2007/07/24 City Council Resolution 2007-122RESOLUTION NO. 2007-122 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK, AUTHORIZING AND APPOVING AMENDMENT NUMBER TWO TO THE AGREEMENT FOR SERVICES WITH MACTEC ENGINEERING AND CONSULTING, INC. REGARDING THE ENVIRONMENTAL IMPACT REPORT (EIR) FOR THE WILFRED /DOWDELL SPECIFIC PLAN WHEREAS, on April 13, 2004, the City entered into an agreement with MACTEC Engineering and Consulting, Inc. to prepare a Supplemental Environmental Impact Report (SEIR) for the Wilfred /Dowdell Specific Plan Area; and WHEREAS, on September 14, 2004, Amendment No. 1 was reviewed and approved by the City Council to add $35,000.00 to the contract to cover the cost of optional tasks including a vernal pool /wetland delineation, thereby increasing the final cost of the SEIR to $98,973.00; and WHEREAS, additional environmental work including an environmental site assessment for the project and the repackaging of the SEIR as an EIR is necessary to assure compliance with the California Environmental Quality Act (CEQA); and WHEREAS, the City has received and reviewed a Budget Increase. Request from MACTEC Engineering & Consulting, Inc. dated June 22, 2007; and WHEREAS, the cost of preparing the additional environmental work per the proposal shall be the responsibility of the developers of the Wilfred /Dowdell Specific Plan Area; and WHEREAS, Staff has prepared Amendment Number Two to the Agreement for Services between the City of Rohnert Park and MACTEC Engineering and Consulting, Inc. regarding the preparation of the work outlined in the Budget Increase Request dated June 22, 2007; and WHEREAS, the City Council of the City of Rohnert Park has reviewed and considered the information contained in the Staff Report and all relevant materials regarding Amendment Number Two to the Agreement of Services between the City of Rohnert Park and MACTEC Engineering and Consulting, Inc. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rohnert Park that Amendment Number Two with MACTEC Engineering and Consulting, Inc. for an amount not to exceed $5,600.00 is approved and the City Manager is authorized to execute said Amendment. Nelson, R.E.A., Principal Date: APPROVED AS M FORM: City Attorney Gabrielle PI Whelan .1X Exhibit "An Proposal to Provide CEQA Environmental Services for the Wilfred /Dowdell Village Project, City of Rohnert Park, California This proposal is organized to contain the following information: • Section 1.0 - Introduction, 'in which the project description, understanding of the .project, and key assumptions are identified; • Section 10 — Scope of Work, that includes CEQA environmental services and associated studies that are designed to provide a technical basis to identify potential project impacts; and • Section 3.0 — _Proposed Schedule and Budget to complete the Supplemental Environmental Impact Report (SEIR). 4.0 INTRODUCTION 1.1 Project Description The proposed Wilfred/Dowdell Village Project (project) comprises the development of an area approximately 25 -acres in size as shopping center with mixed -use commercial facilities. The project site (site) is located in Sonoma County west of Highway 101 in the vicinity of the intersection of Wilfred and Dowdell Avenues, just outside of the City of Rolmert Park (City) limits (Figure 1). The site would be accessible. from Wilfred Avenue, Willis Avenue, Redwood Drive, and- Dowdell Avenue, and from Highway 101. via the ramps at Wilfred Avenue. This center will have the qualities of a convenient shopping center with commercial businesses and personnel 'services arranged in a manner that will be attractive to visitors. Structures will be interspersed throughout the parcel surrounded by a landscaped surface lot facility as illustrated in Figure 2. Such a site layout is a more flexible approach to the plan originally envisioned and addressed in-the EIR originally prepared in 1999 for the Wilfred/Dowdell Village Specific Plan as illustrated in Figure 3. The center is intended to be inviting to people of all ages, and will help further meet the needs for goods and services of local and regional visitors and tourists, as well as enhance the economic vitality of the City. 1.2 Project Understanding We understand that the City requires the completion of a Supplemental Environmental Impact Report (SEIR) for the project to be iii compliance with CEQA, as the project concept for the specific plan has been broadened to allow for a pedestrian- oriented shopping center for which potential changes in traffic and circulation will need to be reassessed. In addition, environmental issues such as utility services (e.g., water and sewer), biological characteristics (e.g. sensitive species and wetland conditions), sphere of influence /land use issues, will be important to address more fully in the context of the new specific plan proposal. Because the site location is in a designated Community Separator area and will need to be annexed by the City for development, the sphere of influence /land use issues are important to the viability of the project. Therefore, the SEIR will also serve as the CEQA documentation for the site annexation Process. The SEIR will complement the 1999 Wilfred /Dowdell Village Specific Plan Elk (State Clearinghouse No. 98072036) as intended in Title 14 California Code of Regulations, Chapter 3, Article 11, Section 15163, Supplement to an EIR. ORM Pw ki -" yam( wa gil Proposal to Provide CCQA Environmental Services for the Wil #red /Dowdell Village Project, City of Rohnert Park, California 1.3 Key Assumptions The fol(owing assumptions were used in preparation of this proposal: • The City is the CEQA Lead Agency and. will be responsible for issuing