2006/06/13 City Council Resolution 2006-161RESOLUTION NO. 2006 -161 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK APPROVING AMENDMENTS TO THE GENERAL PLAN DIAGRAM AND TEXT FOR PROPERTY, LOCATED AT 705 ROHNERT PARK EXPRESSWAY (APNs 143 - 391 -053 AND -054), FILE NO. PL2006- 013GPA (BURBANK HOUSING DEVELOPMENT CORPORATION) WHEREAS, the applicant, Burbank Housing Development Corporation, submitted an application for General Plan Amendment over a 1.88 acre site located on the southwest end of Rohnert Park Expressway; and WHEREAS, pursuant to California State Law and the Rohnert Park Municipal Code, public hearing notices were mailed to all property owners within an area exceeding a 300 foot radius of the subject property, public hearing notice signs were posted in public locations, and a public hearing notice was published for a minimum of 10 days prior to the first public hearing in a published paper having local circulation; and WHEREAS, on May 25, 2006, the Planning Commission held a public hearing at which time interested persons had an opportunity to testify either in support or opposition to the proposal and the Commission did vote to recommend approval of the amendments to the General Plan Text and Diagram; and WHEREAS, in accordance with the provisions of Government Code § 65402, the Planning Commission did approve of the location, purpose and disposition of this City property for use as a residential permanent supportive and /or transitional housing; and WHEREAS, in accordance with CEQA Guidelines § 15225, City of Rohnert Park, as lead agency, will utilize the NEPA "FONSI" (Finding of No Significant Impact) document in place of the CEQA Negative Declaration. Notice that the federal document would supplant the Negative Declaration was posted for 30 days beginning April 17, 2006 in accordance with state law. The review was prepared by AEM, Consulting Inc. in accordance with state and federal guidelines and adequate mitigation measures were adopted by the Planning Commission as indicated in their Resolutions 2006 -28 and 2006 -29. WHEREAS, the City Council of the City of Rohnert Park makes the following findings: NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ROHNERT PARK DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. Recitations. That the above recitations are true and correct. SECTION 2. Findings. The City Council, in approving the application makes the following findings, to wit: A. There are new y identified internal conflicts, or changes in circumstance or policy that would warrant amending the General Plan. Criteria Satisfied. There is a conflict between Housing Programs 16.1 and 16.2 and Housing Element narrative. This project site should have been designated and zoned at a minimum for commercial use or residential use. With either of these designations pennanent supportive and /or transitional housing could have been conditionally considered under the zoning. A contradictory statement then suggests that the site was designated recreational since it is not suitable for residential development due to limited access. Staff has determined that the site does have adequate access for residential uses and should have been designated as Residential. B. The proposed General Plan Amendment is consistent ivith General Plan goals and policies. Criteria Satisfied. In accordance with California Government Code §54220 et. seq., the City of Rohnert Park affirms that housing is of vital statewide importance and the provision of a decent home and a suitable living environment is a priority of the highest order. There is also a serious shortage of sites available for housing for persons and families of moderate and lower incomes. Availing surplus government lands for housing supports the City's interest in meeting special housing needs. The project is consistent with the following General Plan goals: Goal GM -A: Recognize the availability of housing as a vital issue of statewide importance. Cooperate with other local governments and the State in addressing regional housing needs... Goal HO -C: Address to the maximum extent feasible the housing needs of all economic segments of the present and future community, giving highest priority to lower income households. Goal HO -E: Address the need for housing for persons with special needs. Goal HO -I: Maximize attainment of the Housing Element's goals and policies. C. The proposed High Density Residential designation is appropriate fog° this area. Criteria Satisfied. The project site is located across from higher density residential uses such as Rancho Verde Mobile Home Park and Redwood Creek Apartments (aka Spanos). The project is also within walking distance of shopping and transit. D. The project will comply with the new High Density Residential designation. Criteria Satisfied. Permanent supportive and /or transitional housing represents one of the highest categories of unmet housing needs in Rohnert Park. The project is designed to consider and