1999/06/22 City Council MinutesRohnert Park City Council Minutes June 22, 1999 A special "Welcome'Reception" was held from 4:00 p.m. to 5:30 p.m., for the new City Attorney Betsy Strauss at the City Hall Lunch Room. Prior to convening the regular session of the Council of the City of Rohnert Park, the Council met in closed session to consider personnel matters, litigation matters, and real estate negotiations matters. The Council of the City of Rohnert Park met this date in regular session commencing at 7:00 p.m. in the City Offices, 6750 Commerce Boulevard, Rohnert Park, with Mayor Reilly presiding. CALL TO ORDER: Mayor Reilly called the regular session to order at approximately 7:22 p.m. and led the pledge of allegiance. ROLL CALL: Present: (5) Councilmembers Flores, Mackenzie, Spiro, Vidak- Martinez and Mayor Reilly Absent: (0) None Staff present for all or part of the meeting: City Manager Netter, City Attorney Betsy Strauss, Assistant City Manager Leivo, City Engineer Joe Gaffney, Planning & Community Development Director Wendie Schulenburg, Fire Services Director Bob Cassel, and, Finance Director /City Treasurer Michael Harrow, and Planning Consultant Lynn Goldberg. 1. CLOSED SESSION: Mayor Reilly reported that the Council met in closed session and that topics included: labor negotiations (the on -going negotiations with various bargaining units and management staff), and labors salary will be revisiting those issues as they come up during labor negotiations; discussion of the Recreation Department's suggested changes which are going back for further review; and, brief discussions with the City Attorney on East Cotati Ave neighbors law suit against the City of Rohnert Park and the Burbank Housing Authority. INTRODUCTION OF NEW CITY ATTORNEY: Mayor Reilly introduced the new City Attorney, Betsy Strauss and welcomed her as new staff to the City. MOMENT OF SILENCE: MAYOR REILLY CALLED FOR A MOMENT OF SILENCE IN MEMORY OF 'CLOVERDALE MAYOR, CAROL CHASE, WHO PASSED AWAY RECENTLY, AND EXTENDED CONDOLENCES TO HER FAMILY. ROHNERT PARK CITY COUNCIL MINUTES (2) June 22, 1999 Councilmember Mackenzie stated that Ms. Chase represented the City of Cotati on the Countywide Bicycle Advisory Committee and that she was a very warm and friendly human being and that she will be sorely missed. 2. APPROVAL OF MINUTES: Upon motion by Councilmember Flores, seconded by Councilmember Mackenzie, the Minutes of June 8, 1999 were unanimously approved as amended. 3. APPROVAL OF BILLS: Upon motion by Vice -Mayor Vidak- Martinez seconded by Councilmember Mackenzie, City bills presented per the attached list in the amount of $1,417,933.67 was unanimously approved. 4. ADDING INFORMATIONAL NON - AGENDAED MATTERS: Mayor Reilly asked Councilmembers or staff' if there were any non - agendaed informational items to add to the agenda. Councilmember Flores requested to add two items for discussion: (1) mobile home park owners proposal to the City Council; and (2), the Status of the Wellness Center. Mayor Reilly requested to address the issue of policy on signs going up on light poles in the City. Councilmember Spiro requested to report on the Senior Advisory Committee under Item No. 17. Council Committee & /or Other Reports. 5. YOUTH CITY COUNCIL REPRESENTATIVES from High School 1998 -99 Youth of the Year Program High School Representative Senior Angela Broaddus provided the youth report that included: • Expression of appreciation for summer break in lieu of all the emotional high school shooting tragedies, and loss of two Counselors at the school that have occurred this year on various high school campuses. • In preparation for next year school has grown in population and lot of changes to look forward to and prepare themselves for. • On the Youth of the Year Committee's Steering Committee will select New Youth of the Year Candidates with terms beginning for the July and August City Council Meetings. She stated that there are 12 candidates from whom 6 new members will be joining the program and city Council Meetings in July or August. • Project will include the development of a mission project; creating a possible youth job hotline, as well as to pursue other suggestions Councilmember Mackenzie suggested that the Youths of the Year re -visit the idea o formulating the Youth Advisory Task Force. He stated that this might be a worthwhil( project for the Youth of the Year to pursue. ROHNERT PARK CITY COUNCIL MINUTES (3) June 22, 1999 • Youth representative Angela Broaddus stated that the Youth of the Year Committee would consider the suggestion and submit comments to the Council. 