2006/02/14 City Council Resolution (7)RESOLUTION NO. 2006-52 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK Approving MEMORANDUM OF UNDERSTANDING FOR THE REIMBURSEMENT OF LIVE -SCAN FINGERPRINTING EQUIPMENT COSTS BE IT RESOLVED by the City Council of the City of Rohnert Park that that certain Agreement by and between the County of Sonoma and the City of Rohnert Park Department of Public Safety be and the same is hereby accepted for reimbursement of Live -Scan upgrade funds. BE IT FURTHER RESOLVED that the City Manager is authorized to execute this agreement in substantially similar form to the attached agreement for and on behalf of the City of Rohnert Park. RECITALS WHEREAS, Vehicle Code Section 9250.19, ( "Section 9250.19 ") gives the Board of Supervisors the authority to increase vehicle registration fees by $1.00 for each vehicle registered or renewed by Sonoma County residents, which fees are to be used exclusively for the purchase and operation of automated fingerprint identification equipment to identify individuals who may be involved in vehicle - related crimes and other crimes committed while operating a motor vehicle; WHEREAS, Section 9250.19 also permits the fees to be used to establish a local archive of automated fingerprints captured by all law enforcement agencies in Sonoma County; WHEREAS, pursuant to the requirements of Section 9250.19, a Remote Access Network Board (RAN) has been established and has recommended to the Sonoma County Board of Supervisors that funds be authorized to install a local automated fingerprint identification system ( "AFIS ") to be used by all law enforcement agencies in Sonoma County; WHEREAS, the Sonoma County Board of Supervisors has allocated funds from the implementation of Section 9250.19 for the establishment of a Sonoma County AFIS; and WHEREAS, the Agency has an interest in connecting its live -scan fingerprint device to the Sonoma County AFIS. NOW, THEREFORE, in consideration of the mutual covenants contained herein, the parties hereto agree as follows: A. SPECIFIC PROVISIONS 1. RESPONSIBILITIES OF AGENCY (a) Agency shall take all actions necessary to connect its live -scan fingerprint device to the AFIS located at the Sonoma County Sheriff Department ( "SCSD ") estimated to cost $800. As approved by the RAN Board, Agency may in the future also purchase a new live scan fingerprinting device, additional equipment and services related to connecting the device to the SCSD AFIS. All such equipment shall comply with the specifications identified in "Attachment A," attached to this contract and incorporated herein. Agency shall be responsible for bearing the costs of purchasing, installing, and using the live -scan fingerprint devices to the extent that such costs exceed $45,000. 1 of 5 (b) Agency shall provide to the County copies of all invoices and other documents related to the costs incurred for the purchase and installation of the live -scan fingerprint device and related equipment, including costs associated with the SCSD AFIS connection, first year maintenance agreement, vendor training, connection to existing communication lines, and other costs necessary for its first year use. 2. RESPONSIBILITIES OF COUNTY Upon receipt of the documents and invoice referenced above, County shall reimburse the Agency for the costs incurred for the purchase and installation of the Agency's live -scan fingerprint device and any additional related equipment approved by the RAN Board up to a maximum amount of $45,000. Such reimbursement shall not include modification of workspace, excess supplies, Agency employee time and expenses, or other expenditures not directly related to the installation of a live scan fingerprinting device and its connection to the SCSD AFIS. 3. TERMS OF AGREEMENT The term of this Agreement shall commence upon its execution by both parties and end June 30, 2006. 4. WAIVER OF COUNTY'S LIABILITY The County shall have no ownership interest in the equipment purchased or installed under this Memorandum of Understanding, makes no representation or warranties regarding its safety or fitness for use, and shall have no liability for any damages caused by such equipment or its use. B. GENERAL PROVISIONS 1. INDEMNIFICATION: Agency agrees to accept all responsibility for loss- or damage to any person or entity, and to defend, indemnify, hold harmless and release County, its officers, agents, and employees, from and against any and all actions,. claims, damages, disabilities, or expenses that may be asserted by any person or entity, including Agency, arising out of or in connection with the performance of this agreement, whether or not there is concurrent negligence on the part of the County, but excluding liability due to the sole active negligence or sole willful misconduct of the County. This indemnification obligation is not limited in any way by any limitation on the amount or type of damages