CITY COUNCIL, CDC & RPFA JOINT REGULAR MEETING - Call to Order/Roll Call Mayor Belforte called the City Council/CDC/RPFAjoint regular meeting to order at 5:00 p.m. Present: Gina Belforte, Mayor Jake Mackenzie, Vice Mayor Amy Ahanotu, Council Member Joseph T. Callinan, Council Member Pam Stafford, Council Member Staff present: Gabriel Gonzalez, City Manager;. Michelle Marchetta Kenyon, City Attorney; and Judy Hauff, City Clerk. 2. RECESS TO CLOSED SESSION IN CONFERENCE ROOM 2A Mayor Belforte recessed this meeting to closed session at 5:02 p.m. to consider: A. CONFERENCE WITH LEGAL COUNSEL-ANTICIPATED LITIGATION (Government Code 954956.9) Significant exposure to litigation pursuant to subdivision (b) of Government Code 954956.9: 1 case 5. RECONVENE JOINT REGULAR MEETING OPEN SESSION IN COUNCIL CHAMBER Mayor Belforte reconvened this meeting at 5:54 p.m. with all Council Members present. 6. SSU STUDENT REPORT Sonoma State University Associated Students, Inc. (SSU ASI) Legislative Representative, Amanda Burke, Senator of Arts and Humanities, distributed Sonoma State Star publication and SSU Events Card for March 2011 and reported on current activities at SSU. 8. PRESENTATIONS A. Sonoma State University Center for Community Engagement (SSUCCE) Presentation on Posters and Projects by Merith Weisman, Coordinator, SSU Center for Community Engagement B. Regional Climate Protection Authority (RCP A) Program Update: Energy Upgrade California and RESCO by Mike Sandler, Program Manager Public Comments - Mayor Belforte invited public comments on this item at 6: 13 p.m. 1. Lora Neffson and James McGreen shared comments in support of Climate Protection. 9. CITY MANAGER / CITY ATTORNEY / DEPARTMENT HEAD BRIEFINGS ADDITIONAL ITEM: A. Bi-Annual Traffic Collision Analysis July 1 through December 31, 2010 report by Sergeant Jason Krause and Public Safety Officer Aaron Hall, B. Legislative Update - City Manager Gonzalez reported on recent efforts working with state lobbyists and successful scheduling of a series of meetings with legislators last week, at which . the Mayor delivered a number of recommendations to reform Redevelopment Agencies; update of California Legislature letter sent to Governor Jerry Brown; and consideration of requesting cities, by California Redevelopment Agency, to contribute to legal defense fund. 10. City Council Resolutions for Adoption: I. 2011-17 Authorizing and Approving a Fifth Amendment to the Agreement for Services with MACTEC, Inc. for Environmental-Biological Services 2. 2011-18 Authorizing City Manager to Execute Program Supplement Agreement No. 01O-N to Administering Agency - State Agreement No. 04-5379R for Federal Funding for the Copeland Creek Bike Path Rehabilitation Project (Federal Project #RPSTPLE-53 79(0 18)/City Project #2010-08) ACTION: Moved/seconded (Mackenzie/Stafford) and carried unanimously to approve the Consent Calendar items as submitted. 11. SEWER RATE STUDY - Council review of final results and acceptance of the Sewer Financial Plan and Rate Study prepared by The Reed Group, Inc. recommending New Sewer Fees and Rate Structure A. Staff Report by Interim Assistant City Manager Dunn. B. Report of Rate Analyst by Bob Reed of The Reed Group, Inc. C. Council Questions responded to by Bob Reed of The Reed Group, Inc. included Mr. Reed's confirmation of the need to correct the date on page 9, under item 1, in the Sewer Financial Plan and Rate Study, to change July 2001 to July 2011. D. Public Comments - Mayor Belforte invited public comments on this item at 7:45 p.m. 1. Michael (Mac) McCaffry, resident, shared comments in support of this item. 2. Susan Adams, resident, shared comments in support of this item. 3~ Joe Gaffney, resident and member of the Sewer Stakeholder Committee, recognized other members of the Sewer Stakeholder Committee present in the audience, and shared comments in support of this item. 4. Mike Thompson, resident and Assistant General Manager of Sonoma County Water Agency, shared comments in support of this item. 5. David Stubblebine, resident, Vice President of the Association of Retired Employees and Sewer Stakeholder Committee member, shared comments in support ofthis item. E. Resolution for Adoption: 1. 2011-19 Accepting the Sewer Financial Plan and Rate Study Prepared by The Reed Group, Inc., Which Recommends New Sewer Fees and Rate Structure City Attorney Kenyon indicated two corrections for this resolution at the bottom of page 2, Section 1, to change the date to March 3, instead of February 28, followed by inserting, "attached hereto as Exhibit A" referencing the City of Rohnert Park Sewer Financial Plan and Rate Study prepared by the Reed Group, Inc. ACTION:. Moved/seconded (Mackenzie/Callinan) and carried unanimously to adopt above- titled Resolution No. 2011-19 as amended per above City Attorney comments. 