2004/09/14 City Council MinutesCITY OF ROHNERT PARK CONCURRENT MEETINGS MINUTES for: CITY COUNCIL COMMUNITY DEVELOPMENT COMMISSION September 14, 2004 Tuesday The Concurrent Meetings the City Council and the met this date in Regular commence at 6:00 p.m. at 6750 Commerce Boulevard, presiding. CALL TO ORDER: of the City of Rohnert Park for Community Development Commission Session for a regular meeting to the Rohnert Park City Hall, Rohnert Park, with Mayor Nordin Mayor Nordin CALLED the Regular Session to order at 6:03 p.m. ROLL CALL: Present: (5) Councilmembers Martinez; Vice Nordin Absent: (0) None Flores, Mackenzie and Vidak- Mayor Spradlin; and Mayor Staff present for all or part of the Regular Session: City Manager Leivo, Interim City Attorney Whelan; Neighborhood Improvement Officer Denlis, Senior Planner Bendorff, and City Engineer Jenkins. 1. WORK SESSION: Sonoma County Housing Coalition Public Policy and Financing Tools for Affordable Housing City Manager Leivo introduced Jim Leddy from the Sonoma County Housing Coalition. Mr. Leddy DISTRIBUTED AND REVIEWED a document entitled, "Sonoma County Housing Coalition: Public Policy ,& Financing Tools for Affordable Housing." Mr., Leddy discussed ABAG allocations and the need for education, and he responded to Council questions /comments about current projects, future plans, the lack of sites in Rohnert Park and the characteristics of low- and very -low income groups. Mr. Leddy AGREED to meet with City Manager Leivo when the Sonoma County Housing Coalition gets the updated numbers for Rohnert Park. The Work Session concluded at 6:35 p.m. *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINUTES September 14, 2004 Page(2 ) ADJOURN TO CLOSED SESSION: Mayor Nordin adjourned Council to Closed Session at 6:36 p.m. to discuss Litigation Matters and Real Estate Negotiations. Closed Session ended at approximately 7:15 p.m. Mayor Nordin resumed Regular Session at 7:30 p.m. and led the pledge of allegiance. MOMENT OF SILENCE: Mayor Nordin asked the public to observe a moment of silence to remember Nicole Mattison, a young lady from Rohnert Park who recently lost her life in a traffic collision in Sonoma County. 2. MAYOR'S REPORT ON CLOSED SESSION: Mayor Nordin reported that Council voted in favor of a stipulation of dismissal of the Home Builders Association of Northern California v. William, No. S -04 -345 LKK (E.D. Cal.) Distinct Population Designation of California Tiger Salamander. 3. SCHEDULED APPEARANCES /PRESENTATIONS: 1. Mayor's Presentation of Resolution expressing appreciation to Toni Bertolero for her services as Interim City Engineer from December 2002 through August 2004: Mayor Nordin read and presented the resolution to Ms. Bertolero, who thanked Council for the public acknowledgement of appreciation. 2. Barbara Greene, Co -Chair of Rohnert Park /Cotati Creek Council regarding Copeland Creek Nature Park proposal: Ms. Greene was not present. 3. Denis Brown, Shell Oil Products regarding Groundwater Clean -up pertaining to gas station's waste discharge and connection fees: Mr. Brown, Senior Environmental Engineer with Shell Oil, requested Council's assistance in getting the connection fee of approximately $144,000 reduced in order to make the ground water clean -up of a gas station in Rohnert Park a viable project. Mr. Brown responded to Council questions, and Council CONCURRED TO DIRECT City Manager Leivo and Civil Engineer Jenkins to meet with Mr. Brown and to report back to Council. Mr. Brown SUBMITTED his business card to City Manager Leivo. *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINUTES September 14, 2004 Page(3 ) 4. Larry Esparza, regarding Mayor and City Manager correspondence to Lead Tribal Negotiator for Governor of California: Mr. Esparza shared several comments regarding the casino and the recall election. He congratulated Councilmember Flores and Vice Mayor Spradlin on their respective victories, but he noted the small margin of victory and the amount of money poured into their campaigns. He stated that the grassroots movement against the casino will continue. 2. Barbara Greene, Co -Chair of Rohnert Park /Cotati Creek Council regarding Copeland Creek Nature Park proposal: [Out of order] Ms. Greene DISTRIBUTED AND REVIEWED a pamphlet entitled, "Russian River Celebration, September 11 -19, 2004." She discussed all the work that has gone on this summer in terms of flood control, and she INVITED Council to the Russian River Celebration. 