Kian Khatami, Sonoma State University Associated Students, Inc. (SSU ASI) Legislative
Representative introduced himself and reported the SSU ASI is working on a textbook
affordability resolution, reducing on- campus smoking through education, and provided
copies of the Sonoma State Star.
5. PUBLIC COMMENTS
Gretchen Werner, M.ED., Literacy Connection Manager with Volunteer Center of
Sonoma County, announced they are working with the Cotati - Rohnert Park Unified
School District to recruit volunteers to help for an hour each week in the classrooms at
John Reed Elementary, Waldo Rohnert Intermediate, University Elementary at La Fiesta
and Thomas Page Academy. Orientation for volunteers is September 25, 2014 at the
Cotati - Rohnert Park Library.

7. City Council Review and Comments on the Rohnert Park SMART Station Design
Plans
Interim Development Services Director Ponton presented the item. Recommended
Action(s): Comment on the Design Package for the Rohnert Park Sonoma Marin Area
Rail Transit (SMART) Station Design and staff will forward the City Council comments
to the SMART staff.
ACTION: By Consensus City Council (none opposed) directed staff to forward City
Council's comments to SMART which include:
• At 65% design build, what changes or alterations can be made?
• Consideration of landscaping to provide privacy with the elevated
station platform on the east side of the SMART tracks adjacent to the
mobile home park.
• Consider coordination with the owners of the adjacent State Farm
property and the developing Priority Development Area plan for
integration of parking, access, and roads.
• Consider the layout of the platform regarding the ticket vending
machines, lack of restrooms, and the narrow width of the platform.
• The width of the parking stalls should be compliant with City
requirements.
• The design of the SMART station should be subject to the review and
standards that would apply to any other developer in Rohnert Park.
8. Review and Discuss Street Names for Vast Oak Area and University District
Specific Plan
Interim Development Services Director Ponton presented the item. Recommended
Action(s): Review and discuss street names for the Vast Oak area in the University
District Specific Plan. A Resolution for approval of the street names will be brought back
to the City Council for its consideration at a future Council meeting.

ACTION: Moved /seconded (Belforte /Callinan) to create an ad hoc committee
comprised of Mayor Callinan and Council Member Belforte to review
street names provided to staff by interested parties and bring back the item

Golden Gate Bridge District - Council Member Belforte reported a couple of deer
headed north over the bridge safely during commute time. Last year it was a buck
headed south.
Health Action Council 9/5 - Council Member Belforte reported the Portrait of
Sonoma County was a topic of discussion and Rohnert Park was not really part of that
discussion. She reminded Health Action Council of Rohnert Park's need for programs
and requested as they come together and discuss the need for services that Rohnert
Park's needs are taken into consideration. Sonoma County Supervisor Zane, Council
Member Belforte, and Assistant City Manager Schwartz will be meeting to discuss
Rohnert Park's need for services.
10. COMMUNICATIONS
Council Member Belforte received a large postcard promoting not donating to or
supporting the Humane Society of California and does not want the public to think the
Rohnert Park Animal Shelter is part of the Humane Society.
11. MATTERS FROM /FOR COUNCIL
Council Member Mackenzie will be representing MTC at Rail - Volution 2014 conference
in Minnesota, therefore he will be absent from the September 23, 2014 City Council
meeting.
Mayor Callinan will be absent from September 23, 2014 City Council meeting.
A. Consideration of canceling the November 11, 2014, Regular City Council Meeting
due to the Veterans Day holiday and Scheduling a Special Meeting Wednesday,
November 12, 2014

Julieta Valencia expressed concern over the condition of portable toilets in the City's

RECOMMENDED ACTION:
Approve Resolution Amending Conflict of Interest Code Appendix A: Designated Positions and
Appendix B: Disclosure Categories.
BACKGROUND:
The Political Reform Act (California Government Code Section 81000, et seq.) requires every
local government agency to adopt and circulate conflict of interest codes. The Act further
requires government agencies to conduct biennial reviews of their Conflict of Interest Codes by
October 1" of even - numbered years to determine if the Conflict of Interest Code accurately
designates appropriate positions and disclosure categories. In 2004, Council approved
amendments to the Code be made by resolution rather than by ordinance.
ANALYSIS:
The Conflict of Interest Code was reviewed by Human Resources, City Attorney's Office, and
City Clerk. Staff recommends that Council amend Rohnert Park's Conflict -of- Interest Code
Appendix A (Exhibit A to the Resolution) to reflect the addition of new designated positions,
deletion of eliminated positions, and revisions to titles of existing positions (changes are
indicated in red).
Staff also recommends that Council amend Appendix B (Exhibit B to the Resolution) to coincide
with the Fair Political Practices Commission Form 700 used to disclose economic interests. The
recommended changes (indicated in red) include updating the disclosure category descriptions to
include gifts, loans, and travel payment and designate which schedules corresponds with the
disclosure category.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK
AMENDING APPENDICES A AND B OF THE
CITY OF ROHNERT PARK CONFLICT OF INTEREST CODE
WHEREAS, the Political Reform Act (California Government Code Section 81000, et
seq.) requires public agencies to adopt and promulgate conflict of interest codes; and
WHEREAS, the Fair Political Practices Commission has adopted a regulation (Title 2
California Code of Regulations Section 18730) that contains the terms of a standard conflict of
interest code and may be incorporated by reference in an agency's Conflict of Interest Code; and
WHEREAS, the Political Reform Act, Government Code Section 87306.5, requires
government agencies to conduct biennial reviews of their Conflict of Interest Codes; and
WHEREAS, the disclosure categories and the list of designated positions required to file
statements of economic interest under the Conflict of Interest Code are established by resolution;
and
WHEREAS, staff has determined that amendments to the list of designated positions are
necessary.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Rohnert
Park amends Appendices A and B of the Conflict of Interest Code as set forth in Exhibit A
incorporated herein and attached to this resolution.

