The Council of the City of Rohnert Park met this date in
regular session commencing at 7:00 p.m. in the City Offices,
6750 Commerce Boulevard, Rohnert Park, with Mayor
Hollingsworth presiding.
CALL TO CRDER Mayor Hollingsworth called the regular session to order at
approximately 7:45 p.m. and led the pledge of allegiance.
Mayor Hollingsworth advised that a closed session commenced
this evening at 7:00 p.m. to discuss litigation matters,
personnel matters and real estate negotiations. He said the
matter regarding the proposed M Park plans would be scheduled
on the December 11, 1990 agenda and requested that any
comments regarding this matter should be held until then.

Callinan, City Attorney Flitner, Director of Administrative
Services /Assistant to the City Manager Netter, City Engineer
Brust, and Assistant to the City Manager Leivo.
Approval of Minutes Upon motion by Councilman Eck, seconded by Councilman Hopkins,
the minutes of November 13, 1990 were unanimously approved.
Approval of Bills Upon motion by Councilman Hopkins, seconded by Councilmember
Spiro, and unanimously approved, the bills presented per the
attached list in the amount of $662,513.64 were approved. CDA
bills presented per the attached list in the amount of
$82,136.22 were approved.
Non- agendaed Mayor Hollingsworth queried if any Councilmember had any
Mtters non - agendaed items to add to the agenda.
Mayor Hollingsworth said he had one item to add to the agenda.
Lbscheduled Public Mayor Hollingsworth stated that in compliance with
Appearances State Law (The Brown Act), anyone in the audience who wished
to make a comment may do so at this time.

Arthur F. Aran Arthur F. Anderson, 240 Walnut Circle, said he had previously
presented to the City Council and also the Nbbile Home Rent
Review Board legal evidence that the "Greenbook" Agreement is
not legal. He wanted to know what the City Council was
going to do.
City Attorney Flitner responded that the Mobile Home Rent
Control matter is tentative to the court's preliminary ruling
and in the interval the City continues to state that the
ordinance is to be followed asking that those positions like
registration fees and roll backs be held until the ruling is
made. He said he would be glad to talk with W. Anderson in
more detail following tonight's meeting.

regarding the matters on the Consent Calendar which were
explained in the City Manager's Council Meeting's Memo.

Upon motion by Councilman Hopkins, seconded by Councilmember
Spiro, and unanimously approved, the Consent Calendar as
outlined on the meeting's agenda was approved.
Ordinance No. 530 AN ORDINANCE OF THE CITY OF ROHNERT PARK ANEMING CHAPTER 9.46

Assistant to the City Manager Netter explained that copies had
been provided to Council of Ordinance No. 530 which was
introduced at the previous Council meeting and scheduled for
adoption tonight amending Chapter 9.46 of the Rohnert Park
Municipal Code to provide for the recovery of costs associated
with driving under the influence for all persons convicted
(DUI Cost Recovery Program).
Upon motion by Councilman Eck, seconded by Councilman Cochran,
Ordinance No. 530 was adopted by the following vote:

Scheduled Public Appearance:
Rancho Cotate H.S. Mark Alton, Rancho Cotate High School Softball Coach said he
C2arnpionsh.ip is a science and math teacher at the high school as well as
Softball Plaques the softball coach. He said it has been a tradition over the
years for the High School and the City to jointly honor all
the championship teams by sharing the cost of plaques for such
recognition. He said the softball team won the championship
last year and had an exciting season and that he was at
tonight's meeting to formally request Council approval to
share the costs for softball championship plaques in keeping
with the past tradition.
A motion was made by Councilman Eck, seconded by Councilmember
Spiro, and unanimously approved, to share the costs on
a 50/50 basis for softball championship plaques with Rancho
Cotate High School.
Hbbile Hcme Rent Assistant to the City Manager Netter explained that copies had
matters: been provided to Council of Mobile Home Rent Appeals
Increase Space Rents- Resolution No. 90 -01 authorizing the increase in space rents
for mobile home spaces in the mobile home parks by 75% of the
increase in the Consumer Price L^dex for the period October
1989 to October 1990 for the Annual General Adjustment for the

