2005/06/14 City Council MinutesCITY OF ROHNERT PARK CONCURRENT MEETINGS MINUTES for: CITY COUNCIL COMMUNITY DEVELOPMENT COMMISSION June 14, 2005 Tuesday The Concurrent Meetings of the City of Rohnert Park for the City Council and the Community Development Commission met this date in Work Session and Regular Session to at 6:50 p.m. at the Rohnert Park City Hall, 6750 Commerce Boulevard, Rohnert Park, with Mayor Mackenzie presiding. CALL TO ORDER /PLEDGE OF ALLEGIANCE: Mayor Mackenzie CALLED the Council Meeting to order at 6:50 p.m. and led the pledge of allegiance. ROLL CALL: Present: (4) Councilmembers Flores and Smith; Vice Mayor Vidak- Martinez; Mayor Mackenzie Absent: (1) Councilmember Spradlin Staff present for all or part of the Regular Session: Interim City Manager Donley, City Attorney Kenyon, Assistant City Attorney Whelan, Director Public Safety Bullard and Interim Assistant City Manager /City Engineer Jenkins. Mayor Mackenzie stated that Councilmember Spradlin would not be in attendance this evening as she is out of town. REGULAR SESSION - CITY COUNCIL MEETING 1. CLOSED SESSION: Council met in Closed Session and Real Estate Negotiations. Session at 7:50 p.m. to discuss Personnel Matters Council reconvened in Regular 2. MAYOR'S REPORT ON CLOSED SESSION: Mayor Mackenzie stated that there was no action to report per the Closed Session. *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINUTES June 14, 2005 Page(2 ) 3. SCHEDULED APPEARANCES /PRESENTATIONS: 1. Greg Nordin re Economic Development: Mr. Nordin read from a prepared statement, ATTACHED TO THE ORIGINAL SET OF MINUTES, concerning Economic Development. Mr. Nordin urged Mayor Mackenzie, Vice Mayor Vidak- Martinez and Councilmember Smith to focus on bringing sales tax dollars to the community before there are more departmental cutbacks and layoffs. He noted that there has been no agenda item over the past six months regarding increasing revenues. He encouraged the Council to start implementing past decisions regarding infrastructure, Specific Plans and development agreements. He expressed concern that certain Councilmembers' interests*in working on the problems of other entities, such as the City of Cotate, Rancho Adobe Fire District, SSU, and the Library District, as well as the Council's creation of ad hoc committees, is taking away from Council's and staff's time to implement the City's General Plan. He noted the lack of clothing and electronic goods stores, and he reiterated his concern that the next five years will produce more study, possibly bankruptcy, but little real progress for the City of Rohnert Park. Mayor Mackenzie called for any Council questions. Councilmember Smith indicated that staff and Council will be developing plans to pay for the $38.5 million unfunded liability for retiree health care costs. He noted that there was no such plan when Mr. Nordin was Mayor of Rohnert Park. Mr. Nordin stated that he will be back to report on that matter. 4. STUDENT REPORTS: SSU - Sonoma State University Associated Students, Incorporated, by James J. Reilly III, Legislative Representative: Mr. Reilly reported on the following matters: (1) Merging of ESAS position and VP of Student Affairs position into one office under Dr. Katherine Craft; (2) Sustainability Award to the Student Recreation Center. 5. UNSCHEDULED PUBLIC APPEARANCES /COMMENTS: Members of the public who filled out a speaker card were invited to come forward and speak. Items for Consideration: 2005 -165 RECOGNIZING ART IBLETO, THE PASTA KING, AS AN HONORARY CITIZEN OF THE CITY OF ROHNERT PARK *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINUTES June 14, 2005 Page(5 ) Councilmember Smith RECOMMENDED that Mr. Ibleto be recognized for his contributions to the local community. He also commented on Mr. Ibleto's past, including serving as a Freedom Fighter in Italy during World War II. A MOTION was made by Councilmember Smith., seconded by Vice Mayor Vidak - Martinez, to adopt Resolution 2005 -165. Under discussion, Councilmember Flores and Mayor Mackenzie shared comments on Mr. Ibleto's years of providing meals and his non - profit work in the community. After the motion, which was APPROVED 4 -0 -1 with Councilmember Spradlin absent, reading was waived and Resolution 2005 -165 was ADOPTED. 