2004/11/09 City Council Minutes (3)CITY OF ROHNERT PARK CONCURRENT MEETINGS MINUTES for: CITY COUNCIL COMMUNITY DEVELOPMENT COMMISSION ROHNERT PARK FINANCING AUTHORITY November 9, 2004 Tuesday The Concurrent Meetings of the City of Rohnert Park for the City Council, the Community Development Commission and the Rohnert Park Financing Authority met this date in Regular Session for a regular meeting to commence at 6:00 p.m. at the Rohnert Park City Hall, 6750 Commerce Boulevard, Rohnert Park, with Mayor Nordin presiding. CALL TO ORDER: Mayor Nordin CALLED the Regular Session to order at 6.01 p.m. ROLL CALL: Present: (4) Councilmembers Flores and Vidak- Martinez; Vice Mayor Spradlin; and Mayor Nordin Absent: (0) None Late: (1) Councilmember Mackenzie (7:05 p.m.) Mayor Nordin noted that Councilmember Mackenzie would be arriving approximately one hour late. Staff present for all or part of the Regular Session: City Manager Leivo, Interim City Attorney Whelan, Assistant City Manager Donley, City Engineer Jenkins, Finance Services Manager Lauchner and Recreation Services Manager Miller. ADJOURN TO CLOSED SESSION: Mayor Nordin adjourned Council to Closed Session at 6:01 p.m. to discuss.Labor and Real Estate Negotiations. SCHEDULED APPEARANCE /PRESENTATION: Alene Levinson regarding "Let's Get Back Our Teen Center ": Ms. Levinson, accompanied by Carolyn Panikver, a supporter of the Teen Center concept, expressed interest in starting a Teen Center, modeled after Dan Hubley's Homework Club, where teens could meet in a safe place to do homework, meet other youth and engage in various activities in the community. They suggested the Teen Center use the Community Center, hold carwashes and make Valentines for vets for fundraisers, and utilize students from Sonoma State and Santa Rosa Junior College as tutors. Council DIRECTED STAFF (1) To put Ms. Levinson and other Teen Center representatives in touch with the Parks & Recreation Commission, and (2) To look into the possible use of existing City facilities. 3. STUDENT REPORTS: SSU - Sonoma State University Associated Students, Incorporated, by James J. Reilly III, Legislative Representative: Mr. Reilly DISTRIBUTED copies of The Star and a Hunger & Homelessness Awareness Week flier. Mr. Reilly reported on the following items: (1) Hunger & Homelessness Awareness Weeks activities, November 7th -20th; (2) Upcoming Associated-Students election; (3) Interest in Council support /approval for a Safe Rides program to be discussed with City Manager Leivo. 4. UNSCHEDULED PUBLIC APPEARANCES /COMMENTS: No members of the public submitted speaker cards or expressed a desire to speak before the Council on any matter. 5. PERSONNEL RULES AND REGULATIONS: Consideration of updated Personnel Rules and Regulations for compliance with current federal and state laws: 1. Staff Report /Presentation: City Manager Leivo shared opening and closing comments, and Assistant City Manager Donley reviewed highlights of the Staff Report, specifically the Executive Summary. Staff responded to Council comments about Homeland Security and compliance with State regulations. 2. Resolution for Adoption: 2004 -299 AUTHORIZING AND APPROVING UPDATED PERSONNEL RULES AND REGULATIONS Council Motion /Discussion /Vote: Upon MOTION by Councilmember Flores, seconded by Councilmember Vidak- Martinez, and APPROVED 4 -0 -1 with Councilmember Mackenzie absent, reading was waived and Resolution 2004 -299 was ADOPTED. 6. FIRE PROTECTION STANDBY RATES: Consideration of correction of Resolution No. 2003 -118 pertaining to Fire Protection Standby Rates: 1. Staff Report: Finance Services Manager Lauchner reviewed the contents of the Staff Report. 2. Public Hearing: Mayor Nordin opened the Public Hearing at 6:55 p.m. There being no members of the public interested in speaking on this matter, Mayor Nordin closed the Public Hearing at 6:55 p.m. 3. Resolution for Adoption: 2004 -300 AMENDING RESOLUTION NO. 2003 -118 PERTAINING TO FIRE PROTECTION STANDBY RATES Council Motion /Discussion /Vote: Upon MOTION by Councilmember Vidak - Martinez, seconded by Vice Mayor Spradlin, and APPROVED 4 -0 -1 with Councilmember Mackenzie absent, reading was waived and Resolution 2004 -300 was ADOPTED. 