1993/09/14 City Council MinutesRohnert Park City Council Minutes September 14, 1993 The Council of the City of Rohnert Park met this date in regular session commencing at 6:00 p.m. in the City Offices, 6750 Commerce Boulevard, Rohnert Park, with Mayor Pro - Tempore Reilly presiding. CALL TO ORDER -Mayor Pro- Tempore Reilly called the regular session to order at approximately 6:35 p.m. and led the pledge of allegiance. Mayor Pro- Tempore Reilly advised that a closed session commenced this evening at 6:00 p.m. to discuss litigation matters and personnel matters. He said no action was taken and there was nothing to report at this time. ROLL CALL Present: (4) Councilmembers Eck, Gallagher, Spiro and Mayor Pro - Tempore Reilly Absent: (1) Mayor Hollingsworth (out of town on business) Staff present for all or part of the meeting: City Manager Netter, City Attorney Flitner, Assistant to the City Manager Leivo, Director of Public Works /City Engineer Brust, and Finance Director Harrow. Approval of Councilwoman Spiro referenced August 24th, 1993 minutes for two (2) Minutes corrections in the last paragraph of page 9 regarding Condiotti Condos, Spreckels Unit No. 9. She pointed out that the word "was" should be changed to "has" in the third line of said paragraph to read "no one else has asked for sewer allocations at this time "; and that the reference to "126 units" in the last sentence of the same paragraph should be corrected to "170 units ". Upon motion by Councilwoman Gallagher, seconded by Councilman Eck, with above corrections as reviewed by Councilwoman Spiro, the minutes of August 24, 1993 were unanimously approved as amended. Approval of Upon motion by Councilman Eck, seconded by Councilwoman Spiro, Bills City bills presented per the attached list in the amount of $809,722.93 were unanimously approved. Non- agendaed Mayor Pro - Tempore Reilly queried if any Councilmember had any non- matters agendaed items to add to the agenda. Councilmembers Gallagher, Eck and Spiro signified miscellaneous items to add under matters from Council. Unscheduled Mayor Pro - Tempore Reilly stated that in compliance with State Law (The Public Brown Act), citizens wishing to make a comment may do so at this time. Appearances Lhder legislation of the Brown Act, in most cases, the Council cannot handle an item without it being on the agenda. To ensure accurate recording, "Speaker Cards" are provided at the entrance of the Chamber and persons speaking under unscheduled public appearances are requested to submit completed cards to the recording clerk. Rohnert Park City Council Minutes (2) September 14, 1993 Lew Kuehm, President of the Founders Days Association representing the Youths of the Year program, introduced three young ladies for recognition and award. Mayor Pro - Tempore Reilly extended congratulations and presented 1993 -94 Youths of the Year name badge awards to Danielle Loughran, Justine Dyer and Carrie Caudle. Mr. Kuehm, on behalf of Diane Parker of the Northbay Savings Bank, noted that Danielle Loughran received a $50 certificate from the bank with the equivalent worth of $100 in five years. Jim Clark, 80 Walnut Circle, concerning Ordinance 494 amendments, deferred his comments to the time of that agendaed item. Paul Golis, Thousand Oaks, Ca., distributed his written remarks concerning City of Rohnert Park Code of Ethics Resolution No. 72 -38 and the Statement of Economic Interests filed by former City Manager Peter M. Callinan in February of 1977. Mr. Golis shared contents of his written remarks (copy attached to original set of these minutes) which specifically expressed his concerns related to the Rohnert Park Regional Park project and his opposition to Armando Flores' appointment to the Planning Commission. Councilwoman Spiro responded that the Regional Park was to remain in a natural state. Councilwoman Spiro clarified that Mr. Flores had nothing to do with the park matter. Mr. Golis indicated that the city should take advantage of the stadium property for development to help the City's financial situation. W. Golis requested that the Council review the City's Code of Ethics applicable to Commission appointments. Mike Anderson of Sonoma County Comnmity Recycling Center, 3899 Santa Rosa Avenue, requested that the composting pickup and garbage collection contract be competitively bid. Mr. Anderson advised that he would respond to this issue during the scheduled public hearing later on the agenda. Barry Adams, Attorney for Industrial Carting, noted that the city can legally bid the compost portion separately. C O N S E N T C A L E N D A R Mayor Pro- Tempore Reilly queried if anyone had any