2005 -166 RECOGNIZING AND THANKING MARLYN KELLER, HOUSING SERVICES ASSISTANT, UPON HER RETIREMENT Councilmember Flores RECOMMENDED that Ms. Keller be recognized by a proclamation for her years of service to the City. A MOTION was made by Councilmember Flores, seconded by Vice; Mayor Vidak- Martinez, to adopt Resolution 2005 -166. Under discussion, Mayor Mackenzie commended Ms. Keller for her work on the Rebuilding Together program. After the motion, which was APPROVED 4 -0 -1 with Councilmember Spradlin absent, reading was waived and Resolution 2005 -166 was ADOPTED. 2005 -170 ENCOURAGING COLON CANCER AWARENESS Mayor Mackenzie discussed his efforts in working with the community to encourage citizens to undergo colon exams. He also urged Interim City Manager Donley to encourage staff to have the exam. A MOTION was made by Mayor Mackenzie, seconded by Vice Mayor Vidak- Martinez, to adopt Resolution 2005 -170. Under discussion, Councilmember Flores noted that his exam was quick and painless,.and he encouraged citizens over the age of 55 to get the exam. After the motion, which was APPROVED 4 -0 -1 with Councilmember Spradlin absent, reading was waived and Resolution 2005 -170 was ADOPTED. 2005 -183 APPROVE LAND SALE PURCHASE AGREEMENT BETWEEN CITY OF ROHNERT PARK AND KRCB Councilmember Smith stated for clarification that he is of counsel with Lanahan & Re'illey who is dealing with this KRCB matter. He further noted that he has had no dealing in the matter, and that the City Attorney has advised him that he can participate in this decision. *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINUTES June 14, 2005 Page(6 ) A MOTION was made by Councilmember Smith, seconded by Vice Mayor Vidak- Martinez, to adopt Resolution 2005 -183. Under discussion, Councilmember Flores and Mayor Mackenzie expressed pleasure that the purchase is imminent. After the motion, which was APPROVED 4 -0 -1 with Councilmember Spradlin absent, reading was waived and Resolution 2005 -183 was ADOPTED. At this time, Mayor Mackenzie EXTENDED AN INVITATION to Technology High School and the Rancho Cotate High School Girls Varsity Softball Team to attend the June 28th City Council meeting at which time Council will acknowledge their respective accomplishments. Mayor Mackenzie also REQUESTED Council support for a resolution of recognition for Project Graduation to be on the next City Council agenda. Furthermore, the Mayor noted the huge financial success of the American Cancer. Society's recent Rohnert Park Relay for Life. 7. ENERGY CONSERVATION MEASURES AGREEMENTS: 1. Staff Report: Interim City Manager Donley reviewed the contents of the Staff Report, and staff responded to Council questions /comments. 2. Public Comments: None. 3. Resolution for Adoption: 2005 -171 APPROVING CERTAIN ENERGY CONSERVATION MEASURES AUTHORIZING THE EXECUTION OF AGREEMENTS, SIGNATORIES, AND MAKING OTHER DETERMINATIONS IN CONNECTION THEREWITH Council Motion /Discussion /Vote: A MOTION was made by Councilmember Flores, seconded by Vice Mayor Vidak- Martinez, to adopt Resolution 2005 -171. Under discussion, Councilmember Flores reiterated the importance of energy conservation. Mayor Mackenzie discussed the City's efforts and goals in moving in the direction of energy conservation. After the motion, which was APPROVED 4 -0 -1 with Councilmember Spradlin absent, reading was waived and Resolution 2005 -171 was ADOPTED. *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINUTES June 14, 2005 Page(7 ) 8. MARIN MUNICIPAL WATER DISTRICT: Presentation by Paul Helliker, General Manger, Marin Municipal Water District (MMWD) regarding proposal to extend deadline specified in Section 8(b) of Exhibit B of the Supplemental Water Supply Agreement between County of Sonoma Water Agency (SCWA) and MMWD: 1. Staff Report: Mayor Mackenzie shared opening comments. Interim City Manager Donley outlined the matters at issue, and Mr. Helliker gave an oral presentation. Council CONCURRED to authorize the Water Subcommittee, which meets tomorrow at 1:30 p.m., to vote on this matter. Councilmember Smith SUGGESTED that the resolution be amended to include language indicating that Water Subcommittee shall meet to determine the best