1990/07/24 City Council MinutesRohnert Park City Council Minutes July 24, 1990 The Council of the City of Rohnert Park met this date in adjourned regular session in the City Offices, 6750 Commerce Blvd., Rohnert Park, California with Mayor Hollingsworth presiding. Call to Order The adjourned regular session was called to order at 4:00 p.m. by Mayor Hollingsworth. Roll Call Present: (3) Council Members Hollingsworth, Eck and Hopkins Late: (1) Council Member Cochran (time of arrival noted in minutes) Absent: (1) Council Member Spiro Staff present for all or part of the meeting: City Manager Callinan, Finance Director Harrow, Assistant to the City Manager Leivo. 1990 -91 Budget The Council commenced a work session on the proposed city budget as presented by the City Manager. The work session consisted of Council interviews with representatives of different organizations who had requested a contribution or subsidy from the City. Ms. Kim Bricker appeared on behalf of Sonoma County A.I.D.E. and explained her request of $15,000. Ms. Lilith Rogers appeared on behalf of the Sonoma County Storytelling Festival. She indicated that the group had reduced their request from $6,000 to $1,200 and explained her request. Mr. Walt Guanella appeared on behalf of the Guanella Bros. Softball Team and explained his request of $10,000. Council Member Hopkins indicated that he would be a Council representative at the upcoming tournament in Victoria. Ms. Mary Anderson appeared on behalf of the Family Education Center and explained their request of $2,000. Council Member Council Member Cochran arrived, the time being Cochran Arrives 4:45 p.m. Ms. Barbara Harris appeared on behalf of the Sonoma County Arts Council and explained her request of $3,500. Ken Butler, Lon Russell, Diane Parker, Dave Wattell, and Bill Kirkpatrick all appeared on behalf of the Rohnert Park Chamber of Commerce and explained their request of $56,000. Mr. Patrick Ross and Mr. Nabih Geha appeared on behalf of the Sonoma County Convention and Visitor Bureau and explained their request of $180,000. The Council took under advisement all requests for funds. Council The adjourned regular session was adjourned at Adjournment approximately 6:05 p.m. Mayor , City Ma ger /Clerk Rohnert Park City Council Minutes July 24, 1990 The Council of the City of Rohnert Park met this date in regular session commencing at 7:00 p.m. in the City Offices, 6750 Commerce Boulevard, Rohnert Park, with Mayor Hollingsworth presiding. The open regular session was preceded by a closed session which commenced at 7:00 p.m. CALL TO CRDER Mayor Hollingsworth called the regular session to order at approximately 7:45 p.m. and led the pledge of allegiance. Mayor Hollingsworth advised that an adjourned regular session convened at 4:00 p.m. today for a work session on the proposed 1990 -91 City budget. He also advised that a closed session commenced this evening at 7:00 p.m. to discuss litigation, personnel matters, and real estate negotiations during which the Council decided to appeal the Court's decision regarding the mobile home rent control lawsuit and go ahead with the damages phase of the trial. He said that the Council concluded that Ordinance No. 494 should be upheld so there will be no measures put on the November ballot regarding mobile home rent control and the Council will no longer be in negotiations with the mobile home park owners. Mayor Hollingsworth also said that outside support will be given to the City Attorney to proceed with the damages phase of the trial and thereafter. Marian Case, 93 Walnut Circle, comwnted from the audience that it was fantastic that the rent control matter was not going to be put on the ballot, and the Councilmembers deserved a medal for this decision. John Murrain, 203 Circulo Nuevo, asked if Council had any concept of when the Judge would publicize the Court decision to which the Mayor responded that the timing is unknown but the process is moving as rapidly as possible. It was mentioned that the City Attorney had dram up a probable timetable of events that is much longer than could be imagined and that it is available to those interested. Rohnert Park City Council Minutes (2) July 24, 1990 1 of W=tes Upon motion by Councilman Eck, the minutes of July the following vote: Hopkins, seconded by Councilman 10 and 16, 1990 were approved by AYES: (3) Councilmen Eck, Hopkins, and Hollingsworth NOES: (0) None ABSTAIN: (1) Councilman Cochran ABSENT: (1) Councilmember Spiro Approval of Bills Upon motion by Councilman