The Concurrent Meetings of the City of Rohnert Park for
the City Council, the Community Development Commission, and
the Rohnert Park Financing Authority met this date in
Regular Session for a regular meeting to commence at
6:00 p.m. at the Rohnert Park City Hall Conference Room,
6750 Commerce Boulevard, Rohnert Park, with Mayor Nordin
presiding.
CALL TO ORDER:
Mayor Nordin CALLED the Regular Session to order at
6:00 p.m. in the Conference Room.
ROLL CALL:
Present: (5) Councilmembers Flores, Mackenzie (6:03 p.m.),
and Vidak- Martinez (6:04 p.m.); Vice Mayor
Spradlin; and Mayor Nordin

Civil Engineer Jenkins DISTRIBUTED AND REVIEWED a staff
report about Ladybug Park improvements. Councilmember
Vidak- Martinez recommended using Ladybug Park as a pilot
park for a spray park or other use. Council CONCURRED
to form an Ad Hoc Subcommittee to focus on rethinking
the use of Ladybug Park. Mayor Nordin APPOINTED
Councilmembers Vidak- Martinez and Mackenzie to said
Ad Hoc Subcommittee.
Alicia Park Tennis Court Reconstruction:
*Council agreed with staff's recommendation to put this
project on hold.
Neighborhood Traffic Calming - Ongoing program:
*Measures need to be taken on Adrian Drive this year
Civic Center Mini -Park Upgrade:
*Need to fence Civic Center Mini -Park
The Work Session concluded at 7:06 p.m.
REGULAR SESSION:
Council convened in Council chambers at 7:10 p.m., and
Mayor Nordin adjourned Council to Closed Session, which
covered Litigation Matters and Real Estate Negotiations.
Mayor Nordin resumed Regular Session at 7:45 p.m. and
led. the pledge of allegiance.
2. MAYOR'S REPORT ON CLOSED SESSION:
Mayor Nordin stated that there was nothing to report for
Closed Session.
3. SCHEDULED APPEARANCES /PRESENTATIONS:
1. Mayor's Presentation of Resolution honoring and
recognizing Josiah "Joe" Ouellette for his courage
in the face of grave danger as he saved the lives of
Jen Goodman and Tani Sanchez: Mayor Nordin indicated
that Mr. Ouellette was unable to attend this evening,
but he read the resolution honoring Mr. Ouellette and
stated that staff would send him a framed copy of
his resolution.

2. "Relay for Life" Manager Harry Rothman urging
participation in American Cancer Society efforts to
eradicate cancer with the Rohnert Park /Cotati Relay
for Life to be held at Rancho Cotate High School,
Saturday and Sunday, June 5 -6, 2004, 10:00 a.m. to
10:00 a.m.: Kelly Mills, a Relay for Life volunteer,
in the absence of Mr. Rothman, discussed the relay
and its goal to raise $60,000 this year.
4. STUDENT REPORTS:
SSU - Sonoma State University Associated Students,
Incorporated, by Jennifer Wong, Vice President,
Legislative Representative: Ms. Wong DISTRIBUTED
copies of The Star to Council, and she introduced
James J. Reilly III, the new SSU ASI representative.
Ms. Wong and Mr. Reilly announced that SSU's
graduation is May 22nd, reviewed the current Associated
Student Productions, and REQUESTED a copy of the General
Plan Map. Councilmember Flores thanked Ms. Wong for her
reports to Council and inquired about her plans after
graduation.
S. UNSCHEDULED PUBLIC APPEARANCES /COMMENTS:
1. Seamus Seanachaoi, 207 Southwest Boulevard, was
recognized and urged Council to support a stronger
police presence at Southwest Shopping Center to
address gang activity and rowdy youth. Council
DIRECTED City Manager Leivo to discuss this matter
with Director Public Safety Bullard.
2. Tom Thunderhorse, 7553 Bobbie Way, was recognized and
again REQUESTED Council to pass a resolution
providing for a flag on the Avenue of the Flags to
honor Native American veterans. He also discussed
the casino opponents' call for closer scrutiny of
possible hazardous materials on or near the casino
site. He noted that the Army Corps of Engineers
conducted tests, provided reports, and cleaned the
land under Rancho Verde Mobile Home Park before it
was built.
3. Peter Tscherneff, Sonoma County, was recognized and
expressed his views on a variety of current topics,
ranging from the issuance of drivers licenses to
Mexican immigrants to cruelty to animals. He called
for young people to take a more active role in
today's world.

