for service. Councilmember Flores expressed an interest in having the Public Safety Subcommittee represent the City at the meeting with the Rancho Adobe Fire District Committee. 2. City of Cotati to discuss Public Safety services cooperation with City of Rohnert Park at Cotati's regular April 13, 2005 City Council meeting: Mayor Mackenzie reported on this item. At the suggestion of the Mayor, Council CONCURRED TO DIRECT STAFF (1) to contact the City of Cotati following tomorrow night's meeting to determine what ensued regarding this matter, and (2) to work with the City's Public Safety Subcommittee to set up a meeting with appropriate staff representation, including Department of Public Safety staff and representatives of the City of Cotati, to follow up on Cotati's actions after the meeting and report back to Council at the next Council meeting. 3. Employee Appreciation Annual Event format: Assistant City Manager Donley explained this matter to Council. *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINUTES April 12, 2005 Page(13) Council Discussion /Direction: Councilmembers expressed a general preference for a luncheon format to achieve the highest staff attendance. Mayor Mackenzie asked that staff coordinate the event with the Council's calendar as well. 4. Other informational items, if any: a. League of California Cities, Legislative Action Days, May 11 -12, 2005: Assistant City Manager Donley noted that he and City Engineer Jenkins will be attending this event. Mayor Mackenzie asked that they report back to Council any significant matters. 14.
