1993/01/25 City Council MinutesRohnert Park City Council Minutes t January 25, 1993 - Adj.Reg.Meeting- Work Session on Sonoma County Waste Management Agency (SCWMA) - RE: Wood Waste and Composting Facility (including a proposed letter of intent with the selected provider). CALL TO ORDER Mayor Hollingsworth called the meeting to order at approximately 6:10 p.m. and led the Pledge of Allegiance. ROLL CALL Present: (5) Councilmembers Eck, Gallagher, Reilly, Spiro and Mayor Hollingsworth. Absent: (0) None. Staff present for all or part of the meeting: City Manager Netter and Assistant to the City Manager Leivo. Also, the Executive Director of Sonoma County Waste Management Agency (SCWMA), Mr. Ken Wells, was present. UNSCHEDULED PUBLIC APPEARANCES None. ITEMS FOR DISCUSSION The work session commenced on the Sonoma County Waste Management Agency (SCWMA) regarding the wood waste and composting facility and proposed letter of intent with the selected provider. City Manager Netter briefly described the program and indicated that he had submitted to Council the complete binder which represented all of the documentation in regards to the procedures and the selection of the selected provider for the proposed wood waste and composting facility. He indicated the selection process was a long and involved process including many meetings, subcommittees and evaluating criteria. All in all, based on the selection criteria as outlined in the detail provided to the Council, Sonoma Compost /Empire Waste Management has been selected as the proposed provider. Mr. Netter communicated that Mr. Ken Wells was present and also Mr. Carl Leivo who sits as Chairman on the Rohnert Park City Council Minutes (2) January 25, 1993 t Joint Powers Authority was present to answer any questions the Council may have. Mr. Leivo is Rohnert Park's representative on the Joint Powers Authority. Mr. Ken Wells was then introduced and approached the podium and gave a complete summary of the process to date. Councilwoman Dawna Gallagher inquired what the makeup was of the Joint Powers Authority of which Mr. Wells indicated there were nine (9) city seats held by staff members and one County Representative seat which was held by the elected official on the Board of Supervisors, Ernie Carpenter. Councilwoman Gallagher inquired how these selections were made to which Councilman Eck indicated that the City of Rohnert Park City Council like all the other cities left the representation in the hands of staff because of the volume of detail and number of meetings required for this body. There was general discussion regarding the tipping fees and the cost differential between the Sonoma Compost /Empire Waste Management Proposal and the M & M Feed Proposal. Assistant to the City Manager Carl Leivo who is the Chairman of the Joint Powers Authority briefly summarized from his perspective the selection process and justified the Joint Powers Authority's selection of Sonoma Compost /Empire Waste Management as the best qualified, most scientific and best marketing program and proposal submitted. He indicated the M & M Feed Proposal was delinquent in many aspects and during the interview process, some of the answers given were not comprehensive and did not have a lot of prior thought in addressing the questions. This included the issues of contamination and M & M Seed's plan to screen for contaminants. There was general discussion among the Councilmembers which included questions of minimum payment guarantee, the bidding process, the cost of equipment and depreciation to make sure that cities weren't being charged twice and other questions and issues of operations and control. Eric Anderson, representing M & M Feed was acknowledged and indicated that he had a short Rohnert Park City Council Minutes (3) January 25, 1993 t video to show the Council. The Council gave permission to show the short video as long as it did not exceed 5 minutes. At this point Martin Millnick, owner of M & M Feed, proceeded to show the video which showed M & M Feed's operation at various sites both in Sonoma County and other counties in California. Following the video, Eric Anderson addressed the Council with his concerns regarding the selection process and requested the Council's reconsideration to give direction to the City's representative to not approve the continuation of the letter of intent with Sonoma Compost /Empire Waste Management. Councilman Eck indicated he is relying heavily on staff in regards to this matter. In addition, the Joint Powers Authority which includes one elected official, Ernie Carpenter, did approve this unanimously. There was various discussion among the Councilmembers which went into extreme detail regarding toxins in the compost and methods for removing contaminants in the compost. This was of prime concern as any contamination in the compost would reduce the marketability of the product which would ultimately destroy the revenue stream in the proposal. Public Comment Section Pavitra Crimmel commented that she runs the Rycycle Center at the central landfill site and is also on the County's Solid Waste Task Force. She indicated she would like to see the Task Force get involved with the selection process and indicated, in her opinion, the RFP was too large. She also would like to see the yard waste and the wood waste separated. Mr. Paul Paddock of Sonoma. Compost was acknowledged and discussed Sonoma Compost's operation and how they feel they could provide the best and most cost - effective municipal composting facility in the state. He indicated that by joining Empire Waste Management, which would handle mainly the incoming sorting and grinding portion of the project, then Sonoma Compost would take over and provide their expertise. Rohnert Park City Council Minutes (4) January 25, 1993 Kevin Wallbridge of Empire Waste Management was acknowledged and indicated that his company would mainly be providing operations and maintenance of equipment and would leave the composting expertise to Sonoma Compost. He indicated that the process will be elongated due to the state - permitting requirements at all municipal composting facilities. He indicated Empire Waste Management along with Sonoma Compost had been working for over three (3) years on a pilot program in Santa Rosa of which they derived a lot of their statistics and costs in the proposal. Keith Hallock approached the Council and inquired if the composting was contaminated, who would bear the cost? There was general discussion on contaminants in the compost and what would happen to the revenue stream if this happened. Councilman Eck indicated he was extremely concerned with contaminants in the compost as it could have a definite impact on the revenue flows that would impact the costs. Bill Baux representing Sonoma Compost was acknowledged and spoke about the composting process from a technical standpoint and indicated that the Back Yard Composting Program would not effect the Curbside Pick -Up Program and would augment the program. There was general discussions among Sonoma Compost, M & M Feed, Eric Anderson and the City Council on various topics concerning the composting facility, the Waste Management Agency and other matters. MOTION Upon a motion by Councilman Eck, seconded by Councilmember Spiro to direct staff to proceed in the general direction that the JPA is now going with the letter of intent, but to inform the members of the Joint Powers Authority of the issues raised at tonight's meeting, set timelines and goals for the program and keep the Council informed. This motion was approved on a vote of four affirmative and one no. Councilwoman Gallagher voted against the motion.