Hopkins, seconded by Councilman Cochran, and unanimously approved, the bills presented per the attached list in the amount of $1,011,835.21 were approved. CDA bills presented per the attached list in the amount of $233,816.15 were also approved. Moment of Silence A moment of silence was observed in memory of Sergeant for Caouette Steven R. Caouette, who passed away on July 14th, 1990, for the service he gave the City of Rohnert Park as a Police Officer. Mayor Hollingsworth acknowledged the presence of Sergeant Caouette's wife, Melody, in the audience as he had previously advised her of including on tonight's agenda the authorization of a bronze plaque in memory of Sergeant Caouette to be placed in the new Public Safety Building. He said a particular area should be specified in the new Public Safety Building to honor any Police Officers who served the comninity and passed away during their time of service. A motion was made by Councilman Cochran, seconded by Councilman Eck, and unanimously approved, to place a bronze plaque in memory of Sergeant Caouette in the new Public Safety Building, and to honor in the same manner any Police Officers who pass away during their time of service to the comruni ty . I�tteMattegendaed Mayor Hollingsworth queried if any Councilmember had any Matters non - agendaed items to add to the agenda. Councilman Eck said he had one miscellaneous item to add to the agenda. City Manager Callinan said a resolution regarding an agreement with the School District should be added under "other resolutions for consideration ". Lhscheduled Public Mayor Hollingsworth stated that in compliance with Appearances State Law (The Brown Act), anyone in the audience who wished to crake a comment may do so at this time. Arthur Anderson John Murrain, 203 Circulo Nuevo, assisted Arthur E. Anderson, 240 Walnut Circle, in communicating with Council because of W. Anderson's hearing problem. W. Anderson referenced his letter previously provided to Council at the June 12th meeting regarding questions on the Green Book Acireerrrsnt ?rte Rohnert Park City Council Minutes (3) July 24, 1990 his request for response in writing from the City Attorney. He said there was nothing in City Attorney Flitner's letter of response that says it is legal for Valley Village residents to be part of the Green Book Agreement. He requested that the City Council declare Valley Village not subject to the Green Book Agreement since the law is specific that it is not legal for two parties to enter into an agreement without the consent of the third party. City Attorney Flitner said his written response to Mr. Anderson's questions regarding the Green Book Agreement was prior to tonight's decision by Council to uphold Ordinance No. 494. Mr. Martin acknowledged that he would make this clear to Mr. Anderson. Marty Joseph: Martin Marty Joseph Martin, P. O. Box 12231, Santa Rosa, said he was here tonight to address the City Council on the violation of his civil rights when he was recently detained by officers while his vehicle was being searched and he was forced to submit to alcohol sobriety tests. The officers refused his request to stand in the shade during this time so he spent sixty -five minutes standing in the sun. Mr. Martin said at the same time, favoritism was shown to another person who was wanted by the law, while the officers laughed at everything he brought up. City Manager Callinan explained that two claims had been submitted to the City by Mr. Martin after the printing of tonight's agenda and would be on the next Council meeting agenda. Discussion followed during which City Attorney Flitner explained the procedure of referring claims to the insurance company for handling. Rae Dunn Rae Dunn, 183 Verde Circle, expressed appreciation to the Council for tonight's vote in favor of Ordinance No. 494. She shared contents of her written inquiry to the Council (copy attached to original set of these minutes) asking if a dream of approximately three to five years ago of a group of mobile home residents called "Sundial Gardens" would stand a better chance of approval today. Richard Meuse Richard Mause, 8764 Laurelwood Drive, Coach of the Cardinals Cardinals Softball Girls Softball Team, reviewed the team's successes in the Team California State Championships and Western Regions and requested financial assistance for the August 6th ASA Nationals in Winterhaven, Florida. He said the need is for approximately $11,000 to attend this competition of which the team has raised approximately $5,000. Rohnert Park City Council Minutes (4) July 24, 1990 Discussion followed during which it vas acknowledged that this team's request %as scheduled later on tonight's agenda following Council decision regarding establishing policy for financial assistance to local organizations. Council agreed that rather than hold W. Maese until later in the meeting, action could be taken on the Cardinal's request at this time. A motion was made by Councilman Hopkins, seconded by Councilman Eck, and unanimously approved, to approve a $1,000 contribution to the Rohnert Park Cardinals Girls Softball Tournament Team in anticipation of approving the new policy regarding financial assistance to local organizations on tonight's agenda. George Horwedel George Horwedel, 7669 Camino Colegio, distributed copies to Council of his outline entitled "$50 Million Bond To Purchase bbbile Home Parks" and shared the contents therein (copy attached to original set of these minutes). He said this was in response to a challenge from Council at the last meeting to come up with a plan regarding the =bile home rent control matter. Discussion followed. Muscular Dystrophy Association City Manager Callinan explained that copies had been provided to Council of letter dated July 17, 1990 from the Muscular Dystrophy Association (MDA) requesting a 5200 donation to benefit Bay Area Chapter. Discussion followed during which it was acknowledged that the form letter request did not need Council action at tonight's meeting, however, Council agreed that the Muscular Dystrophy Association is a worthwhile cause and the $200 request for support should be included for consideration in the budget review process. Rohnert Park City Council Minutes (6) July 24, 1990 Scheduled Public Nark Wittig, P. O. Box 4092, Santa Rosa, requested on behalf Appearance: of his ice cream vending business by outcry and others Ice Cream Vending previously rejected, that Council give consideration to a by Outcry change in the Noise Ordinance to enable bringing same to Rohnert Park. He advised that for the last year he has been selling ice cream in this manner in Rohnert Park and has not had any complaints about noise; the music used is very low level in order not to disturb sleeping babies, etc. He said he checked with Assistant to the City Nunager and Chief of Police who indicated there have been no complaints regarding the noise of the ice cream truck. Discussion followed. A motion was made by Councilman Hopkins, seconded by Councilman Eck, to take this matter under advisement. Discussion followed regarding the need to clarify the motion as a courtesy to Mr. Wittig. The above motion was clarified by Councilman Hopkins, seconded by Councilman Eck, and unanimously approved, that it is the Council's intention not to change the Noise Ordinance at this time. Rosana Sorensen, 7806 Nbntero Drive, said she has three young boys at home who look forward to the ice cream truck and expressed concern about Council's lighthearted attitude regarding this matter. She said drivers in the neighborhood slow down when they see the blue and white ice cream truck; parents come out with the children reminding her of her own childhood; children are so constrained in every area of life anymore that the ice cream truck is a little bit of freedom to enjoy and makes people happy. She said she did not think she was the only mother in Rohnert Park that feels this way. Mayor Hollingsworth said there have been a lot of mothers who have come to Councilmembers taking the opposite stand and extended apologies to Mrs. Sorensen if the Council sounded insincere to her regarding this matter. Resolution No. 90-162 A RESOLUTION OF THE CITY OF ROHNERT PARK ANEMING RESOLUTION NO. 89 -105 (SETTING GARBAGE AND REFUSE COLLECTION RATES) TO SEPARATE DEBRIS BOX SERVICE AND ALLOW FOR AUM4%TIC RATE INCREASES (Direct Pass - Through) BASED ON INCREASE IN COUNTY DUNE FEES City NNnager Callinan explained the resolution. Upon motion by Councilman. Hopkins, seconded by Councilman Cochran, and unanimously approved, reading of the resolution was waived and Resolution No. 90 -162 was adopted. Rohnert Park City Council Minutes (7) July 24, 1990 Resolution No. A RESOLUTION APPROVING THE LANDLORD'S (S) AGREEMENT AND 90-163 WAIVER REGARDING THE LEASE BETWEEN COTATI - ROHNERT PARK UNIFIED SCHOOL DISTRICT AND SECURITY PACIFIC EQUIPMENT LEASING, INC. RE: NDNTE VISTA ELEMWARY SCHOOL City Manager Callinan explained the resolution and said it did not get on tonight's agenda because of staff