course of action to take on behalf of the City of Rohnert Park. 2..Public Comments: None. 3. Resolution for Adoption: 2005 -187 DIRECTING THE CITY'S WATER ADVISORY COMMITTEE REPRESENTATIVE HOW TO VOTE ON A PROPOSED OPTION EXTENSION FOR THE MARIN MUNICIPAL WATER DISTRICT Council Motion /Discussion /Vote: A MOTION was made by Councilmember Flores, seconded by Vice Mayor Vidak- Martinez, to adopt Resolution 2005 -187. Under discussion, Councilmember Flores discussed a desalination or increased flow infrastructure. Councilmember Smith inquired about the Warm Springs Dam Project. Mayor Mackenzie noted that this is a good faith offer and the Water Subcommittee will have a serious discussion tomorrow. After the motion, which was APPROVED 4 -0 -1 with Councilmember Spradlin absent, reading was waived and Resolution 2005 -187 was ADOPTED AS AMENDED to include language in the final "now therefore" clause indicating that the City's Water Subcommittee will meet to determine the best course of action to take for the City of Rohnert Park concerning this matter. *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINUTES June 14, 2005 Page(8 ) 9. PARKS, RECREATION AND OPEN SPACE (PROS) COMMITTEE: Council consideration regarding filling of vacancies on PROS Committee: 1. Staff Report: Interim City Manager Donley reviewed the contents of the Staff Report. Council Discussion /Direction /Action: Council discussion concluded with CONCURRENCE TO DIRECT the PROS Committee to continue its work with the current ten - member committee. Furthermore, Councilmembers discussed ongoing interaction with the City of Cotati on PROS Committee matters, as well as Ladybug Park and various creek projects. 10. TAXI CAB SERVICE: Consideration of an application from Sammy Tawasha, an individual, for Certificate of Public Convenience and Necessity for a Taxi Cab Service for the City of Rohnert Park: 1. Staff Report: Interim City Manager Donley reviewed the contents of the Staff Report, and staff responded to Council questions /comments. 2. PUBLIC HEARING: Mayor Mackenzie opened the Public Hearing at 8:44 p.m. 1. Sammy Tawasha, 6930 Commerce Boulevard, No. 91, was recognized and stated that he has a clean record and that he would like to start a taxi cab service in Rohnert Park. He commented on the need for additional taxi cab service in Rohnert Park, and he noted that one of his goals will be to provide taxi cab service for citizens in wheelchairs. Councilmember Flores wished Mr. Tawasha success in this endeavor, and he inquired if he had done a thorough review of the need for more taxi service. Mr. Tawasha indicated that he had done such a review. Mayor Mackenzie closed the Public Hearing at 8:47 p.m. 3. Resolution for Adoption: 2005 -188 FINDING THE PUBLIC CONVENIENCE AND NECESSITY FOR SAMMY TAWASHA dba R.P. SAM'S LIMO TAXI TO PROVIDE TAXI -CAB SERVICE TO THE CITY OF ROHNERT PARK *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINUTES June 14, 2005 Page(9 ) Council Motion /Discussion /Vote: A MOTION was made by Vice Mayor Vidak- Martinez, seconded by Councilmember Flores, to adopt Resolution 2005 -188. Under discussion, Councilmember Smith stated that the City will be better served an additional taxi service. Mayor Mackenzie expressed support for Mr. Tawasha's interest in providing wheelchair accommodations. After the motion, which was APPROVED 4 -0 -1 with Councilmember Spradlin absent, reading was waived and Resolution 2005 -188 was ADOPTED. 11. GENERAL PENALTY ORDINANCE: Consideration of Introduction of Ordinance No. 743 regarding General Penalty: 1. Staff Report: Interim City Manager Donley recommended deferring this item to the City Council June 28th agenda. Council CONCURRED with staff's recommendation to DEFER said matter. 2. Public Comments: Item DEFERRED to the June 28th City Council meeting. 