6. SONOMA STATE UNIVERSITY ASSOCIATED STUDENT REPRESENTATIVE: Mayor Reilly asked if SSU Student Representatives were present. No one responded. 7. UNSCHEDULED PUBLIC APPEARANCES; Mayor Reilly stated that in compliance with State Law (The Brown Act), citizens wishing to make a comment may do so at this time (limited to 3 -5 minutes per appearance with a 30 minute total time limit). 1. Ms. Duggan: Ms. Duggan spoke on behalf of ZAP regarding the design and manufacturing of electric bikes /scooters. Ms. Duggan described the features of the bikes, noting that they are pollution free. She requested that the Council pass an Ordinance allowing the scooters to travel where regular bicycles are currently allowed to travel. She reported that approximately 25,000 of these scooters have been sold over the last five years. She pointed out that some of the other areas that have promoted alternative transportation in the form of electric bikes included: San Francisco, Petaluma and Sebastopol. Mayor Reilly stated that Councilmember Mackenzie would introduce this matter under Other Matters from the Council. Councilmember Flores requested that the Director of the organization provide a report to the Council, in addition to Councilmember Mackenzie's report. 8. CONSENT CALENDAR Mayor Reilly asked if there were any questions regarding the matters on the Consent Calendar that was explained in the City Manager's Council Meeting Memo. C O R R E C T 10 N ABOVE from 7/13/99 City Council meeting: Per Mayor Reilly (deletion lined out) It was the consensus of the Council to invite John Flitner to a Council meeting to formally present the Resolution to him so that he can personally accept the resolution honoring his retirement from the Office of City Attorney. 9. OTHER RESOLUTION FOR CONSIDERATION: AUTHORIZING AND APPROVING AN AGREEMENT WITH THE CITY OF COTATI FOR CITY OF ROHNERT PARK SERVICES RELATING TO ANIMAL CONTROL City Manager Netter summarized the staff report on this item, noting that the Agreement is for one year service at a fee of $10,000 a month with a 30 day cancellation notice policy. City Manager Netter recommended approval of the project. Councilmembers Mackenzie & Spiro suggested not to proceed with project until staff has formal discussions with FAIRE volunteers on this item and recommendation, and report back the findings. Councilmember Mackenzie requested to be notified of meeting date and time. Further discussion of this item was tabled until the next meeting. ROHNERT PARK CITY COUNCIL MINUTES (5) June 22, 1999 10. 1999 -2000 CITY BUDGET 1) Status Report on Budget Work Sessions City Manager Netter reported that 1999/2000 budget has been distributed. He noted that the staff report attached to the document outlines the changes to the budget. City Manager Netter stated that the total budget is $22.5 million dollars with an 8% General Fund Reserve. Finance Director /City Treasurer Michael Harrow briefly summarized the 1999/2000 budget and stated that the budget includes 10 additional staff positions. Finance Director /City Treasurer Harrow further summarized the changes to the budget, and noted that the balanced budget was outlined on page 3. 2) PUBLIC HEARING Mayor Reilly opened the public hearing at approximately 7:54 p.m. For the record, City Manager Netter acknowledged letter dated 6/16/99 from Ellen De Martini, Treasurer of the Rohnert Park Boys & Girls Club, for an additional request of $8,443.00 for additional summer staffing. MAYOR REILLY CLOSED THE PUBLIC HEARING AT 7:55 P.M. Upon motion made by Councilmember Spiro, seconded by Councilmember Mackenzie, the Council approved by a 3 -2 vote, with Mayor Reilly and Vice - Mayor Vidak - Martinez dissenting, to add $8,443 to the 1999/2000 City Budget for the above- reviewed additional summer staffing expenditure for the Boys & Girls Club. Resolution No: 99 -151 APPROVING AND ADOPTING A BUDGET FOR FISCAL YEAR 1999 -2000 Upon motion made by Councilmember Mackenzie, seconded by Councilmember Spiro, Resolution No. 151 approving and adopting a budget for fiscal Year 1999 -2000 was unanimously approved. 