A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF ROHNERT PARK, CALIFORNIA,
ADOPTING A MITIGATED NEGATIVE DECLARATION
AND A MITIGATION MONITORING PROGRAM FOR THE
COLEMAN CREEK STORM DRAIN IMPROVEMENTS PROJECT,
PROJECT NO. 2005 -07
AND APPROVING THE PROJECT
WHEREAS, the City desired to alleviate flooding in the Cook Creek channel, reduce
silting of the existing outlets to Coleman Creek near the intersection of Gavin Way and Golf
Course Drive and prevent storm water from entering properties served by the City's 48 -inch
diameter storm drain in Gavin Way; and
WHEREAS, the Storm Drain Extension at Cook/Crane Creek Report completed in
October 2004 identified two alternatives to address the silting and flooding of the 48 -inch and
84 -inch diameter storm drains discharging to the Coleman Creek near the intersection of Gavin
Way and Golf Course Drive and the City selected Alternative One; and
WHEREAS, the City included the Coleman Creek Extension project in its 2005 -2006
Capital Improvement Program; and
WHEREAS, Winzler & Kelly completed a storm drain model for the Sonoma County
Water Agency and the City and used it to prepare the Storm Drain Extension at Cook/Crane
Creek Report; and
WHEREAS, the City approved Task Order No. 2005 -14 with Winzler & Kelly for the
design of Coleman Creek Storm Drain Extension Project; and
WHEREAS, at the request of the City Engineer, a Draft Initial Study and Proposed
Mitigation Negative Declaration was prepared in conformance with the requirements of the
California Environmental Quality Act; and
WHEREAS, on May 11, 2006, the Draft Initial Study and Proposed Mitigated Negative
Declaration were circulated for a period of no less than 30 days and a Notice of Intent to Adopt a
Mitigated Negative Declaration was published prior to that circulation period in the Press
Democrat and mailed to adjacent property owners within 300 feet of the project alignment; and
WHEREAS, on June 27, 2006 the City Council held a public hearing at which time
interested persons had an opportunity to testify regarding the Draft Initial Study and Proposed
Mitigated Negative Declaration; and,
WHEREAS, the Draft Initial Study and Response to Comments did not identify any
significant environmental impacts of the project after implementation of mitigation measures,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ROHNERT
PARK DOES RESOLVE, MAKE FINDINGS, DETERMINE AND ORDER AS
FOLLOWS:
That the above recitations are true and correct;
That the Council has read, reviewed and considered the information contained in the
Mitigated Negative Declaration, and the Mitigated Negative Declaration reflects the
Council's independent judgment and analysis;
That on the basis of the whole record before the Council, there is no substantial evidence
that the project, as mitigated, will have a significant effect on the environment;
That the record of the proceeding on which this decision is based shall be maintained by
the Planning Director at the City of Rohnert Park Planning Department; and
NOW THEREFORE BE IT RESOLVED, based on the records and the findings made
above, the Council determines that the Coleman Creek Storm Drain Improvements Project will
not have a significant effect on the environment with implementation of the mitigation measures
identified in the Mitigated Negative Declaration; and
BE IT FURTHER RESOLVED, that the City Council adopts the Mitigated Negative
Declaration and Mitigation Monitoring Program for the proposed project and approves the
Coleman Creek Storm Drain Improvements Project.