calendar year 1991. Ordinance No. 494 authorizes, without
application to the Rent Appeals Board, an increase in space
rents through an Annual General Adjustment based on 75% of the
CPI from October to October of each year not to exceed 4 %.
The October 1989 Index was 127.5 compared to the October 1990
Index of 134.6. This amounts to a 7.1 point increase which
represents a 5.57° -o change. 75% of the 5.57°-0 equals a 4.18%
increase, rounded to the nearest one quarter of one percent
equals 4.25°x. Therefore, the maximum amount that landlords
iftay charge based on the Annual General Adjustment is 4 %.
Calmer Yr- Budget'91- Assistant to the City Manager Netter explained that copies had
been provided to Council of Rent Appeals Board Resolution
No. 90-02 approving and adopting Calendar Year Budget 1991 and
establishing registration fee for mobile home spaces as
authorized under Ordinance No. 494 for calendar year 1991.
Based on the approved and adopted budget, the registration fee
for 1991 is computed to be $30 per year per space or $2.50 per
month per space. Council was also provided with the
documentation supporting the Rent Appeals Board approved
budget of $38,700 which was used in the calculation of the
annual registration fees. Several categorical areas were
removed by the Rent Appeals Board last year in the
computation of the budget (overriding staff recommendation)
which included items such as the City Nhnager, the Assistant
City Manager, clerical and City overhead items. The budget
and cash flow statements were also provided to Council
for review.
W. Netter explained that formal mailings of the notice to the
Park owners in regard to the authorized 4% rate adjustment
increase for calendar year 1991 as well as the $30
registration fee per space per year will be mailed during
this last week of November so that park owners will have
the necessary sixty days notice prior to implementing the
rate increases.
Discussion followed during which Council expressed concerns
regarding how long it will be necessary to continue with the
double budgets, i.e. staff recommended versus Board approval.
Staff commented that both budgets were submitted for
information purposes and full disclosure as staff time is
chargeable. Discussion continued on the allowable percentage
for rent increases and compliance with Ordinance No. 494.
C nvunications Communications per the attached outline were brought to the
attention of the City Council. No action was taken unless
specifically noted in these minutes.

City Mmk -ger's Report:
Animal Shelter /Public City Manager Callinan said Architect Ken Coker, who designed
Safety Westside the Public Safety Northern Station and the Burton Avenue
Substation Recreation Center remodeling, has submitted a proposal for the
Animal Shelter /Public Safety westside substation. City
Engineer Brust has received the proposal and will review it
prior to Council presentation in the near future.
Maiicipal Election City Manager Callinan said the election results should be
available from the County by next Tuesday, December 4th, and
that it would be appropriate for Council to adjourn tonight's
meeting to next Tuesday night to swear in the new Council.
Council concurred.
Appreciation Affairs City Manager Callinan said the City employees' appreciation
affair has been scheduled at the Red Lion Inn on January 11,
1991 and the Commissioners' appreciation affair scheduled at
Mountain Shadows Resort on January 18, 1991. He said plans
for these occasions had been previously presented to Council
and were placed on tonight's agenda to make sure the times and
places met with Council's approval. Council concurred.
Seasonal Trees Assistant to the City Manager Netter said the seasonal tree
lights will be installed on the Redwood trees on the Rohnert
Park Expressway on December 4th and there will be a gathering
on December 8th at 7:00 p.m. at Great Western Bank for the
lighting ceremony.
City Attorney's Report: City Attorney Flitner said the Harris lawsuit has been
settled, and the last Wilfred Avenue condemnation case
has been resolved and the money tendered.
Matters from Council: Councilman Eck acknowledged P.G.& E. representative Sil
Cincera in the audience and expressed appreciation for getting
Bike Path the lights turned around on the bike path. He said the fence
that's been put up by the High School is blocking the path
leaving a very narrow access to which City Engineer Brust
responded he is currently checking with the School District
regarding plans for that area. He said the fence was needed
for construction purposes but he would see if the opening
could be widened so it could be used.
bftlrice Ave./t49rcedes Mayor Hollingsworth said he had received resident inquiries
Way Traffic Control about speeding traffic in the vicinity of Maurice Avenue and
Marcedes Way, that there were stop signs on Maurice Avenue and
asked if it might not be beneficial to also consider the
installation of stop signs on Marcedes Way. City Engineer
Brust responded that this matter has been reviewed at least a
dozen times and has been discussed with City Manager. He said
stop signs do not slow traffic down but rather takes

enforcement of speeds by Public Safety. He agreed with
Mayor Hollingsworth's suggestion to have Public Safety use
the large traffic control TV screen at this intersection which
could be effective and would indicate to the people the City's
desire to slow down the traffic at that intersection.
Council I -eting Mayor Hollingsworth announced that there would be no Council
Cancellation meeting on December 25th, 1990.
Unscheduled Public Mayor Hollingsworth asked if anyone in the audience wished
Appearances to make an appearance at this time. No one responded.
Adjo unmet Mayor Hollingsworth adjourned the meeting at approxi-
mately 8:15 p.m. to 7:30 p.m. on November 30th at the Rohnert
Park Sports Center and then to 7:00 p.m. on December 4th at
the City Offices /Council Chamber to sear in the new City
Council.