CITY OF ROHNERT PARK
CONFLICT OF INTEREST CODE - 2014
SECTION 1. AUTHORITY. This code is adopted pursuant to and in compliance with
Section 87300 of the California Government Code.
SECTION 2. STANDARDIZED CODE ADOPTED. The Political Reform Act
(Government Code Section 81000, et seq.) requires state and local government agencies to adopt
and promulgate conflict of interest codes. The Fair Political Practices Commission has adopted a
regulation (Title 2 Cal. Code of Regs. Section 18730) that contains the terms of a standard
conflict of interest code and may be incorporated by reference in an agency's code. After public
notice and hearing, the standard code may be amended by the Fair Political Practices
Commission to conform to amendments in the Political Reform Act.
Therefore, the terms of California Code of Regulations Section 18730 and any
amendments to it duly adopted by the Fair Political Practices Commission are hereby
incorporated by reference. This regulation, and the attached appendices designating positions and
establishing disclosure requirements, shall constitute the Conflict of Interest Code of the City of
Rohnert Park. This Conflict of Interest Code of the City of Rohnert Park, adopted by Resolution
No. 2014 -110, replaces any Conflict of Interest Code of the City of Rohnert Park, previously in
effect.
SECTION 3. STATEMENTS OF ECOMONIC INTEREST. Individuals holding
designated positions shall file their Statements of Economic Interest (Statements) with the filing
officer (City Clerk), who will retain the Statements and make the Statements available for public
inspection and reproduction. (Gov. Code Section 81008.)
SECTION 4. EFFECTIVE DATE. This Conflict of Interest Code shall take effect
immediately upon its approval by the City Council of the City of Rohnert Park.

RECOMMENDED ACTION:
Consideration of a Resolution Approving Letter of Public Convenience and Necessity
BACKGROUND:
The property at 1460 East Cotati Avenue is presently a convenience and liquor store. The
present owner of the business is selling the business. The new owner will operate a small
market /delicatessen including the sale of beer and wine. The current business has a Type 21
liquor license that permits the sale of hard liquor. The new owner needs a Type 20 liquor license
that only permits the sale of beer and wine, not hard liquor.
Beer and wine sale will only occupy a small section of the store and there will be a cooler for
display some of the beer offered for sale. There will be no signs on the exterior of the building
indicating the sale of beer and wine. There is only one other business in the immediate area
selling beer and wine.
ANALYSIS:
The California Department of Alcoholic Beverage Control (ABC) is responsible for issuing
alcoholic beverage licenses. Sonoma County has been determined by ABC to be a moratorium
county, meaning one in which the ratio of beer and wine licenses exceeds one for every 2,500
inhabitants. Pursuant to Business and Professions Code Section 23817.7, ABC may approve an
application for an off -sale beer and wine license in moratorium areas if the local governing body
of the area in which the applicant premises are located determine that public convenience and
necessity would be serve by the issuance.
To determine that public convenience and necessity would be served by the issuance of the Type
20 permit in this instance, the City must find the following:
• The premises is not located in a crime reporting district that has a 20% greater number of
reported crimes than other reporting districts within that particular law enforcement
jurisdiction; and
• The premises is not located in an area that would result in an undue concentration of
licenses. Business and Profession Code Section 23958.4 defines "undue concentration"

of licenses in a given area as an area where the ratio of on -sale retail liquor licenses to
population in the census tract or census division in which the applicant premises are
located exceeds the ratio of on -sale retail licenses to population in the county in which
the applicant premises are located.
The proposed business premises is located in the Beat 3 crime reporting district. The
Department of Public Safety has reviewed crime statistics in the area and determined that crime
is not 20% greater than other reporting districts. The premises is located in Census Tract
1513.11 with a population of 6,382. The number of licenses allowed is ten (10) and the number
of existing licenses is three (3) which is not an undue concentration.
One advantage of the proposed change in license type is that the new business will not sell hard
liquor, only beer and wine. In addition, in order to operate lawfully in the City, the business
owner must apply to the Department of Public Safety for an alcohol sales use permit in
accordance with Municipal Code Chapter 8.34 and maintain yearly permits at all times alcohol
will be sold.
Based on the foregoing, staff has determined that the findings can be made to support a
determination that public convenience and necessity would be served by the issuance of the Type
20 license at this premises.
OPTIONS CONSIDERED:
The only other option available to the business owner is not to offer beer and wine for sale in the
market /delicatessen.
ENVIRONMENTAL CONSIDERATION:
This matter is exempt from the California Environmental Quality Act (CEQA) Guidelines
Section 15301 existing facilities, because this involves minor alterations to the interior use of an
existing commercial building and will not involve any exterior physical changes to the premises.
FISCAL IMPACT /FUNDING SOURCE:
The potential fiscal impact to the City is any enforcement actions resulting from the sale of beer
and wine in the market /delicatessen. The use permit fees and sales tax revenue to the City from
the sale of beer and wine will help off -set the cost of enforcement actions.