5. Seamus Seanachaoi, to discuss repercussions of the Recall Election and the healing process of the City: Mr. Seanachaoi discussed how the recall election and casino issues have divided the City, and he congratulated Councilmember Flores and Vice Mayor Spradlin on the results of the recall election. He also ANNOUNCED a fundraiser, the First Annual Sonoma County Musical Extravaganza, on Saturday, September 25th, to benefit the Rohnert Park - Cotati Education Foundation. 4. STUDENT REPORTS: SSU - Sonoma State University Associated Students, Incorporated, by James J. Reilly III, Legislative Representative: Mr. Reilly DISTRIBUTED the following items to.Council: Current issue of The Star, voter awareness pamphlet entitled, "It Matters," and the ASI Senate Meeting Schedule. He reported on upcoming speakers at SSU and the status of the Green Music Center, and he indicated that his senior piece will be on the City's recall election. *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINUTES September 14, 2004 Page(4 ) 5. UNSCHEDULED PUBLIC APPEARANCES /COMMENTS: 1. Patricia.Jonas- Voulgaris, Cotati, was recognized and displayed for Council souvenirs and items from around the world. She noted that said items are from the Helen Delevois Museum- Library, which needs a building, and she urged Council to consider renting the Southwest Boulevard Fire Station to the foudation. City Manager Leivo stated that is working on this matter and that he will provide Council with a report at a later date. 2. Tom Thunderhorse, 7533 Bobbie, was recognized and congratulated Councilmember Flores and Vice Mayor Spradlin for keeping their seats on the Council. He questioned where casino opponents are getting their figure of 20,000 cars a day for casino traffic. Mayor Nordin left the chambers at 8:00 p.m. 6. PLANNING AND ZONING MATTERS: 1. File No. PL2004 -036MC - Consideration of Proposed Amendments to Chapter 1.24 of the Rohnert Park Municipal Code regarding Nuisance Abatement Ordinance and Adequacy of a Negative Declaration for this project a. Staff Report: Neighborhood Improvement Officer Denlis reviewed the contents of the Staff Report. Councilmember Mackenzie expressed concern about the possibility of neighborhood feuds stemming from the ordinance, and he suggested that such a comprehensive measure have guidelines for clarity and compliance. Councilmember Vidak- Martinez concurred and furthermore expressed concerns about placing time limits on certain aspects of the ordinance. Mayor Nordin returned to chambers at 8:11 p.m. b. PUBLIC HEARING: Mayor Nordin opened the Public Hearing at 8:16 p.m. 1. Patricia Jonas - Voulgaris, Cotati, was recognized and compared aspects of the ordinance to another area where she used to live. She indicated that that city successfully encouraged neighborhood participation and effort by presenting awards to neighborhoods and to neighbors for placement in front of their homes. *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINUTES September 14, 2004 Page(5 ) 2. Dennis McCormack, Rohnert Park, was recognized and expressed opposition to provision 22 in the ordinance regarding leaving garbage cans in public sight for more than 24 hours after collection day. He stated he pulls the cans off to the side of his residence and has not had a complaint in the 25 years he has lived there. Mayor Nordin closed the Public Hearing at 8:17 p.m. c. Resolution for Adoption: 2004 -215 CERTIFYING A NEGATIVE DECLARATION FOR AN ORDINANCE AMENDING CHAPTER 1.24 OF THE ROHNERT PARK MUNICIPAL CODE (NUISANCE ABATEMENT ORDINANCE) Council Motion /Discussion /Vote: Upon MOTION by Vice Mayor Spradlin, seconded by Councilmember Flores, and UNANIMOUSLY APPROVED, reading was waived and Resolution 2004 -215 was ADOPTED. .d. Waive First Reading and Introduce Ordinance by reading title: No. 718 AMENDING THE ROHNERT PARK MUNICIPAL CODE BY REPLACING CHAPTER 1.24 (NUISANCE ABATEMENT ORDINANCE) WITH THE REVISED CHAPTER 1.24 (NUISANCE ABATEMENT ORDINANCE) Council Motion /Discussion /Vote: Upon MOTION by Vice Mayor Spradlin, seconded by Councilmember Flores, and UNANIMOUSLY APPROVED, reading was waived and Ordinance No. 718 was INTRODUCED with DIRECTIONS TO STAFF (1) to conduct a three -month period of community education, and with a FRIENDLY AMENDMENT from Councilmember Vidak- Martinez, accepted by the maker of the motion and the second, (2) to DIRECT STAFF to conduct a review of the ordinance six months after it takes effect. Councilmember Mackenzie called for a specific plan to get this information out to the residents, and he asked that staff be very even - handed in handling nuisance abatement matters. 