questions regarding the matters on the Consent Calendar which were explained in the City Manager's Council Meeting Memo. Councilwoman Gallagher requested removal of Resolution Nos. 93 -101 and 93 -102 from the Consent Calendar for further discussion. She also signified that she would vote no on item C of the Consent Calendar regarding final map approval for Spreckels Unit No. 9. Rohnert Park City Council Minutes (4) September 14, 1993 CONSENT CALENDAR - continued Resolution A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK APPROVING No. 93 -101 AGREEMENT WITH THOMS BULLARD (re. attendance at FBI National Academy) City Manager Netter responded to Council policy questions concerning attending the academy. Upon motion by Councilman. Eck, seconded by Councilwoman Spiro, and unanimously approved, Resolution No. 93 -101 was adopted. Resolution A RESOLUTION ACCEPTING COMPLETION AND DIRECTING CITY ENGINEER TO No. 93 -102 FILE NOTICE OF COMPLETION, WASTEWATER PUMP STATION IMPROVEMENTS, PROJECT NO. 1988 -20 Director of Public Works /City Engineer responded to Council questions concerning the need for the improvements. Upon motion by Councilwoman Gallagher, seconded by Councilwoman Spiro, and unanimously approved, Resolution No. 93 -102 was adopted. Spreckels Unit No. 9 final map approval and accepting dedication of sidewalk and public access easement City Attorney Flitner responded to Council inquiry that this final map approval is not a discretionary item but is an administerial procedure. Upon motion by Councilman Eck, seconded by Councilwoman. Spiro, final map for Spreckels Unit No. 9 and accepting dedication of sidewalk and public access easement was approved by the following vote: AYES: (3) Councilmembers Eck, Spiro and Mayor Pro- Tempore Reilly NOES: (1) Councilwoman Gallagher ABSENT: (1) Mayor Hollingsworth Scheduled Public Appearances: 1. Bonnie Bergin, Executive Director of the Assistance Dog Institute, explained the that the Assistance Dog Institute concept was born in Rohnert Park almost 20 years ago to train dogs to assist people with limitations. She noted that this became a reality last October and the training program is currently in operation. The Assistance Dog Institute recently adopted two dogs from the City's new Animal Shelter for training. One of the dogs then demonstrated its training and the effectiveness of the program. 2. Tom Rohner, representative of the California State Automobile Association (CSAA), concerning the AAA Pedestrian Protection Program, presented to the City the 1992 Pedestrian Safety Citation achievement award for its fatality -free pedestrian safety record. Rohnert Park City Council Minutes (5) September 14, 1993 Fiscal 1992/93 - Budget Review of Actual Revenues and Expenditures City Manager Netter referred to the staff report dated August 25, 1993 prepared by Finance Director Harrow outlining the highlights of the fiscal year 1992 -93 (ending June 30, 1993) which compared actual revenues and expenditures. Finance Director Harrow noted the favorable net of approximately $1.4 million overall, ending the year with a positive cash balance in the General Fund of approximately $500,000. Council Committee reports: 1. Interest on Security Deposits - Councilman Eck explained the resolution for consideration and noted that the Council Committee (Eck /Spiro) recornnended adoption of same. Mayor Pro Tempore Reilly read the reso- lution for consideration in its entirety for the benefit of the public. Resolution A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK No. 93 -109 REQUESTING FULL DISCLOSURE TO ALL RENTERS THAT INTEREST ON SECURITY DEPOSITS IS A NEGOTIABLE ITEM IN LEASE AGREENIIM Upon motion by Councilman Eck, seconded by Councilwoman Spiro, following the reading of Resolution No. 93 -109, said resolution was adopted by the following vote: AYES: (3) Councilmembers Eck, Spiro and Mayor Pro Tempore Reilly NOES: (0) None ABSENT: (1) Mayor Hollingsworth ABSTAIN: (1) Councilwoman Gallagher, noting her previous member- ship on the Sonoma County Board of Realtors. City Attorney Flitner confirmed to Councilwoman Spiro's inquiry that being a renter did not constitute a conflict of interest regarding this matter and, therefore, it was correct for her to vote on same. David Rostov, 39 Walnut Circle, asked and was advised that resolution would go into effect when adopted and would be from that time forward, and would not be retroactive. Ben Friedman, 7323 College View Drive, expressed his appreciation to the Council for voting in favor of the security deposit resolution. 