CITY COUNCIL /RPFA /RPD /SUCCESSOR AGENCY TO THE CDC JOINT REGULAR MEETING - CALL TO ORDER/ROLL CALL Mayor Stafford called the joint regular meeting to order at 5 prn, the notice for which being legally noticed on November 21, 2013. Present: Pam Stafford, Mayor Joseph T. Callinan, Vice Mayor Amy O. Ahanotu, Council Member Gina Belforte, Council Member Jake Mackenzie, Council Member Absent: None. Staff present: Interim City Manager Jenkins, City Attorney Kenyon, City Clerk Buergler, Director of Public Works and Community Services McArthur, Director of Public Safety Masterson, Senior Analyst Atkins, Development Services Manager Ponton, Sergeant Nicks, Community Services Supervisor Herman, Deputy Chief Building Official Hughes, Fire Marshall Adam, Interim Finance Director Kwong, and Secretary Lidster. 2. PLEDGE OF ALLEGIANCE Led by Tristan Archer, Marguerite Hahn Elementary School. 3. PRESENTATIONS A. Chamber of Commerce Events Update: Annual Tree Lighting Ceremony and Crab Feed Tony J. Geraldi, Chamber Board Member, provided information on the Holiday Lights event which will be held December 7, 2013 at 5 pm. Amanda Hudson, Event Committee Member, announced the crab feed will be January 10, 2013 at 5 pm. Santa's Sleigh Toy Drive hosted by the Rohnert Park Public Safety Officers Association (RPPSOA) Sergeant Nicks provided an update and explained the schedule and how the toy drive works. Santa Claus provided Council Members with RPPSOA duffel bags to be filled with toys for the drive. 4. DEPARTMENT HEAD BRIEFING A. Department of Public Works and Community Services: 30' Annual Holiday Arts & Crafts Faire held at the Community Center Community Services Supervisor Herman provided the briefing. The event is November 29 and 30, 2013 from 10 am to 4 pm. B. Casino Mitigation Task Force: Graton Mitigation Program Budget Financial Status Report Senior Analyst Atkins provided the briefing and noted a correction to the agenda report (bottom of page one should read $2,944,000 not $2,994,000). Adoption of Ordinances: 1. 872 An Ordinance of the City Council of the City of Rohnert Park, California, Amending the City of Rohnert Park Stadium Area Master Plan Final Development Plan to Reflect the Change in Land Use for the Public Safety Facility Site 2. 873 An Ordinance of the City Council of the City of Rohnert Park, California, Rezoning APN 143 - 040 -127 from Public Institutional (P- I) to Planned Development (P -D) and Amending the City of Rohnert Park Zoning Map 3. 874 An Ordinance of the City Council of the City of Rohnert Park, California, Amending the City of Rohnert Park Stadium Area Master Plan Final Development Plan to Reflect the Addition of 3.0 Acres to the Master Plan ACTION: Moved /seconded (Mackenzie /Ahanotu) to approve the Consent Calendar. City Council Resolutions for Adoption: 2. 2013 -157 Approving a Job Description and Salary Range for Human Resources Director and Changing the Allocated Position from Human Resources Manager to Human Resources Director Recommended Action(s): adopt the resolution. ACTION: Moved /seconded (Ahanotu /Mackenzie) to approve Resolution 2013- 157. Motion carried by a 4 -0 -1 -0 vote ( Belforte ABSTAINED). 7. SELECTION OF CITY COUNCIL OFFICERS FOR 2014 Consideration of nomination and selection of 2014 Mayor and Mayor Pro Tempore (Vice Mayor) for installation at the December 10, 2013 City Council meeting City of Rohnert Park Joint Regular Meeting Minutes November 26, 2013 for City CouncillRohnert Park Financing Authority /Successor Agency Page 4 of 7 ACTION: Moved /seconded (Stafford /Belforte) to nominate and appoint Vice Mayor Callinan as Mayor and Council Member Ahanotu as Vice Mayor. Motion carried unanimously by a 5 -0 vote. 8. BOARD / COMMISSION / COMMITTEE APPOINTMENTS Recommended Action(s): Make nominations and appointments to advisory bodies for terms expiring December 31, 2013 and vacancies. 1. Mobile Home Park Rent Appeals Board — Three, two -year terms (Ahanotu, Belforte, and Callinan nominations) ACTION: Moved /seconded (Ahanotu /Callinan) to reappoint nominee Leonard Carlson. Motion carried unanimously by a 5 -0 vote. ACTION: Moved /seconded (Belforte /Ahanotu) to reappoint nominee Patrick Reymond. Motion carried unanimously by a 5 -0 vote. ACTION: Moved /seconded (Callinan/Belforte) to nominate Sandra Waterman. Motion carried unanimously by a 5 -0 vote. 2. Senior Citizens Advisory Commission — One vacancy, two -year term expiring on 12/31/2014 (Callinan nomination) The City Clerk's office will continue recruitment efforts for the remaining vacancy. 