7. ROBERTS LAKE DOG PARK: Consideration of revised plans to move proposed dog park from the location north of the Golf Course to new location on the existing turf area along Roberts Road, approval of preliminary plans, additional funding, and submission of the project for formal bid process: 1. Staff Report: Recreation Services Manager Miller shared the contents of the Staff Report and responded to Council questions /comments about sanitation, construction costs, proximity to ducks and geese, fundraisers and the idea of a bench with a plaque honoring the man who 'initially proposed the dog park. *City Council /Community. Public Comments: 1. Bonnie Black, 1065 Hawthorne Circle, was recognized and outlined her years of work to build a dog park for the City. She urged Council support as she discussed the benefits of dog parks, including deterring crimes, socializing dogs, and fostering a sense of community. She also noted that she sees this as the first phase of several dog parks for the City, and she thanked members of the past three Parks & Recreation Commissions and City Engineer Jenkins for their support. 3. Resolution for Adoption: 2004 -301 APPROVAL OF NEW LOCATION FOR PROPOSED DOG PARK IN THE VICINITY EAST OF ROBERTS LAKE PARK, PRELIMINARY SITE PLANS, ADDITIONAL FUNDING, AND CALLING FOR SEALED PROPOSALS FOR ROBERTS LAKE DOG PARK Council Motion /Discussion /Vote: Upon MOTION by Councilmember Vidak- Martinez, seconded by Vice Mayor Spradlin, and UNANIMOUSLY APPROVED, reading was waived and Resolution 2004 -301 was ADOPTED. 8. OVERWEIGHT VEHICLE ORDINANCE: Consideration of amending Section 10.56.020 of the Rohnert Park Municipal Code establishing weight restrictions for through commercial vehicles: 1. Staff Report: City Engineer Jenkins shared the contents of the Staff Report and responded to Council questions about Golf Course Drive and gross vehicle weights. 2. Public Comments: 1. George Petker, 4657 Willis Avenue, was recognized and expressed his concerns with the expansion of business traffic into the area of Willis Avenue. He discussed his desire for the residents of Willis Avenue to retain their right of way, and he inquired about whose responsibility it is to maintain Willis Avenue. *City Council /Community Development Commission/ Rohnert Park Financing Authority City of Rohnert Park *CONCURRENT MEETINGS MINUTES November 9, 2004 Page(5 ) City Manager Leivo responded to Mr. Petker's questions and discussed the implementation of the City's General Plan. Mayor Nordin DIRECTED STAFF to report back on the City's responsibility in terms of the maintenance of Willis Avenue. 3. Waive First Reading and Introduce Ordinance by reading title: No. 725 AMENDING SECTION 10.56.020 OF THE ROHNERT PARK MUNICIPAL CODE PERTAINING TO TRUCK ROUTES Council Motion /Discussion /Vote: Upon MOTION by Councilmember Flores, seconded by Councilmember Mackenzie, and UNANIMOUSLY APPROVED, reading was waived and Ordinance No. 725 was INTRODUCED. 9. MEMORANDUM OF AGREEMENT: Consideration of Amendment No. One to Memorandum of Agreement with the Rohnert Park Public Safety Officers' Association (RPPSOA): 1. Staff Report: City Manager Leivo shared opening comments. Assistant City Manager Donley reviewed the contents of the Staff Report and responded to Council questions about collateral assignments, additional costs to the City, and aspects of the Canine Handler's position. 2. Public Comments: None. 3. Resolution for Adoption: 2004 -302 APPROVING AMENDMENT NUMBER ONE TO MEMORANDUM OF AGREEMENT WITH THE ROHNERT PARK PUBLIC SAFETY OFFICERS' ASSOCIATION Council Motion /Discussion /Vote: Upon MOTION by Councilmember Vidak- Martinez, seconded by Councilmember Mackenzie, and UNANIMOUSLY APPROVED, reading was waived and Resolution 2004 -302 was ADOPTED. 10. COMMISSION /COMMITTEE /BOARD APPOINTMENTS: Council review of terms to expire December 31, 2004 and consideration of sending letter to current members inquiring about interest in being re- appointed: *City Council /Community Development Commission/ Rohnert Park Financing Authority City of Rohnert Park *CONCURRENT MEETINGS MINUTES November 9, 2004 Page(6 ) Council Discussion /Direction: City Manager Leivo briefly explained that this is a customary action taken each year. Council CONCURRED TO DIRECT STAFF to send letters to current Commission/ Committee /Board members inquiring about interest in being re- appointed. 