CITY COUNCIL /RPFA /RPD /SUCCESSOR AGENCY TO THE CDC JOINT REGULAR MEETING - CALL TO ORDER/ROLL CALL Mayor Stafford called the joint regular meeting to order at 5:04 pm, the notice for which being legally noticed on October 18, 2013. Present: Pam Stafford, Mayor Joseph T. Callinan, Vice Mayor Amy O. Ahanotu, Council Member Gina Belforte, Council Member Jake Mackenzie, Council Member Absent: None. Mayor's Proclamation Declaring October 2013 as Domestic Violence Awareness Month Mayor Stafford read and presented the Proclamation. Madeleine Keegan O'Connell, YWCA Sonoma County Executive Director, accepted the proclamation. Mayor's Presentation of Certificate of Recognition for the Rohnert Park's Chamber of Commerce 50`x' Anniversary Mayor Stafford read and presented the Certificate to Rohnert Park Chamber of Commerce. C. Library Joint Powers Agreement (JPA) Review Advisory Committee Proposed Governance by Don Schwartz, Sonoma County Administrator's Office Don Schwartz provided the presentation. David Dodd, Interim Library Co- Director, was available to answer questions. 4. DEPARTMENT HEAD BRIEFING A. Department of Public Safety: Halloween Safety Public Service Announcement Lieutenant Taylor and Spiderman provided the public service announcement. 5. PUBLIC COMMENTS Dori Hudson expressed concern regarding her utility bill. City Council directed staff to make contact and answer her questions. Richard Armerding spoke in opposition of Measure A. 6. CONSENT CALENDAR A. Approval of Minutes for: City Council Special Meeting October 16, 2013 City Council /RPFA /Successor Agency Joint Regular Meeting October 8, 2013 B. Acceptance of Reports for: 1. City Council Resolutions for Adoption: (Belforte PULLED for discussion) 2. 2013 -144 Amending the Nationwide Deferred Compensation Plan (457 Plan) 3. 2013 -145 Authorizing and Approving the Second Amendment to the Consultant Services Agreement with CSG Consultants, Inc. for General Engineering and Building Plan Check Consulting Services 4. 2013 -146 Adopting a Digital Billboard Use Policy 5. 2013 -147 Authorizing and Approving the Site Lease Agreement by and Between the City of Rohnert Park and Community Child Care Council of Sonoma County (4C's) for Use of the Gold Ridge Recreation Center Facility City of Rohnert Park Joint Regular Meeting Minutes October 22, 2013 for City Council/Rohnert Park Financing Authority /Successor Agency Page 3 of 7 6. 2013 -148 Authorizing and Accepting the State of California Office of Traffic Safety (OTS) Selective Traffic Enforcement Program (STEP) Grant and Amending the FY 2013 -2014 Operating and Revenue Budget 7. 2013 -149 Authorizing and Accepting the State of California Office of Traffic Safety (OTS) Sobriety Checkpoint Program (SafeTREC) Grant and Amending the FY 2013 -2014 Operating and Revenue Budget ACTION: Moved /seconded (Mackenzie /Ahanotu) to approve the Consent Calendar. Motion carried unanimously 5 -0 vote. C. City Council Resolutions for Adoption: 1. 2013 -143 Authorizing the Purchase of Six (6) Ford Police Interceptor Utility Vehicles including Equipment Build -outs Not to Exceed $240,000 Recommended Action(s): adopt the resolution. ACTION: Moved /seconded (Belforte /Callinan) to approve Resolution 2013- 143. Motion carried unanimously 5 -0 vote. 7. SONOMA COUNTY LIBRARY AMENDED JOINT POWERS AGREEMENT (JPA) Assistant City Manager Jenkins presented the item. Recommended Action(s): provide direction regarding a proposed amended Joint Powers Agreement for the Sonoma County Library System. ACTION: By Consensus City Council concurred with staff's proposed comments listed in the staff report. 