Tuesday
The concurrent meetings of the City of Rohnert Park for
the City Council, the Community Development Commission,
and the Rohnert Park Financing Authority met this date
in regular session for a regular meeting to commence at
7:00 p.m. in the City Offices, 6750 Commerce Boulevard,
Rohnert Park, with Mayor Mackenzie presiding.
CALL TO ORDER:
Mayor Mackenzie called the regular session to order
at 7:24 p.m. and led the pledge of allegiance.
ROLL CALL:
Present: (5) Councilmembers Reilly, Spiro and
Vidak- Martinez; Vice Mayor Flores; and
Mayor Mackenzie
Absent: (0) None
Staff present for all or part of the meeting: City
Manager Netter, City Attorney Strauss, Assistant City
Manager Donley, Planning and Community Development
Director Kaufman, Public Works Manager Stephens,
Recreation Director Barry, Building Official Braun,
Fire Commander Cassel, and Fire Inspector Busch.
WORK SESSION:
A work session commencing at approximately 6:00 p.m. was
held in the Conference Room to discuss the Department of
Public Safety's "Workload Study Patrol Division, 1996-
1999." Director of Public Safety Miller reviewed the
Workload Study, and staff responded to Council questions.
1. MAYOR'S REPORT ON CLOSED SESSION:
Mayor Mackenzie reported on the closed session which
commenced at approximately 6:40 p.m. to discuss matters
listed on the agenda attachment, representing an update.

1. Sonoma County Housing Advocacy Group vs City of
Rohnert Park: Nothing to report.
2. Las Casitas de Sonoma vs. City of Rohnert Park:
Nothing to report.
3. South County Resources Preservation Committee vs
City of Rohnert Park: Nothing to report.
4. Kao vs. City of Rohnert Park: Nothing to report.
EMERGENCY MOTION:
At this time, Mayor Mackenzie ANNOUNCED that State
Assemblymember Joe Nation was present at the meeting.
Upon MOTION by Councilmember Vidak- Martinez, seconded
by Vice Mayor Flores, an EMERGENCY MOTION was
UNANIMOUSLY APPROVED to have an Unscheduled Appearance
from Assemblymember Joe Nation.
UNSCHEDULED APPEARANCE:
Assemblymember Joe Nation greeted the Councilmembers and
the public, and he gave a brief update on the matters in
Sacramento, including the energy issue and the reduction
in energy consumption as well as the cost of spot power.
He also discussed the State budget, particularly per -pupil
funding in K -12 and local government funding. He noted
that he had just received funding for his Select
Committee on North Bay Housing and Transportation.
Mr. Nation invited the public to contact him or his
District Director, Judy Joseph, at the Sonoma County
number, 707 938 -8157. He discussed future scheduling of
sidewalk office hours, pancake breakfasts, and Education
Kitchen Cabinets.

Upon MOTION by Councilmember Spiro, seconded by
Councilmember Vidak- Martinez, the Special 2001 -2002 Budget
Work Session minutes of May 18, 2001, and the Regular
Concurrent City Meetings minutes of May 22, 2001, were
APPROVED AS SUBMITTED 4 -0 -1 with Councilmember Reilly
abstaining only for the Special 2001 -2002 Budget Work
Session of May 18, 2001.
Upon MOTION by Councilmember Vidak- Martinez, seconded by
Vice Mayor Flores, the Special Meeting /Golf Course minutes
of May 29, 2001, were APPROVED AS SUBMITTED 4 -0 -1 with
Councilmember Spiro abstaining.
3. COUNCIL COMMUNICATIONS, IF ANY (INFORMATIONAL ONLY):
Mayor Mackenzie asked the Councilmembers if there were
any informational communications to add to the agenda.
* Councilmember Vidak- Martinez noted that she was still
interested in receiving the memos, which were requested at
the May 8, 2001, Council meeting, from the new department
heads regarding their accomplishments since taking office
as well as description of their new projects.
4. INTRODUCTION AND WELCOME TO NEW EMPLOYEES:
*STEVE DONLEY, ASSISTANT CITY MANAGER
*DEBORAH LAUCHNER, FINANCE SERVICES MANAGER
Prior to introducing the new City employees, Mayor
Mackenzie expressed the Council's best wishes for
long- standing City Commissioner Marie Vinsick, who was
hospitalized with a serious illness. The Mayor
DIRECTED STAFF to send a letter under his signature.
Assistant City Manager Steve Donley was welcomed by
the Council and shared brief comments on his
background. Next, Finance Services Manager Deborah
Lauchner was greeted and spoke briefly about her
background.
5 -A. YOUTH REPRESENTATIVES TO THE CITY COUNCIL FROM HIGH
SCHOOL 2000 -2001 YOUTH OF THE YEAR PROGRAM
SELECTIONS:
1. Senior Samantha Tabacco and Junior Ryan Inlow were
recognized. Senior Alex Teicheria was not present.
The youth representatives shared the contents of the
Youth Report. Highlights included the following:

(1) Update on the success of The Vision Teen Center;
thanks for Council and community support.

Councilmembers congratulated Ms. Tabacco on her
acceptance to U.C. Berkeley. Councilmember Spiro
APPEALED TO THE COMMUNITY for adult participation in
the upcoming Project Graduation program. She noted
that anyone interested in a night shift should call

Councilmember Reilly REQUESTED continuing input from
the teens on the status of The Vision Teen Center.

Mayor Mackenzie asked if there were any questions about
the matters on the Consent Calendar, which were explained
in the City Manager's Council Meeting Memo. No Consent
Calendar items were pulled for further discussion.
Mayor Mackenzie noted for Item 6, "Scheduled
Appearances /Presentations" on tonight's agenda, that the
folders would contain copies of the unsigned resolutions
and the executed originals would be forthcoming to the
recipients.

Presentation on the Sonoma / Marin Area Rail Transit
(S.M.A.R.T.) Commission's Commuter Rail Implementation
Plan: Mr. Fox gave an informative slide presentation
following written materials DISTRIBUTED to the Council
regarding the Final Report on the Commuter Rail
Implementation Plan for Sonoma and Marin Counties.
Mr. Fox responded to Council inquiries at the
conclusion of the presentation.
7. UNSCHEDULED PUBLIC APPEARANCES:
Mayor Mackenzie stated that in compliance with State law,
The Brown Act, citizens wishing to make a comment may do
so at this time, limited to 3 -5 minutes per appearance
with a 30- minute limit. No citizens came forward at this
time.
8. SB 910 (DUNN) - CONSIDERATION OF SB 910 - HOUSING
ELEMENTS, FINES, PENALTIES, AND LITIGATION, STATE
SEIZURE OF LOCAL GAS TAX FUNDS:
*Council Discussion /Action: City Manager Netter gave
an overview of the staff report provided to the
Council in their agenda packets.
Upon MOTION by Councilmember Vidak- Martinez, seconded by
Vice Mayor Flores, a motion to DIRECT STAFF to write a
letter, under the Mayor's signature, opposing SB 910 and
to be delivered to the State Assembly, was UNANIMOUSLY
APPROVED.
RECESS: Mayor Mackenzie declared a recess at
approximately 8:34 p.m.
RECONVENE: Mayor Mackenzie reconvened the Council at
approximately 8:42 p.m. with all of the
Councilmembers present.
9. LIBRARY PROJECT - CONSIDERATION OF SELECTION OF ARTISTS
TO COMPLETE A MURAL IN THE CHILDREN'S SECTION OF THE
NEW LIBRARY:
1. Council Liaison Report: Vice Mayor Flores shared brief
remarks on the Library Committee's selection of the
three artist finalists.

