CITY COUNCIL SPECIAL MEETING - CALL TO ORDER/ROLL CALL Mayor Stafford called the City Council special meeting to order at 6:00 pm, the notice for which being legally noticed on March 21, 2013. Present: Pam Stafford, Mayor Joseph T. Callinan, Vice Mayor Gina Belforte, Council Member Jake Mackenzie, Council Member Absent: Amy O. Ahanotu, Council Member Staff present: City Manager Gonzalez, Assistant City Manager Jenkins, Assistant City Attorney Barnhill, Deputy City Attorney Visick, City Clerk Buergler, and Interim Director of Development Services Ponton. 2. PLEDGE OF ALLEGIANCE Led by City Clerk Buergler. 3. PUBLIC HEARING APPEAL OF PLANNING COMMISSION CERTIFICATION OF THE REVISED FINAL ENVIRONMENTAL IMPACT REPORT (EIR) AND APPROVAL OF THE SITE PLAN AND ARCHITECTURAL REVIEW AND SIGN PROGRAM APPLICATIONS FOR WALMART STORE EXPANSION PROJECT Interim Director of Development Services Ponton presented the item. Leonard Reporting Services provided transcription services. Consultants Grant Gruber, Michael Brandman Associates; Zachary Matley, W- Trans; and Greg Tonkovich, Michael Brandman Associates, were available for questions. Debora Quick with Morgan Lewis representing Walmart was available to answer questions. Recommended Action: Staff recommends City Council take the following actions: 1) Consider and approve the request of the applicant to recirculate the portions of the Draft EIR that were revised in response to the trial court decision and direct staff to recirculate those revised portions of the Draft EIR; and City of Rohnert Park Special Meeting Minutes March 25, 2013 for City Council Page 2 of 2 2) Adopt Resolution 2013 -049 to (1) rescind and set aside the action by the Planning Commission on January 24, 2013 to certify the Revised Final EIR, adopt the Mitigation Monitoring Program and Statement of Overriding Considerations, and approve the Site Plan, Architectural Review and Sign Program for the Walmart Expansion project and remand the project application back to the Planning Commission for action upon completion of the recirculation of the revised portions of the Draft EIR and completion of the Final EIR; and (2) deny the appeals as recirculation of the revised portions of the Draft EIR negates the need to consider further and the appeals are therefore moot. Public Hearing Opened: 6:18 pm Michael Vosler spoke against the Walmart expansion. Matthew Weinstein spoke in favor of recirculating. ACTION: Moved /seconded (Mackenzie /Belforte) Approving the request of the applicant to recirculate the portions of the Draft EIR that were revised in response to the trial court decision and direct staff to recirculate those revised portions of the Draft EIR. Motion carried 4 -0 -1 unanimous vote (Ahanotu Absent).