8. FUTURE LANDSCAPE SERVICE ALTERNATIVES FOR CITY FACILITIES AND PROPERTIES Director of Public Works and Community Services McArthur and General Services Supervisor Kelley presented the item. Recommended Action(s): retain the current model that utilizes City staff for turf and unimproved landscape maintenance and direct staff to prepare plans and specifications to formally bid high and low intensity street landscape services. ACTION: Moved /seconded (Callinan/Ahanotu) to direct staff to prepare plans and specifications to formally bid 12.2 acres of high intensity and 63.3 of low intensity street landscape services. Motion was amended to include a cost analysis comparison in -house (include full -time employee equivalent and equipment) and contracted services. Motion carried unanimously 5 -0 vote. CONSIDERATION OF OPTIONS TO ALLOCATE INCREASED CELL TOWER RENT INCOME City Manager Gonzalez presented the item. Recommended Action(s): allocate increased new cell tower rent income of approximately $31,200 per year to fund repairs /renovations at existing City recreational facilities. ACTION: By Consensus City Council directed staff to bring topic back at the next budget process. 10. REVIEW AND DISCUSSION OF CHAPTER 9.56 OF THE MUINCIPAL CODE, MUNICIPAL GOLF COURSE City Manager Gonzalez and Director of Public Works and Community Services McArthur presented the item. Recommended Action(s): Staff seeks City Council direction on alternatives and process for developing a pedestrian safety plan for the Municipal Golf Course. ACTION: Moved /seconded (Mackenzie /Callinan) staff's recommendation to have the proposed alternatives outlined in the staff report brought before the Golf Course Oversight Committee and upon the Committee's consensus brought before the Parks & Recreation Commission for discussion and recommendation which would be agendized for Council consideration. Motion carried unanimously 5 -0 vote. Vice Mayor Callinan stepped away from dais 7:51 pm 11. CONSIDERATION AND ADOPTION OF RESOLUTION AUTHORIZING AND APPROVING EMPLOYMENT AGREEMENT City Manager Gonzalez presented the item. Recommended Action(s): Adopt Resolution Authorizing and Approving the Employment Agreement Between City of Rohnert Park and Darrin Jenkins to Serve as Interim City Manager. Item was reconsidered following Item 12. Vice Mayor Callinan returned 7:53 pm 12. INTRODUCTION OF AN ORDINANCE ADOPTING BY REFERENCE THE 2013 CALIFORNIA BUILDING CODES, AS AMENDED TO REFLECT LOCAL CONDITIONS, BY REPEALING AND REPLACING SPECIFIED CHAPTERS OF ARTICLE 15 OF THE MUNICIPAL CODE; AND SET A PUBLIC HEARING Development Services Manager Ponton and Deputy Chief Building Official Hughes presented the item. Recommended Action(s): 1.) Introduce for first reading by title only an Ordinance adopting the 2013 California Building Standards Code by reference, as amended to reflect local conditions, and amending Chapter 15.04 (General Provisions and Penalties), Chapter 15.08 (Building Code), Chapter 15.10 (Residential Code With City of Rohnert Park Joint Regular Meeting Minutes October 22, 2013 for City Council/Rohnert Park Financing Authority /Successor Agency Page 5 of 7 Appendix G), Chapter 15.16 (Electrical Code), Chapter 15.20 (Plumbing Code), Chapter 15.22 (Energy Code), Chapter 15.24 (Mechanical Code) and Chapter 15.26 (Green Building Standards Code) of Title 15, "Buildings and Construction," of the Rohnert Park Municipal Code and revising Parts of Chapter 15.36 (Swimming Pools, Spas and Hot Tub Code), of the Rohnert Park Municipal Code and 2.) Set a public hearing for November 26, 2013 for the adoption of Ordinance. Ordinance title read by Mayor Stafford. ACTION: Moved /seconded (Mackenzie /Belforte) Ordinance 870 of the City Council of the City of Rohnert Park, California Adopting the 2013 California Building Standards Code by Reference, as Amended to Reflect Local Conditions, and Amending Chapters 15.04 (General Provisions and Penalties), 15.08 (Building Code, 15.10 (Residential Code), 15.16 (Electrical Code), 15.20 (Plumbing Code), 15.22 (Energy Code), 15.24 (Mechanical Code), 15.26 (Green Building Standards Code), and 15.36 (Swimming Pools, Spas and Hot Tubs Code) of Title 15 "Buildings and Construction" of the Rohnert Park Municipal Code. Motion carried unanimously by a 5 -0 roll call vote. ACTION: Moved /seconded (Mackenzie /Belfoi-te) to approve reconsideration of the action taken on Item 11. Motion carried unanimously 5 -0 vote. 11. CONSIDERATION AND ADOPTION OF RESOLUTION AUTHORIZING AND APPROVING EMPLOYMENT AGREEMENT City Manager Gonzalez presented the item. Recommended Action(s): Adopt Resolution Authorizing and Approving the Employment Agreement Between City of Rohnert Park and Darrin Jenkins to Serve as Interim City Manager. ACTION: Moved /seconded (Belforte /Mackenzie) to approve Resolution 2013 -150. Motion carried unanimously 5 -0. 