2006/01/24 City Council Resolution (8)RESOLUTION NO. 2006- 35 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK REQUESTING THE CONSENT OF THE BOARD OF SUPERVISORS OF THE COUNTY OF SONOMA FOR CHANGES AND MODIFICATIONS TO ASSESSMENT DISTRICT NO. 05-01 (SEWER FORCE MAIN PROJECT NO. 2003-11) WHEREAS, on November 23, 2004 the City Council (the "City Council ") of the City of Rohnert Park (the "City ") adopted its Resolution No. 2004 -237 Requesting the Consent of the Board of Supervisors of the County of Sonoma to the Formation of an Assessment District, the Levy of Assessments and the Installation of Improvements; and WHEREAS, on May 3, 2005 the Board of Supervisors of the County of Sonoma (the "County ") adopted its Resolution No. 03 -3290 Consenting to the Formation of an Assessment District, the Levy of Assessments and the Installation of Improvements; and WHEREAS, on May 10, 2005 the City Council adopted its Resolution No. 2005 -139 Accepting Petition and Declaring Intention to Initiate and Conduct Special Assessment Proceedings, its Resolution No. 2005 -140 Approving a Map Showing the Proposed Boundaries of Assessment District 05 -1 (Sewer Force Main Project 2003 -11) and Ordering the Filing Thereof, and its Resolution No. 2005 -141 Giving Preliminary Approval to the Engineer's Report for of Assessment District 05 -1 (Sewer Force Main Project 2003 -11) and Fixing the Time and Place for a Hearing Thereon; and WHEREAS, on June 28, 2005 the City Council adopted its Resolution No. 2005 -209 Making Determinations, Confirming Assessments and Proceedings and Designating the Director of Finance to Collect and Receive Assessments and to Establish a Special Fund for Assessment District No. 05 -01 (Sewer Force Maim Project No. 2003 -11); and WHEREAS, the Assessment District includes both territory located within the City and territory located in an unincorporated portion of the County; and WHEREAS, the City has received or expects to receive from benefiting property owners requests to expand the scope of the Assessment District to fund improvements (the "Additional Improvements ") which are included in the City's Public Facilities Finance Plan in addition to the Sewer Force Main Project; and WHEREAS, the Additional Improvements will be constructed in both in the City and in an unincorporated portion of the County; and WHEREAS, the addition of the Additional improvements to the projects to be financed by the Assessment District (the "Changes and Modifications ") will not require the inclusion in the Assessment District of additional unincorporated County territory; and WHEREAS, the public interest and convenience require the Additional Improvements, and the City Council is of the opinion that the Additional Improvements are of such a character that they directly and peculiarly affect property in both the City and in an unincorporated portion of the County and that the purposes sought to be accomplished by the Additional Improvements can best be accomplished by a single, comprehensive scheme of work; and WHEREAS, before changing and modifying the Assessment District and ordering the acquisition and construction of the Additional Improvements, the City desires to obtain the consent thereto of the County because the scope of improvements originally approved by the County would be changed as a result thereof; BE IT RESOLVED by the City Council of the City of Rohnert Park that it does hereby find, determine, resolve and order as follows: Section 1. The recitals set forth above, and each of them, are true and correct. Section 2. The Additional Improvements referred to in the recitals are set forth in Exhibit A. Section 3. The County hereby is requested to consent to the proposed Changes and Modifications to the Assessment District and specifically to the construction of the Additional Improvements and to the inclusion in the Additional Improvements of the work that is located within an unincorporated portion of the County and to the assumption by the City of jurisdiction with respect to the foregoing. Section 4. The City Clerk is authorized and directed to transmit a certified copy of this Resolution to the Board of Supervisors of the County. ATTEST: W ... w i /% NERT A.a- CITY OF ROHNERT PARK Mayor Tim Smith BREEZE: AYE FLORES: AYE MACKENZIE: AYE VIDAK- MARTINEZ: AYE SMITH: AYE AYES: (5) NOES: (0) ABSENT: (0) ABSTAIN: (0) EXHIBIT A Description of Improvements Within the limits of the City of Rohnert Park and the County of Sonoma, the construction and/or acquisition of the following Improvements, including all planning, design, contingencies, construction administration and general administration services, the acquisition of all necessary rights of way, the acquisition of licenses, franchises and permits and the construction of all auxiliary work necessary and/or convenient to the accomplishment thereof, in accordance with the plans and specifications approved by the City Council of the City of Rohnert Park, together with the incidental costs of financing including but not limited to, capitalized interest, discounts, legal, financial advisory services, engineering and appraisals. Original Improvements to be funded by Assessment District No. 05-01: The Sewer Force Main Project No. 2003 -11 including a new 30 -inch sewer interceptor /outfall extending from the City's terminal pump station to the City of Santa Rosa's Subregional Water Reclamation Facility and generally following "Wilfred Route" as described in Facility Plan and 10% Design Report for said project. Any necessary modifications to the City's Terminal Pump Station and existing 24 -inch interceptor /outfall required to allow the Sewer Force Main Project to function as an integrated system. Additional Improvements to be added with the proposed Changes and Modifications: Water System Pipeline Improvements including 1.6 miles of water distribution pipelines from eight to sixteen inches, in diameter and pressure regulating stations, generally located near or along Rohnert Park Expressway. Eastside Sewer Project including approximately 18,000 feet of new trunk sewer ranging in size from 21- inches to 42- inches and generally extending along the Southwest Boulevard Route as described in the City's Sewer Routing Study. Rohnert Park Expressway Improvements including 5,400 linear feet of roadway widening, construction of median strips, curbs, gutters, sidewalks, ancillary utility and street lighting systems and traffic signals. Keiser Avenue Improvements including 5,400 linear feet of roadway widening, construction of median strips, curbs, gutters, sidewalks, ancillary utility and street lighting systems and traffic signals. Snyder Avenue Improvements including 8,400 linear feet of roadway widening, construction of median strips, curbs, gutters, sidewalks, ancillary utility and street lighting systems and traffic signals. East Cotati Avenue Improvements including 2,700 linear feet of roadway widening, construction of median strips, curbs, gutters, sidewalks, ancillary utility and street lighting systems and traffic signals.