Convenience and Necessity (PC &N) for my new business ` Ronnie's' that will be
located at 1460 East Cotati Avenue #B, in the Sonoma Square Shopping Center.
My new business will replace the business `Dash Market' that is currently open
and operating in this location. Dash Market is more of a convenience & liquor
store and it currently has a type 21 Off -Sale General Liquor License. My business
will be more of a business that is directed towards families and students, so I will
incorporate a delicatessen with beer and wine (no liquor). The sale of beer and
wine is an integral part of our operation, and it will be a necessary element in the
success of our business as well as being a convenience to our customers. We feel
that our establishment will be an asset to the nearby business community and to
the surrounding neighborhood. For this reason, I am applying for a type 20 Off -
Sale Beer and Wine License which is actually a downgrading of the ABC
privileges that currently exists.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK
MAKING A DETERMINATION OF PUBLIC CONVENIENCE AND NECESSITY FOR
A MARKET AND DELICATESSEN TO SELL BEER AND WINE LOCATED AT 1460

WHEREAS, a business located at 1460 East Cotati Avenue No. B is changing from a
convenience store that sells hard liquor under a Type 21 Liquor License to a small market selling
beer and wine under a Type 20 license; and
WHEREAS, California Department of Alcoholic Beverage Control (ABC) , which is
responsible for issuing alcoholic beverage licenses, has placed a moratorium on the approval of
applications for off -sale beer and wine licenses because the ratio of such licenses exceeds one for
every 2,500 inhabitants; and
WHEREAS, pursuant to Business and Professions Code Section 23817.7, ABC may

RECOMMENDED ACTION:
Consider and adopt the attached Resolution approving the ROPS 14 -15B (Recognized
Obligation Payment Schedule for the period January 1, 2015 to June 30, 2015) of the Successor
Agency to the former Community Development Commission of the City of Rohnert Park.
BACKGROUND:
Health & Safety Code Section 34177 (m)(1) requires successor agencies to submit the
Recognized Obligation Payment Schedule (BOPS) to the State Department of Finance (DOF).
The ROPS 14 -15B must be submitted to the Sonoma County Auditor - Controller Treasurer -Tax
Collector, State Controller's Office and Department of Finance no later than October 3, 2014,
after approval by the Oversight Board which is scheduled for September 29, 2014.
ANALYSIS:
The attached ROPS 14 -15B addresses $2,836,434 in enforceable obligations to be paid from
Redevelopment Property Tax Trust Funds ( "RPTTF "). The enforceable obligations include bond
debt payments and the administrative cost allowance for the period January 1, 2015 to June 30,
2015, and to claim a prior eligible administrative cost. In addition, with the receipt of the Notice
of Completion on April 26, 2013 and other required actions, the Successor Agency is now
eligible to include previously unallowable items on the 14 -15B ROPS. These include 1) a request
for repayment of a loan the City made to the former Community Development Commission with
a total repayment amount including principal and interest of $2,157,867 (repayment based on an
amortization schedule thru 2036), and 2) a request to use bond proceeds for infrastructure
projects in the amount of $5,700,064, which was recently directed in Resolution 2014 -109 by
Council on September 9, 2014.
Staff recommends that the Successor Agency consider and adopt the attached Resolution
approving the ROPS 14 -15B. If approved, the ROPS 14 -15B will be submitted to the Oversight
Board for approval.

THE CALIFORNIA HEALTH AND SAFETY CODE
WHEREAS, in accordance with Section 341710) of the California Community
Redevelopment Law (Health & Safety Code § 33000 et seq.) ( "CRL "), the City Council of the
City of Rohnert Park ( "City" or "City Council," as applicable) is the Successor Agency to the
former Community Development Commission of the City of Rohnert Park ( "Commission "), and
is responsible for, among other things, winding down the dissolved Commission's affairs,
continuing to meet the Commission's enforceable obligations, overseeing completion of
redevelopment projects and disposing of the assets and properties of the Commission, all as
directed by the oversight board created pursuant to Section 34179 of the CRL ( "Oversight
Board ");
WHEREAS, Section 34177 (1)(2) of the Health and Safety Code requires the City of
Rohnert Park as the successor agency to submit to the State Department of Finance ( "DOF "), the
State Controller, and the Sonoma County Auditor - Controller Treasurer -Tax Collector ( "County
Auditor ") for review, Recognized Obligation Payment Schedules ( "ROPS ") which include
enforceable obligations and Successor Agency administrative costs for six -month periods;
WHEREAS, on June 27, 2012, the Governor signed into law, AB 1484 ( "Redevelopment
Budget Trailer Bill ") to make technical and substantive amendments to AB 26 ( "Dissolution
Act ") concerning issues including but not limited to, enforceable obligations and successor
agency administrative costs;
WHEREAS, pursuant to AB 1484, the ROPS for the period of January 1, 2015 to June 30,
2015 ( "ROPS 14 -1513") shall be submitted to the Sonoma County Auditor - Controller Treasurer -
Tax Collector, the State Controller's Office, and Department of Finance no later than October 3,
2014, after approval by the Oversight Board.
WHEREAS, successor agency staff have prepared the attached ROPS as required pursuant
to Health and Safety Code Section 34177(1)(2)(B).
NOW, THEREFORE, CITY OF ROHNERT PARK FOR THE SUCCESSOR
AGENCY OF THE CITY OF ROHNERT PARK DOES RESOLVE AS FOLLOWS:
Section 1. The Recognized Obligation Payment Schedule for the period January 1, 2015 to
June 30, 2015 in the form attached to this resolution and incorporated herein by reference is
hereby approved.
Section 2. The staff of the Successor Agency is hereby directed to submit the ROPS to DOF,
the State Controller, and the Sonoma County Auditor - Controller Treasurer -Tax Collector and
post the ROPS on the Successor Agency's website in accordance with Health and Safety Code
Section 34177(1)(2)(C), and to cooperate with DOF to the extent necessary to obtain DOF's
acceptance of the ROPS, including, if necessary, making modifications to the ROPS determined
by the City Manager to be reasonable and financially feasible to meet its legally required
financial obligations.