4. Larry Esparza, 44 Verde Circle, was recognized and
indicated that though he has endured unkind remarks
from those who disagree with his anti - casino views,
he will not respond to such attacks. He also stated
that personal lives will not be an issue in his
campaign efforts unless there is a conflict of
interest.
5. Barbara Greene, P.O. Box 758, Cotati, was recognized
and stated she would wait to speak on Item 7.
6. Fred Soares, 4319 Primrose Avenue, Sonoma County, was
recognized and stated he would wait to speak on
Item 6.
6. PLANNING AND ZONING MATTER:
File No. 2003 -067SP - Consideration of a Preliminary
Specific Plan for the South Portion of the Northwest
Specific Plan area, bounded by Wilfred Avenue to the
north, Dowdell Avenue to the east, Business Park Drive
to the south, and Langner Avenue to the west (APN
045 - 073 -001 to -003, 045 - 074 -001 to -004, -006, -007,
-009 to -012, and -014 to -016):
1. Staff Report: City Manager Leivo shared opening
comments, and Senior Planner Bendorff reviewed the
contents of the Staff Report. Staff responded to
Council questions about the residential to commercial
ratio of the project, the timeline for the Specific
Plan, the need for improvements to the
Wilfred / Dowdell interchange, and concerns from local
landowners.
FOR THE RECORD, Councilmember Mackenzie inquired if there
is any connection between the Northwest Specific Plan and
the Southeast Specific Plan. Senior Planner Bendorff
responded that, as far as he knew, there was no connection.
Gordon Linden, representing Parsons Corporation of
Walnut Creek and Coordinator of the Northwest
Specific Plan, reviewed the proposal via a power
point presentation. Ken Blackman, also representing
the Northwest Specific Plan Area, responded to
Council questions about the phasing of the project
and the 68 acres north of Wilfred Avenue.
2. PUBLIC HEARING: Mayor Nordin opened the Public
Hearing at 8:32 p.m.

1. Fred Soares, 4319 Primrose Avenue, Sonoma County, was
recognized and stated that he feels the people living
in the vicinity have been alienated from the County
process. He also indicated that even though it
appears the project has gone through the necessary
process, there are concerns with traffic congestion,
the legitimacy of the tiger salamander study, water,
and the road connecting the project to Santa Rosa.
He noted that people bought homes in that a_rPa fnr
the open space, and he said Rohnert Park's City
seal is misleading and should have streets and cars
and houses depicted on it.
2. H.R. Downs, Penngrove, was recognized and reiterated
that the City has no proven resources to support a
project like this. He stated that the project has to
be based on the amount of water available. He said
he liked the design of the project, but at the time
of the EIR it must be proven that there is enough
water to support this project.
3. Lloyd Iverson, 4230 Hargrave Avenue, Sonoma County, was
recognized and stated that, as a property owner in the
area, he was not notified. He said that some people in
Sonoma County prefer to live in the open spaces, and he
shared a personal example of the City's eminent domain.
He called for the leadership of Rohnert Park to listen
and include the larger community in its decisions, and
he remarked that the general direction of the City
will meet resistance if an attitude of inclusion is not
promoted. Senior Planner Bendorff indicated that
although Preliminary Specific Plans do not require
notification, the City has used the Press Democrat to
notify the public. He also stated that he would send
future notice to anyone in the area who requested it.
4. Marilyn Blair, 4412 Langner Avenue, Sonoma County, was
recognized and stated that she believes her land is
within 300 feet of the project and she should have
been notified. She indicated she bought her land nine
years ago and her water has gone from ten gallons a
minute to 1/3 of a gallon per minute. She asked where
the water for the project would come from, and she
questioned the accuracy of the Vicinity Map. She
emphasized that she was very upset about not receiving
notification and that she would move'if the project
is built. Mayor Nordin informed Ms. Blair and everyone
in the Northwest area that Senior Planner Bendorff would
take their names and addresses to send them future
notices. Mr. Blackman noted that three meetings were
held with property owners within the area and that they
had been notified by certified mail.