3. Council Discussion /Action: Council discussion centered
around the timing and budgeting of the project, as well
as possible additional mural locations in the new
library. Lynne Conde, Library Mural Committee Chair,
responded to Council inquiries about the timing of
the library construction around the mural work.
Upon MOTION by Vice Mayor Flores, seconded by
Councilmember Vidak- Martinez, a motion was made to select
Robert Eisenberg as the designer and artist for the mural
in the dome of the new library's children's section, with
a pledge for the Library Subcommittee to work with the
other two artists to have their work represented in the
new library /city hall. A FRIENDLY AMENDMENT was made by
Councilmember Reilly and accepted by the maker of the
motion and the second to have staff review the feasibility
of the proposal and the application for the dome mural.
Said motion was UNANIMOUSLY APPROVED.
10. FEE SCHEDULES FOR PERMIT AND INSPECTION FEES:
1. Staff Report: City Manager Netter gave a brief summary
of the new fee schedules each provided to the Council
in the agenda packets. Planning and Community
Development Director Kaufman shared the contents of the
staff report and DISTRIBUTED a handout entitled,
"Changes to the Budget based on the New Fee Schedules."
Building Official Braun shared the contents of the
Building Department staff report. Finally, Fire
Inspector Busch discussed the staff report regarding
fire prevention fees. Staff responded to Council
questions.

Councilmember Vidak- Martinez REQUESTED that a report from
staff regarding fire inspection provisions be considered
as an emergency agenda item this evening to be brought
back as an action item at the next meeting. After comments
from City Attorney Strauss, Mayor Mackenzie indicated
that Councilmember Vidak- Martinez' request for a report
would be considered for emergency item addition to this
evening's agenda under Item 19, "Matters from /for
Council." Furthermore, Councilmember Reilly clarified
that the "Grand Total" figure on the Budget handout from
Director Kaufman for "Total Increase Over FY 100 -01"
should reflect $145,750, rather than $135,750.

At this time, Mayor Mackenzie OPENED the Public Hearing at
9:55 p.m. There being no citizens desiring to speak on
this item, the Mayor CLOSED the Public Hearing at
9:55 P.M.

11. PLANNING AND ZONING MATTERS:
*Amendments to the Housing Element and Land Use and
Growth Management Element of the Rohnert Park General
Plan - RECOMMEND PUBLIC HEARING BE RECONVENED TO
JUNE 26, 2001:
1. Staff Report: Mayor Mackenzie stated the staff
recommendation to carry this item over to the Council
meeting on Tuesday, July 10, 2001. Based on staff
recommendation, Council CONCURRED TO HOLD OVER this
item to the Tuesday, July 10, 2001, Council meeting.

Tuesday, July 10, 2001.

12. GENERAL PLAN IMPLEMENTATION PROGRAM - MATTERS RELATED
TO THE GENERAL PLAN IMPLEMENTATION PROCESS, IF ANY:
1. Staff Report: City Manager Netter indicated that the
staff report will be shared at the next Council meeting
on Tuesday, June 26, 2001.
2. Other informational items, if any: Mayor Mackenzie,
Councilmember Vidak- Martinez, and City Attorney Strauss
updated the Council on the draft letter regarding
expansion of the City's Sphere -of- Influence sent to
Supervisors Smith and Kerns. City Attorney Strauss
discussed recent staff meetings with L.A.F.C.O. staff,
and she elaborated on the agreements outlined in the
draft letter that will come back for Council review
as more formal draft agreements.
Councilmembers REQUESTED STAFF (1) to seek further
clarification between parties in the future regarding the
availability to the public of draft documents; and (2)
to ensure that any such draft documents available to the
public are sent to the Councilmembers in a timely manner.
EXTEND COUNCIL MEETING:
Upon MOTION by Vice Mayor Flores, seconded by
Councilmember Vidak- Martinez, a motion to extend the
meeting past 10:00 p.m. to finish necessary agenda items
was UNANIMOUSLY APPROVED at approximately 10:10 p.m.
13. BUDGET MATTERS - REVIEW DECISIONS FROM CITY COUNCIL
BUDGET WORK SESSION ON JUNE 8, 2001:
City Manager Netter recapped Council and staff discussion
from the June 8, 2001, Budget Work Session as outlined in
the Budget Work Session minutes provided to staff in the
agenda packet. The City Manager then responded to Council
inquiries.