oversight and would therefore need Council action as an emergency item prior to adoption of the resolution for consideration. He advised that Council action prior to the next regular meeting was important to the school district. A motion was made by Councilman Hopkins, seconded by Councilman Cochran, and unanimously approved to consider Resolution No. 90 -163 an emergency item and place said resolution for consideration on tonight's agenda. Upon motion by Councilman Hopkins, seconded by Councilman Cochran, and unanimously approved, reading of Resolution No. 90 -163 was waived and said resolution was adopted. Nbbile Hone Rent Mayor Hollingsworth said the litigation update regarding the Control Update Mobile Home Rent Control was handled previously in tonight's meeting and no further discussion was necessary. Resolution No. A RESOLUTION OF THE ROHNERT PARK CITY COUNCIL REQUESTING 90-164 CONSOLIDATION OF THE REGULAR m-vICIPAL ELECTION WITH THE STATEWIDE GENERAL ELECTION TO BE HELD ON NOVEMBER 6, 1990 AND ANY ELECTION WHICH MAY BE HELD IN THE SANE TERRITORY THAT IS IN PART THE SANE (ELECTION CODE S 23301.5, 23302) City Manager Callinan explained the resolution. Upon motion by Councilmen Cochran, seconded by Councilman Eck, and unanimously approved, reading of Resolution No. 90 -164 was waived and said resolution was adopted. Ballot M3asure re. hbbile Hone Rent City Manager Callinan said with Council's earlier decision Control Mtter to uphold Ordinance No. 494 there would be no consideration of a resolution to place a measure on the ballot regarding the mobile home rent control matter. Planning & Zoning: landscape Plan City Manager Callinan referenced a plan on display for the for SW Blvd. Southwest Boulevard landscaping plans for the old shopping center. He requested Council's approval of this plan and authorization for staff to contact property owners to work with the City on efforts to upgrade and improve the appearance of the shopping center. Discussion followed during which concerns were expressed regarding the unstaffed recycling barrels, teepee's and parked trucks on the shopping center parking lot. Rohnert Park City Council Minutes (8) July 24, 1990 A motion was made by Councilman Cochran, seconded by Councilman Hopkins, and unanimously approved, to approve staff's recommendation for landscaping plans of the Southwest Boulevard Shopping Center and authorize staff to contact property owners to work with the City on efforts to upgrade the shopping center. General Plan City Manager Callinan said the matter regarding the formation of a separate local housing task force to assist in implementing the many suggestions made in the General Plan Housing Element ( #18, page 4 -41) was discussed at the last Council meeting. He suggested that Council may initially want to defer such needs to the Planning Commission for surveys and to obtain further information before developing a large housing task force. A motion was made by Councilman Hopkins, seconded by Mayor Hollingsworth, to defer the local housing task force matter to the Planning Commission for review and recommrendations. Said motion was not acted on. Discussion followed during which Council agreed there are some very active people in the community who want to work on designated areas of housing needs including the consideration of future annexations. If there's citizens that want to get involved, this Council should fully sanction it. It seems there are citizens that want to do something about the homeless. Council should direct staff to develop a plan regarding a separate local housing task force in order to be consistent with General Plan recommendations. A motion was made by Councilman Hopkins to substitute his previous motion and appoint Councilmen Cochran and Eck as Council Committee to make a recomrendation as to how to implement the many suggestions made in the General Plan regarding the assistance of a separate local housing task force. Said motion died for lack of a second. Further discussion followed regarding the possibility of the Planning Commission reviewing all available agencies between now and the end of the year in order to work out recommendations for housing needs, the advantages of citizens putting together things that the City does not do, and State /Federal funds available that are not being utilized. A housing task force should be made up of not only homeless but low income needs. Since this is a County and State issue and not only a Rohnert Park issue, and in order not to be like a