RECOMMENDED ACTION:
Approve a Resolution Supporting the Board of Directors of the Sonoma County Water Agency's
Adoption of the Santa Rosa Plain Groundwater Management Plan and Authorize the Execution of a
Cooperative Funding Agreement to Implement the Same.
BACKGROUND:
The Santa Rosa Plain Watershed (Plan Area) covers an area of approximately 167,000 acres and is
home to approximately half of the population of Sonoma County. The groundwater system beneath
the Santa Rosa Plain provides numerous benefits to the region, including rural residential and
municipal water supplies, irrigation water for agriculture, and base flow to streams and surface water
bodies. The City draws a portion of its municipal water supply from the groundwater system beneath
the Santa Rosa Plain and has been an early adopter of groundwater management. Both the General
Plan and the City's 2004 Water Policy Resolution provide a framework by which the City manages
its groundwater supply for a sustainable yield.
However, successful groundwater management cannot be achieved by the City acting alone. State
policy and the California Water Code encourage local agencies to use integrated strategies for
groundwater management by developing and implementing non - regulatory, voluntary groundwater
management plans. In particular, California Water Code Section 10750 and following provides a
framework under which regional groundwater management plans can be developed and
implemented. Regions with established groundwater management plans experience numerous
benefits including increased water supply reliability, minimized adverse impacts to groundwater,
enhanced local management of groundwater resources, and economic opportunities through
available state grant funding programs.
For over ten years, the City has participated in efforts to study and manage groundwater regionally.
In collaboration with the Sonoma County Water Agency, the cities of Cotati, Santa Rosa and
Sebastopol, the town of Windsor, the County of Sonoma, and the California American Water
Company, the City has funded a United States Geological Survey (USGS) study of the Santa Rosa
Plain groundwater basin, which was completed in 2014. The USGS study includes significant data

analysis and powerful modeling tools that can be used to guide management activities. The findings
of the USGS study demonstrate the need for careful monitoring and management of groundwater
and surface water in the region to provide a sustainable supply of water for groundwater users and
the environment.
In 2010, the Sonoma County Water Agency convened a Steering Committee to help assess the
willingness of the region to undertake the development of a groundwater management plan. By late
2011, the Steering Committee recommended that the region undertake the development of
groundwater management plan, with the Sonoma County Water Agency as the lead agency. The plan
development process was guided by a stakeholder - driven Basin Advisory Panel and a Technical
Review Committee. City staff has participated in both the Basin Advisory Panel and the Technical
Review Committee.
The goal for the plan is for a balanced group of stakeholders to locally manage and protect
groundwater resources through non - regulatory measures to support all beneficial uses, including
human, agriculture, and ecosystems, in an environmentally sound, economical, and equitable manner
for present and future generations. In August 2014, the Basin Advisory Panel recommended that the
Sonoma County Water Agency's Board of Director's adopt the groundwater management plan,
developed under the Panel's guidance and direction. Staff from the Sonoma County Water Agency
has requested that the stakeholders involved in the Basin Advisory Panel and Technical Review
Committees seek letters or resolutions of support from their governing bodies in order to
demonstrate the depth of regional support for the proposed plan.
ANALYSIS:
The proposed groundwater management plan recommends a range of voluntary water management
actions to achieve the stated goal of managing and protecting groundwater resources. The
management actions are grouped into seven major components: (1) Stakeholder Involvement and
Public Awareness; (2) Monitoring and Modeling Program; (3) Groundwater Protection; (4) Increase
Water Conservation and Efficiency; (5) Increase Groundwater Recharge; (6) Increase Water Reuse;
and (7) Integrated Groundwater Management.
The plan has been structured so that many of the voluntary management actions take advantage of
work the City is already doing to comply with its own policies and storm water management permit
and to achieve its stated water use targets. The monitoring and modeling program is particularly
beneficial to the City because it provides a regional framework in which to understand the local data
that the City collects and reports. In addition, an established local groundwater management plan
assists all regional participants in qualifying for certain types of grant funding.
The initial implementation of the plan will focus on the monitoring and modeling program and will
be funded by a Cooperative Funding Agreement between the Sonoma County Water Agency, the
cities of Cotati, Rohnert Park, Santa Rosa and Sebastopol, the town of Windsor, the County of
Sonoma, the California American Water Company, United Wine Growers, Agricultural Preservation
and Open Space District and the Federated Indians of Graton Rancheria. If approved by the City
Council, the City's obligation under the Cooperative Funding Agreement is $10,000 per year for two
years. Staff believes that the data and analysis generated through the cooperative program is more
valuable than what the City could achieve on its own.