Mayor Nordin closed the Public Hearing at 8:45 p.m.
3. Council Discussion /Direction:
Councilmember Vidak- Martinez commented that the location
of the park should be moved. She said she liked the
clustering idea for the project. She also commented on
inclusion and notification concerns, stating that
extensive meetings with plenty of notice were held for
the City's General Plan. She noted that meetings were
well attended and that the public said they wanted to
keep residential largely on the east side and commercial
on the west side. She also said that this information is
all documented.
Councilmember Mackenzie commented on the EIR process and
noted that Council will be looking closely at traffic
impacts in light of the casino site to the west. He said
the proposal falls into the City's General Plan language
on requirements of a Specific Plan, and he commended the
developers for their inventiveness with denser housing
and the protection of open space. In regard to citizen
concerns, he remarked that the City made every effort from
'96 through 2000 to publicize the direction it was going.
Councilmember Flores discussed the passage of the General
Plan in 2000 with its one - percent growth rate. He noted
that Specific Plans fill out the General Plan and that
developers need to sustain affordable housing for all
members of the community. He suggested the developers look
to providing beyond the 15- percent affordable housing
requirement. He said the City needs to be sure it has a
balance of commercial /industrial with residential. He also
stated that no projects mover forward unless sewer and
water can be provided.
Vice Mayor Spradlin said that the City is doing its due
diligence to protect its agricultural and open spaces
as well as to balance the need for commercial, industrial,
and residential. She said she feels the project meets
the housing requirements, and she called for thorough
planning in the provision of parks. She encouraged staff
to communicate with those property owners who will be
neighbors with the casino, and she suggested that all
landowners in the area come to the table and share their
input so the City can make well informed decisions.

Mayor Nordin encouraged staff to increase the affordable
housing for the project. He discussed a recent article
in the Press Democrat about Rohnert Park's rather slow
growth rate, and he made comparisons with other cities.
He asked staff to consider school children in the area
and to make sure street crossings will be safe for them.
Senior Planner Bendorff responded to a Council question
about timing of the Draft Specific Plan and EIR. He
stated that sometime next spring or summer said documents
should be ready.
7. STREAM MAINTENANCE PLANS FOR SUMMER 2004:
Consideration of Stream Maintenance Plans for Summer
2004 and directing staff to implement one of the five
options:
1. Staff Report: City Manager Leivo provided
preliminary comments. Assistant City Manager Donley
shared the contents of the Staff Report and
DISTRIBUTED a color diagram for Council
consideration. Staff recommended Option 4. Mike
Thompson, Deputy Chief Engineer for the Sonoma County
Water Agency (SCWA) reviewed the key issues and
alternatives, and he responded to Council questions.
Council REQUESTED to be notified of the schedule for
the Stream Maintenance Plan.
2. Public Comments:
1. Barbara Greene, P.O. Box 758, Cotati, was recognized and
SUBMITTED to Council a letter from the Sonoma Group of
the Sierra Club to SCWA regarding their proposals for
the management of urban creeks. As co -chair of the
Rohnert Park /Cotati Creek Council, she asked that her
creek group be properly noticed as to any work to be

missing from this current process.
2. Lloyd Iverson, 4230 Hargrave Avenue, Sonoma County, was
recognized and discussed the need for the aquifer to
recharge. City Manager Leivo briefly commented on the
City's new design standards in the General Plan that
provides for measures to address stream water in
Specific Plan areas. He also noted that the City's
water recharge rate is higher than the 1.2 MGD that
Mr. Iverson mentioned in his comments.