or compensation payable to or for Agency or its agents under workers' compensation acts, disability benefit acts, or other employee benefit acts. 2. TERMINATION: (a) Termination Without Cause: County may terminate this Agreement by giving thirty (30) calendar days written notice to Agency. In the event County elects to terminate the Agreement without cause, County shall reimburse Agency for any receipts submitted up to the date of termination that do not (when taken together 2 of 5 with all other reimbursements made by the County under this Agreement) exceed $45,000. Upon termination, Agency shall retain ownership of the equipment purchased under this Agreement. County shall not be responsible to reimburse the Agency for any costs incurred subsequent to the date of termination (b) Termination For Cause: If Agency fails to perform any of its obligations hereunder within the time and in the manner required, or otherwise violates any of the terms of this Agreement, then County may immediately terminate this Agreement by giving written notice of such termination and stating the reason for such termination. In such event, Agency shall be required to transfer its ownership interests in and possession of all equipment purchased with funds provided via this Agreement to County. 3. METHOD AND PLACE OF GIVING NOTICE, SUBMITTING BILLS, AND MAKING PAYMENTS: All notices, bills, and payments shall` be made in writing and may be given by personal delivery or by mail. In all other instances, notices, bills, and payments shall be deemed given at the time of actual personal delivery. Changes in the designated recipients or addresses set forth above may be given in writing to the other party. 4. AGENCY'S WARRANTIES: Agency hereby makes the following representations and warranties. (a) Conflict of Interest:. -Agency represents that it presently has no interest which would conflict in any manner or degree with the performance of this Agreement. Agency further represents that in the performance of this Agreement, no person having such interest will be employed or engaged as a subcontractor. (b) Nondiscrimination: Agency shall comply with all applicable federal, state, and local laws, rules, and regulations in regard to nondiscrimination in employment because of race, color, ancestry, national origin, religion, sex, marital status, age, medical condition, handicap, or other prohibited basis. All nondiscrimination rules or regulations required by law to be included in this Agreement are incorpo- rated by this reference. 3 of 5 Agency has reviewed Sonoma County Ordinance No. 4291 prohibiting dis- crimination in housing, employment, and services because of AIDS or HIV infection. Agency agrees to comply with the provisions of that Ordinance during the term of this Agreement and any extensions of the term. 5. NO THIRD -PARTY BENEFICIARIES: Nothing contained in this Agreement shall be construed to create, and the parties do not intend to create, any rights in or for the benefit of third parties. 6. NO WAIVER OF BREACH: The waiver by County of any breach of any term or promise contained in this Agreement shall not be deemed to be a waiver of such term or promise or any subsequent breach of the same or any other term or promise contained in this Agreement. 7. ASSIGNMENT/DELEGATION: Neither party hereto shall assign, sublet, or transfer any interest in this Agreement or any duty hereunder without the written consent of the other party. No assignment or delegation shall be of any force or effect unless and until the necessary written consent has been provided. 8. MERGER: This writing is intended both as the final expression of the Agreement between the parties hereto with respect to the included terms and as a complete and exclusive statement of the terms of the Agreement. No modification of this Agreement shall be effective unless and until such modification is evidenced by a writing signed by both parties. 9. CONSTRUCTION OF AGREEMENT AND VENUE: This Agreement shall be construed and enforced pursuant to the laws of the State of California. Venue of any action or proceeding regarding this Agreement or performance thereof shall be proper only in the County of Sonoma, State of California. System Certification The live -scan system optics must be FBI - certified to meet or exceed the IAFIS Image Quality Standard (IQS), at 500 dpi, for every capture format (rolled finger, slaps, palms). The optics device must be produced by using the IQS parameters as the final quality measures for assessing the conformance of every device. Delivery of the devices must be accompanied by certificates issued by the original device manufacturer declaring full compliance to the IQS and detailing the parameters measured at each device for all parameters of the IQS. If requested, vendor should reperform all measurements of the IQS at any device selected by user out of the delivered quantity of devices. Vendor should also be able to offer a quality assurance program to user that makes sure every device in the field can be maintained to keep the IQS complaince over its planned lifetime. 