OPTIONS CONSIDERED:
None. The recommended action is consistent with the City's policies and its ongoing participation in
groundwater management efforts for the region.
ENVIRONMENTAL ANALYSIS:
The Sonoma County Water Agency is the lead agency for the purposes of the California
Environmental Water Quality Act and is responsible for analyzing the environmental impacts of the
adoption of the proposed groundwater management plan. The Sonoma County Water Agency is
proposing to find that the adoption of the proposed groundwater management plan is categorically
exempt from the California Environmental Quality Act (CEQA) under State CEQA Guidelines
Sections 15306, 15307 and 15308.
Guideline 15306, Information Collection, provides, generally, that basic data collection, research,
and resource evaluation activities, which do not result in serious or major disturbance to an
environmental resource, are categorically exempt from CEQA. Implementation of the proposed
groundwater management plan would not result in a serious or major disturbance to an
environmental resource and is for information gathering purposes which will help meet the Basin
Management Objectives outlined in the proposed groundwater management plan. Guidelines
Sections 15307 and 15308, Actions by Regulatory Agencies for Protection of Natural Resources and
the Environment, provide that actions taken by regulatory agencies to assure the maintenance,
restoration or enhancement of a natural resource and the environment are categorically exempt. The
proposed groundwater management plan provides a framework to support coordination of public and
private groundwater management efforts and protect groundwater resources and to support all
beneficial uses, in an environmentally sound, economical, and equitable manner.
While the Sonoma County Water Agency is proposing to find that adoption of proposed
groundwater management is categorically exempt from CEQA, it will also acknowledge that any
future projects that result from plan implementation, such as but not limited to construction activities
identified in Section 5 of the proposed groundwater management plan, would be subject to future
evaluation under CEQA.
CEQA is not applicable to the City's adoption of a resolution of support. In addition, staff believes
that taking this position is consistent with the City's General Plan and if CEQA were applicable, this
action would be categorically exempt under Sections 15307 (Protection of Natural Resources) and
15308 (Protection of the Environment) of the CEQA Guidelines because the adoption of a
groundwater management plan will manage and protect the groundwater resources in the Santa Rosa
Plain Watershed.
FISCAL IMPACT /FUNDING SOURCE:
Early implementation of the groundwater management plan will be funded by a cooperative
agreement between the Sonoma County Water Agency, the cities of Cotati, Rohnert Park, Santa
Rosa and Sebastopol, the town of Windsor, the County of Sonoma, the California American Water
Company, United Wine Growers, Agricultural Preservation and Open Space District and the

Federated Indians of Graton Rancheria. The City's obligation under the cooperative agreement is

WHEREAS, there can be multiple potential benefits to developing and implementing
a groundwater management plan including increased water supply reliability, minimized adverse

WHEREAS, the State of California's policies support the local development and
implementation of non - regulatory, voluntary groundwater management plans; and
WHEREAS, the City of Rohnert Park draws a portion of its water supply from the
groundwater system beneath the Santa Rosa Plain and has been an early advocate of groundwater
management through policies contained in both its General Plan and its 2004 Water Policy
Resolution; and
WHEREAS, the City of Rohnert Park, in collaboration with the Sonoma County
Water Agency, the cities of Cotati, Santa Rosa and Sebastopol, the town of Windsor, the
County of Sonoma, and the California American Water Company supported the United States
Geological Survey's study of the groundwater system beneath the Santa Rosa Plain, which
was completed in 2014 (the USGS Study); and
WHEREAS, the USGS Study includes significant technical data and
groundwater modeling results that demonstrate the need for careful monitoring and
management of groundwater and surface water in order to provide a sustainable supply of
groundwater for all users; and
WHEREAS, the City of Rohnert Park has participated in a stakeholder- driven
process to develop a Groundwater Management Plan for the Santa Rosa Plain area which will
be administered by the Sonoma County Water Agency; and
WHEREAS, after a four year period of study, public outreach and negotiation,
the stakeholders have recommended that the Board of Directors of the Sonoma County Water
Agency adopt the Groundwater Management Plan for the Santa Rosa Plain which provides
for local management and protection of groundwater resources through non - regulatory
measures to support all beneficial uses; and
WHEREAS, implementation of the Groundwater Management Plan for the Santa
Rosa Plain is structured to encourage an open, collaborative and cooperative process for
groundwater management activities, and to maximize coordination future actions, which will
benefit the City of Rohnert Park by including the City's existing monitoring within a regional
context.
WHEREAS, the initial implementation of the Groundwater Management Plan
will focus on the monitoring and modeling program and will be funded by a Cooperative
Funding Agreement among several stakeholders. The City's obligation under the Cooperative
Funding Agreement is $10,000 per year for two years.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Rohnert Park that it supports the Board of Directors of the Sonoma County Water Agency's
action to adopt and implement the recommendations of the Santa Rosa Plain Groundwater
Management Plan.
BE IT FURTHER RESOLVED that the City Manager is hereby authorized and
directed to execute documents pertaining to same for and on behalf of the City of Rohnert
Park, including and without limit to a Cooperative Funding Agreement that supports
implementation of the plan, which is attached hereto and incorporated by this reference,
subject to minor modification by the City Attorney or City Manager.