3. Ordinance for Introduction by waiving First Reading and reading the title: No.743 AMENDING SECTION 1.16.010, "GENERAL PENALTY," OF CHAPTER 1.6 OF THE ROHNERT PARK MUNICIPAL CODE TO DESIGNATE MUNICIPAL CODE VIOLATIONS AS INFRACTIONS AND EXCEPTING CERTAIN VIOLATIONS THAT WILL CONSTITUTE MISDEMEANORS Council Motion /Discussion /Roll Call Vote: Item DEFERRED to the June 28th City Council meeting. PLANNING AND ZONING MATTERS: 12. CONDO CONVERSION ORDINANCE: Consideration of Adoption of Ordinance No. 742 adding Municipal Code Section 17.07.020: 1. Ordinance for Adoption by waiving Second Reading and reading title: No. 742 ADDING MUNICIPAL CODE SECTION 17.07.020 (HH) REGARDING CONDOMINIUM CONVERSIONS Council Motion /Discussion /Roll Call Vote: A MOTION by Vice Mayor Vidak- Martinez, seconded by Councilmember Flores, to adopt Ordinance No. 742. Under discussion, Councilmember Flores discussed the critical aspect of affordability. After the motion, which was APPROVED 4 -0 -1 with Councilmember Spradlin absent, reading was waived and Ordinance No. 742 was ADOPTED BY ROLL CALL VOTE. 13. SUBDIVISION ORDINANCE: Consideration of Public Hearing for File PL2005 -031MC Proposed Amendment of Title 16 of the Rohnert Park Municipal Code regarding subdivisions: 1. Staff Report: Interim City Manager Donley stated .that due to staff vacation schedules, staff recommends waiting until after the Planning Commission's June 23rd meeting to hold the Public Hearing for this matter. Assistant City Attorney Whelan noted that members of the public wishing to comment on this matter should wait until the scheduled Public Hearing. Toni Berto,lero of Winzler & Kelly reviewed the contents of the Staff Report and responded to Council questions /comments. 2. PUBLIC HEARING: DEFERRED to the next City Council meeting on June 28, 2005, to allow the Planning Commission the opportunity to review said matter. At this time, Assistant City Attorney Whelan asked if there were any members of the public interested in sharing public comments. No one responded. 3. Resolution for Adoption: 2005- CERTIFYING A NEGATIVE DECLARATION FOR THE ADOPTION OF AN ORDINANCE AMENDING TITLE 16 SUBDIVISIONS OF THE ROHNERT PARK MUNICIPAL CODE Council Motion /Discussion /Vote: Item DEFERRED to the June 28th City Council meeting. *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINUTES June 14, 2005 Page(11) 4. COUNCIL COMMITTEE AND /OR OTHER REPORTS: 1. California Tiger Salamander meeting, May 25, 2005: Mayor Mackenzie stated that this item will be .reported on during the City Manager's Report. 2. Russian River Watershed Association meeting, May 26, 2005: Mayor Mackenzie noted items regarding the Ahwahnee Water Principles and the 2005 Student Video Contest. 3. Sonoma County Agriculture Preservation & Open Space District, May 26,2005: Mayor Mackenzie noted efforts to solicit support for the measure to re- authorize the quarter -cent sales tax. 4. World Environment Day Events (WED), June 1 -5, 2005: Councilmember Smith noted a presentation regarding the City's adoption of clean air principles. Mayor Mackenzie commented on this event and the accord that was signed. He thanked Vice Mayor Vidak- Martinez for her work regarding greenhouse gas emissions. 5. Business Environmental Alliance Breakfast, June 8, 2005: Councilmember Smith noted presentations regarding water and.a waste update. He indicated that he REQUESTED a PG &E representative to get in touch with the City regarding undergrounding of utilities. 6. North Coast Integrated Regional Water Management Plan meeting, June 8, 2005: Mayor Mackenzie gave an update on the submission of planning requests to the State Water Control Board. 7. Sonoma County Transportation Authority meeting, June 13, 2005: Mayor Mackenzie commented on the adoption of the Strategic Plan for Measure M, and he gave brief updates on the Wilfred project, the Park & Ride project and the Steele Lane project. *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINUTES June 14, 2005 Page(12) 8. Bay Area Water Forum, June 13, 2005: Mayor Mackenzie noted that he was representing ABAG for this forum, and he shared comments about water management planning activities. 9. Other informational items, if any: a. Redwood Empire Municipal Insurance Fund (REMIF): Councilmember Smith commented on various premiums, and he noted that he is now the Vice President of that board. 