11. UNIFORM FIRE CODES - PROPOSED AMENDMENTS 1) Staff report City Manager Netter referred comments on this item to Public Safety Commander Bob Cassel. ROHNERT PARK CITY COUNCIL MINUTES (6) June 22, 1999 Public Safety Commander Cassel stated that the most significant singular change to the Code was that the Code would require full sprinkler systems for all single family detached dwellings. Mr. Cassel stated further that his department would continue to work on the project to assure that existing dwellings voluntarily install sprinkler systems. Mr. Cassel noted that he was opposed to hot spots. Mr. Cassel informed the Council that the Code is being modified to make the designs of the sprinkler systems more specific, and he recommended approval of the changes. City Manager Netter informed the Council that proper notices were posted for the public hearing, including noticing developers. 2) PUBLIC HEARING Mayor Reilly opened the public hearing at approximately 8:06 p.m. Public Sneakers Mr. Robert Anderson spoke briefly regarding the qualifications of his company. Mayor Reilly closed the public hearing at 8:09 p.m. 3) Urgency Ordinance for introduction: Ordinance No.: No. 651 REPEALING AND REPLACING CHAPTER 15.28 OF THE ROHNERT PARK MUNICIPAL CODE ADOPTING THE 1998 EDITION OF THE CALIFORNIA FIRE CODE, VOLUMES I and H and ADOPTING THE 1997 UNIFORM FIRE CODE, VOLUMES I AND H WITH CHANGES, ADDITIONS, AMENDMENTS AND DELETIONS AND DECLARING THE URGENCY THEREOF Upon motion by Councilmember Flores, seconded by Vice -Mayor Vidak- Martinez and unanimously approved, reading was waived, and Urgency Ordinance No. 651 was introduced. 12. FIRE SUPPRESSION BENEFIT ASSESSMENT DISTRICT 1) Staff report City Manager Netter summarized the Engineering Report provided to the Council. Resolution No.: 99 -152 SIGNIFYING THE COUNCIL'S INTENT TO CONSIDER AN INCREASE OF THREE PERCENT IN THE CITY OF ROHNERT PARK FIRE SUPPRESSION BENEFIT ASSESSMENT AND SCHEDULIGN A PUBLIC HEARING ROHNERT PARK CITY COUNCIL MINUTES (7) June 22, 1999 Upon motion made by Councilmember Mackenzie, seconded by Councilmember Spiro, and unanimously approved, reading was waived and Resolution No. 99 -152 was adopted. 13. BURBANK HOUSING PROPOSAL FOR "SCATTERED SITE" AFFORDABLE HOUSING (COUNCILMEMBER SPERO LEFT THE COUNCIL MEETING AT 8:14 P.M.) 1) Staff report City Manager Netter summarized the staff report submitted to the Council. City Manager Netter reported the matter has been set for hearing for July 2, 1999, City Manager Netter stated that either site is not in contract at this time and recommended that the matter be held over until the impacts of pending litigation matters are determined. City Manager Netter suggested that the City proceed with purchase of the 20 -unit site subject to conditions as outlined by City Attorney Strauss. 2) Memo from Nick Stewart, Burbank Housing Development Corp. Nick Stewart of Burbank Housing stated that he is optimistic that his organization will acquire both sites. He stated that basically Burbank Housing is unable to proceed without Council direction to do so. Councilmember Vidak- Martinez asked if a 20 -unit project is economically feasible and efficient. Councilmember Flores noted that he would be willing to proceed with proceeding contingent on the purchase agreements and contracts being in place. City Attorney Strauss recommended clarification of the following: 1) contingent upon confirmation of the dollars needed for tax credit application by June 25th or early July; 2) confirmation that the single project is feasible; 3) confirmation that the purchase agreement has been signed; and, 4) re- payment of the dollars to the City if construction does not commence by April 1, 2000 (changed to June 2001) Mr. Stewart commented that the date of April 1, 2000 could not be met. The Council and staff agreed to extend the date for commencement of construction to June 2001. Mayor Reilly suggested approval for one or both, and stated for record, that he does not think that the lawsuit has any merit from stopping the project. ROHNERT PARK CITY COUNCIL MINUTES (8) June 22, 1999 3) Council discussion /action Upon a motion made by Councilmember Mackenzie, seconded by Vice -Mayor Councilmember Vidak- Martinez, the Council approved by a 4 -0 vote, with Councilmember Spiro absent due to a possible conflict of interest, to proceed under the conditions recommended by the City Attorney (COUNCILMEMBER SPIRO RETURNS TO COUNCIL MEETING AT 8:30 P.M.) 14. REVIEW OF RECREATIONAL VEHICLES & EQUIPMENT STORAGE IN RESIDENTIAL AREAS Councilmember Spiro reported that she had received numerous calls regarding this issue. She reported that a document provided