Cooperative Agreement for Implementation of Santa Rosa Plain
Groundwater Management Program
This agreement ( "Agreement ") is by and among Sonoma County Water Agency, a body
corporate and politic of the State of California ( "Water Agency ") and County of Sonoma,
Agricultural Preservation & Open Space District, City of Santa Rosa, City of Rohnert Park,
Town of Windsor, City of Cotati, City of Sebastopol, California- American Water Company, and
United Wine Growers, (collectively "Participants "). The Effective Date of this Agreement is the
date the Agreement is last signed by the parties to the Agreement, unless otherwise specified in
Article 7.1 (Term of Agreement).
RECITALS
A. The Santa Rosa Plain Groundwater Management Program (Program) is described in Exhibit
A and covers the Santa Rosa Plain Watershed Area (Plan Area).
B. Program cost allocation is shown in Exhibit D.
C. The Sonoma County Water Agency, City of Cotati, City of Santa Rosa, City of Sebastopol, City
of Rohnert Park, Town of Windsor, and California- American Water Company utilize, or will
utilize, groundwater from the Plan Area for all or part of their municipal water supply. The
City of Sebastopol utilizes groundwater from the Plan Area for all of its municipal water
supply.
D. The County is interested in the adequacy of the groundwater supply in the unincorporated
portions of the Plan Area.
E. The Water Agency and the Sonoma County Agricultural Preservation and Open Space
District have been working collaboratively to evaluate the relationship between watershed
conservation and sustainable high quality groundwater supplies and are in the process of
quantifying the economic benefits associated with land conservation related to maintaining
groundwater quality and supply.
F. The Sonoma County Agricultural Preservation and Open Space District has acquired land
and may in future acquire land in the Plan Area. The information generated from this effort
will support the Agricultural Preservation and Open Space District's acquisition planning and
prioritization process. The Sonoma County Agricultural Preservation and Open Space
District will utilize data and planning recommendations from the Groundwater
Management Plan — in concert with other District conservation planning data —to more
efficiently and effectively prioritize land acquisition and stewardship tasks that may protect
or enhance groundwater resources.
G. United Winegrowers represent wine grape growers in the Plan Area that rely on a
sustainable supply of groundwater as a source of water for growing wine grapes.
H. The Water Agency and Participants agree it is in the public interest to work collaboratively
with other entities or individuals whose service areas, boundaries, or properties overlie the
Plan Area.
I. The purpose of this Agreement is to: (1) provide a funding mechanism for Participants to
contribute a not -to- exceed total cost of $330,000 to pay for Years 1 and 2 of implementing
Cooperative Agreement for Implementation of Santa Rosa Plain Groundwater Management Program
the Program and (2) further establish working relationships amongst Participants staff and
develop Program monitoring tools and protocols.
In consideration of the foregoing recitals and the mutual covenants contained herein, the
parties hereto agree as follows:

4. COST SHARING
4.1. The estimated cost to complete the first two -years of the implementation
process is $330,000 to fund technical consultant and facilitation costs, with in-
kind staff support from the Water Agency and Participants, as identified in
Exhibit C. Water Agency in -kind staff support for the first two years of Program
implementation is estimated to be $270,000 and is not included in the $330,000
estimated cost share associated with this Agreement.
4.2. Participants and Water Agency shall share in the estimated $330,000 local share
for each of the two years up to the "not to exceed" amounts as listed in Exhibit
D.
S. WATER AGENCY'S RESPONSIBILITIES
Water Agency will complete all the following, in accordance with "Project
Implementation," as described in Exhibit A, at its cost and expense, except to the extent
of Participants funding provided for in Sections 6 and 7 below.
5.1. Program Supervision: Retain and supervise technical consultant and facilitation
consultant in implementation of the Santa Rosa Plain Groundwater Management
Plan that complies with AB 3030 and SB 1938. Act as liaison with Department of
Water Resources and provide Program management, and Program coordination.
This responsibility includes coordinating any necessary technical review meetings
and providing status updates to Participants as needed.
5.2. Technical Support: Perform computer simulations of planning scenarios in
consultation with Participants and Basin Advisory Panel using GSFLOW model of
the Santa Rosa Plain developed by the U.S. Geological Survey. Develop data
management protocols and system for managing monitoring data collected
under the Program. Preparation of annual reports summarizing progress and
monitoring data for the Program.
5.3. Presentations by Request: If requested, assist Participants' staffs in making
presentations to Participants' governing boards regarding the Program.
5.4. Record Maintenance: Maintain complete and accurate records of all
transactions in compliance with generally accepted accounting principles for
enterprise accounting as promulgated by the American Institute of Certified
Public Accountants and the Governmental Accounting Standards Board.
Maintain complete Program files with all correspondence, including letters and
meeting notes. Such records shall be available to each Participant at all
reasonable times for inspection and analysis.
5.5. Information Sharing: Gather and deliver Program information, data, results and
work - product to the Participants in an electronic format.
6. PARTICIPANTS'S RESPONSIBILITIES
6.1. Funding: Participants shall fund the costs and expenses of Program up to the
"not to exceed" amounts shown in Exhibit D.