2. Nbbile Home Parks Purchase Program - (Council Committee Eck and Reilly) Councilman Eck confirmed that some communications have proceeded with Mr. Heath of Valley Village Wbile Home Park and that a meeting was also held with representatives from the Rancho Felis Wbile Home Park for a Mobile Home Parks Purchase Program and working out a formula to project dollar values. Bond Counsel Sutro & Co. is scheduled to meet with the owner of Rancho Felis to review fair market values. City Manager Netter added that Mr. Heath is working up a proforma regarding this item which should be ready for review in a couple of weeks. Councilman Eck noted that the method of financing could have a huge impact on the program. Councilman Eck felt the commmica- tions and meetings were developing trust between the City and mobile home park owners. Rohnert Park City Council Minutes (5) September 14, 1993 Mobile Home Park proposed Ordinance 494 amendments: City Manager Netter referred to a letter dated August 29, 1993 from Geneva Trent regarding Ordinance 494 amendments amendments which requests the City's consideration for the ordinance as a June 1994 ballot measure. Councilman Eck expressed varied concerns regarding reasonableness of the proposed ordinance. Councilman Eck also noted that the City's Rent Appeals Board should be included in the review. Councilman Eck thought that the Rent Appeals Board might be willing to collect data and make recommendations for Council's consideration. James M. Clark, 80 Walnut Circle, distributed to Council copies of his letter dated September 10, 1993 concerning the Valley Village Homeowners' informal meeting recommendation that the Council accept the offer of Coleman Persily, Region 2 Manager of the Golden State Nbbilehome CVners League (GSNDL) to assist the Council concerning Ordinance 494 amendments and the June 1994 ballot measure proposal. Following discussion, Council directed staff to schedule a joint meeting with the Mobile Home Rent Appeals Board considering the possibility of 5:30 p.m. on October 7, 1993 which is just prior to the regular Rent Appeals Board meeting. Council also accepted the GSNDL offer and invited W. Persily to attend the joint meeting. RECESS Mayor Pro Tempore Reilly declared a recess at approximately 8:07 p.m. RECONVENE Mayor Pro Tempore Reilly reconvened the Council meeting at approximately 8:14 p.m. and with the exception of Mayor Hollingsworth, all Councilmembers were present. Garbage matters: City Manager Netter referred to the staff report information regarding recycling alternatives for compliance with AB 939 mandates. Assistant to the City Manager Leivo then gave a report regarding the options and responded to various Council questions. Kevin Walbridge, Division Manager of Empire Waste Management, also made a short presentation and then invited Council to view a relevant materials exhibit during a brief recess following the presentation. Mayor Pro Tempore Reilly explained that tonight's presentation was for Council's initial review and that a public hearing for this issue is scheduled for the next City Council meeting of September 28th, 1993. RECESS Mayor Pro Tempore Reilly declared a recess at approximately 9:14 p.m. in order for Council to view the above- referenced exhibit. RECONVENE Mayor Pro Tempore Reilly reconvened the Council meeting at approximately 9:20 p.m. and with the exception of Mayor Hollingsworth, all Councilmembers were present. Rohnert Park City Council Minutes (7) September 14, 1993 Parks and Recreation matters: 1. North Bay Breakers - Use of stadium for concerts Resolution A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK No. 93 -110 AUTHORIZING AND APPROVING AN AGREE ME WITH THE NORTH BAY BREAKERS SOCCER TEAM FOR USE OF THE ROHNERT PARK STADIUM FOR CONCERTS City Manager Netter explained the resolution. Following discussion, Council concurred that this resolution should be specific to North Bay Breakers' use of the stadium only and that staff should proceed with the development of a more general standard use resolution with broader terms and more flexible language. Council also agreed that items 10 and 11 of the agreement should signify cost reimbursement for utilizing city personnel. Upon motion by Councilwoman Spiro, seconded by Councilwoman Gallagher, and unanimously approved, reading of Resolution No. 93 -110 was waived and said resolution was adopted as amended to include cost reimbursement when city personnel is utilized. 