to her by a citizen entitled "RV Parking Manual Rights" outlined some good ideas on the issue. Councilmember Spiro suggested that a Committee be formulated by residents of the community consisting of both owners of RV's and non - owners of RV's. 1) Staff report Staff Lynn Goldberg, Planning Consultant, summarized the staff report on this item, which included a survey. She summarized some of the options for regulating the storage of vehicles and other items in residential areas. City Manager Netter noted that currently there is no criteria governing recreational vehicle and equipment storage regulations as outlined in the Municipal Code and that matters have been handled on an individual case basis. PUBLIC SPEAKERS: 1) Mr. Jim Cronin 205 Alma: Mr. Cronin expressed concern regarding RV parking, long -term street parking or storage in residential areas. He expressed opposition to creating a more restrictive parking policy /regulation. Mr. Cronin provided copies of manual for Council review. Stated current Ordinance is not enforced consistently. Requested Council review options as presented. 2) Mr. P. Adams 716 Brett Avenue: Mr. Adams stated he does not own an RV, or boat. Mr. Adams further stated that he is in favor of allowing residents to park on their lawns. Mr. Adams stated also that he was not aware of any designated areas in Rohnert Park to store recreational vehicles. Councilmember Spiro will be the Council liaison to work with Mr. Cronin and other volunteers with an advisory- working group, and it was suggested that each Councilmember recommend a participant to work on the matter. RECESS: MAYOR REILLY RECESSED THE CITY COUNCIL MEETING AT APPROXIMATELY 8:45 P.M. ROHNERT PARK CITY COUNCIL MINUTES (9) June 22, 1999 RECONVENE: Mayor Reilly reconvened the City Council at approximately 8:51 p.m. REPORT FROM SSU REPRESENTATIVE: Sonoma State University Representative Eric Karlson arrived at the meeting at 8:56 p.m. He stated that he is looking forward to working with the Council and that one of the major issues will be addressing the housing needs of the students. 15. WASTE MANAGEMENT ISSUES: 1) Informational Report on Santa Rosa Waste Management Proposal City Manager Netter noted that Assistant City Manager Carl Leivo has submitted a staff report on an update on this proposal. City Manager Netter summarized the key proposals as bulleted on the Staff report. City Manager Netter pointed out that the City's contract would expire in two years. City Manager Netter noted that a checklist is included in the report, which includes items that the Council may wish to consider as part of our upcoming negotiations in the year 2001. City Manager Netter suggested the need to formulate a `Waste Management Committee to work on this project. 2) Report on Waste Management Survey Councilmember Mackenzie and Vice -Mayor Vidak- Martinez volunteered to serve on the Waste Management Committee. 3) Report on Rohnert Park Franchise with Empire Waste Management (expires June 30, 2001) A representative reported that a management team of Empire Waste had a planning retreat a few weeks ago and provided several members of the Council with a survey of desires for additional services to review and consider. 16. COUNCIL YEAR 2000 PROJECT - MATTERS RELATED TO THE GENERAL PLAN PROCESS 1) General Plan Oversight Committee Update: Vice -Mayor Vidak- Martinez reported that the Ad Hoc Committee is attempting to meet the timeline as outlined on handout. She noted there has been little time to work on draft plan. Councilmember Mackenzie reported that an Ad Hoc Committee meeting is scheduled for tomorrow night on education with Rick Brown, Consultant, to discuss how to publicize the update of the General Plan process and keep the other Agencies informed. Time Line Status for General Plan Update Mayor Reilly noted that formal public hearings would be held in August, September and October. ROHNERT PARK CITY COUNCIL MINUTES (10) June 22, 1999 3) Other There were no other reports on this matter. 