2. Uncoated Platens The live -scan system must utilize an uncoated platen to avoid the image degradation that occurs with coatings and the requirement of periodic platen coating replacement. The system must have been certified under the FBI IAFIS IQS without use of a coating. The user must not be required to perform installation of new coatings. 3. Live Image Preview and Non - moving Platens The system must provide the capability to display live image preview (i.e. repetitive capture and instant displaying of finger and palm impressions placed and positioned on the capture platens) before capture of every capture format (rolled fingers, slaps, palms), and display the finger as it is being rolled as well as the palm as it is being scanned. This instant preview is essential to assess correct placement, pressure, and skin condition, resulting in well adjusted images. The system must use stationary platens with no moving or rotating parts for every capture optics (rolled fingers, slaps, palms), to assure higher reliability. The capture of rolled fingers must use a technique similar to that used for ink rolling of prints. 4. Single Large Platen for Capture of all non - rolled Impressions The live -scan system must utilize a single optical deck for all kinds of non - rolled prints (i.e. four finger slaps, two thumbs, palm, hypothenar /writer's palm images). Image quality should be optimized for all non - rolled images so that comparisons between them cannot be compromised. The capture format for four -flat- fingers must comply to every four- finger- capture format defined in the FBI IAFIS Appendix F, including the new ID- Flats capture format (3.2 by 3.0 inch) to allow the use of the livescan MOU for the Acquisition of a Live Scan Fingerprint Devcie Page 1 of 5 ATTACHMENT A system also in the new and very time efficient "10 finger flats in 3 steps" transaction mode. The data formatting of the livescan system software must include the generation of the new ID -Flats type -14 record. 5. Short Capture Time The live -scan device should capture all prints in the shortest possible time. Capturing the rolled fingerprint shall not take longer than the same procedure performed with an inked finger on paper when applying the same degree of care. Capturing all flat and palm prints shall not take longer than 2 seconds per print, regardless of the number of fingers or part of the hand to be captured (i.e. upper or lower or writer's palm, 4 fingers, 2 thumbs). 6. Moisture Eliminating Optics System The live -scan device should include moisture eliminating optics to avoid the image degradation potentially caused by moisture. The live -scan optics must produce a clean, precise image of finger ridge detail with or without the presence of moisture. 7. Clear Imaging and Uniform Illuminated Background The live -scan system should produce clean, clear images free from artifacts caused by any misoperation by the operator or misperformance of the device. The livescan device shall detect potential misoperation such as finger shifted /slanted while rolling, palm shifted while scanning, multiple fingers shifted or lifted while scanning and the system shall instantly prompt a clear warning message to the operator. Thresholds defining the severity of such quality checks shall be pre- defined by the device vendor, but shall be tunable. Images shall present a fully uniform white background. 6. Flexible System Configuration The live -scan device should be configurable to work in a stationary ruggedized cabinet set -up as well as in a desk -top set -up. The live -scan device should be configurable to work with a notebook PC as a portable system to allow applications remotely from an office. Price options requested for ruggedized, desktop and portable systems. 9. Hand Scanner The live -scan system must have the capability of capturing all parts of a full hand as defined by the ANSI /NIST standard ITL 1 -2000. Stitching together of separate images should not be permitted. In case of capturing ANSI /NIST compliant upper and lower palm prints of the same hand, these captured images have to be handled as separate images all the time. 10. Simple Two Button Control with Foot Pedal Option The system should allow capture of the fingerprint by either a simple two MOU for the Acquisition of a Live Scan Fingerprint Devcie Page 2 of 5 ATTACHMENT A button control or a footpedal. Use of a footpedal should allow the operator to capture the fingerprint image without releasing the subject's hand. 11. Signature Capture Computerized signature capture option may be desired. Vendor to include pricing for optional signature capture pad and stylus. 