magnet drawing homeless to the area, this effort needs to be done in cooperation with other cities and counties. Rohnert Park City Council Minutes (9) July 24, 1990 Dawna Gallagher, 7342 Rasmussen Way, referenced an earlier discussion with the City Manager during which agreement was expressed regarding the proposed housing task force and was sorry to hear the change of mind expressed tonight by the City Manager. In response, City Manager recalled a wide ranging discussion with Ms. Gallagher regarding this matter. Further discussion followed during which Mayor Hollingsworth appointed Councilmen Cochran and Eck to be the Council Sub- committee to meet with the interested citizens regarding the proposed housing task force and come back to Council with recommendations. Council concurred. Commerce Blvd. Councilman Eck said he had met with Howard Boggs regarding Tree Lapping the tree landscaping on Commerce Boulevard. A very tentative plan has been presented to Planning Director Schanky to submit to the Planning Commission and will be presented to Council for consideration at the next meeting. So.Co.Transportation Authority City Manager Callinan explained that copies had been provided to Council of memorandum dated July 9, 1990 from Office of the County Counsel regarding the proposed Sonomm County Transportation Authority and Expenditure Plan and Timetable. Copies were also provided to Council of Sonoma County Transportation Authority Meeting Agenda with attachments dated July 16, 1990, and letter dated July 20, 1990 from Office of the County Counsel to Sonoma County City Managers regarding same. Councilmen Hopkins shared comments regarding the above - referenced meeting as well as results of meeting on July 23, 1990 during which the would be Sonoma County Transportation Authority agreed to put a 3/4 cent ballot issue on the November ballot versus the half or full cent previously considered. The cities were not all that strong on the satellite roads of Petaluma Hill Road and Stony Point Road, but the 3/4 cent was a tremendous compromise to make and the cities will probably be unanimous on this. Resolution No. 90-165 RESOLUTION OF THE CITY COLUCIL OF THE CITY OF ROMERT PARK REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF SONOMA TO CREATE THE SONOMA COUNTY TRANSPORTATION AUTHORITY; APPROVING THE MQMBERSHIP OF THE GOVERNING BODY OF THE AUTHORITY; APPOINTING A REPRESENTATIVE TO THE GOVERNING BODY OF THE AUTHORITY; APPROVING THE SONOMA COUNTY TRANSPORTATICN AUTHORITY EXPENDIIURE PLAN; DESIGNATING THE SONOMA COUNTY TRANSPORTATION ALMfORITY AS THE RESPONSIBLE AGENCY FOR THE PREPARATION AND ADOPTION OF A CONGESTION M MGETvEMT PROGRAM; AND APPROVING AN ANNUAL APPROPRIATIONS LIMIT Rohnert Park City Council Minutes (10) July 24, 1990 City Manager Callinan explained the resolution. Upon motion by Councilman Cochran, seconded by Councilman Hopkins, and unanimously approved, reading of Resolution No. 90 -165 was waived and said resolution was adopted. Parks & Recreation Caanission City Manager Callinan explained copies had been provided to Council of memo dated July 17, 1990 from Director of Recreation Pekkain regarding matters from Parks and '14' Park Recreation meeting of July 16, 1990. He referenced plans on display and said Council had previously approved "M' Park plans from the tennis courts to the east and that direction was needed by Council for the balance of the land. He said copies were also provided to Council of several letters supporting the proposed tennis center as follows: Red Lion Hotel; Sonoma State University; Donna Yock, D.M.D. and Thomas Fitzgerald, D.P.M.; Craig W. Stephens of Sonoma County Tennis Association; and John S. Hunt, O.D. and family. Discussion followed regarding funding sources for the proposed tennis center including consideration of proceeds from the tennis courts. City Engineer Brust confirmed there would be a financial breakdown prepared for Council's review. City Manager Callinan reconrended consideration be given to use Architect Ken Coker who has previously done work for the City. Concerns were expressed regarding noise and light factors with confirmation given that there are currently no residents in the area to give input. Mayor Hollingsworth acknowledged a group of citizens in the audience who were attending tonight's meeting to express support of the proposed tennis complex with confirmation that it would not be necessary to speak if Council approved development of the tennis complex. A motion was made by Councilman Hopkins, seconded by Councilman Cochran, and unanimously approved, to approve in coricept '"he.