17. COUNCIL COMMITTEE & /OR OTHER REPORTS: 1) Cable TV Franchise & Other Issues Councilmember Flores reported that the Committee met last week to discuss the franchise renewal matter. Also discussed change of ownership situation. Issue of concern - implementation of 54 channels (concern with issue compliance that has not been met regarding delivering all 54 channels in Rohnert Park. Councilmember Spiro pointed out that the committee also requested a map of the area and clarification on how long the project will take to complete. Mr. Bill Adams thanked the Council for the invitation to speak. He stated they have met with TCI on the locations of the hookups and on the timeline. Mr. Adams further reported on the progress that has been made. He stated not going to 61 channels, and would add 10 -12 channels. Mayor Reilly requested that staff remind P.G. & E. -and PAC Bell that the City would like to have notification when they are working in the areas so that any new trenches could be jointly used. 2) Senior Citizens Advisory Committee Meeting: Councilmember Spiro reported on the Senior Advisory Committee stating that the annual blood pressure day drew some 6,134 visitors in April. Councilmember Spiro further reported that 433 seniors participated in the Tax Assistance Program and also reported on successful results of recent Seniors Dance. 3) Mobile Home Parks Matter: Councilmember Flores, suggested that the Council discuss the recent letter regarding Mobile Home Parks settlement discussions, as a Sub - Committee, schedule a meeting, and then report back to residents on the Committee's efforts. 18. TRANSPORTATION MATTERS: 1) Report on Bicycle Tour, June 12, 1999 Councilmember Mackenzie acknowledged summary report provided by Tim Barry, Recreation Director. Councilmember Mackenzie noted that participants were able to tour facilities first hand, He noted excellent tour of Senior Center and thanked staff Barry for organizing the activity. 2) Sonoma County Transportation Authority (SCTA), June 14, 1999 Meeting Councilmember Mackenzie requested that Joe Gaffney brief the Council on status of what has transpired since last meeting, ROHNERT PARK CITY COUNCIL MINUTES (11) June 22, 1999 Staff Joe Gaffney summarized the staff report provided to the Council. He stated that there is a meeting scheduled for early July to meet with representatives of Caltrans, Congresswoman Woolsey's office, the County and with Councilwoman Mazzonni. Staff Gaffney stated that staff would report back to the Council after the meeting. Councilmember Flores suggested that a letter be written to Congresswoman Woolsey to reconsider use of funds for park and ride construction. Councilmember Mackenzie volunteered to accompany staff Joe Gaffney to the meeting. 3) Other: There were no other matters to discuss under this item. 19. COMMUNICATIONS Vice -Mayor Vidak- Martinez referred to Communication #13 from Sonoma County Action Program regarding a Program for a Healthy & Safe Community she called attention to the inaccurate information and figures in the report as noted by Project of United Way and Sonoma Human Services Commission. 20. MATTERS FROM/FOR COUNCIL: 1) Cotati - Rohnert Park Unified School District Letter Regarding Proposed Joint Meeting with Rohnert Park City Council and City of Cotati City Council: Mayor Reilly acknowledged a letter received from Janice Heffron, Superintendent of Cotati Rohnert Park School District proposing possible meeting dates for the trustees to meet with the City Council (Oct 6, 7, 21, or 28th), and asked for preference of Council. Mayor Reilly asked if the Council wanted to meet with the City of Cotati. Flores suggested that the Council first meet solely with the School District. Councilmember Mackenzie suggested prioritizing items for discussion and meet on a regular basis. Councilmember Mackenzie stated that he is not opposed to meeting with City of Cotati and the School District. Vice -Mayor Vidak- Martinez agreed also to schedule a meeting including all parties. *She pointed out, for the record that the City Council was invited to a meeting the School District would host, and she agreed to meet with them. *C O R R E C T 10 N FROM 7/13/99 City Council meeting: Per Vice Mayor Vicki Vidak- Martinez (addition underlined) Mayor Reilly suggested that 2x2x2 Committee meet to discuss this matter to discuss item #1 of the School Board letter and bring back recommendations to the full Council. Following discussion on this item, it was the consensus to schedule an initial meeting with the 2x2x2 Committee, prior to meeting with the other interested parties. The Council also requested that meeting dates for the meeting be faxed and scheduled before October. ROHNERT PARK CITY COUNCIL MINUTES (12) June 22, 1999 2) Resolution Proposal In Support of Greater Public Access to the Open Spaces of Sonoma County: Councilmember Mackenzie requested that this matter be agendized for discussion at a future Council meeting as an action item. The Council concurred. 