12. Slap to Roll Matching The live -scan system must have slap -to -roll minutiae matching to guarantee proper capture sequence of the rolled fingers. This option must match minutiae of each rolled finger against the corresponding plain impressions and give an immediate warning to the operator if a finger has been rolled out of sequence. When the Hand Scanner is employed, the live -scan system must be able to extract minutiae from the fingers of the hand and match those to the rolled images. This insures that the hand image belongs to the same subject as the rolled finger print images. 13. Finger Capture Quality Control The live -scan system must provide real time feed back to the operator of both the coverage and the quality of the rolled impression. Areas that are too light, too dark, or smeared must be identified on- screen to assist the operator in re- rolling the questionable print. In addition the live -scan system should provide a numeric score for each rolled image and have a threshold below which the prints are automatically rejected. 14. User Interface The live -scan system must be user friendly in a fingerprinting environment. The application software should "walk the user through" the various steps to completion of a record in a simple and intuitive manner. Live scan system must also be able to interface with existing Unix booking systems currently in place. 15. System Security The live -scan system must require an operator to perform a simple, fast log -on procedure to access the system. The operator must be able to use a soft key sequence to lock the system at anytime during the booking process. In addition the system must automatically lock itself after a configurable span of no activity. The system should have multiple levels of password security to separate the functions available to users, system managers, and maintenance personnel. Warranty /Maintenance Service Program The livescan system vendor must provide a one -year warranty with multiple levels of coverage available, including Help Desk, 8AM- 5PM /Monday- Friday on -site support, or 24Hour /7 Day on -site support. When on -site response is required to restore operation, support personnel are to be on -site within 4 hours from time deemed necessary. Multi -year warranty options to be considered as well. The livescan system vendor must be the single source for warranty and post- warranty maintenance support and service. All elements of the system provided by the vendor must be serviced /warranted directly by the vendor. The customer should not have to use a third party warranty service for any component of the system. The vendor must have an established field service support organization in the state, and have demonstrated an ability to provide responsive on -site and help -desk support for a period of three years. The vendor must be able to provide references. 17. Printer Support LOCAL PRINTING The live -scan system must be able to support a local printer for output of hardcopy cards at the local site without an external print server. Network printer connectivity is preferred over a parallel interface so that the printer may be placed anywhere on a local network and not be limited to location near the live -scan system. NETWORK PRINTING The live -scan system must be capable of printing to a central site networked printer using TCP /IP over Ethernet. Multiple live -scan systems must be able to access the network printer(s) at the central site. The operator must be able to select options that enable or disable printing of a card at the network site. 18. Training One day of Vendor supplied training and orientation to the live scan device should be provided for each individual live scan purchased. 19. Installation In an effort to maintain a seamless transition of the live scan devices within the facilities, installation and full operation of the new live scan devices shall occur within 4 hours of the start of installation or within a mutually agreed upon time frame for each of these devices. Store and Forward This proposal also is to include an option for of a Store and Forward system that is capable of receiving live scan print images from multiple live scan terminals (approx. 16) and forwarding them on to Cal DOJ within compliance of the DOJ /FBI certification standards. This system must also be capable of storing records not only until they are transmitted to DOJ but also until they are downloaded on a weekly basis for eventual transfer and storage into a planned local archive /AFIS system. This option may be superceded by the simultaneous purchase and installation of an all - inclusive archive /AFIS with store & forward capabilities. 21. Selection Process The customer reserves the right to select the vendor best suited to meet its requirements and may, at its discretion, select other than the lowest bid presented. The selection process may include factors such as system features, operability, service support, company experience /capabilities, compatibility and price.