12. TAXICAB SERVICE - Consideration of an Application from Richard Corbett, d.b.a. ABC Cab Company for a Certificate of Public Convenience and Necessity to Provide Taxicab Service in the City ofRohnert Park A. Staff Report by City Manager Gonzalez B. PUBLIC HEARING Mayor Belforte opened the public hearing for this item at 8: 12 p.m. 1. Richard Corbett shared reasons for offering his taxicab service in the community. C. Resolution for Adoption: 1. 2011-20 Finding the Public Convenience and Necessity for Richard Corbett, d.b.a. ABC Cab Company to Provide Taxicab Service in the City of Rohnert Park Mayor Belforte indicated she would be abstaining from voting on this due to being a personal friend ofMr. Corbett's family. ACTION: Moved/seconded (Mackenzie/Callinan) and carried4 - 0 - 1 abstaining (Belforte) to adopt above-titled Resolution No. 2011-20 as submitted. 13. AUTO AID AGREEMENT WITH RANCHO ADOBE FIRE PROTECTION DISTRICT Approval of an Auto Aid Agreement with Rancho Adobe Fire Protection District A. Staff Report with introductory comments by City Manager Gonzalez and report by Lieutenant Marty B. Public Comments - Mayor Belforte invited public comments on this item at 8:32 p.m. 1. Andy Taylor, Battalion Chief of Rancho Adobe Fire Protection District, summarized letter from Chief Treanor stating that the Auto Aid Agreement was beneficial to both agencies. C. Resolution for Adoption: 1. 2011-21 Authorizing and Approving an Auto Aid Agreement by and between the City of Rohnert Park and Rancho Adobe Fire Protection District City Attorney Kenyon indicated the City Manager may have minor changes to make to this Auto Aid Agreement prior to execution and reviewed revised language needed in the resolution that the first resolved section should read, "does hereby approve the Agreement in substantially the same form attached hereto as Exhibit "A" and delete "the form attached hereto as "Auto Aid Agreement by and between the City of Rohnert Park and Rancho Adobe Fire Protection District." ACTION: Moved/seconded (Mackenzie/Callinan) and carried unanimously to adopt above- titled Resolution No. 2011-21 as amended per revised language to the resolution indicated above by City Attorney Kenyon. 14. STANDING COMMITTEE / AD HOC COMMITTEE / LIAISON REPORTS A. Standing Committee Reports - None B. Liaison Reports 1. Solid Waste Advisory Group (SWAG) meeting - Council Member Stafford reported on . recent SWAG meeting and making progress on efforts focusing on waste reduction in the county, education enforcement and the processing of the facility. 2. Local Agency Formation Commission (LAFCO) meeting - Council Member Stafford reported on last week's LAFCO meeting with approval of Rohnert Park Southeast Specific Plan annexation. 3 . Russian River Watershed Association meeting - Vice Mayor Mackenzie reported on this meeting held last week regarding storm water management requirements. 4. Rohnert Park 50th Anniversary Planning Committee meeting - Mayor Belforte shared reminder that the next meeting for this Committee will be March 16th at 5:30 p.m. at the Community Center. 5. Water Advisory Committee/Technical Advisory Committee (WAC/TAC), 317/11 mtg. Vice Mayor Mackenzie reported on this meeting which included unanimous approval to recommend to the Board of Directors of the Sonoma County Water Agency to approve the budget. C. Other Reports 1. Health Action Council, 3/4/11 mtg. (AA) Council Member Ahanotu reported on this meeting supporting wellness in Sonoma County. 15. COMMUNICATIONS - None 16. MATTERS FROM/FOR COUNCIL A. Council Member Stafford commended the recent performance she attended on Sunday of the Community Volunteer Band Concert on rivers. B. Council Member Ahanotu called attention to the Miss Sonoma Pageant he attended this past Saturday in Rohnert Park. C. Vice Mayor Mackenzie advised he would be going to Washington DC next week as part of the Metropolitan Transportation Commission (MTC) annual legislative visit and will report back to Council on the state of the federal budget pertaining to transportation. D. Mayor Belforte commented on the following items: 1. She and Council Member Stafford attended and participated in the recent Dr. Suess's Birthday event at Hahn Elementary School. 2. Called attention to another new business in town called Sweet Expectations with recent ribbon cutting at Sally's Tomatoes. 3. The recent North Bay Business Journal Event attended by several City Council and City Staff representatives. 4. Commended City Manager Gonzalez on recent efforts with lobbyists in Sacramento to save redevelopment funds. 17.