11. COUNCIL COMMITTEE AND /OR OTHER REPORTS: 1. Russian River Watershed Association, October 28, 2004 meeting: Councilmember Mackenzie reported on current issues involving the new California Toxics Rule, and he discussed the City's partnership in the Integrated Regional Water Management Plan. 2. Board of Supervisors' Water Supply Workshop, November 1, 2004: Councilmember Mackenzie discussed the City's water conservation report card, and City Manager Leivo shared comments on the City's compliance with the Best Management Practices (BMP) and the 11th Amendment and Impairment Agreement. 3. Tiger Salamander Ad Hoc Committee, November 2, 2004 meeting: Councilmember Vidak- Martinez reported on (1) continued work on the Draft Conservation Plan and (2) upcoming Federal Fish & Wildlife meetings with local ad hoc committees in December. Councilmember Mackenzie responded to a Council question about designation of specific tiger salamander areas. 4. Sonoma County Transportation Authority (SCTA), November 8, 2004 meeting: Councilmember Vidak - Martinez reviewed the discussion about SCTA's concerns about the future casino on the west side of town, and she noted that the District Division Chief of Cal Trans will look into a better plan for the Wilfred - Dowdell interchange. 5. Other informational reports, if any: a. ABAG Energy Efficiency Planning meeting: Councilmember Vidak- Martinez indicated that she and City Manager Leivo attended said meeting. She discussed aspects of an energy efficiency pilot program by the Public Utilities Commission (PUC). City Manager Leivo noted that he just heard from ABAG and that he will forward that information to Councilmember Vidak - Martinez. *City Council /Community Development Commission/ Rohnert Park Financing Authority City of Rohnert Park *CONCURRENT MEETINGS MINUTES November 9, 2004 Page(7 ) b. Speech at Sonoma State University: Councilmember Vidak- Martinez discussed aspects of a speech she recently heard at SSU given by SSU's Assistant Vice Chancellor of Government Affairs. She noted that there has been a 2.5 percent enrollment growth for Sonoma State University, and that for every university dollar spent, the City gets four dollars back. 12. COMMUNICATIONS: Communications per the attached outline were brought to the attention of the Council. The following communication was discussed: D. & J. Richards, Residents, re suggestions for traffic, speeding, and reckless driving in H Section: Councilmember Vidak- Martinez inquired if staff had contacted the Richards regarding traffic - calming measures for Hudis Street. City Manager Leivo indicated that he would verify that staff has contacted the Richards. Councilmember Mackenzie expressed concern about the .effectiveness of the Country Club zebra crosswalks to slow down drivers. 13. MATTERS FROM /FOR COUNCIL: 1. Schedule of Events and Meetings: Mayor Nordin reviewed the "Upcoming Events" document, and Councilmembers indicated attendance at various functions. 2. City Council Agenda Forecast: Provided in the agenda packet. 3. Other informational items, if any: Refuse Trucks and Diesel Emissions: Councilmember Mackenzie referred to articles about the safety of the garbage trucks operated by Windsor's waste hauler, West Sonoma County Disposal. He expressed concern about Rohnert Park Disposal's plans to reduce diesel emissions for its refuse trucks, and the City's ability to conduct safety inspections of said trucks. *City Council /Community Development Commission/ Rohnert Park Financing Authority City of Rohnert Park November 9, 2004 *CONCURRENT MEETINGS MINUTES Page ( 8 ) Council CONCURRED with Councilmember Mackenzie's request (1) To AGENDIZE said matter after the first of the year and (2) To receive a staff report at that meeting. City Manager Leivo noted that staff has access to Rohnert Park Disposal's vehicle maintenance records and that staff will review them. Councilmember Flores SUGGESTED that an overview of the diesel emissions and vehicle maintenance records be done by Rohnert Park Disposal and included as part of the Staff Report at the Council meeting next.year when this item is agendized. 14.