3. Sister Cities Relations Committee — Six, two -year terms expiring on 12/31/2013 (At Large nomination) ACTION: Moved /seconded (Mackenzie /Belforte) to reappoint nominees Tadao Kunishi and Kate Sanderson and nominate and appoint Sachiko Knappman to the current term expiring December 31, 2013 and to the 2 -year term which commences January 1, 2014. Motion carried unanimously by a 5 -0 vote. The City Clerk's office will continue recruitment efforts for the remaining vacancies. 9. STANDING COMMITTEE / LIAISON REPORTS A. Standing Committee Reports 1. Waste & Recycling, 11/14 a. Discussion of proposed Second Amendement to the Sonoma County Waste Management Agency Joint Powers Agreement (JPA) City of Rohnert Park Joint Regular Meeting Minutes November 26, 2013 for City Council / Rohnert Park Financing Authority /Successor Agency Page 5 of 7 Mayor Stafford, Council Member Ahanotu, and Director of Public Works and Community Services McArthur provided the report. Recommend Action(s): Support the second amendment to the JPA and Agendize the item for City Council consideration on December 10, 2013. ACTION: By Consensus City Council directed staff to bring the item back for Council consideration on December 10, 2013. B. Liaison Reports Library JPA Review Committee, 11/14 Council Member Ahanotu reported the JPA has support with one exception; Sonoma County is requesting two representatives (votes) on the board. If the County has two representatives, the City of Santa Rosa requests two representatives. ACTION: By Consensus City Council requested that Council Member Ahanotu remind Supervisor McGuire Rohnert Park supports one representative for each agency. 2. Chamber of Commerce, 11/19 Mayor Stafford reported the Chamber continues supporting and expanding membership and working with the business community. C. Other Reports Health Action: Council Member Belforte reported the Committee requested the City consider adding a health action component to the General Plan when it is updated. 10. COMMUNICATIONS A. Request dated November 14, 2013, from Nancy Kaufman to ban fireworks in the City of Rohnert Park Council Member Mackenzie stated for the record he is requesting the consideration of a ban on fireworks be placed on a subsequent agenda for deliberation and action. The item will not be Agendized as it lacked concurrence of two Members. 11. PUBLIC HEARING: (NO EARLIER THAN 6PM, Noticed 11/1/13 and 11/8/13) ADOPTION OF AN ORDINANCE ADOPTING BY REFERENCE THE 2013 CALIFORNIA BUILDING CODES, AS AMENDED TO REFLECT LOCAL CONDITIONS, BY REPEALING AND REPLACING SPECIFIED CHAPTERS OF ARTICLE 15 OF THE MUNICIPAL CODE Development Services Manager Ponton and Deputy Chief Building Official Hughes presented the item. Recommended Action(s): 1.) Conduct Public Hearing and 2.) Adopt Ordinance 871. Public Hearing Opening 6:16 pm Public Hearing Closed 6:16 pm ACTION: Moved /seconded (Callinan /Belforte) Ordinance 871 of the City Council of the City of Rohnert Park, California Adopting by Reference the 2013 Edition of the California Fire Code, as Amended, by Repealing and Replacing Chapter 15.28 of the Rohnert Park Municipal Code. For the record Council Member Mackenzie stated he will vote in favor because it does permit the use of state approved fireworks in the city. Motion carried by the following 4 -1 -0 Roll Call vote: AYES: Ahanotu, Belforte, Vice Mayor Callinan, Mayor Stafford, NOS: Mackenzie, ABSTAIN: None, ABSENT: None. 13. CITY MANAGER EMPLOYMENT AGREEMENT City Attorney Kenyon presented the item. Recommended Action(s): Adopt Resolution authorizing and approving the City Manager Employment Agreement between City of Rohnert Park and Darrin Jenkins. ACTION: Moved /seconded (Callinan/Mackenzie) to approve Resolution 2013 -163. Motion carried by a 4 -0 -0 vote (Belforte ABSTAINED). PUBLIC COMMENTS Marc Orloff, Assistant Athletic Director for CYO Basket Ball, congratulated Darrin Jenkins on becoming the city manager and announced the annual CYO tournament is November 29 to December 1, 2013 in Rohnert Park. 16. CLOSED SESSION A.