- "Li' Paris Tennis Complex as presented by staff and to proceed as funding is available. "G" Park Councilman Eck referenced the miscellaneous item to put on tonight's agenda as mentioned at the beginning of the meeting. Tennis balls hitting the backboard area of the "G" Park tennis courts are creating excessive noise. City Engineer Brust confirmed that a fence has been put up around the area to prohibit throwing baseballs which did not stop the noise problem. An acoustical engineer has reconrended punping cement into the fence as there needs to be a heavy mask to deaden the sound. City Manager Callinan suggested replacement of the facility with one constructed of concrete. Rohnert Park City Council Minutes (11) July 24, 1990 Resolution No. 90-166 A RESOLUTION APPROVING POLICY FOR ALLOCATING FUNDS FOR COWBITY PROK) TION City Imager Callinan explained the resolution. Discussion followed during which Council reviewed the recommendations of the Parks and Recreation Commission regarding the proposed policy for financial contributions to sport groups, teams, and other organizations. Council concluded said recommendations met with its approval with the exception that, in emergency situations only, it would not be necessary for an application to be reviewed by the Parks and Recreation Commission prior to being reviewed by the City Council because of timing of scheduled events such as tournament games. Council concurred the words "if feasible" should be added to requirement No. 9 of the policy for financial contributions. Upon motion by Councilman Cochran, seconded by Councilman. Eck, and unanimously approved, reading of Resolution No. 90 -166 was waived and said resolution was adopted. RP Cardinals Girls The request for financial assistance from the Rohnert Park Softball Tournament Cardinals Girls Softball Tournament Team was reviewed and Tom► approved at the beginning of tonight's meeting under Unscheduled Public Appearances. RP Girls Softball Joyce Poueu, 5760 Dolores Drive, representing the Rohnert League Park Girls' Softball League, said requests for financial assistance had been reviewed by Council at two previous meetings during the policy review process. She said that it was necessary to use some of the older team's funds for the younger team's tournament expenses and funds are now needed for the older team to go to the nationals in Idaho on August 7th at a cost of approximately $5,000. A motion was made by Councilman Hopkins, seconded by Councilman Cochran, and unanimously approved, to approve a $1,000 contribution to the Rohnert Park Girls Softball League for the eighteen and under team to go to the nationals in Idaho on August 7th. City Kn ager's Report: City Picnic City Manager Callinan said the City Picnic held last year for employees and families was a great success, and this year's City Picnic is planned for September 16th from 11:00 a.m, to dark at Alicia Park. Setting Council City Attorney Flitner said the law states that City Council Salaries salaries cannot be handled automatically through a budget process but must be processed through the introduction and adoption of an ordinance. In response to Council questions, he confirmed the timing of the ordinance could be changed to be done at budget time, and that such reconsideration could be done anytime with majority approval of the Council. Rohnert Park City Council Minutes (13) July 24, 1990 Sister Cities BBQ for Hone America Exchange -City Manager Callinan said the Sister Cities Relations Committee has planned a barbecue for Home America Exchange on August 11 at Lady Bug Park. A welcome dinner is also planned for Mr. Hideharu Otani, President of Association in Hashimoto on July 30th at the Red Lion Inn with no host coctails at 6:30 p.m. and dinner at 7:00 p.m. of which the City has been requested to pay. The Sister Cities Committee is also requesting the City to pay Mr. Otani's hotel bill at the Red Lion Inn. Council concurred. Governor's Visit City Manager Callinan referenced copies of letter provided to Council for informational purposes only dated July 12, 1990 from Michael P. Rosen, Co-Chairman for Founders' Day regarding Governor Deukmejian's scheduled visit to Rohnert Park for Senator Jim Nielsen event during Founders' Day on September 22nd. Spray matter City Manager Callinan responded to the Mayor's inquiry that staff has followed up on the spray incident involving Mrs. Faye Azevedo on Arlen Drive.
