2008/09/23 City Council Resolution 2008-156RESOLUTION NO. 2008-156 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK, CALIFORNIA, APPROVING SPECIFIC PLAN AND DESIGN GUIDELINES DOCUMENTS FOR PROPERTY LOCATED ON EACH SIDE OF WILFRED AVENUE, EAST OF DOWDELL AVENUE, AND NORTH, EAST, AND SOUTH OF THE CURRENT CITY LIMITS IN THE VICINITY OF THE INTERSECTION OF REDWOOD DRIVE AND WILFRED AVENUE (APN 045-055-007,045-075-001 THROUGH 045 - 075 -003, 045 - 075 -005, 045- 075 -006, 045- 075 -008, AND 045- 075 -009 THROUGH 045 - 075 -012) (City of Rohnert Park) WHEREAS, the City of Rohnert Park ( "Applicant ") intends to adopt a Specific Plan and Design Guidelines for properties located on each side of Wilfred Avenue, east of Dowdell Avenue, and north, east, and.south of the current City limits in the vicinity of the intersection of Redwood Drive and Wilfred Avenue (APN 045- 055 -007, 045- 075 -001 through 045- 075 -003, 045- 075 -005, 045- 075 -006, 045- 075 -008, and 045- 075 -009 through 045- 075 -012); WHEREAS, pursuant to California State Law and the Rohnert Park Municipal Code, public hearing notices were mailed to all property owners within an area exceeding a 300 foot radius of the subject property, public hearing notice signs were posted on the property, and a public hearing notice was published for a minimum of 10 days prior to the first public hearing in The Community Voice; WHEREAS, on August 14, 2008, the Planning Commission held a public hearing at which time interested persons had an opportunity to testify either in support or opposition to the proposal; WHEREAS; on September 23, 2008, the City Council held a public hearing at which time interested persons had an opportunity to testify either in support or opposition to the proposal. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ROHNERT PARK DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. The above recitations are true and correct. Section 2. Findings. The City Council, in approving Specific Plan 1799 (Specific Plan Application) makes the following findings, makes the following findings; to wit: 1. The specific plan or specific plan amendment is consistent with the city's general plan. Criteria Satisfied. The specific plan would implement the General Plan's goals for the Wilfred /Dowdell Specific Plan Area in that it would allow the development of the property with a pedestrian- oriented, commercial complex that is consistent with the goals and objectives of the General Plan for this area. 2. The specific plan or specific plan amendment will not adversely affect the public health and safety or result in incompatible land uses. Criteria Satisfied. The specific plan would direct the development of the area with a pedestrian- oriented, commercial complex that is intended to encourage walking and cycling through the project, thereby reducing the use of the automobile to travel from one commercial use to another. The proposed commercial development would benefit existing . residents in the area, as well as the greater region. 3. The specific plan or specific plan amendment provides the framework to phase and pace growth within the specific plan area so as to ensure completion of all necessary public facilities concurrently with completion of the specific plan; or, alternately, a statement of public policy consideration can be adopted and /or an exception granted in accordance with general plan policies GM -10, GM -11, and GM -12. Criteria Satisfied. Chapter 4 of the Specific Plan document presents the infrastructure plan for the project and includes the timing of necessary improvements. 4. The specific plan or specific plan amendment identifies adequate financing mechanisms for the infrastructure and public facilities required to support the development. Criteria Satisfied. The project will be subject to the Public Facilities Financing Plan fees to help fund off -site improvements. On -site improvements shall be the responsibility of the developer(s). 5. The proposed specific plan is consistent with the planning and prezoning designation provided for the specific plan area, pursuant to Government Code Sections 65300 and 65859, or alternatively functions as prezoning for the unincorporated territory. Criteria Satisfied. The site will be prezoned "Specific Plan District (SP)," which would be consistent with the direction of the City's General Plan. Section 3. Environmental. Clearance. The City adopted CEQA findings, a Statement of Overriding Considerations, and a Mitigation Monitoring and Reporting Program in connection with the Prezoning adopted in Ordinance 803, in connection with the Wilfred /Dowdell Village Specific Plan Project ( "Project "). The City is now granting an approval subordinate to the Prezoning, for all or a portion of the Project addressed in that prior Resolution. In connection with that subordinate approval, the City finds that each of the mitigation measures applicable to the subordinate approval, and which was found in Ordinance 803 to avoid or reduce potentially significant impacts, has been imposed as a condition of approval of that subordinate approval. In addition, the City finds that there have been no substantial changes in the aspects of the Project reflected in the subordinate approval, the surrounding circumstances, or the balance between the benefits of the aspects of the Project reflected in the subordinate approval and the acceptability of its significant and unavoidable impacts. There are no substantial changes proposed in the 2 Project which will require major revisions of the previous EIR due to the involvement of-new significant environmental effects or a substantial increase in the severity of previously identified significant effects; no substantial changes with respect to the circumstances under which the project is undertaken which will require major revisions of the previous EIR due to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects; and no new information of substantial importance, which was not known and could not have been known with the exercise of reasonable diligence at the time the previous EIR was certified as complete. Accordingly, no supplemental or subsequent EIR is required or appropriate. NOW THEREFORE BE IT RESOLVED, that the City Council does hereby approve Application No. 1799: application for a Specific Plan for property located on each side each side of Wilfred Avenue, east of Dowdell Avenue, and north, east, and south of the current City limits in the vicinity of the intersection of Redwood Drive and Wilfred Avenue (APN 045- 055 -007, 045- 075 -001 through 045- 075 -003, 045- 075 -005, 045- 075 -006, 045- 075 -008, and 045- 075 -009 through 045- 075 -012) with the following amendments: 1. Parking requirements for uses within the Specific Plan shall be consistent with the latest parking requirements established by the Rohnert Park Municipal Code; 2. Staff shall work with the Cotati - Rohnert Park Unified School District (CRPUSD) to amend the school district boundaries so that the Specific Plan area is transferred from the Bellevue Union School District .(BUSD) and Santa Rosa High School District (SRHSD) boundaries to the CRPUSD. 3. The Specific Plan shall be amended to reflect the removal of the Specific Plan area from the Community Separator.