2. File No. PL2004 -004ZO - Consideration of Kenneth R. Blackman application for a revision to Chapter 17.07.020.N of the Rohnert Park Municipal Code regarding Inclusionary Housing with Adequacy of a Negative Declaration: *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINUTES September 14, 2004 Page(6 ) a. Staff Report: Senior Planner Bendorff reviewed the contents of the Staff Report and responded to Council questions. b. PUBLIC HEARING: Mayor Nordin opened the Public Hearing at 8:25 p.m. 1. Kenneth Blackman, 1224 St. Helena Avenue, Santa Rosa, was recognized and summarized his meeting with the Planning Commission. He referred to his report regarding affordable housing, and he noted that it would be possible to include second units with improved appearance to the neighborhood and to change the wording on second units. He also expressed support for the one -to -one approach. Councilmember Flores confirmed that the thrust of Mr. Blackman's presentation is the one -to -one consideration for affordable housing. Mayor Nordin closed the Public Hearing at 8:30 p.m. c. Options for Consideration - Options 1,2 and 3 as outlined on the agenda. OPTION No. 2: REFERRAL OF THE APPLICATION BACK TO THE PLANNING COMMISSION, WITH DIRECTION TO STAFF TO WORK WITH THE APPLICANT ON A POSSIBLE ALTERNATIVE RECOMMENDATION TO THE CITY COUNCIL Council Motion /Discussion /Vote: A MOTION was made by Councilmember Vidak- Martinez, seconded by Councilmember Mackenzie, (1) to maintain 50 percent affordable units with deed restrictions, (2) to go one -to -one for Option 2, and (3) to refer said matter back to the Planning Commission, with DIRECTIONS FOR STAFF to work with the applicant on a possible alternative recommendation to the City Council. Said motion was APPROVED 3 -2 with Vice Mayor Spradlin and Councilmember Flores dissenting. Councilmember Mackenzie emphasized that deed restriction is essential. Councilmember Flores noted that this is the first generation of young people that will not have the same opportunity to own their own homes as their parents had. Vice Mayor Spradlin expressed support for Option 3, noting the opportunities for families to combine for affordable housing and for elderly family members to stay close to their families. *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINUTES September 14, 2004 Page(7 ) 7. PROPOSED SALE OF NW ACRES (STADIUM LANDS): Consideration of Sale of Real Property owned by the City west of U.S. 101 and north of the Rohnert Park Expressway (Stadium Lands) APN's 143 - 040 -103, 143 - 040 -104, 143 - 040 -106 and 143 - 040 -109: 1. Staff Report: City Manager Leivo shared the contents of the Staff Report and responded to Council inquiries. 2. PUBLIC HEARING: Mayor Nordin opened the Public Hearing at 8:50 p.m. 1. Bruce Codding, Santa Rosa, was recognized and stated .that there had been a change in leadership at Codding Enterprises. He inquired into the possibility of having the City extend the deadline until the end of tomorrow's work day for Codding to reconsider the southern parcel of the Stadium lands. City Manager Leivo stated that Codding had missed its deadline for right.of first refusal. 2. Kenneth Blackman, 1224 St. Helena Avenue, Santa Rosa, was recognized and noted that he was present to answer any questions of Council. He indicated that Redwood Equities has made significant headway on this project, but he stated that he would talk to Codding Enterprises. 3. Maurice Fredericks, 242 Alden, was recognized and reviewed a bit of Rohnert Park's history in terms of Paul Golis' vision of a city of 25- to 30,000 people which managed its own sewer system. He blamed the greed of developers for ruining that vision. He also questioned if the sale of the Stadium lands had gone through all of the required Government Code sections, and he stated that the City should not be selling its assets to maintain itself financially. Interim City Attorney Whelan indicated that the Surplus Lands Act and all other relevant documents are available at the City Clerk's office. Resolution for Adoption: 2004 -217 ACCEPTING THE PUBLIC TESTIMONY REGARDING THE PROPOSED SALE OF REAL PROPERTY OWNED BY THE CITY OF ROHNERT PARK WEST OF U.S. 101 AND NORTH OF THE ROHNERT PARK EXPRESSWAY (THE "STADIUM LANDS "), DECLARING THE STADIUM LANDS TO BE SURPLUS, AND APPROVING AN AMENDMENT TO OPTION.TO PURCHASE AND PURCHASE AGREEMENT FOR THE STADIUM LANDS (GOV. CODE SECTIONS 37350, et seq. AND 54220, et seq.) Council Motion /Discussion /Vote: Upon MOTION by Councilmember Vidak- Martinez, seconded by Councilmember Flores, and UNANIMOUSLY APPROVED, reading was waived and Resolution 2004 -217 was ADOPTED. Councilmember Flores commented on the rapidly rising cost of healthcare benefits for City employees. Councilmember Mackenzie stated that the City has known for some time about the rising cost of health plans and benefits, and he emphasized the importance of the Master Plan for the Stadium Lands. 