the Notice of Preparation and all other public notices for the project- However, as the City may elect to have MACTEC undertake this activity, an optional task has been added to Task [ to address accomplishment of this item. • MACTEC assumes that the City will be responsible for conducting the public meetings associated to the project, and will include at least one Planning Commission and one City Council meeting. • A public scoping. meeting will not be necessary for the project. Potential project impacts include: traffic and circulation, biological and wetland resources, water supply and waste water services, and sphere of influence /land use and planning. Other related impacts for consideration include: air quality and noise (related to traffic and circulation); geology and soils, surface and groundwater resources (related to biological and wetland resources); and cultural and visual resources (related to design. changes). Those environmental dimensions of the project for which resource studies are addressed in this proposal include: trafficicirculation, -and biological and wetland resources. Other environmental resources required in the CEQA process are . appropriate to address using existing documents prepared for projects proximate to the Wilfred/Dowdell Village area and site reconnaissance. • The alternatives addressed in the May 5, 2002 Revised Draft EIR for the Rohnert Park General Plan and June 1, 1999 Wilfred/Dowde(1 Village Specific Plan Draft EIR, will be evaluated in the SEIR_ Of the alternatives in the 2002 DE[R, the Canon Manor Alternative will be considered as the remedy for the City's annexation of the site, and perhaps the preferred alternative. The No Project Alternative may result in a "County [stand" being created if the Northwest Specific Area Plan is implemented. The "Off- Site" Alternative addressed in the 1999 DEIR apparently has been approved for business park development in Cotati; the feasibility of off- -site alternative will. be evaluated in the SEHR. In addition, the proposed Indian Casino west of town wilt be addressed in the SEIR. • The primary data sources for the tasks described herein will be provided to MACTEC by the City, and may include any and al( applicable documents, plans, maps, correspondence, 'or other data that the City may have in their possession. • Additional data regarding existing project site conditions will be obtained by MACTEC from agencies and organizations, and incorporated into the CEQA document as may be appropriate. • MACTEC will be responsible for the agency coordination and/or consultation for this project. For Purposes of this scope of work, it is assumed that coordination and/or consultation will be needed with the California Department of Fish and Game (CDFG); U. S. Fish and Wildlife Service (USFWS), and the Sonoma County Planning Department. The proposed work program involves the completion of the following tasks that are described in detail in text- Task is Project Scoping.: This ' task will include document review, regulatory requirement analysis, and site reconnaissance. •- Task 2: Preparation Draft SEIR. This task will include performance of a traffic and circulation analysis, and biological and wetland resource analysis so that impacts may be defined in the SEIR. • Task 3: Public Meeting Attendance. o Task 4: Preparation of Response to Comments and Final SEIR_ Task 1: Project Scoping Task l.l: Initial Staff Meeting and Site Visit. Upon City authorization to proceed, the MACTEC Team will meet with the City to discuss and refine the work scope, preferred document format, schedule and specific due dates, and to identify. specific information needs. In coordination with the City, MACTEC will initiate consultation efforts with the appropriate agencies and other - bodies, and solicit their comment Input received wili'be used to determine the scope of the environmental document. Task 1.2: Data Gathering. MACTEC will review available data relevant to the project, including the documents and correspondence provided by the City, the California Natural Diversity Database, local USGS maps applicable City and County ordinances, general plans, and land use plans. Task 1.3: Prepare Project Description. The project description will include the following in which the differences between the original and more flexible proposed specific plans will be identified. The project description will include: • A summary of the project objectives • Text and illustrations describing the regionat'setting, location and boundaries of the site Text, tables, and illustrations describing the proposed project activities and components Task 1.4: Prepare Notice of Preparation and other CEQA Public Notices At the request of the City; MACTEC will be responsible for preparing the CEQA forms associated with the preparation of an EIR, including: the Notice of Preparation (NOP), Notice of Completion (NOC), Notice of Determination (NOD). Task 2: Preparation of the Draft SEIR MACTEC will. evaluate and summarize potential impacts .associated with the environmental issue areas identified in Section 1.3 (traffic and circulation, biological resources, wetland resources, sewer and water service, and land use and planning /sphere of influence) to determine their relative significance. MACTEC's proposed scope of work for the key environmental issues identified in discussions with City staff are described in the. following sections. Task 21- Prepare Resource Analyses Task 2.1.1 - Traffic and Circulation. Whitlock & Weinberger Transportation, Inc: (W- Trans) will prepare the analysis of project traffic- related impacts associated with the amended Wilfred/Dowdell Specific Plan. The W -Trans scope of