3. Bev Ortiz, 1778 Sunnyvale Avenue, Walnut Creek, was
recognized and noted that she has been a park
naturalist for 25 years. She recommended that staff
use local genetic seed stock and that the implications
of the vegetation component be carefully studied in
terms of preventing the spread of diseases such as
Sudden Oak Disease. Mr. Thompson from SCWA commented
that the plan is to use plants and seeds native to the
area.
3. Council Discussion /Direction /Action: Upon MOTION
by Councilmember Vidak- Martinez, seconded by
Councilmember Mackenzie, a motion to DIRECT STAFF
to proceed with Option 3 as outlined in the Staff
Report and to proceed with Option 4 if it is deemed
necessary upon review, was UNANIMOUSLY APPROVED.
8. PUBLIC FACILITIES FINANCE PLAN (PFFP) DRAFT:
Opportunity to receive public and City Council comments
and consideration of directing staff to schedule the
Public Hearing to consider approval of the PFFP:
1. Staff Report: City Manager Leivo introduced Mary
Grace Pawson who recently joined the firm of
Winzler & Kelly. Ms. Pawson reviewed the contents
of the Staff Report and responded to Council
questions.
2. Public Comments: None.
3. Council Discussion /Direction /Action: Councilmember
Mackenzie noted his current concerns about traffic
movement out of the south end of the City from
Bodway, and he indicated that he looks forward to
hearing from staff and SCTA through Councilmember
Vidak- Martinez at the time of the Public Hearing
on this matter. Upon MOTION by Councilmember
Mackenzie, seconded by Councilmember Vidak- Martinez,
a motion to DIRECT STAFF to schedule a Public
Hearing for the Public Facilities Finance Plan was
UNANIMOUSLY APPROVED.
9. COMMISSION /COMMITTEE /BOARD MATTERS:
1. Bicycle Advisory Committee - Consideration of
accepting resignation from Commissioner with a
two -year term to expire December 31, 2004:

Council action accepting resignation from Gary
Jelinek: Upon MOTION by Councilmember Flores,
seconded by Councilmember Vidak- Martinez, a motion
to accept the resignation of Gary Jelinek and to
DIRECT STAFF to send a letter over the Mayor's
signature expressing appreciation for his service,
was UNANIMOUSLY APPROVED. Mayor Nordin DIRECTED
STAFF to advertise the vacancy.
2. Cultural Arts Commission —Consideration of
appointment to fill vacancy with a four -year term to
expire December 31, 2006:
Council action to fill vacancy due to acceptance
of resignation of Crissey Cossey: Vice Mayor
Spradlin indicated that there have been no responses
yet to the advertisement, and she encouraged anyone
interested in the appointment to submit an
application.
3. Parks and Recreation Commission - Consideration of
appointment to fill a vacancy with a two -year term to
expire December 31, 2004:
Council action to fill vacancy due to acceptance
of resignation of Michelle Rogers: Councilmember
Vidak- Martinez described Chuck Rogers' background
with youth and families. Upon MOTION by
Councilmember Vidak- Martinez, seconded by Vice
Mayor Spradlin, a motion to appoint Chuck Rogers to
a two -year term to expire December 31, 2004, was
UNANIMOUSLY APPROVED.
10. STORM WATER ORDINANCE:
Consideration of Ordinance adding Chapter 13.64, "Storm
Water Discharge," to Title 13, "Water and Sewers," of
the Rol pert Park Tvrunicipal Code:
1. Staff Report: Mary Grace Pawson of Winzler & Kelly
reviewed the contents of the Staff Report.

Upon MOTION by Councilmember Mackenzie, seconded by
Councilmember Flores, and UNANIMOUSLY APPROVED,

11. LOCAL AGENCY FORMATION COMMISSION (LAFCO) MATTER:
Consideration of LAFCO letter requesting approval of a
new funding formula:
1. Review of LAFCO letter describing funding
requirements and alternatives: City Manager Leivo
reviewed the contents of the Staff Report.
2. Public Comments: None.
3. Resolution for Consideration:
2004 -110 APPROVING SONOMA LAFCO'S FUNDING OF NET OPERATING
COSTS BY THE FOLLOWING FORMULA: COUNTY - 40 %;
CITIES - 40% AS A WHOLE; INDEPENDENT SPECIAL
DISTRICTS - 20% AS A WHOLE
Council Motion /Discussion /Vote:
Upon MOTION by Councilmember Flores, seconded by
Councilmember Mackenzie, and UNANIMOUSLY APPROVED,

12. CLIMATE PROTECTION PLAN:
Consideration of Greenhouse Gas (GHG) Reduction
Goal for Municipal Operations and directing staff to
develop a Climate Protection Action Plan:
1. Staff Report: City Manager Leivo introduced
Administrative Assistant Eydie Tacata who
summarized the contents of the Staff Report and
responded to Council questions.

