A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK
AUTHORIZING THE CITY MANAGER TO EXECUTE A LETTER OF INTENT TO REMAIN
A PARTICIPANT IN THE JOINT POWERS AGREEMENT FOR HOUSING AND
COMMUNITY DEVELOPMENT ACTIVITIES FOR THE
2012 /2014 RENEWAL CYCLE
WHEREAS, on July 5, 2005, the County of Sonoma ( "County "), the Town of Windsor and the
cities of Cloverdale,.Cotati, Healdsburg, Rohnert Park, Sebastopol and Sonoma ( "Municipalities ")
entered into a Joint Powers Agreement ( "JPA ") to engage in housing and community development
activities; and
WHEREAS; every three years, the County and Municipalities have an opportunity to re- qualify
as a HUD- designated "Urban County" thereby entitling us to continue to receive an annual allocation of
federal CDBG, ESG and Home funding as a "entitlement jurisdiction;" and
WHEREAS, the County must re- qualify as an urban county for the period of 2012/2014 during
the present fiscal year; and must submit documentation to HUD by the July 10, 2011 deadline; and
WHEREAS, the Joint Powers Agreement will automatically be renewed unless Rohnert Park
chooses to terminate the agreement and not participate during the 2012/2014. qualification period; and
WHEREAS, the City Council of the.City of Rohnert Park wishes to remain a participant in the
JPA; and
WHEREAS, the County is asking the City Manager to execute a Letter of Intent signifying that
the City has been made aware of its option to exit the JPA and elects to remain a participant in the JPA
for the 2012/2014 renewal cycle.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rohnert Park that it does
hereby authorize the City Manager to take such further actions and execute any agreements as may be
necessary or appropriate to carry out the City's obligations under the terms of the Joint Powers
Agreement. .

Re: Participation in the Community Development Block Grant (CDBG) and HOME
Investment Partnership Entitlement Programs for 2012- 2014.
Dear Mr. Gonzalez:
Every.three years, the County of Sonoma, the Town of Windsor and the cities of
Cloverdale, Cotati, Healdsburg, Rohnert Park, Sebastopol and Sonoma have an
opportunity to re- qualify as a HUD- designated. "Urban County" thereby entitling us to
continue to receive an annual allocation of federal CDBG, ESG and HOME funding as a
so- called "entitlement jurisdiction ". It is time to communicate to HUD our intentions to
remain an urban county of eight jurisdictions for 2012 through and including 2014. HUD
stipulates the process and time line associated with this exercise and the purpose of this
letter is to lay out that process.
Pursuant to HUD regulations which govern the qualification process.for urban county
status, Sonoma County, as the funding administrator, is required to notify each
participating jurisdiction of the following at this time:
1. The County of Sonoma must re- qualify as an urban county for the period of 2012-;
2014, during the present fiscal year.
2. Your jurisdiction is automatically included as part of the urban county unless you
choose to be excluded from the urban county program..
3. The urban county cooperation agreement, in the form of a Joint Powers
Agreement (JPA) executed in 2005, will automatically be renewed unless you
choose to terminate the agreement and not participate during the 2012 -2014
qualification period.
4. If you choose to remain as part of the urban county, your community may
participate in the county Community Development Block Grant and NOME
Investment Partnership Programs.
5. If you choose to remain as part of the urban county, your community will be
ineligible to apply for grants from appropriations under the Small Cities or State

CDBG and HOME prograins for the duration of the 2012 -2014 urban county
agreement. Your jurisdiction may only receive formula allocation under the ESG
and HOME Programs only through the urban county.
6. If you choose to be excluded fiom the urban county, or if you choose to terminate
the. urban county JPA. and not participate during the 2012 -2014 qualification
period, you must notify both the county and HUD.in writing by June 3, 2011.
A copy of the 2005 JPA is enclosed fot your convenience although you should already
have a copy on file. You will note tliat paragraph 12, Term of Agreement, clearly
contemplates this automatic three -year renewal consistent with HUD guidelines.
As a means to document intent to remain an eight - jurisdiction urban county.for 2012-
2014 and thereby exercising the automatic three -year renewal feature in the existing JPA,
we ask that you sign the certification below and return to us at your earliest convenience.
In any event, we will need this documentation for submission to HUD by July 10, 2011 at
the latest and we'd be appreciative in receiving it much earlier.

INTENT TO RENEW JOINT POWERS AGREEMENT
I certify that the City of Rohnert Park intends to remain a participant in the Joint Powers
Agreement (JPA) enabling the eight jurisdiction Urban County to continue to participate
in the federal Community Development Block Grant (CDBG) program and the Home
Investment Partnership Program as an entitlement jurisdiction and that the City has been
made aware of the option to exit the JPA and elects to remain a participating jurisdiction
for the 2012 -2014 renewal cycle.