services is summarized below. Study Area and Periods. The. study area will be the same as previously evaluated for the City in the Wilfred/Dowdeli Village Specific Plan Draft Supplemental EIR, November 2000, and includes the following intersections:. • Redwood Drive /Commerce Boulevard • Redwood Drive/U.S. 101 South Ramps • Redwood Drive/Business Park Drive (future site of State Farm Drive Overpass) • Redwood Drive/Rohmert Park Expressway • Commerce Boulevard/Golf Course Drive • Commerce Boulevard/U.S_ 101 North Ramps •. Commerce. Boulevard/State*Farm Drive {future. site of the Overpass) • Commerce Boulevard/Rohnert Park Expressway. • Rohnert Park Expressway/U.S. 101 South Ramps Rohnert Park Expressway/U.S. 101 North Ramps As was previously performed; the weekday p.m. and weekend midday peak periods will be evaluated. Subtasks: L The project manager will attend a kick -off meeting with City staff to discuss the proposed scope, analysis assumptions, and standards of significance. Subsequent to this meeting, the scope and fee Will 'be firialized. 2. A site visit will be performed to determine if any changes have been made to the study intersections since the previous report was completed. 3. Peak period traffic counts have recently been obtained at six of the study intersections. New counts will be obtained at the remaining four existing study intersections. 4. Project trips will be estimated based on information contained in the latest Specific Plan using rates from the Institute of Transportation Engineer's Trip Generation. Distribution assumptions for these trips as well as potential for internal capture will be discussed with City staff, and their concurrence obtained 'S. Because the proposed project is consistent with the General Plan, it is assumed that the trips associated with this development will already have been accounted for in evaluating future infrastructure needs. The assumptions used in the General Plan EIR model will be reviewed, and compared to the project's current trip generation estimate. In addition, the traffic study will be consistent with, and coordinated with, analyses being performed for the City's Financing Plan and the Specific Plan EIRs currently in progress, including the Indian Casino proposed to be proximate to the Wilfred/Dowdell project . If the project, as proposed, results in substantially more trips than were assumed in the General Plan modeling, build -out traffic volumes for the ten study intersections will be obtained from Crane Transportation Group unless this information is available through City staff. .7.' Existing conditions will be presented based on current traffic volumes, field observations, and levels of service. This information will be discussed in the. text, and presented in figures and tables. A technical appendix with all calculations will be provided. 8. Project- generated trips will be assigned to the street network and impacts assessed. Improvements planned as part of the development will be included in the analysis of this scenario. 9_ If appropriate, Future and-Future-Plus Project scenarios will be compleierL Trips associated with the current project that exceed those assumed in the General Plan analysis will be added to future volumes and any additional infrastructure needs assessed. 10. Parking demands for the site will be evaluated in terms of the City's zoning requirements_ i I. Facilities for pedestrians and bicyclists will be evaluated. 12. Transit availability will be discussed - 13. Adequacy of emergency vehicle access will be evaluated. 14. Mitigation measures necessary to achieve or maintain acceptable operation under all scenarios will be developed and presented with impacts and mitigation measures paired. 15. An administrative draft report containing all of the assumptions, discussion, analysis, results and recommendations, including appropriate figures and tables, will be submitted to the City for review. One copy of the technical appendix with all calculations will be provided. A meeting will be held with City staff to discuss the draft report 16. Staff comments .will be incorporated, and the draft report section submitted. l7. Public comments on the draft final report will be addressed, and a final report, eport prepared. Task 2.1.2 - Biological and Wetland Resources. Biological resources of concern may be present ort, and in the vicinity of, the proposed project. Inasmuch as the project area was developed for agricultural use, ponds developed to support that use may be inhabited by plant and animal species considered sensitive under state, federal, and local laws. MACTEC understands that the California Tiger Salamander. (Ambystomia californiense), a sensitive species, inhabits areas proximate to the project site and that there may be wetland or vernal pool habitats on the southern portion of the project site. Therefore, an evaluation, of the project site would be warranted to. identify impacts to biological and wetland resources. MACTEC proposes to undertake this evaluation by completing the following subtasks. Gather background information and data, and consult with agency biologists to establish a . baseline of information about the biological resources of the .project site. Sources will include the California Natural Diversity Data Base and resource reports from the California Department of Fish and Game and U.S. Fish and Wildlife Service. 