3) Ordinance Proposal Promoting the Use of Electric- Assisted Bikes and Scooters : Councilmember Mackenzie requested a formal discussion on proposed Ordinance be agendaed. He noted he would work with staff to develop the language for the Ordinance. 4) Letter proposal to Santa Rosa City Council Regarding Urban and Agricultural Use of Reclaimed Water from the Santa Rosa Subregional Waste Water System: Councilmember Mackenzie summarized his written report and stated that the City could benefit from the proposal. Councilmember Mackenzie requested a letter from the Council encouraging the City of Santa Rosa to investigate the storage proposal and consider supporting the proposal. 5) Request for Resolution Celebrating July 1 as A Day of Celebration in Scotland Councilmember Mackenzie informed the Council that he would be visiting Scotland, and stated he would bear a resolution on behalf of the City to the first Minister of the Scottish Parliament. Resolution No.: 99 -153 CELEBRATING JULY 1, 1999 AS A TRUE DAY OF CELEBRATION SCOTLAND Upon motion by Councilmember Flores, seconded by Vice -Mayor Vidak- Martinez and unanimously approved, reading was waived and Resolution No. 153 was adopted, Councilmember Flores suggested that names of all of the members of the Council b included on the Resolution and that it be mounted on a nice frame. The Council concurred. 6) League of CA Cities/North Bay Division Meeting, Yountville, Wednesday, June 30, 1999 Mayor Reilly announced this meeting. 7) Rohnert Park Wellness Center (RPWC): Councilmember Flores requested that staff provide the Council with a Status Report on the Wellness project at the next Council meeting. 8) Church Signs on City Property: Mayor Reilly suggested staff check into Church signs posted on city property. ROHNERT PARK CITY COUNCIL MINUTES (13) June 22, 1999 City Manager Netter stated that he would have staff Planning Director, Wendie Schulenberg report back on the process. 21. CITY MANAGER'S REPORT: 1) Consideration of Opening Ceremony for New M Park Tennis Courts City Manager Netter stated that he feels that it would be appropriate to have some type of event at the park. 2) Groundbreaking Ceremony for Expressway Overpass Proposed dates: July 7th, 8th, or 9th - Council to select date The Council unanimously recommended that July 8, 1999 at noon, be the preference date for the Groundbreaking Ceremony for Expressway Overpass. 3) Update on Canon Manor Review by County City Manager Netter reported that the County did authorize $12,000 for establishing the Assessment District. 4) Library & City Hall Projects - Update: City Manager reported that staff met with Library and City Architects. City Manager provided the Council with a timeline that included key dates as well as 11 questions to be considered by the Council, prior to the 7/13/99 meeting. City Manager Netter recommended that an hour and a half meeting with the Council be scheduled. Councilmember Spiro asked for clarification of when the Council will receive input from community on the design. City Manager Netter stated that committees would be formulated to address the design of the project. The Council recommended that the timetable be adjusted to assure public comment and involvement prior to any final decision on the design. Mayor Reilly suggested that a public hearing be held to approve a Schematic Design around 10/12/99. EXTENDING CITY COUNCIL MEETING PAST 10:00 P.M. Upon a motion made by Councilmember Flores, seconded by Councilmember Mackenzie, and unanimously approved to extend the City Council meeting past 1 0:00 p.m. to finish necessary agenda items. ROHNERT PARK CITY COUNCIL MINUTES (14) June 22, 1999 Councilmember Flores stated that public hearings could be incorporated into the timeline, as well as including suggestions and comments from residents on monthly bills. Mayor Reilly suggested the formulation of a City Hall Committee, City Manager stated that he would work with staff Joe Gaffney and the Architect to adjust the timeline to include public input. 5) Employee Appreciation Event; City Manager Netter announced an upcoming Employee Appreciation Event to be held on January 28, 2000, and asked Councilmembers to mark their calendars. 22. CITY ATTORNEY'S REPORT: 1) Items from Closed Session: There were no other matters to report under closed session. 2) Rohnert Park District matters: None.