15. COMMUNICATIONS: Communications per the attached outline were brought to the attention of the Councilmembers. The following items were pulled for discussion: 1. Letter from Michael Schwarz, resident, re concerns over utilities rate increases: Councilmember Flores noted that said increases are due to the increased cost of providing treatment. He also noted that it is important that staff respond to such letters. Interim City Manager Donley indicated that staff does respond to such letters, and Mayor Mackenzie SUGGESTED that the City's responses be placed on Communications for the Council to review. 2. Letter from T. Poff, Petaluma resident, re possible site for Rohnert Park downtown: Councilmember Smith indicated that he has correspond back and forth with Mr. Poff on this matter. 3. Letter from B. Rohnert Park: Snyder Lane is staff has been matter of road Snyder Lane wi discussions. Coats, resident, re road repair in Mayor Mackenzie noted that because not within the City of Rohnert Park, in touch with County services and the repair and a full reconstruction of Ll be considered in General Plan 4.Sonoma County Mayors' Committee: Mayor Mackenzie indicated that he has been asked to nominate a local company for an Employee Best Practices Award. He SUGGESTED that staff look at the City of Santa Rosa's Agenda Forecast in terms of adding a section for Proposed Agenda Items to the City's Agenda Forecast. 18. MATTERS FROM /FOR COUNCIL: 1. Comcast, San Rafael, May 25, 2005: Mayor Mackenzie indicated that he had a discussion with Comcast representatives regarding forecasted growth this summer. 2. Meeting with Wade Belew re Laguna de Santa Rosa, June 2, 2005: Mayor Mackenzie discussed restoration and outreach efforts of the Laguna de Santa Rosa Foundation and the recent grant they and the Sonoma County Water Association received. He encouraged the City to apply for such grants. 5. Relay for Life, June 4 -5, 2005: Mayor Mackenzie and Councilmember Smith indicated that they participated in this event. The Mayor reiterated his desire to recognize the American Cancer Society Relay for Life group for its efforts. 6. Bay Area Public Officials Leadership Forum, June 9 -10, 2005: Councilmember Smith commented on the excellence of the forum, and Mayor Mackenzie noted that he wants Professor Elwood to meet with City representatives. 7. Other informational items, if any: a. Eagle Scout event: Councilmember Flores stated that he attended a recent event honoring a local Eagle Scout. b. California Junior Miss: Councilmember Flores asked members of the public interested in being host families to contact him at 795 -4386. c. AB939 Local Task Force: Councilmember Smith indicated that any member of the public interested in recycling issues should apply to be the local representative. He noted that Interim City Manager Donley may have to consider appointing a staff member to be said representative. 19. CITY MANAGER'S REPORT: 1. Doggie Day Care - Staff recommendations: Interim City Manager Donley noted that the Animal Shelter Supervisor recommended against said idea due to the amount of potential disease in the Animal Shelter. 2. California Tiger Salamander meeting, June 8, 2005: Interim City Manager Donley stated that the Federal Registry is going to list the rule for a 60 -day comment period. He noted that the next meeting will be on June 29, 2005. 3. Fireman's Fund Heritage Grant: Interim City Manager Donley reported on the Department of Public Safety's receipt of said grant written by Lieutenant Frazer. Council commended Lieutenant Frazer and the department. 4. Retirement Celebration in honor of Paul Berlant, Windsor Town Manager: Interim City Manager Donley reviewed the invitation to the Councilmembers. Councilmember Smith indicated that he has a REMIF meeting at said time. Mayor Mackenzie SUGGESTED that staff prepare a resolution of acknowledgement for the next Council agenda. 5. Informational items, if any: a. Eagles at Green Music Center, August 14, 2005: Interim City Manager Donley explained the Department of Public Safety's interaction with adjacent agencies to coordinate this event. At the suggestion of Councilmember Smith, Council CONCURRED TO AGENDIZE consideration of Mr. Fox's request for appointment for the next Council meeting. Additionally, Councilmember Smith commented on a communication from the U.S. Environmental Protection Agency regarding termination of Federal Administrative Order Docket Number OWS -AO- 2004 -133. Mayor Mackenzie reviewed Interim City Manager Donley's memo re vacation and military duty as follows: Vacation, August 17 -22; Military Duty, August 1 -5 and September 20 -26. 