Council CONCURRED to conduct the next Budget Work Session
on Wednesday, June 20, 2001, at 6:00 p.m.
14. REDISTRICTING:
1. Staff Report: City Manager Netter referenced the staff
report provided to the Council in their agenda packets.
2. Council Discussion /Direction:
Councilmember Spiro made a MOTION to send a letter to the
Supervisorial Redistricting Advisory Committee in support
of Option 3 as outlined in the staff report. Said motion
DIED FOR LACK OF A SECOND.
Council CONCURRED on two matters: (1) To place this item
on the next Council agenda; and (2) To request a staff
recommendation on the redistricting options. City Manager
Netter noted that the decision on redistricting may be
decided prior to the next Council meeting.
15. PARKS AND RECREATION MATTER - CONSIDERATION OF
APPLICATION FOR GRANT FUNDS FOR THE PER CAPITA GRANT
PROGRAM UNDER THE SAFE NEIGHBORHOOD PARKS, CLEAN WATER,
CLEAN AIR, AND COASTAL PROTECTION BOND ACT OF 2000:
1. Staff Report: City Manager Netter recapped the staff
report provided to the Council in the agenda packets.
2. Council Discussion /Action:

2001 -131 APPROVING APPLICATION FOR GRANT FUNDS
Upon MOTION by Councilmember Vidak- Martinez, seconded by
Vice Mayor Flores, Resolution 2001 -131 was UNANIMOUSLY
APPROVED BY ROLL CALL VOTE.
16. COUNCIL COMMITTEE AND /OR OTHER REPORTS:
1. Executive Sub - Committee Meeting June 4 2001: Mayor
Mackenzie reported briefly on the discussion of budget
items and the arrival of the new Assistant City
Manager, Steve Donley.

2. Canon Manor Committee Meeting, Mav 31, 2001: Mayor
Mackenzie and Councilmember Vidak- Martinez reported
on several matters related to the meeting: (1) Update
on Assessment District Status report from Dave Knight,
Sonoma County Director of Public Works; (2) Ad Hoc
Committee's recommended support for assessment
district with possible annexation as a long -term goal;
(3) Arrangements in progress for Director Knight and
his staff to make a full presentation to the Council
in July regarding the assessment district and sewer
hook -up fees and ongoing maintenance.
3. Restorative Justice Meeting: Councilmember
Vidak- Martinez shared the contents of the informational
packet, provided to the Council, outlining a new
way of approaching working with youth that focuses
on accountability and the community's role in getting
young people to turn their lives around in a productive
manner.
4. Local Government Commission Board of Directors Meeting,
June, 2,2001: ITEM DEFERRED.
5. Sonoma State University Joint Meeting, May 29, 2001:
Mayor Mackenzie reported on the joint meeting, and
Council CONCURRED to send a letter to SSU President
Arminana thanking him for the hospitality, requesting
his support for the City's Sphere -of- Influence change
with L.A.F.C.O., and pledging Council support to work
with him around issues relevant to Sonoma State
University.
17. TRANSPORTATION MATTERS:
*Sonoma County Transportation Authority Ad Hoc Committee
Report: Mayor Mackenzie reported that the focus of the
upcoming July meeting will be placement of a sales tax
measure on the November, 2001, ballot to support
alternative modes of transportation in Sonoma County.
For City Attorney Strauss, he noted that the Deputy
Counsel from Sonoma County would be contacting her
regarding any necessary C.E.Q.A. action prior to
putting a ballot measure on in November of 2001.
18. COMMUNICATIONS:
Communications per the attached outline were brought to
the attention of the Councilmembers.