2. Public Comments:
1. Anne Hancock, Coordinator, Climate Protection Campaign,
was recognized and commended Council for taking the
lead in Sonoma County to reduce its greenhouse gas
emissions.
2. Dave Erickson, Analyst, Climate Protection Campaign., was
recognized and discussed how important it is for local
governments to take a lead in reducing their greenhouse
gas emissions. He noted independence from crude oil is
achievable, intelligent and money- saving. He urged the
Council to provide the community more choices to
reduce emissions and to go beyond the requirements of
the program.
3. Resolution for Consideration:
2004 -111 ADOPTING A GOAL OF 20- PERCENT REDUCTION IN
GREENHOUSE GAS EMISSIONS FROM CITY OF ROHNERT
PARK MUNICIPAL OPERATIONS FROM 2000 TO 2010
Council Motion /Discussion /Vote:
Upon MOTION by Councilmember Vidak- Martinez, seconded by
Councilmember Flores, and UNANIMOUSLY APPROVED, reading
was waived and Resolution 2004 -111 was ADOPTED.
13. COUNCIL COMMITTEE AND /OR OTHER REPORTS:
I. "Your Business and the New Consumer," presented by
Sonoma County Economic Development Board, April 29,
2004: Councilmembers Mackenzie and Vidak- Martinez
briefly commented on the interesting demographic
data that they reviewed.
2. Water Advisory Committee, May 3, 2004 meeting:
Councilmem hers F iores and Mackenzie briefly
commented on the ongoing work on the impairment
allocations.
3. Garbage Subcommittee, May 4, 2004 meeting: Vice
Mayor Spradlin indicated that she saw the plans for
North Bay Corporation's new recycling facility.
She stated there will be a meeting this Friday with
Rohnert Park Disposal about amending the existing
franchise agreement. Councilmember Flores discussed
global warming and efforts to increase recycling.
Councilmember Mackenzie encouraged Council to
continue to review the bidding process.

4. Sonoma County Transportation Authority (SCTA),
May 10, 2004 meeting: Councilmember Vidak- Martinez
discussed the Railroad Avenue Interchange concept
and the possible use of a "hard sweeper" off of
Petaluma Hill Road and out of Penngrove. She urged
Council to watch this issue and talk to the City
of Cotati. Councilmember Mackenzie agreed that
this issue has to be watched and that the "hard
sweeper" approach is a bad idea. He noted that
LAFCO told SCTA to be the lead agency in this matter,
and he said the City needs to focus on this as part
of the General Plan implementation.
5. Other informational reports, if any: None.
14. COMMUNICATIONS:
Communications per the attached outline were brought to the
attention of Council.
League of California Cities matter:
Councilmember Mackenzie REQUESTED Council direction
regarding an important vote he will be casting for
the City with the League of California Cities. City
Manager Leivo recommended declaring this item an
emergency item.
EMERGENCY ITEM:
Upon MOTION by Vice Mayor Spradlin, seconded by
Councilmember Flores, a motion to declare consideration
of this League of California Cities matter an
emergency item was UNANIMOUSLY APPROVED.
City Manager Leivo summarized the League's proposal with
the Governor for cities to help with the State budget
over the next two years in exchange for the Governor's
support of a similar ballot measure that would provide
backfill in 2006 and 2007. Councilmember Flores
concurred that this proposal is the best possible
approach.
Upon MOTION by Councilmember Flores, seconded by
Councilmember Vidak- Martinez, a motion to direct
Councilmember Mackenzie to vote in favor of the
League of California Cities' proposal was

15. MATTERS FROM /FOR COUNCIL:

Leivo indicated that said item has been placed on the
Economic Development Committee's agenda.

briefly reviewed this document.
3. City Council Agenda Forecast: Councilmember
Vidak- Martinez thanked staff for the Agenda
Forecast.

Mackenzie stated that he will be out of the country