6.2. Initial Payment: Upon execution of this Agreement and receipt of an invoice
thereof, each Participant shall deposit with Water Agency its share of Fiscal Year
14/15 costs as described in Exhibit D of this Agreement.
6.3. Payment Obligation: Participants shall have no obligation to provide funding for
the Program after Year 2, except pursuant to a future written amendment of this
Agreement.
6.4. Technical Review: Each Participant's Program Manager shall provide technical
review and comment on draft work products and reports, and each Participant
shall provide a representative to attend Basin Advisory Panel meetings and
technical meetings, as needed. Participants shall maintain the confidentiality of
any draft report to the extent Water Agency notifies them that such
confidentiality is requested and is in accordance with law.
7. ADDITIONAL REQUIREMENTS
7.1. Term of Agreement: This Agreement shall expire on December 31, 2016.
7.2. Authority to Amend Agreement: Changes to the Agreement may be authorized
only by written amendment to this Agreement, signed by all parties. Minor
changes, which do not increase the amount paid under the Agreement, and
which do not significantly change the scope of the agreement or significantly
lengthen time schedules may be executed by the Water Agency's General
Manager in a form approved by County Counsel.
7.3. Refund of Remaining Funds: If the Program cost under Exhibit C are less than
the amounts paid to Water Agency, Water Agency will refund difference to
Participants within 30 calendar days of Program completion.
7.4. No Waiver of Breach: The waiver by Water Agency or Participant of any breach
of any term or promise contained in this Agreement shall not be deemed to be a
waiver of such term or promise or any subsequent breach of the same or any
other term or promise contained in this Agreement.
7.5. Notice: Except as otherwise provided in this Agreement, any notice, submittal or
communication required or permitted to be given to the Water Agency or a
Participant shall be in writing and may be given by personal delivery to the office
of the person identified in Section 3. Service may also be made by United States
mail or by electronic mail.
7.6. Construction: To the fullest extent allowed by law, the provisions of this
Agreement shall be construed and given effect in a manner that avoids any
violation of statute, ordinance, regulation, or law. The parties covenant and
agree that in the event that any provision of this Agreement is held by a court of
competent jurisdiction to be invalid, void, or unenforceable, the remainder of
the provisions hereof shall remain in full force and effect and shall in no way be
affected, impaired, or invalidated thereby.

Participants and Water Agency acknowledge that they have each contributed to
the making of this Agreement and that, in the event of a dispute over the
interpretation of this Agreement, the language of the Agreement will not be
construed against one party in favor of the other. Participants and Water
Agency acknowledge that they have each had an adequate opportunity to
consult with counsel in the negotiation and preparation of this Agreement.
7.7. No Third -Party Beneficiaries: Nothing contained in this Agreement shall be
construed to create and the parties do not intend to create any rights in third
parties.
7.8. Applicable Law and Forum: This Agreement shall be construed and interpreted
according to the substantive law of California excluding the law of conflicts. Any
action to enforce the terms of this Agreement or for the breach thereof shall be
brought and tried in the County of Sonoma.
7.9. Captions: The captions in this Agreement are solely for convenience of
reference. They are not a part of this Agreement and shall have no effect on its
construction or interpretation.
7.10. Merger: This writing is intended both as the final expression of the Agreement
between the parties hereto with respect to the included terms and as a
complete and exclusive statement of the terms of the Agreement, pursuant to
Code of Civil Procedure Section 1856. No modification of this Agreement shall
be effective unless and until such modification is evidenced by a writing signed
by both parties.
7.11. Time of Essence: Time is and shall be of the essence of this Agreement and
every provision hereof.
B. TERMINATION
8.1. Any Participant may terminate its participation in this Agreement by giving
ninety (90) calendar days advance written notice to all other parties of its intent
to terminate its participation in this Agreement. Termination shall not relieve
the Participant of its obligation to pay costs incurred before the effective date of
the termination.
9. COUNTERPART SIGNATURES
9.1. This Agreement may be executed in counterpart and each of these executed
counterparts shall have the same force and effect as an original instrument and
as if all of the parties to the aggregate counterparts had signed the same
instrument.

Program Description
Program Background
The Santa Rosa Plain Watershed (Plan Area) covers an area of approximately 167,000 acres and is home to
approximately half of the population of Sonoma County. The groundwater system beneath the Santa Rosa
Plain provides numerous benefits to the region, including rural residential and municipal water supplies,
irrigation water for agriculture, and baseflow to streams and surface water bodies.
An integrated strategy being undertaken statewide by many local agencies is to develop and implement
non - regulatory, voluntary groundwater management plans in compliance with 1992's Assembly Bill 3030
(AB3030) and 2002's Senate Bill 1938. Such plans include public involvement, groundwater level and quality
monitoring, and management strategies. Such a plan has been successfully developed and implemented in
Sonoma Valley. Development of such a plan for the Santa Rosa Plain is one of the immediate actions
identified in the Water Agency's Water Supply Strategy No. Five (Work with Stakeholders to Promote Sound,
Information -Based Water Supply Planning Programs) of the Water Supply Strategies Action Plan.
Potential benefits to developing and implementing a groundwater management plan include increased
water supply reliability, minimized adverse impacts to groundwater, enhanced local management of
groundwater resources, and economic opportunities through available state grant funding programs.
To assess whether stakeholders within the Santa Rosa Plain were interested in pursuing groundwater
management planning, the Water Agency retained the Center for Collaborative Policy (CCP) to conduct a
stakeholder assessment of groundwater users and those interested in groundwater in 2009. Based on the
findings of the assessment, CCP concluded that collaborative groundwater planning for the Basin would
require significant pre - planning steps to lay the foundation for a phased groundwater management planning
process. These steps included convening a small, representative steering committee to guide pre - planning
work and initiating a robust education effort and outreach campaign on the USGS technical study and the
groundwater management planning process.
In April 2010, consistent with CCP's recommendations, the Water Agency convened a Steering Committee
comprised of representatives from a diverse range of stakeholder constituency groups, including business,
environmental, and community organizations; government; municipal water supply; agriculture; and rural
residential well owners. Based on understanding and input gained through these outreach activities, in
January 2011 the Steering Committee recommended that stakeholders collaboratively develop a non -
regulatory, voluntary groundwater management plan for the Basin under AB3030.
As part of initiating a groundwater management planning process in the Plan Area, a Basin Advisory Panel
(Panel) was formed in December 2011 to lead development of the groundwater management plan for the
Santa Rosa Plain. The Panel includes 28 stakeholders from throughout the Santa Rosa Plain representing
agricultural interests, local citizen groups, environmental groups, business interests, local well owners
and government interests. The Panel selected the Water Agency as the lead agency for the Santa Rosa
Plain Groundwater Management Plan. The Panel formed a Technical Advisory Committee (TAC) to
provide expert advice on scientific and technical matters related to Plan development and program
implementation. The TAC includes experts from diverse backgrounds and disciplines, including geology,
hydrology, engineering and ecology.
The United States Geological Survey (USGS) completed a study of the Santa Rosa Plain groundwater
basin in 2014 in collaboration with the Water Agency, the cities of Cotati, Rohnert Park, Santa Rosa and
Sebastopol, the town of Windsor, the County of Sonoma, and the California- American Water Company.
As part of this study, the USGS developed an innovative computer model that fully integrates surface
water and groundwater to better understand and manage the Plan Area's water resources. The study

