2003/09/23 City Council MinutesCITY OF ROHNERT PARK CONCURRENT MEETINGS MINUTES for: CITY COUNCIL COMMUNITY DEVELOPMENT COMMISSION September 23, 2003 Tuesday The Concurrent Meetings of the City of Rohnert Park for the City Council and the Community Development Commission met this date in Regular Session for a regular meeting to commence at 6:00 p.m. at the Spreckels Performing Arts Center, 5409 Snyder Lane, Rohnert Park, with Mayor Flores presiding. CALL TO ORDER /PLEDGE OF ALLEGIANCE: Mayor Flores CALLED the Regular Session to order at 6:03 p.m. The pledge of allegiance was not recited. ROLL CALL: Present: (5) Councilmembers Mackenzie, Spradlin and Vidak- Martinez; Vice Mayor Nordin; and Mayor Flores Absent: (0) None Staff present for all or part of the Regular Session: City Manager Leivo, City Attorney Strauss, Director Public Safety Bullard, Deputy City Clerk Hauff, and Managing Di.rector'Performing Arts Center McDougall. 1. SCHEDULED APPEARANCES /PRESENTATIONS: 1. Anita Felton re Citizens Against the Casino: Ms. Felton expressed concerns that the City Council has not been doing enough to stop the proposed casino next to Rohnert Park. She reiterated concerns about the casino's impacts on traffic, crime, and local businesses. She urged the Council to fight the casino with the same vigor as those who opposed the proposed site at Highway 37. 2. PUBLIC COMMENT: Mayor Flores stated that in compliance with State law, The Brown Act, members of the public wishing to make a comment may do so at this time. STUDENT REPORTS: SSU - Sonoma State University Associated Students, Inc_, Jennifer Wong,-Vice President, Legislative Representative: Ms. Wong was not present. 4. RESORT - CASINO MATTERS: 1. Staff Report on Negotiation Meetings: City Attorney Strauss gave a brief oral report on the negotiation meetings, and she discussed the applicability of the California Environmental Quality Act (CEQA) in terms of the proposed casino. ANNOUNCEMENT: City Manager Leivo announced that copies of the 9/23/03 Draft of the "Proposed Memorandum of Understanding between the City of Rohnert Park, California, and the Federated Indians of the Craton Rancheria" were being DISTRIBUTED to members of the audience. 2. Council Ad Hoc Committee Report and Recommendations: Councilmember Vidak- Martinez and Mayor-Flores shared the highlights of the proposed MOU with the Craton Rancheria, which includes the following: One -time payment of $2.664 million to the City at the start of the project, $5 million a year to the City in 12 monthly installments, $2 million a year to the Craton Rancheria Charitable Foundation for the City, financial assistance and cooperation in several road - widening projects, $2.25 million to build a new west - side Public Safety headquarters, $350,000 for a new City fire truck, $410,000 for new police cars, and a $700,000 contribution to fund a program to fight gangs and criminal activity in the City. Councilmember Mackenzie voiced his objection to the Ad Hoc Subcommittee's insistence on closed -door meetings since his request in July that such meetings be open to the public. He also expressed dissatisfaction with receiving the more detailed draft MOU at the beginning of this evening's meeting. He asked the Councilmembers what the rush was in placing the Resort - Casino matter on the agenda and requesting Council direction and /or action. *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINUTES September 23, 2003 Page(3 ) 3. Public Comments: Mayor Flores initially called forward Greg Sarris of the Graton Rancheria Tribal Council to share additional comments regarding the proposed MOU. Mr. Sarris discussed (1) the illegal termination of his tribe's reservation in the 19501s; (2) the unprecedented revenue - sharing agreement with the City, which, he noted, would be the Indians' money, not the Nevada investors' money; and (3) the chance to create a history of cooperation between Indians and non - Indians. Mayor Flores reminded members of the audience to be respectful of opposing points of view during the public comment period. Policy Direction from Council and /or Action on Ad Hoc Committee Recommendations: Councilmembers shared their perspectives. Vice Mayor Nordin noted that Councilmembers could not vote against a casino. Councilmember Spradlin cited past citywide controversies over various construction projects. Councilmember Vidak- Martinez defended location of a sovereign nation outside of Rohnert Park and outlined the steps leading up to tonight's draft MOU. Mayor Flores discussed the Council's responsibility to negotiate with the Tribe. Upon MOTION by Councilmember Vidak- Martinez, seconded by Vice Mayor Nordin, a motion (1) to approve the recommendations of the Ad Hoc Committee and (2) to DIRECT STAFF to prepare a Memorandum of Understanding between the City of Rohnert Park and the Federated Indians of the Graton Rancheria, was APPROVED 4 -1 with Councilmember Mackenzie dissenting. *City Council /Community Development Commission City of Rohnert Park *CONCURRENT MEETINGS MINUTES September 23, 2003 Page(7 ) Councilmember Mackenzie expressed his dissatisfaction at this evening's process as follows: (1) He indicated the resort - casino matter should have been agendized for a full Council discussion back in July and August as he had requested of City Manager Leivo and Mayor Flores; (2) He noted that he will file a complaint with the Sonoma County Grand Jury to investigate the Council's procedures in framing the MOU; and (3) He stated that he will work on higher governmental levels to get legislation in Congress to curb the current sovereign - state status of Indian tribes. Upon MOTION by Councilmember Vidak- Martinez, seconded by Councilmember Mackenzie, a motion to declare consideration of CDC Resolution 2003 -14 an emergency item due to time constraints was UNANIMOUSLY APPROVED. At the request of Councilmember Mackenzie, staff expressed a preference for Option 2. Water Issues Subcommittee, September 16, 2003, meeting: Councilmember Mackenzie and Mayor Flores shared brief updates on the following items: monitoring system, settlement with Penngrove, interest in seeking reparations for accidental clear - cutting of section of Copeland Creek, Collector 6, and water meters. 2. Sonoma County Waste Management Agency (SCWMA), September 17, 2003, meeting: Councilmember Mackenzie gave a brief updates on the Joint Powers Agreement, the Integrated Plan for Sonoma County, and Energy Commission grant monies. ANNOUNCEMENT: Mayor Flores announced that Vice Mayor Nordin left the meeting at 11:35 p.m. due to a family medical emergency. 3. Water Advisory Committee (WAC), September 22, 2003, meeting: Councilmember Mackenzie and Mayor Flores were not able to attend said meeting. 4. Other, if any: None. 10. PUBLIC COMMENT: 1. Tina Davalos, YWCA of Sonoma County, was recognized and, along with another representative from the YWCA, thanked Council for Resolution 2003 -224 which proclaims October, 2003, as "Domestic Violence Awareness Month." They noted that domestic violence does occur in Sonoma County, and they called attention to various projects and displays that will be in the County throughout October for "Domestic Violence Awareness Month." 2. Debbie K. Clarkson, 510 Corte Naranja, was recognized and stated that she does not want Rohnert Park to become a tourist destination with a resort - casino. She used the City of Sonoma as an example of the frustration of locals when their city becomes a tourist destination.
