2013/08/13 City Council Resolution 2013-119RESOLUTION NO. 2013 -119 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK APPROVING LETTER OF INTENT BY AND BETWEEN THE SONOMA COUNTY COMMUNITY DEVELOPMENT COMMISSION AND THE CITY OF ROHNERT PARK FOR THE PURPOSE OF CONTINUING A DUE DILIGENCE PROCESS AND NEGOTIATING TERMS FOR THE TRANSFER OF CERTAIN HOUSING ASSETS AND FUNCTIONS OF THE FORMER ROHNERT PARK COMMUNITY DEVELOPMENT COMMISSION WHEREAS, ABxl 26 and AB 1484 (jointly, the "Dissolution Act "), eliminated redevelopment agencies statewide and required the unwinding and liquidation of the obligations and assets of the former redevelopment agencies; WHEREAS, Health and Safety Code Section 34176(a) gave the city that authorized creation of a redevelopment agency the option of retaining the redevelopment agency's housing assets and functions, excluding amounts on deposit in the Low and Moderate Income Housing Fund; WHEREAS, local housing authorities were designated as the "housing successor entities" for all local municipalities that did not elect to retain the housing functions, assets, and obligations of their former redevelopment agencies; WHEREAS, in Sonoma County, the cities of Sonoma and Sebastopol declined to retain their former redevelopment agency's housing functions, and the Sonoma County Housing Authority (otherwise known as the "Sonoma County Community Development Commission ") consequently became the housing successor entity for these jurisdictions; WHEREAS, unlike Sonoma and Sebastopol, on January 10, 2012, the City of Rohnert Park elected to retain the housing assets and functions of the former Rohnert Park Community Development Commission ( "CDC "); WHEREAS, the SCCDC has proposed certain nonbinding terms as the basis for the contemplated transfer of the housing assets and functions of the former CDC to the SCCDC, which terms are incorporated into the proposed Letter of Intent dated August 13, 2013 from the SCCDC to the City. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rohnert Park that it does hereby authorize and approve execution of the Letter of Intent by and between the Sonoma County Community Development Commission and the City of Rohnert Park. BE IT FURTHER RESOLVED that the City Manager is hereby authorized and directed to carry out such tasks and negotiate the terms of such additional documents as are necessary for the transfer to the SCCDC of the housing assets and functions of the former CDC consistent with the proposed terms set forth in the Letter of Intent.