2. Western League /Dukes Baseball, Inc. letter of September 3, 1993 requesting use of Rohnert Park Stadium along with staff memo were reviewed. Following discussion, Council concurred that the item should be referred to the Council Committee Eck and Reilly for further review. Bodway Parkway Extension, Project 1993 -5 City Manager Netter referred to the Hewlett Packard letter dated August 17, 1993 which requests the City to take over the management of the Bodway Parkway Extension Project with Hewlett Packard reimbursing the City for associated costs. City Manager Netter recommended that this project be taken over by the City under an assessment district. Upon motion by Councilwoman Spiro, seconded by Councilman Eck, the City's management of Bodway Parkway Extension, Project 1993 -5, as recommended by staff under an assessment district with Hewlett Packard reimbursing the City for associated costs, was approved by the following vote: AYES: (3) Councilmembers Eck, Spiro and Mayor Pro Tempore Reilly NOES: (0) None ABSTAIN: (1) Councilwoman Gallagher, due to concerns related to proposed assessment district costs not being shared by others benefiting from the roadway extension and because residents of Cannon Manor do not want it. ABSENT: (1) Mayor Hollingsworth Council also directed that appropriate sound walls next to Cannon Manor residents be part of the design. Rohnert Park City Council Minutes (8) September 14, 1993 Planning and Zoning matters: File No. 1612 - Appeal Planning Commission approval of granny unit at 97 Adele Ave. City Manager Netter said copies were provided to Council of petition signatures and staff report regarding this appeal. Lenore Strande, 97 Adele Avenue, responded to Council questions concerning the granny unit and use permit noting that she no longer has the potbellied pig referenced in the use permit and that she was in the process of cleaning up the property. Mayor Pro Terrpore Reilly asked if there were others in the audience desiring to speak regarding this matter. No one responded. Councilman Eck said he would not be able to support the use permit until the differences between the neighbors were resolved. Upon motion by Councilwoman Spiro, seconded by Councilwoman Gallagher, to uphold the Planning Commission's approval of File No. 1612 for a granny unit, was approved by the following vote: AYES: (3) Councilwomen Gallagher and Spiro and Mayor Pro Tetrpore Reilly NOES: (1) Councilman Eck ABSENT: (1) Mayor Hollingsworth File No. 1615 - Codding Construction - Site Plan and Architectural Review for 8,400 sq.ft. 4 -H meeting facility to be located at rear of Payless Drug Store and Albertson's market in the Northbay Shopping Center - City Manager Netter referenced plans on display and the staff report dated August 12, 1993 regarding this matter. Jim Groom of Discovery Office Equipment and representative for the referenced 4 -H meeting facility responded to Council questions. Upon motion by Councilman Eck, seconded by Councilwoman Gallagher, File No. 1615 - Codding Construction site plan and architectural review for the 4 -H facility as recommended by the Planning Commission, was unanimously approved. Poison Control Center /San Francisco - City Manager Netter referenced the letter dated August 17, 1993 from County Supervisor Michael Cale requesting consideration of a County -wide cost sharing program to maintain the Poison Control Center in San Francisco. Councilman Eck recommended following suit with the majority of the other cities and take no action. Council agreed. Rohnert Park City Council Minutes (9) September 14, 1993 Minor alcohol offense /loud party ordinance City Manager Netter referenced copies provided to Council of staff report with attached minor alcohol offense /loud party ordinance for consideration. Mayor Pro Tempore Reilly consented to move an agenda item forward in order to review specified matters from/for Council at this time. Matters from/for Council: 1. County of Sonoma proposed furlough - City Manager Netter referenced the letter dated August 16, 1993 from the Town of Windsor opposing the County of Sonoma's closure during the holiday season. Council concurred that the City Manager write a letter to the County requesting that the furlough program should only be a last resort. 