A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK
APPROVING TASK ORDER 2007 -01 WITH WINZLER & KELLY FOR
UPDATE OF THE CITY'S SEWER USE ORDINANCE
WHEREAS, on May 2, 2006 the State Water Resources Control Board adopted General
Waste Discharge Requirements for sanitary sewer collection systems; and
WHEREAS, the City is required by the State's General Waste Discharge Requirements
to develop a Sanitary Sewer Management Plan that outlines, among other things the City's legal
authority which is contained within its Sewer User Ordinance; and
WHEREAS, the City has entered into a settlement which requires it to consider a sewer
lateral replacement ordinance; and
WHEREAS, a single comprehensive review of the Sewer Use Ordinance will allow the
City to address new regulatory requirements and the settlement in a comprehensive fashion; and
WHEREAS, Winzler & Kelly is most familiar with the City's sanitary sewer collection
system and its Sewer User Ordinance as a result of its work on the City's sewer model study and
Sewer Capacity Fees;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rohnert
Park that it does hereby authorize and approve Task Order No. 2007 -01 with Winzler & Kelly
Consulting Engineers to include an update of the City's Sewer Use Ordinance for an amount not
to exceed $25,800.
BE IT FURTHER RESOLVED that the City Manager is hereby authorized and directed
to execute documents pertaining same for and on behalf of the City of Rohnert Park.

AUTHORIZATION OF ENGINEERING SERVICES
TO UPDATE THE CITY'S SEWER USE ORDINANCE
SECTION 1— PURPOSE
The purpose of this Task Order is to authorize and direct Winzler & Kelly to proceed
with the work specified in Section 2 below in accordance with the provisions of the MASTER
AGREEMENT between the City of Rohnert Park ( "City ") and Winzler & Kelly ( "Consultant ")
dated June 27, 2006.
SECTION 2 — SCOPE OF WORK
The items authorized by this Task Order are presented in Attachment "A" — Scope of
Services.
SECTION 3 — COMPENSATION AND PAYMENT
Compensation shall be as provided in the AGREEMENT between the parties hereto
referenced in SECTION I above. The cost for the services as set forth in SECTION 2 shall be
actual costs (time and materials) based on Consultants' standard labor charges in accordance with
the provisions of the AGREEMENT and as shown in Attachment "B" for an amount not -to-
exceed $25,800.
SECTION 4 — TIME OF PERFORMANCE
The work described in SECTION 2 shall be completed By May 31, 2007.
SECTION 5 — ITEMS AND CONDITIONS
All items and conditions contained in the AGREEMENT for professional services
between City and Consultant are incorporated by reference.

SCOPE OF SERVICES
UPDATE THE CITY'S SEWER USE ORDINANCE
1. General Description and Background
On May 2, 2006 the State Water Resources Control Board approved General Waste Discharge
Requirements (GWDRs) that outline requirements for the owners and operators of sewer
collection systems, specifically related to overflows from collection systems. The City has filed
for coverage under these GWDRs and will need to review the legal authority contained in its
Sewer Use Ordinance and develop a Sanitary Sewer Management Plan over the next 12 to 18
months.
At approximately the same time, the City settled a complaint filed by River Watch also related to
overflows from the collection system. This settlement also requires that the City review its Sewer
Use Ordinance, particularly with respect to its policy on inspection and repair of sewer laterals
tributary to the collection system. Among the issues the City must consider is whether or not to
require inspection and repair of sewer laterals upon transfer. of property (point -of -sale
requirements).
The scope includes:
a. Work with City staff and community stakeholders to fully understand concerns;
b. Development of a range of policy strategies that would allow the City to comply with the
GWDRs and the settlement;
c. Modifications to the Sewer Use Ordinance to implement the preferred policy strategies
and;
d. Presentation to the Water Issues Subcommittee and City Council.
2. Project Tasks
Task 1 City Kickoff Meeting and 1st Stakeholder Meeting
This task includes an initial kick -off meeting with City, followed by a meeting with community
stakeholders. Winzler & Kelly will work with the City, and if requested the North Bay
Association of Realtors, to convene a working group of real estate professionals and local
contractors experienced in inspecting and repairing sewer laterals. The purpose of this initial
meeting is to exchange data and build a clear understanding of the concerns of all parties.
Winzler & Kelly will come prepared to suggest a range of potential implementation strategies as
a starting point for the discussions.
Deliverable: Meeting Minutes
Task 2 Research and Review
This task includes collecting and reviewing Sewer Use Ordinances from other jurisdictions that
include private lateral inspection and repair requirements, specifically point -of -sale
requirements. Winzler & Kelly will develop a matrix of requirements in order to allow the City
to review strategies that have been successfully implemented by other jurisdictions. This task
also includes review of the GWDRs, applicable guidance material and any information related to
the City's settlement in order to develop a clear understanding of the programmatic requirements
that may affect the City.
Deliverable: Matrix of Requirements
Task 3 Summary Memo — Implementation Strategies
Based on our initial review and feedback received at the stakeholder meeting, Winzler & Kelly
will draft a summary memo that outlines at least three implementation strategies including order -
of- magnitude budgets, potential incentives and schedules. Winzler & Kelly will make revisions
based on comments received.
Deliverable: Up to two drafts of the Implementation Strategies
Task 4 Follow -up Stakeholder Meetings
Winzler & Kelly will facilitate up to three follow -up stakeholder meetings to discuss the Draft
Implementation Strategies and receive comments.
Deliverable: Meeting Minutes
Task 5 Water Issues Subcommittee Meeting
Winzler & Kelly will attend a meeting of the City's Water Issues Subcommittee in order to brief
the Subcommittee on the policy development process.
Task 6 Finalized Implementation Plana and Update Sewer Use Ordinance
Based on review and comments received on the two drafts of the Implementation Strategy
Memo, Winzler & Kelly will finalize the hnplementation Plan, in the farm of a staff report to
City Council, and will make revisions to the current Sewer Use Ordinance to incorporate the any
requirements of the GWDRs, the settlement and the Implementation Plan.
Deliverable: Staff Report Outlining Final Implementation Plan and Ordinance
Task 7 Council Presentation
This task includes up to two fonnal presentations to the City Council on the Implementation Plan
and Ordinance modifications.