shows that increased groundwater pumping has caused an imbalance of groundwater inflow and
outflow. This imbalance could affect groundwater levels in wells and reduce flows in creeks and
streams, leading to a potential for decline in habitat and ecosystems. These findings demonstrate the
need for careful monitoring and management of groundwater and surface water in the Plan area to
provide a sustainable supply of water for groundwater users and the environment.
The Panel developed the Santa Rosa Plain Groundwater Management (Plan) through monthly meetings
and sub - committee discussions of topics including groundwater management goals and objectives, a
monitoring framework, and groundwater management implementation actions. The Panel also
developed a Charter outlining Panel member roles, responsibilities' and functions, and a Governance
Proposal that describes the governance structure for Plan implementation. The Panel formed a TAC to
review and present plan elements to the Panel for discussion and approval during the monthly
meetings.
During Plan preparation, the stakeholders discussed the uncertainties and data gaps related to the
current knowledge of groundwater conditions in the Santa Rosa Plain Watershed area. The Plan
identifies those uncertainties and prioritizes the efforts that will be required to develop needed
information. Stakeholders also recognize that funding sources must be identified for supporting studies
and monitoring programs that will enhance the understanding of groundwater conditions in the Santa
Rosa Plain Watershed area. The Plan recommends a range of voluntary water management actions to
achieve the stated goal, which are grouped into seven major components: (1) Stakeholder Involvement
and Public Awareness; (2) Monitoring and Modeling Program; (3) Groundwater Protection; (4) Increase
Water Conservation and Efficiency; (5) Increase Groundwater Recharge; (6) Increase Water Reuse; and
(7) Integrated Groundwater Management.
Program Implementation
Implementation of the Santa Rosa Plain Groundwater Management (Program) is structured to
encourage an open, collaborative and cooperative process for groundwater management activities, and
to maximize coordination of the many future actions envisioned by the Panel. Studies, projects, and
programs conducted under the Plan may be implemented by one or more lead agencies (the Water
Agency or other agencies), following input or guidance from the Panel and a supporting TAC.
The first two years of Program implementation funded under this Agreement focus on core
implementation components, including stakeholder involvement and monitoring, which under the
Water Code define the Plan's eligibility for state funding for groundwater projects. Specific tasks to be
conducted under the Agreement include:
• Preparation of outreach materials for initial plan implementation.
• Organization, preparation of materials and work products for 8 Panel meetings and 12 TAC
meetings.
• Initial development of existing data compilation framework and monitoring and reporting
protocols.
• Organization of voluntary groundwater level monitoring program and evaluation of
groundwater level data.
• Development of groundwater quality data compilation and reporting framework.
• Coordination of data management and preparation of annual reports.
• Develop and run management scenarios, in consultation with the Panel, using the computer
model (GSFLOW) developed for the Plan area by the United States Geological Survey.
During Program implementation, the Water Agency and the Panel will continue to prioritize and develop
other Plan components, and seek funding and leveraging opportunities for implementing recommended
actions, outreach, coordination, and partnerships. The Program also serves to coordinate all sorts of

projects, actions and activities conducted by local agencies, non - governmental organizations (NGOs),
and private parties as appropriate, to assist in collaborations and leveraging of limited resources.
The Water Agency and Participants have negotiated a projected cost sharing for implementing the Santa Rosa
Plain Groundwater Management Program (Program) for two years. The total cost for implementing the study
for the first two years is estimated to be approximately $600,000 which covers technical consultants ($215,000),
facilitation services ($115,000) and Water Agency staff costs ($270,000) for the core actions associated with
implementing the Plan, including stakeholder involvement, monitoring and scenario modeling. The cost sharing
associated with this Agreement is for $330,000 over the two years and does not include Water Agency staff
costs.