2. Council concurred approval for Councilwoman. Spiro to attend the following three meetings as requested: 1) League of California Cities Revenue and Taxation Committee meeting on September 23rd, 1993; 2) ABAG meeting on November 18th, 1993; and the "Call to Action" meeting of Governor Pete Wilson on November 4th, 1993. In response to Councilwoman Spiro's request to place revisiting the need for obtaining additional Council approval to attend meetings if a Councilperson has been previously appointed to such committees or commissions, Council signified that this was assumed and understood, therefore, placing the item on an agenda for further review would not be necessary. DUI Cost Recovery Program - Billing and Collection Analyses /Recommendation Due to the lateness of the hour, this item was deferred to the next Council meeting. EXTEND COLUCIL MEETING TIME - Upon motion by Councilwoman Gallagher, seconded by Councilman Eck, and unanimously approved, the Council meeting adjournment time was extended in order to complete necessary items listed on the agenda. Laguna de Santa Rosa Foundation letter of September 7, 1993 requesting a resolution supporting the Coordinated Resource Management and Planning (CRMP) Process - Kim Cordell of Laguna de Santa Rosa Foundation explained the process and responded to Council questions. Upon motion by Councilman Eck, seconded by Councilwoman Spiro, endorsement of the Laguna de Santa Rosa Coordinated Resource Management and Planning (CRMP) Process and preparation of an appropriate supporting resolution, was unanimously approved. Communications - Communications per the attached outline were brought to the attention of City Council. No action was taken unless specifically noted in these minutes. Rohnert Park City Council Minutes (10) September 14, 1993 City 1. Measure A - Local Sales Tax Measure - City Manager Netter confirmed Manager's the Board of Supervisors has agreed to add language to Measure A that Report: would mirror Proposition 172. 2. Fall Clean Up - City Manager Netter referenced the City's annual Fall Councilmembers that the event would begin at 11:00 p.m. on Saturday, Clean Up program. Council concurred to proceed with the standard September 18th, 1993 at the State Farm Insurance Parking lot. program of two weekends at a cost of approximately $16,000. 3. School District fees /Snyder Lane - City Manager Netter noted that Councilwoman Spiro is the alternate. preliminary staff meetings between representatives of the School National League of Cities Congress of Cities and Exposition - Mayor District and the City are in the process of being scheduled. City 1. FPPC Advice Letter regarding ability of a Councilmember to vote on Attorney's General Plan with Councilmember owning property within affected area - Report: City Attorney Flitner referred to his memorandum dated September 14, 1993. Discussion included staff response that the referenced city employee was a civil engineer and does not inspect buildings and, therefore, concerns expressed related to the FPPC do not apply. It was pointed out that the civil engineer does review improvement plans, but actual approval or disapproval of such plans is the responsibility of the City Engineer. 2. Opinion regarding Wine Center agreement was deferred to the next Council agenda of September 28, 1993. Matters from/for Council: 1. County of Sonoma proposed furlough - handled under previous agenda item discussion. 2. Founder's Day Parade - Mayor Pro Tempore Reilly reminded Councilmembers that the event would begin at 11:00 p.m. on Saturday, September 18th, 1993 at the State Farm Insurance Parking lot. 3. Hands Across the County "CCMVtVITY ACTION DAY" - Mayor Pro TenQore Reilly confirmed that this event will be held on Saturday, September 25th, 1993. 4. Selecting voting delegate and alternate for League of California Cities Annual Conference in San Francisco, Tuesday, October 19th, 1993 at 10:30 a.m. - Mayor Pro Tempore Reilly confirmed he would be attending this conference as the voting delegate, and noted that Councilwoman Spiro is the alternate. 5. National League of Cities Congress of Cities and Exposition - Mayor Pro Tempore Reilly confirmed this event would be held in Orlando, Florida, December 2 - 5, 1993. I reside at 202 Sundown Road, Thousand C).+hs, California, 91360. My only direct connection to Rohnert P rk is a reversion in twenty acres of property located east of Ili- I ad um whose title is held by the city. But historically ]_ have the best of reasons. If it weren't: for nice, Rohnert Park would not be here today. If Rohnert Park had not begun when it did, Sonoma State University would not be :Located here today. There are many other special aspects of the city that wonid not be hare. For example, the concept of neighborhood parks. For that matter, you would not be here today. But tonight, I am limiting my remarks to a facility that is not here, whose creation was destroyed by a previous council for the musL selfish of reasons, and the individual who led the movement: to destroy it. The project was the Rohnert Park Regional Park! Ile individual is Armando Flores who has returned to your city government to pursue the purpose and tactics he has used in the post which has caused damage to this city in the millions of dollars.