further the following General Plan goals and policies: Land Use and Growth Management Element Policy LU -8: Require that residential development projects comply with the maximum and minimum density. (2) Goal GM -B: Exempts affordable housing from any numerical trigger cap restriction. - Policy GM -13: Requires that new development maintain creek sides and open spaces. Community Design Element - Goal CD -F: Requires maintenance of a distinct urban edge with a gradual transition between urban uses and open space. The city currently has a hard edge along most sides, creating a strong distinction between urban and rural uses. Policy CD -10: Requires buildings to foster a sense of place by providing transitions between the street and building, front setback variation for residential development, and building articulation and massing. Elements such as porches and landscaping should be designed to create a transition between public and private spaces. When porches are used they should be designed as usable outdoor space. Transportation Element Policy TR -42: Requires developers to provide bikeways and associated amenities in conjunction with new development) see also Figure 4.4 -1 which shows a proposed Class 1 Bike Path along the creek). Policy TR -43: Requires bicycle parking with new development; the Zoning Code requires 1 bicycle space per 4 units. Open Space, Parks, and Public Facilities Element - Policy OS -16: Requires the expansion of the city's network of bike and pedestrian paths in areas of new development. PolicyPF -22: Requires water - efficient landscaping in accordance with State law §65591 et. seq. Environmental Conservation Element Policy EC -7: Requires the planting of native vegetation in new development sites and adjacent open spaces see also Policy EC -11 which discusses Zoning Code requirements for landscaping and tree planting standards. Policy EC -15: Requires implementation of the NPDES permit requirements to protect water quality. Policy EC -19: Requires specialized construction techniques to prevent stream erosion, sedimentation, and contamination. Policy EC -21 Requires that new construction minimizes paved areas and water retention areas for water to reduce storm water runoff. (3) Health and Safety Element Policies HS -1 and -2: Requires new construction to follow recommendations of a registered civil engineer to minimize impacts of geologic hazards such as expansive soils and seismic shaking. Policy HS -9: Requires appropriate conditions of approval related to flood hazards be incorporated into the development review process. Policy HS -15: Requires that new multifamily residential development incorporate interior and exterior storage areas for recycling. Noise Element Goals NS -1 and -2: Requires appropriate noise analysis and review be conducted to ensure proper noise attenuating measures are included in the construction of residential uses. Housing Element Goal HO -C: To the maximum extent feasible, requires that the City meet the housing needs of all segments of the community, giving highest priority to lower income households. Goal HO -E: Requires that the City provide for housing for persons with special needs. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rohnert Park that it does hereby authorize and approve the following: SECTION 3. Amendments. The General Plan Land Use Diagram and Text shall be amended to read as follows Amendments to the General Plan Land Use Diagram (Figure 2.2-1 of the General Plan): Amend the Land Use Diagram, for Assessor Parcel Numbers: 143 - 391 -053 and -054 to "High Density Residential. " Amendment to the General Plan Housing Element: 2. Amend the first paragraph on page 9 -56 to read.- "A 1.9 acre site owned by the city at 705 ,Rohnert Park Expressway, located near Food Maxx, is designated for- residential purposes by the General Plan and is suitable for residential development; " and 3. Amend Program 16.2 on page 9 -87 to read: "In addition to the three COTS transitional homes, potential locations for a shelter or other housing serving homeless or previously homeless households include the following surplus well sites: Camino Colegio north ofE. Cotati Ave (5,200 sq.ft.,- Multifamily zoning) and Rohnert Park Express Way west of Food Maxx (81,600 sq.ft.,- Residential (4) zoning), two additional ivell sites may also be available, but may not be viable due to deed restrictions, size, and location behind the big box retail outlets: Behind Wabnart (6,000 sq,ft.,- Commercial zoning) and behind home Depot (4,300 sq.ft.,- Commercial zoning). Additional potential locations include the following sites when they become available after construction of the new, city hall: former library, and former finance office building, and any school sites determined to be surplus. T'urther, provide additional funding support for the purchase of three additional transitional homes by COTS or another non-profit. " DULYAND REGULARLY ADOPTED this 13'x' day ofJune, 2006.