8. COMMISSION /COMMITTEE /BOARD MATTERS: 1. Bicycle Advisory Committee: a. Consideration of accepting resignation from Commissioner with a two -year term to expire December 31, 2004: Council action to accept resignation from James Kline: At the suggestion of Councilmember Flores, Council CONCURRED to accept the resignation of James Kline and to DIRECT STAFF to send a letter over the Mayor's signature of regrets and appreciation for his service. b. PROPOSITION 1A "PROTECTION OF LOCAL GOVERNMENT REVENUES ": Consideration of supporting Proposition 1A "Protection of Local Government Revenues ": 1. Resolution for Adoption: 2004 -221 SUPPORTING PROPOSITION 1A "PROTECTION OF LOCAL GOVERNMENT REVENUES" Council Motion /Discussion /Vote: Upon MOTION by Vice Mayor Spradlin, seconded by Councilmember Flores, and UNANIMOUSLY APPROVED, reading was waived and Resolution 2004 -221 was ADOPTED. 16. COUNCIL COMMITTEE AND /OR OTHER REPORTS: 1. Federated Indians of the Graton Rancheria (FIGR) Gaming Compact: Status Report: Provided to Council in the agenda packet. Councilmember Mackenzie objected to this process of governance, and he noted that this subject matter should be regularly discussed and that the Mayor should not represent the Council without full disclosure in a full Council meeting. Councilmember Vidak- Martinez concurred that FIGR matters should be a regular agenda item, and she asked for confirmation of the Council's past practice of informing the Council and voting on letters written over the Mayor's signature. She also stated that the letter to the Governor's Office misrepresented the Council's direction to reject the word "support" in terms of urging the Governor to sign the gaming compact. Councilmember Flores referred to a clause in the MOU that says the Council will foster the MOU, and he indicated that parameters were established for the Mayor to act. Vice Mayor Spradlin said the City Manager and the Mayor were following through with the MOU, and she questioned some past actions of other Councilmembers. Councilmembers Vidak- Martinez and Mackenzie reiterated her desire to have all Councilmembers treated fairly and included in Council policy decisions and directives. Mayor Nordin stated that he appreciated the comments and will make an effort to communicate better to all Councilmembers in the future. 2. Technical Advisory Committee /Laguna Treatment Plant, August 11, 2004 meeting: City Manager Leivo stated that City Engineer Jenkins attended said meeting. Sonoma County Waste Management Agency (SCWMA), August 18, 2004 meeting: Councilmember Mackenzie gave an update on the Second Amended Agreement and matters relating to Petaluma, and he reported on the crisis at the landfill. Councilmember Mackenzie REQUESTED INPUT as to whether the City wants to be part of the Joint Powers Agreement (JPA). Council and staff recommended waiting a while to make a decision, and Councilmember Mackenzie stated that he will report back on the results of the next meeting. 4. Sonoma County Transportation Authority (SCTA), September 13, 2004 meeting: Councilmember Vidak- Martinez reported on various topics, including Cal Trans and the draft environmental documents for the Wilfred Avenue Interchange, the Highway 116/101 options in Cotati, and she DISTRIBUTED AND REVIEWED an excerpt of SCTA's Comprehensive Transportation Plan (CTP). CITY MANAGER'S REPORT: 1..City's Sphere of Influence and the Community Separator - Minor Amendments to Agreement with Sonoma County: City Manager Leivo reviewed the Staff Report and responded to Council questions. At this time, Mayor Nordin called forward a member of the public interested in speaking on this matter: 1. Van Logan, 2560 West Dry Creek Road, Healdsburg, was recognized and questioned.staff about how to proceed in this matter. He indicated that certain Sphere of Influence and Community Separator issues need to be added to and expounded in the Sonoma County agreement for Community Separator. Council discussion centered around protecting the Sphere of Influence and the need for full discussion and direction of the Council, as well as discussion with County representatives, in terms of major amendments to the City's agreement with the County. Council CONCURRED TO DIRECT City Manager Leivo to move forward with this matter and report back to the Council. 2.