* Councilmember Vidak- Martinez directed attention to
Item EE, a letter from Mr. William Canning regarding
a vehicle injury and a request for immediate traffic
control at Golf Course Drive and Halcyon Place.
Mayor Mackenzie DIRECTED STAFF to follow up on this
traffic matter.
19. MATTERS FROM /FOR COUNCIL:
1. Consider handling of requests for resolutions from
organizations with implications of international
activities: Mayor Mackenzie noted that he does not
desire to handle these types of resolutions which
carry international implications.
2. Agenda Item Transmittal Reports: Council CONCURRED
with the suggestion of Councilmember Vidak- Martinez to
AGENDIZE this matter of reconfiguring the Staff Memos
to include the City Manager's recommendation.
3. Local Government Commission request for appointing a
local government staff member - "Watt's Going On
California ? ": Council CONCURRED with the suggestion of
Mayor Mackenzie to AGENDIZE this item about energy
programs for full Council discussion.
4. Mayors' & Councilmembers' Association City Selection
Committee & General Membership Meeting, 6.30 p.m.,
June 14, 2001, representation considerations:
*ABAG Executive Board: Mayor Mackenzie reiterated
Council direction for him to support Bryant Moynihan
from Petaluma for this appointment.
*County Agricultural Preservation & Open Space District
Advisory Committee: Current appointments held by
Harold Berkemeier, Cotati, and Mayor Mackenzie, Rohnert
Park;
and
*JPA Sonoma /Marin Area Rail Transit Commission: Current
appointments held by Robert Jehn, Cloverdale, and Matt
Maguire, Petaluma;
Council CONCURRED to DIRECT Mayor Mackenzie to support the
current representatives for all of the appointments to
which the Council has not given specific directions.

5. Traffic Calming Workshop, Saturday, Julv 14, 2001:
Mayor Mackenzie noted this INFORMATIONAL ITEM and
DIRECTED the City Manager to come back with a detailed
itinerary for either a half day or a full day,
including a possible trip to the field.
6. Japanese Students Visit /Reception July 31, 2001,
1.00 p m , Public Safety Training Room: Mayor
Mackenzie noted this INFORMATIONAL ITEM and indicated

and Vice Mayor Flores will report back on his

7. Las Casitas Homeowners Association Open House,
6.30 -8.30 -P.m., June 14, 2001: Mayor Mackenzie noted
this INFORMATIONAL ITEM, and Vice Mayor Flores
indicated that he will attend for the Mayor who will
be at the Mayors' & Councilmembers' Association
meeting.
8. Citv Attorney's review of meeting briefing on LAFCO &
Cortese -Knox: City Attorney Strauss referred Council
to her staff report provided in the agenda packets.
Council CONCURRED to bring this item back for full
Council discussion at such time as matters relating
to this agreement arise.
At this time, City Attorney Strauss DISTRIBUTED an
informational memo regarding the decision in the Howard
Jarvis Taxpayers Association v City of La Habra. She
noted that this decision has implications for the City's
taxes.
EMERGENCY MOTION CONSIDERATION:
Upon MOTION by Councilmember Vidak- Martinez, seconded
by Vice Mayor Flores, a motion was made to add to this
evening's agenda consideration of a request for a staff
report on fire inspection provisions /services to come
back as an action item on the following Council agenda.
Said motion FAILED 3 -1 with Councilmember Reilly
dissenting and Councilmember Spiro absent.

FOR THE RECORD, Councilmember Reilly stated that he does
not believe the request for a fire inspection provisions
report merits emergency action. However, he noted that it
is a good topic worthy of full Council review. He
reminded Council of the procedures for adding agenda items.
Furthermore, he added that little can be done in two weeks'
time without a budget in place if a staffperson is
considering employment in another jurisdiction.
20. CITY MANAGER'S REPORT:
1. City Hall Project - Status Report: City Manager Netter
referred to the memo provided to the Council in the
agenda packets, and he noted that the floor plan and
exterior design will be considered at a meeting
tomorrow with Fisher Friedman Associates.
2. Maqnolia Park Pool Grand Opening 6.00 p.m., Friday,
June 22, 2001: INFORMATIONAL ITEM. Councilmember
Reilly noted that he will try to attend the function.

ANNIVERSARY OF THE PASSAGE OF PROPOSITION 20 -
THE CALIFORNIA COASTAL ACT
Mayor Mackenzie informed the Council of the Board of
Supervisors' request for consideration of Resolution No.
2001 -132 as an emergency item to allow preparation time
for the next Coastal Commission meeting on July 11,
2001, in Sonoma County.
Upon MOTION by Councilmember Vidak- Martinez, seconded by
Vice Mayor Flores, a motion to declare consideration of
Resolution No. 2001 -132 an EMERGENCY ITEM was APPROVED
4 -0 -1 with Councilmember Spiro absent.
