2006/02/28 City Council Resolution (3)RESOLUTION NO. 2006 -60 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK AUTHORIZING AND APPROVING AMENDMENT NO.3 TO TASK ORDER 2004 -10 WITH WINZLER & KELLY CONSULTING ENGINEERS FOR PROFESSIONAL SERVICES RELATED TO THE CITY -WIDE WATER SUPPLY ASSESSMENT BE IT RESOLVED by the City Council of the City of Rohnert Park that it does hereby authorize and approve Amendment No. 3 to Task Order No. 2004 -10 by and between Winzler & Kelly Consulting Engineers, a California Corporation, and the City of Rohnert Park, a municipal corporation, for additional professional services related to responding to challenges of the City - Wide Water Supply Assessment. BE IT FURTHER RESOLVED that the City Manager is hereby authorized and directed to execute this amendment in substantially similar form to the attached agreement for and on behalf of the City of Rohnert Park. SECTION 2 — SCOPE OF WORK The scope of services for this Task Order.consists generally of the work necessary to provide technical support to the City's Attorney's office in its response to the OWL Foundation's Petition for Writ of Mandamus and Complaint for Declaratory and Injunctive Relief. Consultant will proceed only on the request of the City Attorney's office and the work scope will determined by the City Attorney's needs. SECTION 3 — COMPENSATION AND PAYMENT Compensation shall be as provided in the AGREEMENT between the parties heretofore referenced in SECTION 1 above. The total cost for services as set forth in SECTION 2 shall be actual costs (time and materials) based on Consultants' standard labor charge, which is attached. SECTION 4 TIME OF PERFORMANCE The work described in SECTION 2 is anticipated to be complete within 9 months of the City's Notice to Proceed. Consultant will proceed only on the request of the City Attorney's office and the project schedule will be dictated by the City Attorney's needs. SECTION 5 — ITEMS AND CONDITIONS All items and conditions contained in the AGREEMENT for professional services between City and Consultant are incorporated by reference. The City received 29 comment letters and took oral testimony at a Public Hearing. A number of the comments made on the Draft EIR were directed at the Water Supply Assessment. In order to assure a consistent presentation of the technical findings in the Water Supply Assessment, Winzler & Kelly will provide written responses to these questions. Tasks included in the Scope of Services 1. Attend general coordination meetings or conference calls with City staff, City Attorney and Jones & Stokes. 2. Review comment letters and public hearing transcripts that have been preliminarily organized by Jones & Stokes. 3. Update comment organization and numbering as necessary to provide clear responses to the technical questions put forward in the comments. 4. Develop a list of comments that can be grouped for "Master Response ". Review with City staff, City Attorney and Jones & Stokes. Finalize based on comments received. 5. Prepare preliminary written Master Responses and individual responses. Review with City staff, City Attorney and Jones & Stokes. Finalize based on comments received. 6. Attend Planning Commission and City Council Public Hearings as requested to present responses and address questions that may be raised by the decision makers. These rates are subject to change on an annual basis. For other than professional employees, time spent over 8 hours per day, time spent on swing shifts, and time spent on Saturdays will be charged at 1.5 times the hourly billing rate. Work on Sundays will be charged at 2.0 times the hourly billing rate and holiday work will be charged at 2.5 times the hourly billing rate. All field personnel charges are portal to portal. Professional employees will not be charged out at premium charge rates for overtime work. Expenses and other similar project related costs are billed out at cost plus 15 %. The cost of using equipment and specialized supplies is billed on the basis of employee hours dedicated to projects. Our rates are: A. Office consumables $5.00/hr B. Environmental Department, Survey and Inspector consumables $10.00 /hr C. Environmental, Construction and Land Surveying equipment Various at market Payment for work and expenses is due and payable upon receipt of our invoice. Amounts unpaid thirty (30) days after the issue date of our invoice shall be assessed a service charge of one and one half (1.5) percent. M These rates do not apply to forensic - related services, or to work for which Prevailing Wage obligations exist.