2. Conduct a field investigation of the project site to evaluate and screen for sensitive biological resources. The field investigation will include the following tasks: delineate (using GPS equipment) and describe terrestrial and aquatic biological communities; compile an inventory of observed plant and animal species; and evaluate the potential use of riparian corridors for wildlife movement. Such an analysis will be important to identify a baseline project site condition to determine the necessity of performing additional studies such as ihose identified in Subtask 3, or whether valid assumptions can. be developed about project impacts from which mitigation measures can be identified. 3. In the event preliminary investigations identify potential impacts to wetland areas, *a wetland delineation survey will then be conducted in accordance with the U.S. Army Corps of Engineers, and identify potential vernal pool or other wetland conditions and habitat in accordance with the U.S. Fish and Wildlife protocol that may present on the project site. This will include an estimation of potential wetland encroachment by the project. Such a survey can only be conducted during the winter months beginning after the first storm event and could take between 9 (fora wet and dry season beginning roughly it, September, depending on weather) and t8 months (for two wet seasons beginning in September year no. 1 through April year no. 2) to complete. Because of the time element involved in performing such analyses; a cost estimate to Perform this work has been identified as an optional task and is not in cost. cluded in the total proposal 4. Conduct a habitat suitability analysis for California Tiger Salamander, as well as other potentially occurring sensitive species. The analysis will include the identification of onsite habitat suitable to support sensitive species and the potential for species presence onsite. S. Identify the potential impacts to biological resources of the proposed project and evaluate the significance of those impacts. Criteria for defining the significance of project- related impacts to biological resources will be developed in consultation with the City. Criteria will be.drawn froth the City General Plan and CEQA Guidelines, Appendix G. MACTEC will coordinate with responsible agencies regarding the completion of the EIR as necessary. This coordination would potentially involve contacting the: U.S. Army Corps of Engineers. (Corps), U.S. Fish and Wildlife Service (USFWS); San Francisco Bay Regional Water Quality Control Board (RWQCB), California Department of Fish and Game (CDFG), and various City and Sonoma County agencies. Task 2.2 Prepare the Supplemental EIR The cotntertt of the SEIR is described below, and the development of the iterative SEIR documents follows that description. Page 6 Proposat to Provide CEQA Environmental Services for the Wilfred /Dowdell Village Project, City of Rohnert Park, California Task 2.2.1 - Summarize Traffic and Circulation and Biological Resource Studies. The focused studies prepared in Task 2.1 to address the traffic and circulation, and the biological and wetland resources will be summarized in the SEIR, and the project's affects on flee current baseline conditions will be summarized. Differences between the original Wilfred/Dowdell Specific Pian will be identified. The interrelatedness of the noise and air quality characteristics with changes in traffic and circulation patterns will be. identified. In addition, the interrelatedness of the geology and soils, surface and groundwater resources with the biological and wetland resources will -be described. Findings and recommendations will be cross - referenced between these sections when appropriate. In addition conducted: , the following.tasks will be Task 2.2.2 Utilities, Infrastructure, Ilealth and Safety. MACTEC will evaluate the .project's affects on water supply and wastewater disposal systems. The proposed project is.expected to be approximately 300,000 sq. ft. in size, and is below the threshold of 500,000 sq. ft. that would trigger review in accordance with the California Urban Water Management Planning Act (Water Code Section Nos. 10610- 10656). However, it is assumed that the City will provide the estimated water use and wastewater generation data for the project, at`which time a final evaluation of the project's potential impacts, if any, will be made. Police arid .fire services and potential project impacts will also be evaluated. It is assumed that the City will provide information as to the locations of police and fire stations, manpower, and response times. MACTEC will analyze potential hazards as well as health and safety issues related to flte development of the project site. it is assumed current data will be readily available from City sources and that m new studies- or investigations will be necessary. . Task 2.2.3 -- Land Use and Planning/ Sphere of Influence. MACTEC will develop a description of the existing latid use setting as derived from the General Plan, Draft Witfred/Dowdell Village Specific Plan, the Northwest Specific Area Plan, as well as previous environmental 'documents, and :evaluate the compatibility of the project with surrounding agricultural and open space uses, and with nearby cottitriercial, -residential and institutional uses. Compatibility will be assessed based on a combination of - visuat, biological, noise, air quality, privacy, and nuisance issues. As required by CEQA, the relationship of tale proposed plan and its environmental effects to adopted local and regional plans will be evaluated. County planning requirements will be addressed because the project site is located in unincorporated Sonoma Couaty. The County General Plan Open- Space Element designates tite area as a Community Separator, and it is likely that Open Space mitigation will be required to comply with Rohnert Park City Council Resolutions No. 2001 -205 and 2001 -252. Current county development plans associated -with the