20. ARTS IN THE PARKS PROJECT: Emily Wiseman, Cultural Arts Commission, to update Council: Mayor Mackenzie commented on the efforts of the Cultural Arts Commission, and he expressed a desire to ask Ms. Wiseman to attend a future Council meeting to provide this update. Council Discussion /Direction /Action: Interim City Manager Donley advised Council that he will DEFER this matter to.the June 28 City Council meeting. At this time, Mayor Mackenzie SUBMITTED to Interim City Manager Donley a letter from the Governor expressing appreciation for the City's support of Proposition 42. The Mayor REQUESTED that copies of said letter be sent to all of the Councilmembers. 21. PUBLIC COMMENTS: Members of the public desiring to speak were invited to come forward. Of: "100 cc: cc: File: Flle: The headline in this article could be Rohnert Park's future slips away. While our Council plods through "the process," Santa Rosa (and Petaluma and Cotati also) are doing what it takes to bring sales tax dollars to their communities. These cities will have tax dollars to pay for community services while Rohnert Park will continue to make budget cuts. Unless you change your ways, Mayor Mackenzie, Vice Mayor Vidak - Martinez, and Council member Smith, your next job will be cut backs in police, fire, recreation, street maintenance, park upkeep and other services people in our community need. Where are you going to make layoffs, what programs are you going to cut? City's General Plan. Rohnert Park's number one priority, right above your heads, is to increase revenues. You have not had one item on your agenda for over six months to deal with increasing revenues. You've created committees for everything else but increasing revenues. The most important job the Council has to do is implement the Infrastructure needs to be upgraded, specific plans need to be improved, and development agreements need to be negotiated. There is no higher priority for staff time, the Council's time, the Planning Commission's time, and the Parks and Recreation Commission's time. The Council should look up the term implementation. It means putting in place decisions that already have been made. It is not rehashing and debating again the decisions that were made over 5 years ago. But what does the City Council trio and their Planning Commission appointments do, they assign all sorts of meaningless jobs and research projects to staff. At the suggestion of Council member Smith, we are working on the problems of Cotati, the Rancho Adobe Fire District, Sonoma State University, and the Library District. These organizations are not going to bail Rohnert Park out of its financial problems. Vice Mayor Vidak - Martinez had the Council create an Ad Hoc Public Safety Committee because Public Safety staff was "out of control." It would be much better to have Public Safety staff out on the streets protecting our citizens instead of meeting to satisfy the egos of Council members. Mayor Mackenzie is traveling the state instead of attending to the business of Rohnert Park. Staff time taken to "hold the hands" of our Council trio would be better spent working to implement the City's General Plan. Mayor Mackenzie, Vice Mayor Vidak- Martinez and Council member Smith, you talk a lot about energy conservation and reducing congestion on 101. Rohnert Park residents are not saving energy and reducing congestion when they get in Rosa. their cars and go to Petaluma or Santa Petaluma has a Kohls but Rohnert Park does not have such a clothing department store. Santa Rosa has any number of consumer electronic stores but Rohnert Park does not have one. Our community is not very sustainable for the average citizen. We are now more than five years after adopting the General Plan, h6 tew land has been added to the City and the clock keeps ticking. What will be the legacy of the Council trio? I fear for Rohnert Park citizens that it will be another five years of study but little real progress. I fearAhat the City is headed for bankruptcy because Mayor Mackenzie and his cohorts do not know how to implement anything. I fear that Rohnert Park's future is slipping away.