13. INTRODUCTION OF AN ORDINANCE ADOPTING BY REFERENCE THE 2013 CALIFORNIA FIRE CODE, AS AMENDED TO REFLECT LOCAL CONDITIONS, BY REPEALING AND REPLACING MUNICIPAL CODE CHAPTER 15.28 (FIRE CODE); AND SET A PUBLIC HEARING Fire Marshal Adam presented the item. Recommended Action(s): 1.) Introduce for first reading by title only an Ordinance adopting by reference, with applicable amendments to reflect local conditions, the 2013 California Fire Code based on the 2012 International Fire Code, including listed chapters, appendices, and repealing all former ordinances or parts thereof conflicting or inconsistent with the provisions of the proposed ordinance or California Fire Code, by repealing and replacing Rohnert Park Municipal Code Chapter 15.28 (Fire Code) and 2.) Set a public hearing for November 26, 2013 for the adoption of Ordinance. Ordinance title read by Mayor Stafford. Motion carried by a 4 -1 -0 roll call vote (Mackenzie — No). 14. STANDING COMMITTEE / LIAISON REPORTS A. Standing Committee Reports 1. Economic Development, 10 /10 Mayor Stafford reported topics of discussion were the way finding signs for Sonoma State University, the electronic billboard policy, and a possible City banner program. 2. Golf Course Oversight, 10/15 Mayor Stafford and Vice Mayor Callinan reported on the performance evaluation process. Education, 10/17 Mayor Stafford reported the way finding signage and casino mitigation planning were discussed. Sonoma State would like to add to the current sign; consensus is to wait until the City has a way finding sign program. B. Liaison Reports 1. SCTA /RCPA, 10/14 Council Member Mackenzie reported the Climate Action 2020 stakeholder advisory group was approved and Mackenzie's three nominations were accepted. 2. Chamber of Commerce, 10/15 Mayor Stafford reported she was presented with a 50 year proclamation from the County Board of Supervisors and had a successful golf tournament. C. Other Reports 1. Development Agreement Ad Hoc Committee, 10/17 Vice Mayor Callinan reported the committee discussed the University District and South East District and the items will come before Council for discussion. Golden Gate Bridge District: Council Member Belforte announced December 5, 2013 will be the Golden Gate Bridge tour for city council members and city managers. Health Action: Council Member Belforte announced a Value Market is opening at the Redwood Empire Food Bank 10:30 to 6:30 and provided the Health Action 2020 Vision for Sonoma County Impact Report — October 17, 2013 to Council. Council Member Belforte reported the Rotary Bunco Tournament raised $2,500. City of Rohnert Park Joint Regular Meeting Minutes October 22, 2013 for City Council/Rohnert Park Financing Authority /Successor Agency Page 7 of 7 Council Member Belforte reported Rohnert Park was highlighted at the Impact Sonoma meeting held at Sonoma Mountain Village. 15. COMMUNICATIONS Council Member Belforte said a request was received from the Surfrider Foundation to install "drains to the creek" decals where they are missing on storm drains and would like to have any decals the City has in storage. The Surfriders would work on this project in conjunction with the Public Works Department. 16. MATTERS FROM /FOR COUNCIL 17. PUBLIC COMMENTS City Manager Gonzalez shared parting remarks of serving as the City Manager of Rohnert Park and expressed gratitude. City Council commented on City Manager Gonzalez's management of the City and expressed appreciation. 18. CLOSED SESSION A. Mayor Stafford made the closed session announcement pursuant to Government Code §54957.7 and Council recessed to Closed Session at 8:34 pm in Conference Room 2A to Consider: Conference with Labor Negotiators (Government Code §54957.6) Agency designated representative(s): Gabriel Gonzalez Employee Organization: a.