proposed Indian Casino located proximate to the project site will 'be evaluated. MACTEC will evaluate the applicable elements of these plans and will incorporate the findings into the SEIR. Task 2.2.4 - Cumulative Impacts and other CEQA Required Assessments. An analysis of cumulative impacts will be summarized in one concise EM section. It is assumed that the City will identify all relevant projects, and provide all available information they may possess concerning that which may have impacts cumulative.to the project. As required by CEQA, the growth - inducing aspects of the project, if any, will be described and evaluated. In addition, significant environmental effects that cannot be avoided will be identified. A brief statement will be provided explaining why various project effects were deemed not to be significant in the initial study and therefore have not been addressed.i.n detail in tite EIR. . :Preparation of Administrative Draft Supplemental EIR. The project description, existing conditions, impact assessment, and mitigation measures will be refined and, presented in the Administrative Draft EIR. To expedite the process, the Administrative Draft will be submitted to the City electronically (Microsoft .Word format) for internal review and comment- The Administrative Draft EIR will be concise and written for clear and easy understanding by responsible agencies and the general public. It is assumed . that tine City will provide the appropriate template(s) as to how the document is to be prepared. Preparation of Draft Supplemental EIR. A Draft EIR will be prepared, incorporating as' necessary revisions and refinements based upon City staff comments on the Administrative Draft EIR, and a summary of the document. After City approval of a screen review copy, twenty (20) bound copies of the Draft EIR and one reproducible original will be submitted to the City for public distribution.' Preparation of Administrative Final Supplemental EIR. At the conclusion of the comment period, the MACTEC project -manager will meet with City staff to discuss the comments received and appropriate .responses to those comments. An Administrative Final EIR will then be prepared that includes (1) letters received on. the Draft EIR and summaries of substantive comments made on the Draft.EIR at the public hearing, (2) consultant written and City staff approved responses to each comment, and (3) minor revisions to. the Draft EIR text that do not substantially change findings necessitating a second review period_ The Administrative Final EIR will be submitted to the City for internal review and comment ill electronic format (Microsoft Word). Mitigation Monitoring.Pfan. Some of the environmental mitigation measures likely to be. recommended in the EIR will be subject to effective monitoring through the City's standard plan check and inspection process. However, to satisfy the requirements of AB 3180, a documented mitigation monitoring record will be necessary. In compliance with City reporting and/or monitoring requirements, MACTEC will prepare a mitigation monitoring checklist that can be used by the City to establish the details of each mitigation . measure that is ultimately adopted as a part of the certified EIR. The mitigation monitoring program will be prepared concurrently with the Administrative Final EIR, .but will be formatted as a concise matrix (in a separate booklet) and made to be all independently used document .for field verification of adequate implementation of mitigation measures. The matrix would include the following information: • Mitigation measures, including specific information on the party(s) responsible for implementation, and the required timing of such implementation • Monitoring responsibility, type, and timing, including the City department or other entity responsible for monitoring a mitigation measure, the type of monitoring required (e.g., a one -time check for compliance, an ongoing study, or monitoring of the implementation of a specific program overtime), and the associated time frame within which the monitoring should occur. Public Meeting Attendance MACTEC will provide information on the EIR in meetings as part of the CEQA process. For purposes of this scope of work, three meetings are included in this task, as follows: Kickoff Meeting to obtain input from City staff and the applicant regarding scope and content Of the environmental documentation. Kickoff meeting will include one MACTEC environmental scientist/regulatory specialist. Planning Commission and City Council Meetings - The MACTEC project manager will attend One. planning commission and one city council meeting to present the SUR findings and to anser questions regarding the EIR preparation process and content. It is assumed that the City will either provide or secure the meeting. location, and provide all required noticing. It is also assumed that the City will provide any court reporter or other transcription services used. Task 4: Preparation of Response to Comments and Final SEIR MACTEC will revise the Administrative Final EIR to create a Final EIR after receiving comments on the Administrative Final EIR from City staff_ The cost estimate for this task assumes that there will be approximately 10 letters containing comments for which to prepare responses. MACTEC will prepare the. Findings. for Approval according- to CEQA Guidelines for the City's endorsement. After City approval of a screen review copy, twenty (20) bound copies and one reproducible original will be submitted to the City. 3.0 PROPOSED SCHEDULE AND COST ESTIMATE The MACTEC Team is prepared to undertake the scope of work identified herein upon the City's Notice to Proceed.
