A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK
INCREASING THE AUTHORITY OF THE CITY MANAGER TO EXECUTE CHANGE
ORDERS TO FIFTEEN PERCENT (15 %) OF THE ORIGINAL CONTRACT AMOUNT
TO ALLOW FOR ADDITIONAL PAVING WORK ON ROHNERT PARK
EXPRESSWAY (CITY PROJECT NO. 2004 -08)
WHEREAS, on May 27, 2014, the City Council adopted Resolution No. 2014 -050
adopting the plans and specifications for the Rohnert Park Expressway Water Main Project No.
2004 -08 and approved a resolution awarding the contract to Argonaut Constructors Inc., for an
amount of $1,462,535.00; and
WHEREAS, the City Manager is authorized to execute Contract Change Orders (CCOs)
up to ten percent (10 %) of the original contract amount on City Capital Improvement Projects;
and
WHEREAS, as of October 28, 2014, the City Manager has authorized $134,476.64 in
CCOs, which represents 9.2% of the original contract amount; and
WHEREAS, staff expects that an additional $70,000 is needed to allow Argonaut
Constructors Inc. to complete paving on Rohnert Park Expressway, in the railroad right -of -way;
and
WHEREAS, the paving will complement the work that the City plans to do with the
Rohnert Park Expressway Rehabilitation Project (City Project No. 2013 -01) beginning in the
spring of 2015; and
WHEREAS, the Rohnert Park Expressway Rehabilitation Project includes a federal
funding component that will prohibit work in the railroad right -of -way; and
WHEREAS, the Rohnert Park Expressway Water Main Project does not have the same
funding restrictions and can efficiently accomplish the work in the railroad right -of -way,
concurrent with repaving the water main trench; and
WHEREAS, the City Council determined that the Project is exempt from the
requirements of the California Environmental Quality Act (CEQA) pursuant to the following
authorities: Section 21080. 21 of Title 14 of the California Code of Regulation and section
15282( k) of the CEQA Guidelines for public right -of -way pipeline projects less than one mile
in length because the Project involves construction of a water main approximately 4800 feet long
entirely within the preexisting right of way of Rohnert Park Expressway. Construction of the
water main requires trenching beneath and repaving Rohnert Park Expressway, therefore the
change order for repavement of a portion of this right of way is within the scope of the
exemption, and would also be exempt pursuant to section 15301 of the CEQA Guidelines for
repair and maintenance to existing highways and streets, sidewalks, gutters bicycle and
pedestrian trails and similar facilities.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Rohnert Park,
does hereby find that the authorization of this change order is a minor modification of the prior
approval of the Rohnert Park Expressway Water Main Project and is statutorily exempt from
compliance with CEQA.
BE IT FURTHER RESOLVED that the City Council does hereby authorize the City Manager
to execute Contract Change Orders up to fifteen (15 %) of the original contract amount and other
documents pertaining to the same for and on behalf of the City of Rohnert Park.
